And about interview and embassy work, you can do that anywhere there is an American embassy-consulate as long as you have residency and permitted to stay or work in that country.

It seams that you want to have some time after graduation to travel and work overseas, and that's absolutely fine. However from what I noticed that the process for the k series is faster than IR (ie after marriage) because it is designed so that you get to the states but they give you 90 days to get married ( not an hour more) so half the process is done in the states while if you apply as an IR in the first degree the whole process is done through the USCIS and the embassy and it totals between 8-12 months while in the first case you get in the states fast in a short time but continue your process after and that could be longer since it is processed from within the US.
When you apply as IR all you do is fly to the states and claim your Green C and social S C within a few weeks from entry
So you decide and pick which way is better for you time wise. Either way it could take up to a year to get the GC. But one way gives you the chance to do your traveling and work while your application is in process and the other limits you to the states while your application is in process. (I am not aware if you can leave the US after you get married as K applicant awaiting your GC, it would be nice if they allow you to do so. Better ask about it)

I need support on my I-134 form, affidavit of support. My US Citzen fiance was honrable discharged from U.S. Navy in October 2012 after serving for five years (2007-2012). Since he was discharged he started studying (within a U.S. Military Benefit Program) he does not have a job since that time. He also applied for a monthly benefit within the Unemployment Department and he is also collecting money from there.

 

Do you think we can consider he is unemployed due to his school program paid by the military and have his income from the unemployment benefit as a proof to fill I-134 requirements?

Hi everyone! I am so sorry for not responding to your posts! The night I wrote that first post, I had 101 different emotions going on all at once and had no idea what to do! It all happened on a Saturday and no one was able to answer any questions for me - my lawyer, the customer service number that you have to pay for, even my family. It was terrible... everyone who I talked to had different answers, some said go, some said it was a scam for money, just terrible!

But I prayed about it, followed my heart, and hopped on a plane the very next morning. Sure enough we had the interview just two days after and had only 1 day to recover any missing documents he needed (which we were supposed to find out in a letter what exactly those items were) But we managed... it was a very stressful trip and this is what we were told. Good we came to the interview, because packages get lost in the mail all the time (like - no biggie whatsoever)

Everything looked good, had the papers we needed and the money for every fee they asked for - - We were basically "approved", however, pending the results of his medical exam. They never sent us the package with the paper work that he needed to get filled out, so the day of our interview, we submitted every document we had, pictures and everything, and were asked the most uncomfortable questions just to see if we were legit.

And then that's when we were told, he will get his papers back in the next couple weeks and then he can fly out. The word "approved" was never said, but implied. We dropped off all the remaining medical papers/results on the 22nd of October. My fiance was told the package will arrive anywhere between 3 days and 4 weeks. Well, we charted the dates. Haven't heard anything yet and praying it comes before Thanksgiving. November 19th is exactly 4 weeks, so we're just hoping, wishing and praying that everything comes soon! Missing each other so much and can't wait for our lives to officially begin together!

Thank you for your concern and if anyone has any more advice or has heard of a situation similar to ours, please let us know the outcome. Until my fiance has his papers and is here in the US, I'll still be in doubt about the whole process... Please keep us in your prayers!

Hi Everyone,

I'm not sure how many of you are in the same situation as we are, but here it is. We received the letter stating that the NVC approved our 1-129 F petition and that my fiance would soon receive a packet with instructions from the consular section on how to apply for the K1 visa and indicate which documents we will need.

Well, for about a month and a half we waited, and waited, and to this day, have received nothing. I called the information number and the person I spoke to was able to pull up our information, but he said there was no interview date chosen for our case and that we would have to wait another 4-6 weeks. However, they just posted the October interview appointments this morning, and my fiance's new case number was found through the search box for this Tuesday, October 2, 2012! I booked my ticket and plan on being there, but are we going to run into issues because the packet was never received? What does this mean for the medical exam? I've read that the medical exam needs to be complete before the interview, the problem is, I just found out the interview date TODAY because they posted the new October list just this morning.

If anyone has any suggestions or has been through this same situation, PLEASE HELP!!

I want to make sure I do everything on my part before I leave to be with my fiance for the interview. Any suggestions or advice, please!!!

Hi, guys!

I have a question about reapply for K1 visa. Hope you can give me some good answer.

I came to the USA on K1 visa this spring 2012 but we failed to get married. 90 days are over now but we still love each other, and dont want to be separated. I can stay in the USA till 3rd of August (thats the date written by US officer in my I94 card), so 1st of August I WILL SURELY leave the country, so I wont violate visa requirements and wont brEAK ANY OF US LAWS. The reason why we failed to get married is at first we were not sure, then we realized that YES, we are right for each other, but we got to know from the attorney that the prenuptial agreement is not ready (but the point is that we DID think and we were SAID its READY), some paper was missing, and at that time we were too close to the end of 90 days (like a week), so to make this paper and complete the prenup we had already no time. Without prenuptial agreement marriage is impossible in our situation. (he is rich and im not, so he doesnt want to take risk, it is understandable). So...now we want to reapply for k1. We didnt break any laws, any rules, any requirements. The question is...Do you think they will approve us the second time? Will we be alright? Will I get visa again?

I am also confused with your dates. You began by saying 90 days are over then you go on and say you can stay up to August 3rd? I don't get it. If you go back before the end of 90 days you might be able to come back.

It will pick up again. statisically the service centers receive the fewest number of submitted petitions in the months of December and January. They will most likely move through adjudication of these petitions at a faster rate than the previous months and then as visa journey members update their timelines it should all even out. I'm still hoping that I might get lucky with a late April approval. I'm feeling May is the month for January filers however.

Stay patient bro. April should be a good month for December filers (especially for Vermont) They have started processing December petitions. The timeline is a bit skewed right now, so don't take it too seriously. The trends are good. They are finished with most October and November petitions. April seems to be the time of the year when processing rates increase at the service centers too. I think you'll have NOA2 this month or at the worst early May. Again some people get unlucky but it's not the norm. This time of the year is typically under that 5 month time frame (3-4) months. There are simply fewer petitions submitted in the winter and holiday months. Honestly, I think it could be any time for you. Another user recently look at the USCIS official data right off the government website for December. It indicated the fewest number of K1 petitions submitted in 2 years. They will work through it quickly.

OMG!! I just visit the processing times for VSC & noticed the processing times has changed from 5 months to June 14th, 2011. I almost lost my mind. I read Gary's post regarding an interview with the director of VSC & now i am a little at ease but just a tad dissappointed. The most positive way to look at this is that it gives us more time to save up money & thank God that we still have eachother. Long distance relationships are hard enough without the added stress but hey what can you do?! Vermont, I know you will get us done asap I just hope we are done in time for the christmas & new years holiday. I soooooo wish to spend my first christmas with my baby...i guess if we can't do it here we will do it in kenya :ot: hee hee....oh well..Good luck to everyone & may GOD continue to bless you on your journey!!!!!


It is likely some kind of error in the system. multiple users have called (including myself) and been told 5 months. They are supposedly work on all November 14th petitions. They are not on June. Logically, the approvals of December petitions invalidates that document. and we've had a few go through this week already.

But my main sponsor only has the tax returns for 2011 /paystubs/letter from his employer.

Will that be an issue?


Nope. The embassies are most concerned about current employment. Won't matter what someone earned three years if they don't have a job this year. You will be absolutely 100% okay with what you have. And if you are using a co-sponsor because your income is not adequate than I don't think it matters what you include about your current employment other than maybe the tax return. At the AOS stage you can use the sum of two sponsors. Right now they will only look at your co-sponsor.

Yes. If anything were to delay adjudication right now it certainly would not be a back log (at least for K1 or I-130s or CR1s). This is the time of the year (statistically) where the service centers receive the fewest number of submissions. (December and January in particular). If anything, there should be fewer petitions to approve right now than usual. Maybe a backlog from one of the more recent months? But that would not affect the months that had fewer submissions and are currently very close to adjudication. They will address the petitions submitted earlier first. And that one document listing the June 2011 frame was so absurd that it's obviously an error.

The error is probably system wide. There's absolutley no way that processing times would add an additional 4 months when we still have a steady number of December petitions receiving approval. Also, some forum members (including myself) have called and were told 5 months...I think another user also was told that they are currently working on all November 14 petitions. so that document should not say June. it's clearly an error. They are not working on June.

Definitely. It warns us all to continue to expect the unexpected and honestly just to be prepared for anything throughout this process. We can all help our fiances be prepared for any questions at POE, so something like this doesn't alarm them or catch them off guard. After a long flight, it's better that they know what to expect.

Definitely an attorney is the right way to go now. Although you often don't need one in this process, now it's clearly necessary. They may be able to assist you in fully exploring your options and navigating the intricacies of this situation because it's certainly going to be very complicated from here on out. The question they asked was very bizarre. She definitely must have reached an officer on a very bad day because this is just not common at all for K1s.

Something really crazy must have happened at POE. This is just not at all common. It had to be above and beyond her saying "husband." I think we would need play by play details of what happened to make sense of it. It had to have been like a domino effect coupled with limited English skills that yielded such a disaster. Something she said had to have been very severe or severely misinterpreted.

According to an interview with a former adjudicator, senatorial or congressional inquiries sometimes force a pull of the file. It could cause them to just work it and get it done. However, you would need to wait the 5 months before doing this. So between 5 and 6 months I will use this resource if necessary.

I feel like just the simple fact that we have waited 5 + months should be enough for approval. This is enough of a test for me; I feel like we shouldn't have to go through the interview process!

Everyday, several times a day (even on weekends, I know it's pointless) I check USCIS and Visa Journey. I am really beginning to hate Igor and his stupid list. I get a twitch each time I see "Initial Review."

Yes. There is no reason why this should ever take more than 5 months. 5 months should be the absolute longest it should ever require to approve these especially for people that have a very simple petition without any complications. I'll probably start getting things lined up for my Congressman or Senator if I don't have approval in the next 2 weeks. I saw a couple December petitions got left behind at VSC. Always seems like a couple people get neglected when you look a the timelines... Terrible for them. It's very disappointing.

Definitely. I really hope we see a flood of approvals these next 2 weeks to compensate for this slow down. I really don't see how they'll have any other option because if they don't speed this up, god help everyone who filed after us. I can't imagine how backlogged they'll become. There was a pretty significant number of petitions submitted in the Spring and the summer will only get worse for them.

Yes. Do not expect adjudication before 6 months. Of course 4 months is possible. 5 months is average. But trends right now are pointing to a real slow down that will not be overcome very easily...

Hey Ron. I was wondering the same thing about the police certificate. Julia got hers back in March when the NOA2s were coming a little faster. She called the police department to ask about the validity, and they told her something about it expiring in 3 months (July 23rd for us) However, the KEV instructions from the embassy website say something about police certificates being valid for one year. I asked in our regional forum and they confirmed it. I had emailed my lawyer Friday, and I think he will probably have the same response. So hopefully one year is accurate.

We put in a k1 visa middle of jan got the letter saying it was recived. I have heard nothing its keeps say review all the time. My girlfiend phone saying call back end of june ok its now the 12th of june and still nothing what is happing. Have we done anything wrong. The thing is i see people in the time line that put in for the same visa give or take 3 weeks and they were aproved in may or beging of june and there from the uk.

Despite a few of the more recent adjudications..Not much is happening. For whatever reason VSC slowed down significantly in May and it has continued into June. We are all hoping to just get out of June with an NOA2 and god help us before 4th of July (which will probably slow things down again). VSC usually trended toward a significant number of adjudications in the month of June....unfortunately for us...they decided to break it this year...We'll know over the next couple of weeks just how bad it's going to be. You are not alone. Hang in there. It's been a rough ride.

Hello fellow VJ'ers!

Can't help but notice how slow Vermont has become when sending approved petitions to the National Visa Center. I called today and they still have no record of our case. Maybe it's just sitting at the NVC and waiting to go into the system? Does anyone know why a process that once took less than 7 days is now taking a month?

It's taking 3-4 weeks for them to send to the NVC and then the NVC takes about 2 weeks to give you a case # for the embassy (I'm going through Montreal). After waiting so long for the NOA2, it hurts to know the waiting isn't close to being over. :(


Wow. Sounds like more disappointment to look forward to now...I guess it's better I didn't know how bad this would all become. It really couldn't be much worse....Can only hope and pray it won't stay like that. This is crazy.

Tomorrow marks our fifth month since NOA1. I just check uscis website for our status. It says they approved our i-129f application. I was so happy when I saw it.
I didn't get a txt or email notification unlike our NOA1. Is it possible to get this maybe later or even tomorrow?
Anyway I'm soooo happy. Another step closer to be with my fiance. Thank you God. :)


Nice! And congrats!! I really like what I'm seeing with a couple of the past approvals they are seeming more consistent in the 1/11 - 1/13 range. Going through receipts on USCIS database is showing a similar trend. Maybe things will be getting better for all of us now.

They usually don't need such intricate details and even an interview conducted with a Service Center Director (VSC) and a former adjudicator indicated an emphasis upon establishing that a meeting occurred within the past two years as the most important criteria. I did include circumstances of meeting with my petition in addition to the above evidence. It was merely a paragraph, but it simply stated that I met her while she was on her J1 Work and Travel. It's unfortunate that they would have RFE'd you for something like that. Must have been an adjudicator on a bad day.

Hi all. Just to give you a little background, I filed for a K1 visa using an attorney before I discovered VJ, and I've regretted it ever since finding this website. That said, I got an RFE (email notification 7/13, hardcopy was received by the lawyer today). I'm not sure if I'll actually get a hard copy of the RFE- kinda hoping I will because I don't trust my lawyer- but as of now, the lawyer is the only one who got it. It said we need proof of meeting. Here is what I gave the lawyer to send in the initial filing:

1. 14 Pictures printed on 5 pages, each picture containing a description of location, the date it was taken, and names of individuals in each picture (mostly us, but sometimes family and friends with us).
2. Flight itineraries from both Rob and myself for each visit
3. Hotel itineraries for my visits (he always stayed at my place when he was here).
4. Passport pictures and stamps (did not submit all the blank pages, just the stamped ones and the front page with the identification part)

6. Not that it's proof that we met in person (of course we did, though), but I also submitted about 30 emails and handwritten cards and letters.

I'm thinking the two things I should do are get copies of every page of both of our passports and see if I can try to scrounge up actual boarding passes from our visits. Admittedly, I'm not the most sentimental person so I probably don't have that many boarding passes. Anyway, the lawyer is saying that all I submit is the passport. I obviously have little trust in the lawyer, and I'm turning to you fine (and smarter) people to perhaps give me some direction about what else I can/should provide. Should I resubmit the evidence that was previously submitted?

Any help you can provide will be appreciated :)


Other than submitting copies of the boarding passes, I have absolutely no clue how you would respond to this RFE. You should have satisfied the requirement merely with the passport pictures and stamps (in addition to all the extra proof you submitted which was secondary evidence anyway). Sounds like someone lost something along the way, or there was a mistake that occurred during adjudicative review of the petition. Maybe describe the circumstances of the meeting? Although really the only requirement is the submission of proof that a meeting occurred a maximum of 2 years before filing the petition. Even if the passport stamps weren't dated they should have aligned with the itineraries. A strange RFE indeed. Especially if it asked for proof of meeting. You already provided the evidence....
