Normally it takes a month and sometimes it can take upto 2 months.

If it doesn't arrive after 2 months, making an infopass appointment is good. But most will have it within this timeframe.

msd, If you have received the welcome letter (it is another notice of action), it has a receipt#. You will need to enter this receipt# to track the GC production. Sometimes, both will arrive almost at the same time :star: I don't from where welcome letter comes now. But 2.5 years back, though our petition was processed at VSC, welcome letter came from Texas Service Center.

Carol Anwar, I have PMed you so many times, it is not your case. You filed I-130 and waiting for the approval based on your previous feedback and timeline.

NVC entered my DOB wrong. Me too sent the DOB correction package (passport copy & birth certificate) to NVC and they corrected it.

Until the correction, I was unable to talk to NVC operator about our case since my DOB was wrong.

And petitioner & beneficiary name, DOB and NVC/CIS Case# are the required input to talk to an NVC operator.

While people MAY debate whether the entry date or visa interview date controls whether the immigrant is entitled to the 10 year card or the conditional status and 2 year card, the issue is settled law and policy. Entry after the two year anniversary of the marriage entitles the immigrant to full LPR status regardless of the designation on the visa itself.


I completely agree with this point.

The reason why few people didn't get IR1 at POE even after the 2 year marriage anniversary is either the POE officer made a mistake and the beneficiary failed to inform them clearly.

Darnell has clearly pointed out this in many occassions, as well.

Yes, NVC requires original documents or certified copies of the documents plus a photocopy of each.

"All documents not written in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations. The translation must include a statement signed by the translator stating that the:
Translation is accurate, and
Translator is competent to translate."

The passport change is basically a choice. If you want your wife's green card to have her MARRIED name, then the passport should be changed first because the green card will show exactly what the passport says. If not, then her green card will be issued with her maiden name.

It's always cheaper and easier to have the passport changed in the home country (at least, most of the time). It took me 4 weeks to get my new passport, I had to bring the marriage certificate and 2 photos, that was basically it. But again, it DOES NOT have to be changed.

Since your spouse cannot live in the US without a proper visa, and a tourist visa or the VWP is not authorized to 'live' in the US, you want to avoid the presuption of that. Your spouse must have a residence in the UK correct? put that down as her address. Her time in the US is a visitor, not 'living'

The only proof of your marriage you need is your marriage licence. And assuming you are married, you obviously know each other since you had to (at least) meet the day of your wedding.

Just my opinion, I'm sure others will weigh in

I sent my husband's DS-3032 through snail mail and email. The snail mail DS-3032 was processed first (about a week)...the emailed one was processed after 13 days. I would send it both ways to cover all bases. Good luck on your journey!

When we went through NVC last year email was not being used to the extent it is now so we had to rely on constant calls to operators or AVR. However, we still made it though in 19 days by being proactive.

As soon as we had our case number we sent our DS-3032 via email and snail mail. Never did figure out which one was accepted but our IV bill was invoiced and paid 5 days later.

Ok so my husband recieved CR-1 visa and entered the US on 9/29 in ATL. All went fine there but after a about 7 days of being here due to a family emergency he had to travel back to Germany to be with a loved one. I just want to confirm no AP was needed, because we still have not recieved welcome letter, SSN #, or resident card. Can anyone help put my mind at ease. Thanks


No AP is needed. There's a stamp on his visa that serves as a temporary green card for one year. The actual card usually arrives within a month.

I travelled back to Canada a week and a half after my POE and had no issues at all re-entering using my passport with the visa stamp. He will be fine!

A photocopy is sufficient for the I-130 petition but you will need the originals or certified copies for NVC. While you are waiting for your NOA2 you will have time to order more copies. And yes, you will need to submit one for each previous marriage as per NVC instructions. Good luck!

So I was getting my packet together (I-130) and making sure every last i is dotted and every t crossed and then I see... CERTIFIED marriage certificate.
So first I do a little searching on VJ...seems others had the same question. And most of the consensus is that a license ISN'T the same as a certificate because it doesn't prove marriage. Well, here's my question...

My marriage license is also a certificate of marriage because we take the license to the officiant and after the marriage, he signs it, we sign it, the marriage date is listed and then he presses his offical "SEAL" on it (in our case it was a Judge and he SEALED 3 copies for us and we signed all 3). We keep one, and send 2 back to the county it was filed in. The form even says at the top "STATE OF XXXXXX LICENSE AND CERTIFICATE OF MARRIAGE" on it. Soooooo....

Will it work???



Ours was similar; application, license and certificate of marriage all-in-one. Immediately following our ceremony the officiant allowed us to take the signed form back to the county office where they immediately registered it and gave us certified copies. This is what we photocopied and included with our I-130 petition.

From what you describe your form had not been registered yet. If you want to take a chance and send it in I would suggest you oder the certified copies ASAP so that you are prepared if you get an RFE.

Before one week i had my medical exam at Apollo Hospital,Gandhinagar,India.I received vaccines for tentanus,varicella and MMR.When i went there to pickup reports then the Guy at the clinic said that everything is good and that I am good to go (having all my age appropriate vaccines complete). But I got home and looked at the results in the Vaccination Worksheet and the doctor has marked those vaccins as "Taken" which are given by them and the rest have been checked as "Not appropriate for age".The form was checked that the "Vaccine History Incomplete" and "Applicant may be eligible for blanket waiver because vaccines not medically appropriate".

After searching on VJ i found that it can create problem in visa interview in only K-1 visa category.Also found that for Immigrant Visa applicants its okay. I also read that mostly people have that type of result. So i want to know that is it a common or what?? Anybody has/had the same results?? Anybody had the problem due to this in past??

My report lat year said the same thing; it just indicates that there were some vaccines that were not age appropriate for you. Nothing to worry about. If there were any problems they would have told you.

At the I-130 stage proof of termination of any and all prior marriages of both petitioner and beneficiary are required. Photocopies are acceptable.

"If either you or your spouse were previously married, submit copies of documents showing that all prior marriages were legally terminated (court certified copies of the petitioner's and/or intending immigrant's divorce documents)."


Originals or certified copies are required for NVC and "should" be forwarded to the consulate for the interview but as squeaky580 posted better to be safe than sorry. I bought duplicate originals of all the required documents to my interview just in case.

I have sent many emails to US embassy in montreal but haven't heard anything back from them. This is the auto response, i received whenever I sent them an email.

"Thank you for your message to the Immigrant Visa (IV) unit of the U.S. Consulate General in Montreal, Canada. Please note that due to the volume of messages received, you may expect a reply to your inquiry within two weeks.

there is no contact number available...I also called the number where they charged on credit card but the lady told me that they can only help for the non immigrant visa.


Good! Forward this NVC message with the proof of child birth (reason for re-schedule) such as copy of the birth certificate etc. to the Embassy again.

Keep on trying until you get a positive response from them.

I am Canadian Citizen and my husband is US citizen. I received my interview date last year in December for January 28, 2010 but I had to reschedule it because my due date was January 29, 2010. We sent them an email regarding the situation and got the reply in February from the Visa department that they will reschedule the date and it will take 2-5 months. It has been almost 6 months and we haven't heard anything from them. I called the Visa department in US and they told me that your file is in the US embassy in Montreal and they haven't reschedule your interview date yet and they are very busy so just wait. Please let me know what should i do? its very difficult situation for us because we are living separately from last 6 months. how long does it take to reschedule the interview date? we didn't have any choice except reschedule the date :(

You have to co-ordinate with NVC and Canada U.S Consulate to get new schedule. IMO, I don't see any other options. Try calling and emailing to both everyday. Also, attach the baby's birth certificate for the proof of re-schedule.

Originals submitted to USCIS with I-130 will be part of their file. It will not be forwarded to NVC. At NVC stage, you need to submit the required docs again. But NVC will forward your entire file to the foreign consulate.

Ok so this is the info I have gathered but I want to be sure if its the one they are asking for. Keep in mind I filed the I-130 and I-485 at the same time.
So would the date of filing be the received date shown on the attached form?

That looks like I-485 filed date. USCIS wants I-130 filing date, because that's the petition.

Lot of other posters have given the clue how to get I-130 filing date.

If you still think, it is un-obtainable, how about your ex's A# writing if you have?

If you still not have any information, put the I-1485 filing date since that's the closest match in your case. Also, write the Service center where it filed, name of your ex and the outcome of the case.

you can file a G-639 Freedom Of Information/Privacy Act Request ... it would require a signature from your ex but the file would be sent to you but it takes a few weeks... nice thing is IT'S FREE to file

Any chance you have a photocopy of the NOA1 or NOA2 in your files? The petition date would be on it.

Your next option would be just to ask your ex for a copy of it.

The most expensive option would be to request for a duplicate copy of the approval notice (which also has the receipt date/petition date)...you'd need to file an I-824 Application for Action on an Approved Application or Petition...the fee is $340.

Im not sure on how to answer the question on Part D (Other Information) that asks: Have you ever filed a petition for this or any other alien? and
If "Yes," give name, place and date of filing and result.

I am stuck on this question and would like to know if I can just put an approximate date or how I can gather this info. I filed a couple of years ago for my ex but dont remember when the filing date is, all I have is the date the I485 was received. Also what terminology should I put if the application was "successful"? Would "APPROVED" be appropriate?


If you have ex spouse's A#, list that as well. It might help.

Just to give everyone an update...if interested. The explanation letter apparently worked as we got a notification that our case was completed at NVC on Oct 18, more than 2 months after we sent in our DS230- :(. Now we have to wait for the interview to be scheduled, for which supposedly missed the scheduling window for November (first two weeks of the previous month - grrr). I wonder if this will be brought up again at the interview....I still don't understand why on our case completion letter the "Country of Chargeability" is still stating Libya....As I understand, this has no effect on spousal immigrant visas, so I'm going to ignore it. It still is bothersome though....thoughts?

NVC will pass it. That does not mean you are done. CO is the person who decides it finally. Chances are there to bring it up at the interview. Prepare very well for it. And Good luck to your interview :thumbs:
