Most consulates only use part 1 of the DS-230 for K-Visas. Part 2 is used by Immigrant CR-1/IR-1 visas.

To correct Slamber (my fiance) we had a dated picture, 2 flight itineraries, and a few boarding pass stubs. If the picture(s) you sent are dated, I think you should be fine. As for the paystubs, not sure that proves anything about your relationship =\ but I guess they can't hurt.

hi aschaal03,

as to my understanding of the directions on how to file the petition, we have to prove that we have actually met within 2 years before filing. therefore, by sending them copies of the paystubs (from the month of sept/oct 2007) which has dates and the name of the company, they will (i hope) realize that we had constantly seen each other everyday at work. thank you for your input. goodluck.

Hi there- It's hard to say if this enough. You will get an RFE if the person that looks at your paperwork doesn't think it is good. You are certainly in a different situation because you have already been to the U.S. Did you date the pictures to show it was within the last 2 years. Also, are the paystubs within the last 2 years? Try to get more evidence now. Even if you do not get an RFE, you will need it for the interview. Better safe than sorry. Good luck and have fun playing the waiting game.

Chuck

hi chuck,

the paystubs were the most recent ones and definitely within the last 2 years. at any case, i will send copies of the visa and passport to my fiancee so she'll have them on hand if needed. thanks and goodluck to us all.

hello to everybody. as usual, the more i read the topics in this forum, the more information i get and for that, i thank everybody. i've been reading topics about what would be considered as evidence to prove that the petitioner and benficiary have met within 2 years before filing the 129f. we sent our application before we discovered and joined this forum so we really never got the chance to see what document/s is/are considered as "substantial" evidence/proof aside from the pictures that we have together. i (the beneficiary) was in the US under a temporary working visa (H1B) when i met my fiancee at work. i've read in the forum that pictures are just considered as secondary evidence. aside from the pictures, we've also included two of our most recent pay stubs (before i left for the philippines) along with the pictures to prove that we worked for the same company and that we have actually met and seen each other. the pay stubs has the company name and address on it as most pay stubs would have. do u think this will serve or be considered as enough evidence that we have actually met before filing the petition? thank you in advance for any replies.

Maybe. Did your pay stub have a US address printed on it? Did you also send a copy of your passport with H1B visa or at least mention the visa?

unfortunately, we didn't send any copies of the visa nor mention the visa. the paystubs doesn't include my address (the address is printed on the paycheck that i deposit to a bank). we did however, indicated on the the I-129F question #18 that we met at work. hopefully, that will direct the attention of whoever is going to review our petition to the paystubs. thank you for everybody's reply to this question.

I agree, So many times you have the veterans of VJ posting guides6ly.gif and that includes doing research and using the search engine for old applicable topics.

Now you have new-comers using the search engine and they get reprimanded for that as well.

I don't tell people to read the guides, I answer their questions.

Bumping an old post is far less productive than posting your own question in a new post.

and if i or anybody else post or start a similar topic, then the older members will tell us "do a search". and i do search the forum first before i ask questions. but i still appreciate your response/opinions. everybody here just wants to help everybody.

hello to everybody in this very informative site. thanks to all the members for all the insights that they have contributed to the forums. i've been reading through the different topics about the k1 process and i'm not sure if this question that i'm about to ask has been discussed before.

my question is: if the beneficiary has relatives living in the US, will this cause any problem during the application process? will this cause a red flag at the consulate? i'm asking this because somebody said this might cause a problem although it wasn't really discussed extensively. in the ds-156 form, question #37 asks if the applicant has relatives in the US. i'm wondering why would this be a problem? any input about this will be greatly appreciated.

K-1 Fiance(e) Visa Process & ProceduresPlease help! Confused about K-1 or K-3!?
I am a US citizen and I come and visit friends and family every summer in Romania. Last summer I met someone on my usual visit here in Romania. We kept our relationship even though I had to go back home to finish college. I came to visit last winter and now in summer. Its about time for me to leave again and we both cant stand the idea of being apart again. He asked me to marry him! I was so excited at first until I did more research on the different types of visa's and the waiting times. I am still here in Romania until the end of August. I want to do whats best and quickest for us. Should we get married here and then apply for the K-3 visa or is it for our best interest to remain engaged and then marry in America.

Please any advice or tips about what I should do is greatly appreciated! star_smile.gif

I started to write about how I met my fiance for our declaration of how we met and I started to become worried that I was writing to much information. I am not sure exactly what they are looking for in this part of the form. I just started by explaining why I was in Romania and how I met him. Then I started getting carried away describing in detail about when we started dating and how many times I came back to visit and how hard it was to leave. I just wanted to know if its a good thing that I am going in such detail or am I including the wrong details? Can someone please give a sort of outline of the main topics I should talk about?

I guess it should be
-How and when we met
-When we started dating?
.......

-When we got engaged?

Help please~ smile.gif!

My other question is on number 15, can you put more then one phone number? Like a home phone and a cell phone?

Advanced thanks to all those that take time to read my questions! good.gif

The "A#" is the Alien Registration Number which he may or may not have - if he never had one, leave it blank or write "None."

Number 15 - put the best number and leave it at that. It's unlikely they will call.

When including photo's of me and my fiance together is it necessary that they be actual photo's on photographic paper? Could it just be print out digital pictures on regular paper? K-1 Fiance(e) Visa Process & ProceduresEvidence
QUOTE (Carlawarla @ Aug 29 2008, 06:03 AM) <{POST_SNAPBACK}>
Is this evidence you're looking for the initial filing of your 129F petition? You just need evidence of having met in person at least once in the last 2 years. The best evidence of this is passport stamps showing you and your fiance in the same country. Boarding passes, hotel receipts, itineraries...something from where you guys met. This is primary evidence.

Secondary evidence are things like emails, cards, chats, and pictures of you two together. You could send the above primary evidence, and perhaps a picture or two with the dates on the back with the intial filing.

Later, when you get an interview at the Embassy/Consulate, you're going to provide further documentation/forms, and along with that evidence of your continued on-going relationship, which can include, but is not limited to, further pictures, emails, phone bills, boarding passes, cards, letters etc. This is brought to the beneficiary's interview later in the process.

Good luck in your journey!

Yes its for my 129F petition smile.gif thanks for the advice! I have passport stamps I have visited my fiance three times but I stayed with family and with him at his apartment so I dont have hotel reciepts or iteneraries sad.gif I hope that this will not impede my chances!

That should be enough to show that you were there during the times you stated.

Just make sure when you make copies, you can clearly read them.

You could even write something short below the passport stamp pics on the paper you print them on.

K-1 Fiance(e) Visa Process & ProceduresWhen should I book our chapel for the wedding?
Hello everyone!

Thank you first off to those taking the time to read my question and give advice I really appreciate it!!

- I have started planning things for our wedding ( I know its seems really really early but I was surprised to find out that its isn't) I filed in september and I still did not recieve my NOA2 yet but I am trying to do the impossible and estimate when I should book the Chapel that we want to get married in. I decided that since we filed in early september that he should be here before June 2009. I know that it is very well possible he will however not be here untill after June but I just dont want to even think about that. I was surprised to find out when I called that already the chapel is almost booked! So I have a decision to make as to whether or not to put down a deposit to hold June 13th 2009. I figure I should just do it because if worst comes to worst I will get my 300 dollars back but I would just like to know if my estimate seems logical. Does June 2009 fit what I think the average is? I was hoping for some advice from all of you smile blush.gif please

Sorry to hear this..wish you good luck!

Don't want to kick you while your down but the annulment process is long and expensive. If you have questions drop me a pm. I have a good friend that went through this prior to his wedding in the Philippines. The saving grace; he is retired and living in the Philippines so he was with his girlfriend during the process. He has recently filed for a K-3 and plans to return to the US next month to set up house while he waits out the K-3 process.
