Hi,

We recently submitted DS-230 with all the required documents. NVC replied saying that the Birth Certificate I submitted was not an original. I was born in Libya to Serbian parents (Serbia is my native country) and they registered my birth at the Embassy of Serbia in Tripoli, Libya. Since then my Birth Certificate has always been issued by the Ministry of Foreign Affairs in Serbia. I cannot obtain a birth certificate from Libya as I am not a Libyan citizen. Is there anyone else in a similar situation? Would a letter of explanation be sufficient since I have already submitted the only original birth certificate that I have?
I would be very grateful if you could post your comments and suggestions.

Talk to NVC supervisor and explain your situation clearly and proceed as what they say. Or email to NVC with all the details making the subject ATTN:Supervisor Sue with your NVC Case#. In addition talk to a live person as well - not the first level, second level supervisor.

At the end, suggest them the notarized affidavits from your parents in addition to your Serbia BC would be suffice.

I am a U.S. Citizen and my wife lives in Romania. I notice that it says for HER interview, the last three years of tax returns are needed. I'm confused if this means that she needs to present MY tax returns, or if I am supposed to present them myself, because when she goes for her interview at the US consulate in Romania, I will be in the USA. Also, I noticed that on one of the forms, it asks for just the most current tax year, and the last 3 years is listed as optional. Why? Thanks in advance for any responses.

Hi Everyone,

I am married to a non US citizen living outside US. I(USC) am going to sponsor my husband. For filing I-130, Could anybody advise me how many g-325 forms need to be submitted? I see in USCIS it is written

Two completed and signed G-325A forms (one for you and one for your spouse).

What does this mean? Do I have to submit two filled g-325a forms for me and two g-325a forms for my husband(total 2+2 = 4)? OR Do I have to submit four filled g-325a forms for me and four g-325a forms for my husband(total 4+4 = 8)?

Yes, photos are required during interview but are they required with I-130 application? Also, if the "court marriage" was only done in the US, do they still suspect/question as much as if the marriage took place outside of the US? Sorry to capture the OP's question but did not want to start a new thread for it.


Some people has mailed photographs with their I-130 petition. I didn't do it.

Again, it all depends on the adjudicator and from where the beneficiary is from. These adjudicators weigh some countries liberally whereas others not.

Always it is better to carry those evidences at interview time. You never know what they ask.

Having said this, CO asked my wife only our wedding album and few photos together during her interview time, though she carried a box full of secondary evidences.

Just a few more silly questions on the I-130 bonafides ...

1. Are we to submit photos or color print-outs ... or does it matter? It matters if the applicant is from a country where fraud relativity is higher and there is no scale to measure it. It is assessed by the adjudicators and CO.

2. Can we send in a photo copy of the notarized afidavits from friends and relatives instead of the originals? I only have a single copy of some and will need to use them for Consulate interview packet too.
Photocopy of affidavit is fine. I sent only copies.

3. Also, if the afidavits are in a foreign language, will they need to be translated?
Yes, it has to be translated.

4. And for the copies of chats and such, I was thinking to only send excerpts showing the start and end of each conversation, but by the very fact that it could be editted might make the reader sceptical ... so should I send the complete contents?
As long as sufficient random sampling of chat is present, it should be fine.

Just because you become a US citizen doesn't mean your Alien Number goes away. That number you were assigned stays with you for rest of your life. So when asked, especially by a federal employee or form, you should specify it. If you look at your citizenship certificate, you will find the alien number is prominently displayed.

So when asked on I130 form for your alien number, fill it in. When asked on your G325A, also fill it in.

If one is a natural citizen, A# will not have. My both children do not have A#.

But if you are naturalized citizen, yes A# will be part of your record until the death.

You only need a photocopy of the marriage certificate (the one duly recorded at the local civil registry)...a photocopy of the NSO certificate would be better, but if it is not available yet, that's fine. :)

Just make sure the NSO copy will be available later in the NVC process.

hello every one my wife had here interview on 03/24/2010 and thay gave here 221g for missing birth certifcats and thay did the interview and fingerprentand the med /exm.she send it in the same day and told here aftar one week she is under a/p .we cheacked the consular section visa case status every day on may 19 2010 thay said send your passport she did sendit on may 20 2010 and will it take 5 to fourteen days to get the visa.on 06 30 2010thay ask for 2end interview and thay ask about my family.and thay have here passport since may 20 2010 untel now 09 14 2010 .each time we we send email thay said case under review we will be in toush when the case completed.so i dont know what happen next,pls if any one have this kind case .thank you,and i will let you know what happen if somthing come up


Since you have made so many mistakes, now it is Consulate's turn to call you back. Keep in touch with them.

Your only option I do see here find out another co-sponsor. If your beneficiary or you have any other assets such as bank balance, home etc., it can be counted.

Hello again, everyone!

As what all of you advised that we should get ready with NVC papers, we will start with filling up the I-864. We came up with the following questions:

1. Since Matt's mom is co-sponsoring and she will be signing the I-864A, does this mean that Matt is going to pay $88 for his I-864 and another $88 for his mom's I-864A?
There is only one $88 fee for AOS review.

2. What is his current individual annual income? Is it the one showed in IRS for 2010?
He can show it from his latest employment letter or from the last year tax transcript's "Total Income" line.

3. What is his current household annual income when he is now living with his parents?
His income will be shown. Then his mom's income will be shown. Then both will be added together to get current household income.

4. Is number 24b which says, Income you are using from any other person who was counted in your householdsize, including, in certain conditions, the intending immigrant. (See step-by-stepinstructions.) Please indicate name, relationship and income. --- This is where his mom's income goes?

No, NVC has live operators until midnight. USCIS timing is normal business hours.

So, husband called USCIS on his lunch break. If the one he talked to before about requesting the expedite was exceptionally nice, this one was the opposite. My husband said that the USCIS was very rude at him that when he told her the tracking number, she said that she cannot disclose the information about the update and that it is still pending. She even said that the tracking number is useless. Btw, my husband requested the expedite last September 21 and was told to wait 5-10days. Todays is the 7th business day. Well, anyway, God bless that agent. We will try to call again if we get another reply or another different reply. HAHAHA. We'll call and call until we get the same replies :D


Once the SR is open, you don't have to call again. They will reply soon normally, but they say they would respond within 30 days. So, wait a week or so.

So, I have an additional question. I'm living with mom, dad, and sister but she's now lodging near her school. If my mom will co-sponsor me to bring my wife over, how many household unit are we? What is the 125% poverty line in this situation? Oh, dad is working in the government but only mom will be the one who will sign the papers. So, she will be the co-sponsor only.


If your mom has filed separate tax return in the last years, her household is 1.
If your mom has filed joint tax return with your father last years, her household is 2.
If your mom has filed separate tax return with your sister as dependent in the last years, her household is 2.
If your mom has filed joint tax return with your father and sister is dependent in her return last years, her household is 3.

Plus, you and your wife are always included - 2.

You were NOT supposed to send the originals to the USCIS with I-130. They will NEITHER return it to you NOR to forward to NVC. It just cost more money to order it in the Philippines and have them send it to me again. But I will do that if that's the option left.

If your mom lives at your address (household member), yes, she will file I-864A with your I-864.

I-134 is not needed at all for IR1/CR1, that's for non-immigrant categories.
