K-1 Fiance(e) Visa Process & ProceduresHoneymoon locations in the US
HI! Congratulations on mailing your packet, I hope all works out well & fast without a RFE (request for more evidence).
First off all, I'm a detective when it comes to traveling, finding deals/coupons and doing reviews!
But to answer your quesion, I'd have to know what's YOUR ideal honeymoon taste. Some people like #1: island atmosphere, #2: snowy mountain atmosphere, #3: live excitement/entertainment or #4: just romantic peaceful and serene atmosphere.
For #1, you can try US Virgin Islands or Hawaii, both can be pricey and you should check with USCIS before you go! Or even Florida.
For #2, you can try Alaska or New York, not New York City but deep down in the country side of New York.
Tor #3, you can try Atlantic City, New Jersey; Las Vegas; or New York City, LOTS of stuff to do and see in all three other than gambling and shopping!
For #4, you can try the Poconos in Pennsylvania, very popular for honeymooners.
I'm not sure what your taste or budget is, but all those cities has a bunch of free and affordable things to. Lastly, sometimes it's better to stay at a hotel in a neighboring city to save $. For instance, if you chose New York, you can book a hotel in Jersey City, New Jersey and it'll only be a 5 minute drive or (10 minute bus ride) through the Lincoln Tunnel to get to the city itself.
Goodluck and let me know what you think.

K-1 Fiance(e) Visa Process & ProceduresJust Beginning...Need my UK fiance' here yesterday.....
It is absolutely no one's business what you decide to do, however since you started a topic that everyone can see, most people ate going to comment before they address the question that you're asking.
How in the world do you decide to marry someone you have never met, too fairy tale. He is allowed to visit the US just as much as you are allowed to visit the UK. I would suggest you two visit each other at least ONCE, meet his family, have him meet yours and then decide where to go from there. The k1 is meant to be a quicker process than the cr1, however it can be a major headache dealing with uscis, the cost is never ending, even after he comes. So decide if you really want to go through with this for someone you have never met.
The only way uscis accepts you two jot ever meeting, is unless its an arranged marriage and you have to show proof that its an arranged marriage.
Welcome to vj and best of luck on your journey!

K-1 Fiance(e) Visa Process & ProceduresFor how long does the process for the K 1 visa takes?
On a regular basis, it usually takes 6 months but it also depends on the beneficiary's country. I'm posting from my phone so I can't see your country but countries that has a high fraud rate usually is more hassle and takes a bit longer but the cr1 procedure is longer than the k1

I don't know anything about Columbian record keeping (so forgive me if this is a totally ignorant question), is it possible she could find this out at a records office?

You obviously did not READ my post well. It is Colombia not columbia, and I stated there are no records as this was in 1927 in Colombia. Colombia is a third world country. So how can there be records in a records office if it was never recorded. ? Or if it was it is not there now..

I am finally sending in my I-129F soon and was missing some information about my fiancee's father. for the G325A form. He died in 1969 and the only information the family has on him is he was born in 1927 But no Month or day. I have this information for her mother but not her father. Also where it says place of residence I would put deceased in 1969. Is that OK ? again nobody seems to remember when in 1969 he died.. I know it says [if know] in parentises. What should I do? Put the year only? I have spent 4 weeks trying to get the exact info from my fiancee. and I guess there was not such good record keeping in 1927 in Colombia. Also it is dated 09-23-2009 when she signed all 4 copies . I assume that as long as there is no change in address or employment this will be OK.

She tried asking her mom but she is so old now that she has a hard time remembering she was even married as her husband is dead 40 years now.So no luck there.. This was the first person she went to.

Fiance is from Spain. We were under the mistaken impression that he'd be able to get a temp EAD. K1 already applied for, so that's a done deal.

The thing is, under the terms of his VWP (when he visits here, before he gets the K1), he's allowed to do *everything* he needs to do to get his business up and running. Do all the research, buy things, rent space, make contacts, even hire people. He's just not allowed to actually manage the business. I'm wondering if that's something I could do until he gets his EAD. At any rate, we obviously need to speak to an immigration lawyer! I really want to make sure everything is above board.

And at any rate, the CR1 requires that we be married first! Getting married abroad takes time--and a lot more $$ than a K1. If we got married abroad, we'd want to do the whole shebang.

I agree with you on this as Colombia and Spain are similar in what is needed to marry in these countries. After investigating all the cost and problems with marrying in Colombia I decided that the K-1 was cheaper and easier to do..I am sure you have done your homework about the requirements in Spain and decided like I have to opt for the K-1...

next time you see him , take photos of the two of you together, holding today's NEWSPAPER , clearly showing the date.

practice a bit with this - just a headshot, yer two heads together, with the newspaper under yer chin, showing the date.

Take photos like this , each time you are together. Frame the shot so it's just yer two heads, and the newspaper. He can probably do this with one hand holding the camera out.

Also, suggest you get some photos of the two of you together WITH YOUR parents and other relatives.

Also, when you go out to eat, GET THE RECEIPT !

This is exactly what I did ....Hold up a newspaper under our chins together in the photo and sent in a COLOR photo copy of the front page so they can clearly see the date..This was for my I-129F petition..There is no better proof than that...Along with your boarding passes and passport stamp copys.

K-1 Fiance(e) Visa Process & ProceduresUnable to work and filed k-1 visa??

Why would you burden another individual and create much further stress for yourself by bringing another person from another country to this country?

Unless that person can immediately begin to work, I'd say you should wait until your life is more stable and you can take care of yourself before you add another person's life to the mix. Sri to be so blunt, but if you're stressing over this now, the situation will only be compunded much-fold with this other person.

I fully agree with Baron555 ................. Personally..... I waited 7 months till I went back to work with stability and benefits.. I was ready to file in March 2009 but did not till November 2009.

Previously (in 2004) you had to register at the USCIS web-site for email contact to know it was touched. If I remember correctly, you could only do that after receiving a hardcopy of NOA1 and entering it at the USCIS site.

How do you see the status online when you do not know your file number (A number)?
Where online?
What do you use to look, last name, etc...???

Thanks

I am also an old timer going back to 02 and 04..As far as I see it you can't see anything unless you have an A # If you sent your paymeny in with a check for you petition then contact your bank for a scan of the back of the check and you will see a # starting with EAC followed with 10 numbers. This is your file/case number..

She will need to provide everything listed. Also she will need to provide 4 copies of G-325A Biographical sheet. You need everything listed above and it wouldnt hurt to include the W-2s as well. ;)

K-1 Fiance(e) Visa Process & Procedures3+ convictions, will it cause delay?

Hello all,

I submitted our I-129F package with all certified court and police records for my convictions. These convictions are nothing more than a few misdomeanors that include "minor under the influence of alcohol", "under the influence of controlled substance" (not in a vehicle, on foot!), and intoxocated in public (also on foot!); all of which resulted in a fine and no jail time. I had a few wild years in college but since then I've graduated and am currently a Civil E.I.T. (Engineer-In-Training). My fiance knows all about everything and she's understanding. I was wondering, does anyone know if the USCIS will delay my process to run a more-in-depth background check? I have nothing else to hide, I'm simply wondering if it will take longer. We have an NOA1 date of Oct 27th, 2009 and we are 6 days behind Igor's list (which I know has much variability). Let me know

Thanks for your answers!

It's sad that in 2 weeks nobody can give you an answer..I am also in the same situation your in and would like to see someone HERE answer this for you and countless others.

Yup - I'm saying that.
The 'application of stuff' to actually get it done seems to be sporadic, so far -
i.e. - everyone with a felony conviction has NOT been sent to an ASC for ADIT (biometrics/fingerprinting)

The information comes from reading IMBRA regs and the Adam Walsh Act.

re: 3rd quarter of last year - sorry, can't cite the source, exactly - but I did read it on ILW.com that 'that portion of the act, covering fingerprinting of convicted felons' was to be instituted starting the 3rd quarter of 2009.

If I have time this week to scour ILW.com and find it again, I'm happy to post the link. IIRC, it was a 'weekly review' from one of the attornies that post there.

FWIW, there IS another VJ member here that went through exactly the same thing.

If you feel incredulous by what I wrote - well, you should be, ya? It makes no sense to me, to make this 'extra step' for Biometrics on a US Citizen that has a felony conviction - is dead easy to match up prior fingerprint records WITH the USC's ssn.

Darnell,
Thanks for the reply..Now it's just another thing I have to worry about.. And yes it makes no sense whatsoever..

I've never heard of a biometrics step in a K-1, even when Adam Walsh criteria was present. I was under the assumption that for those with IMBRA issues or even those with Adam Walsh issues that a waiver was the course of action.

I wish this guy luck - it would help if he would provide details of what his felony conviction was.

az110965................................. This is what I'm saying also...What was the conviction for ? and fingerprints for a K-1 petition for the petitioner ??????????? Never heard of that before..........I want to know what source this info was taken from..
PanamaJackMaleColombia2010-02-14 21:23:00
K-1 Fiance(e) Visa Process & ProceduresTime frame

Yup - the ADIT at ASC (biometrics, fingerprinting) was done, IMO, because of the felony conviction. This is a new thing, mostly, started in 3rd quarter of last year, and is some procedural stuff from a combination of the IMBRA regs and the Adam Walsh Act. You should not sweat it, much, but mention it to yer lawyer, tell him you fell into an 'exception' area.

re: service request. Time to do another one.

re: infopass appointment. It's a face-to-face meeting, at the local USCIS office, with a USCIS officer, who supposedly can tell you what's going on with yer casefile AND where, exactly, the casefile is. It's a PITA, you'd think you can find out from calling the hotline.. grrr.

There's a web portal to make an infopass appointment (I don't know the url, alas).

Good Luck !

So you are saying that anyone with a felony conviction is going to have a fingerprint request? Where did you get this information from? The OP never stated what the conviction was for...I think this makes a big difference if it was for spousal abuse or the Adam Walsh act.. Correct me if I am wrong and again where did you obtain this info about this started in the 3rd. quarter of last year..

My Attorney agreed it should be ok to do another service request and possibly set an infopass appointment.

My issue now is I will call in the service request but in regards to the inforpass appointment I only have 4 options which I do not believe I fall under.

they are

- Order from Immigration Court - If you were directed to us for processing based on an order from the Immigration Judge. You must bring all documents required in the post order instructions given to you by the court.

- Case Processing Appointment - If you received a notice to go to your local office for further case processing.

- EAD inquiry appointment - If your I-765 employment authorization application has been pending for more than 90 days.

- Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment.

Any ideas.

Evli ,you have no timeline..Please fill one in to fully understand this situation better.

But my fiancé called them (few months ago) and they said we would only hear after 60 days if they needed more information, otherwise they would just send us their decision. It's been more than three months and we haven't heard anything from them.  :(

Ok! Lets assume you get an RFE for not having 2 seperate Letters of Intent .. What are you going to do then? You will need to then have one sent overseas from your fiancee. This could add weeks on to your process not to mention there is only a certain ammount of time you have to reply to an RFE.. As I suggested have one sent to you as an insurance policy if you get an RFE.. Which is likely to happen.. I am offering helpful advice to you and not trying to bring you down.. Better to be ready than sorry you weren't........ If you read the instructions it says ONE from you and ONE from your Fiancee...Signed and dated...

K-1 Fiance(e) Visa Process & ProceduresIntent to marry letter.

Hi everyone!

When we sent our k1 visa application to USCIS, we included an intent to marry letter, but it was written by my fiancé on behalf of both of us. We didn't include a separate letter written by me. Is it enough or they can ask us to send them one more intent to marry letter?

Thanks.

I forgot to do this before I left Colombia so we used DHL for her to send me this signed in BLUE ink by my fiancee in Colombia so they can see it is original and not a faxed copy.It was worth the $35.00 to not get a possible and likely RFE for not having this as part of my petition.. They specifically ask for a seperate letter of intent from each of you and signed by each of you..Not one person signing both. You will be RFE'd for this so I suggest you have one sent so if and when the RFE comes you have it on hand to send right back to them ...

K-1 Fiance(e) Visa Process & ProceduresI am NEW to this.... Looking for HELP

I am looking to see if I can get some help here or suggestions. I am not up to speed with all of the abbreviations used and would like a little guidance if someone has the time please.

Here is the deal:

I was told this would take 5 months to get my Fiance from Brazil to here in California so we can get married but I am finding out this is not going to happen so fast.

12/23/09 - Submitted Paperwork to: California Service Center
12/28/09 - Received Receipt ( I guess this is my 1st NOA??? )
3/25/10 - Received another "Notice of Action" so the USCIS can capture my BIOMETRICS (Fancy word for FINGERPRINTS) on 4/8/10
4/8/10 - BIOMETRICS appointment is done
4/16/10 - Case was transferred to VERMONT SERVICE CENTER location for processing because they now have jurisdiction over the case.

Why the heck is it taking so long?
From what I have seen, nobody has commented that there file has ever been transfered... What does this mean?
Am I on Track for 5 months or could something be wrong?

Also, I am told that they will ask me for tax returns to show income to support that I can afford to support my fiance but I have been unemployed all last year, I filled for an extension just the other day and I was wondering if you think they will accept my previous years returns? I made plenty in "08" "07" & "06"...

Any comments are welcomed and appreciated!

thank you all...

wow...5 months....that would be fast...good thing you didnt file a year or two earlier...good luck
