K-1 Fiance(e) Visa Process & ProceduresCanceling Visa process
Sorry to hear this..wish you good luck!

Don't want to kick you while your down but the annulment process is long and expensive. If you have questions drop me a pm. I have a good friend that went through this prior to his wedding in the Philippines. The saving grace; he is retired and living in the Philippines so he was with his girlfriend during the process. He has recently filed for a K-3 and plans to return to the US next month to set up house while he waits out the K-3 process.

K-1 Fiance(e) Visa Process & ProceduresPacket 3
Hello all. Anyone ever gone through the process and never recieve packet 3? I know it's the holiday season and delivery of mail can fall behind, especially when some countries don't regularly get mail to begin with. But has there ever been a instint when a packet was never recieved? Should I be worried? I know the Manila Embassy website has many forms that you can download and fill out. Is that all you really need to do? I checked online with the Case number I recieved and was able to find out the date of the Medical and the interview. I have about 1 month before those dates and it's been almost a month since I recieved confirmation of the interview time. Anyone that can shed some light on this, I would really appreciate it. Everyone on here is so helpful with shareing their knowledge and experience.

Thanks,

Mark

K-1 Fiance(e) Visa Process & ProceduresAdvanced Parole
Hi all. Got a question on Advanced parole. What exactly is it? how long does it take to get and how long is it good for?

My fiance and I would like to have 2 weddings. One in the U.S. when she arrives (of course we have to have that). We have the U.S. wedding planned for March, a little more than a month after her interview. We would like to return to her home and have another wedding that her family can be a part of as well. We are planning the second wedding for October. What can anyone tell me about the Advanved Parole.

Thanks,

K-1 Fiance(e) Visa Process & Procedurestimeline question
QUOTE (Craig & Julia @ Feb 12 2008, 06:54 PM) <{POST_SNAPBACK}>
I love reading all the timelines on here, and cant wait to put all my dates in mine, but now I wonder, how good does it work. Mine now tells me "Based on timeline data, your I129f may be adjudicated as early as August 19, 2008", how good does that work, how many got approved around that time, ahead or later? I know, I'm not really patient, and I just can't wait to be with him again, and get everything over with, and set a date for our wedding. Even I just got back from Cleveland last week, it feels like forever already, but since then, I spend a lot of time on here blush.gif

It wasn't very accurate for me. I filed in June of 2007 and my adjudicated date had September. It wasn't till the end of November that My papers were finally going to the NVC and then it was like a rollercoaster ride how fast things moved after that. 2 weeks to the Embassy and by mid December I had the medical and interview date for Feb. We just got our Visa yesterday and now it'll be a few weeks till we hold each other again.

K-1 Fiance(e) Visa Process & ProceduresPacket 3
Hey Guys,

We are in the same boat - interview and medical scheduled but no receipt of packet 3 or 4. The only problem is that Jovy has no access to the internet, nor any idea what to do with it if she did. She's watched me surf around or send e-mail when we were together, but has had no access to it because her village is somewhat remote. I know thats shocking because many people here have met on the internet, but we have had to use the phone to keep in touch (talking every day blink.gif ). The problem is, I don't know what to do if she does not receive her instructions and forms directly from the Embassy.

On my trips to visit, I have left Jovy with many printouts of the guides and other info found here, and she has a full copy of the I-129F with plenty of pictures and relationship evidence. I also left her with some travel documents of mine when I left in early October. I will be providing her their phone number and will also be shipping the I-134 and supporting documents to her in the next week or two, but have been counting on her receiving the info needed from the embassy by mail. Makes me nervous!!

Huggyapple, it looks like our appointments are around the same timeframe. Jovy will be flying from General Santos to
Manila, arrangements to be determined. Good luck to you!

Why should you get processed any quicker being in the Forces when you're not even in the country? Slightly irritating that everyone else has to wait in turn for their approval and Forces personnel can bypass the system?????

And before everyone jumps on me think about it, there are many other professions that are "doing good" for the country" like nurses, police officers etc etc do they qualify for expedited approval too??

probably because there is a greater risk for the military when deployed to a war zone. personally i don't see anything wrong with them getting expedited good.gif

Well, I want to thank everyone who gave me answers to my to my question. Well, you sure are right.....there are many other professions that are "doing good" for the country. And YES, maybe they should be considered too for exedited approval. Thank you for letting me see it from you angle. We (vj's) are on this site to give each other advice and support. We are just trying to get our loved ones closer to us. We search for answers to questions. We have no time for opinions that don't reflect the mission of this website. I sure don't. Never give someone you money first BEFORE they do any work!!! Our lawyer does installments with us because they know that the process takes a long time and you shouldn't be giving your money for something that hadn't even begun yet. You should have, at the point, realized the lawyer was a bit shady.

I was visiting my bf in the US when he popped the question and we decided to get married. I filed for AOS on the advice of my lawyer and have had no problems so far. You never know what is going to happen but all I am saying is that when i entered I didn't have the intention of marrying, just visiting. It can be hard for USCIS to distinguish either way.

where does it say anything about this being an english only board? i cant find it... and frankly, this is a website about ppl from all over the world, not just english speaking countries... anyone can post their questions in any language they want (are able to speak)... if you dont speak that language, then just dont respond... there are plenty of others (for whatever language is needed) that can give assistance... there are certainly plenty of dutch/flemish

im amazed at the intolerance on this board... you would think that a website based on bringing together unions from different cultures would be a bit more accepting of diversity

ewok, if i am wrong, please correct me

Dfgrerr gjfd grertr kgriof!!!! Cfjkfr fdsk wosdjr!

(Hint....that's total jibberish, just as many foreign languages are to many US citizens. This is a board concerning visas to the US. As such, I would guess that at least 50% of the people here speak English only. I would further suggest that if any non-English-speaking people are on this board and intending to immigrate here, then they need to learn English if they intend to get a job, make friends, function in society, etc. Ergo, shouldn't English be the ONE thing everyone here has in common? Regional forums are a different matter. General topics though should be made in English so that everyone can read and understand the post.)

WOW!!!! thanks ewok!!!!!!!! i didnt know you changed your user name!!!!

from her other posts, it seems she can speak english... but even if she couldnt, she would have plenty of time to learn it when she arrives... she wasnt asking for language lessons... and if anyone couldnt tell that because it was in a different language, then they just shouldnt answer her

K-1 Fiance(e) Visa Process & ProceduresKeine Ahnung was zu tun

Hallo an alle,

Gruss Stephanie

you do have to prove your relationship... so, use pics of you together from before he left, cards, bills that might be in both your names, etc... but also gather proof of your relationship continuing after he returned to the states... so phone bills, cards, letters, etc...

i am the USC, so i cant tell you personally what happens during the interview at the consulate/embassy... but maybe you could find someone who has been thru that consulate/embassy who could help you...

good luck with your visa journey :)

K-1 Fiance(e) Visa Process & ProceduresFiling a k-1 petition - second time around

If you are file for different person though, I think there is a timeline you need to follow.

Hi rosyanne,

thank you for your response. Not sure if I understand which timeline I need to follow? Do you mean I need to wait a certain amount of time before I can file the K-1 again? That's why I'd include the waiver.

I really appreciate the help so if my understanding is not accurate, please let me know.

thanks again.

K-1 Fiance(e) Visa Process & ProceduresFiling a k-1 petition - second time around

Hello everyone, I posted earlier in the K-1 forum and thought I post again here.

Hi everyone,

I am not new to the immigration process as I went through the K-1 process a year ago, married and now divorce (all in 2 years). I am in a new relationship and my fiance and I are trying to decide if we should go the K-1 route or just marry. I contacted USCIS and have read the notices regarding the IMBRA laws. I have some questions and I hope you all can help.

First, it says if you have filed two k-1's previously or have an approved k-1 in the past two years (this applies to me) you need to file a waiver. Based on my conversation with USCIS, the waiver in the case is just a letter stating my situation and that I have no criminal record whatsoever (the rep suggested I attached my clear police record to support that). So the question is, what is the waiver really? Is it just the letter as the USCIS rep expressed to me.

Second, I know its a long shot, but has anyone had a similar experience? I mean filing for K-1, marriage, divorce and then filing for another K-1? Are we better off with filing CR1?

Thanks in advice for any advice. Good luck to all!

Your first petition was approved. You are filing a second petition within the two year threshold. You are not alone. I know someone who is in your situation but he just filed within the last month. Just answer the IMBRA questions truthfully. Attach a "waiver" statement and file. This is new territory for all of us. My understanding is that the only effect should be at the interview stage where the CO will quiz you fiancee about your past a little more. This is what i have heard and we are really waiting for that true "beta" test case to report in.

thank you so much. I'll keep everyone posted on our progess. I won't be filing until the end of the year because I'll be traveling back to visit my fiance and have him complete his portion of the G325A etc. So most likely the first of January.

thanks again!

Hi there,

I didn't have a copy of my fiance's birth cert. so i included a copy of his passport first page. I used index tabs to separate and included a table of contents. Also, remember to write your names and info on the back of all photos and your names on the back of the passport photos. I put the passport photo for myself in a zip lock back and stapled to the front of my g325a forms and did the same for his.

I used UPS for delivery with no problems. I mailed overnight thursday and they received friday am.

here's to a speedy journey for you!

I filed once before a few years ago and had forgotten to make a copy. I did keep the letter with table of contents on my hard drive, so I always had that to refer to. Did you type the letter on your pc and save it with a list of enclosures? Worst case you can always make copies again if needed.

i heard of someone getting a "soft" denial because in their application for tourist visa they didn't mention they were going to see fiance, and they were already engaged. he should tell the truth so it doesn't come back to haunt you.

just my two cents. oh and don't forget to use the new form if you do file the one that expires 12/31/2006 is only good thru 2/18/07. good luck

Just my two cents, I don't see the harm. You're doing it the right way. I have never heard that they have to be in their country just to file. That's great that you can spend some of that time anyway. I'm sure someone else will come along to confirm or correct me, but I am pretty certain it's ok.

I wish my fiance could get a tourist visa just to hang with me for a while!

Yep add that in too! Also, if you can try to "index all your attachments." On page two of my cover letter to my I129F I included and "contents" index by number. Every attachment had it's own corresponding index. Like the attorneys do it. This way, it's listed and they can't say they didn't get it. It's helps to make it as organized as possible.

Good luck and I'm sure you'll do just fine.

FeatherB I'm with you on that. I used the older I129F and the new form has check boxes now in teh IMBRA section. Of course I panicked one night around 2am that I forgot to write in something - thank God for the copies lolol.

At least tomorrow is Monday and my obsessive checking of the USCIS case status may not be a waste! I hope to see some approvals rollin' in for us this week.

good luck all.
