IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion Regarding NVC

Thank you guys for the reply so at the top of the choice of agent form it says place case bar-code strip here before mailing to the national visa center

Where do i get that

You will get an email from NVC around 2 to 3 weeks after the NVC Case# generation with a PDF file that will have IIN, AOS fee invoice and "bar-coded DS-3032". You can use it. In the meantime,

if you are worried that is a long time to respond, the guide here has DS-3032 email template, that can be filled out and emailed.

Still worried - you can use that DS-3032 form without barcode, but write NVC Case# and CIS Receipt# on the top to deliver by mail or scanned version by email.

If all fails, shoot another DS-3032 email with everything same as DS-3032 email template, but prefix the subject with "Attn: Supervisor Sue"

We paid my husband's AOS before we sent in the choice of agent form. You will be allowed to pay the IV bill once choice of agent is received and processed.

Curious :)

DS-3032 acceptance can be confirmed:
1) The real response to your email. (Not auto-response)
2) IV fee invoice ready to pay in the payment portal

Regular email review currently takes around 2 weeks I think. Also, email response back to our regular emails takes many days after that.

Don't be surprised that the response of your initial emails pops up next week. Just ignore them ;)

IR-1 / CR-1 Spouse Visa Process & ProceduresSt. Lukes Medical (Walk-in) for exam

Can anyone go to the medical center and pay to have their medical exam taken even if they do not have an interview date set? MY wife's paperwork was sent to the Manila Embassy on Oct.20th but we have not recieved an update for anything as of today. We are hoping to fly her there Sunday and have her medical exam taken. Also we're wondering how long it will take them to give the exam so as to reserve the hotel and flights for her too.

Please give us your needed input into this matter.

Thank You,

Dan

Dan,

It is a good link for your questions - http://manila.usemba...218.html</span>

The below are required in St.Luke's Medical Center.
  • Appointment letter sent by the National Visa Center or an e-mail print out of your appointment sent by the Call Center.
  • Appropriate medical examination fee.
  • Passport (valid for at least 6 months)
  • Two colored pictures (2 inches x 2 inches) with a white background
NVC will email the petitioner a PDF version of the appointment letter 2 to 3 weeks after NVC Case completion. Then only your wife can proceed for medical.

Do you think I should also receive the postal letter for my interview date or the email attachment pdf letter is OK?

Do any one have any idea about this?
Please inform.

Email PDF appointment letter is good for medical and interview. Snail mail (packet 4) will arrive little later to the beneficiary with the appointment letter, medical info, docs requirements etc. In our previous case, we got this packet4 after the interview. You sent your ORIGINAL PASSPORT to NVC :o

I just can't believe it! God help you out to get the passport back. NVC needs the passport copy of the beneficiary only.

Write an email to NVC immediately to return your passport back.

Frame the subject: "ATTN: SUPERVISOR SUE - NVC Case# <enter it> PLEASE RETURN ORIGINAL PASSPORT"

Frame the email body with NVC Case#, CIS Case#, Petitioner Full name and Date of Birth, Beneficiary's full name and Date birth. Then include a detailed message to return the original passport back to your petitioner.

NVC email id is NVCINQUIRY@state.gov

After sending this email, wait for their response. Also call them now before midnight or Monday early morning at 603-334-0700. It is difficult to get them, but redial many many times to get them.

You need to submit a photocopy of the beneficiary's passport biographic page to process your IV package.

Oh I am terribly sorry for that mistake.

At I-130 stage, the copies of both the petitioner's and/or beneficiary's divorce decree are needed, if they have divorce in their prior marriage(s).

Loto

IR-1 / CR-1 Spouse Visa Process & ProceduresDivorce Decree & Beneficiary Interview

Okay, part of my confusion was that I was also unsure if they were requesting the petitioner's divorce decree (if applicable), or the beneficiary's divorce decree (if applicable).

IV package at NVC asks about the beneficiary's divorce decree if applicable.

But at interview time, as all others said, it is a "very good" idea to carry the petitioner's original divorce decree (if applicable) as well.

Oh, I think you are in the initial stage with I-130. Here the copy of the petitioner's (if applicable) divorce decree is enough.

Any amount of money greater than 10,000 US dollars must be reported on your customs declaration documents when entering the USA. The penalty for not declaring is more than you care to lose.

The funds would not be considered income but would be an asset and could be transfered from bank in her country to a US bank via wire transfer.

Since the transaction took place in her country and any taxes would have been paid there, there should be no tax liability in the USA.

Richi,

I know you have all those beautiful guides to cruise the NVC in a lightning speed!

Medical - Normally, the appointment letter is necessary to do the medical. But I have seen the people in Philippines have done it with other NVC correspondence that has NVC Case#. Check with your panel physician, if an early medical is possible with NVC Case#

Agent & DS-3032 - Now you can shoot a DS-3032 email (This is just form data). Normally, the beneficiary assigns the petitioner as choice of agent to speed the things, but it is not a requirement. I prefer the petitioner to be the COA so that all package deliveries locally can be done quickly (Every second in NVC is damn important to me!). Also, if you get DS-3032 email from NVC as PDF, you can complete it and scan it and email back to NVC, if your first DS-3032 is still not accepted at that point.

Follow the below guides, if you count every second in NVC.

Department of State Official link - http://travel.state....1335.html<br />Also follow LingChe shortcut (http://www.visajourn...he_NVC_ShortCut) for fastest NVC processing. Current record is 13 days using LingChe shortcut in the past.

Your current year paystubs and employment letter would be enough from your side.

Prepare the tax documents from the co-sponsor's side with their USC/LPR status document.

IR-1 / CR-1 Spouse Visa Process & Proceduresi-864A current income question

Thank you all,

Pushbrk - I will follow your idea because you are right - the FIL is zero income presently.

I will file using just the MIL and provide all necessary documents to show what she earned - as her accountant already has these.

Have a great day, everyone, and thanks for helping me with the final stage of my immigration.

-Mike

Good luck Mike and that is the best case in your AOS too, since you already have that separate income details.

LotofPatienceMaleIndia2010-10-31 14:43:00
IR-1 / CR-1 Spouse Visa Process & Proceduresi-864A current income question

This is a bad idea, IMO. FIL would state zero income currently, so there's no benefit in him providing an I-864a. Follow the suggestion I gave in my earlier post and yes, leave out the assets if the schedule C income alone is sufficient.

pushbrk is correct.

It is a weighing game which is easier method.

Separate out MIL income alone and MIL prepares I-864A

OR

No complexity of the separation and MIL's income and asset is way above the poverty line.

IR-1 / CR-1 Spouse Visa Process & Proceduresi-864A current income question

Thank you LotOfPatience - I'll make sure we stick the assets in too.

The household size is 4 and combined income last year was just under 100k.

Back to my original question - what do you think I should put for 'current income' for
my MIL? Is the figure she earned last year (individual income) appropriate given how strong the AOS will be?
It could fluctuate between 20% +- but whatever it ends up as, it will still be well
over the poverty lines. There is no way of guestimating it until the taxes are done by
her accountant. I could always write (ESTIMATED) next to the figure?

For self employed persons, last year income is the exact true picture.

Current year can only be projected (unless it reaches the end of the year), based on their quarterly estimated tax filings.

Loto
LotofPatienceMaleIndia2010-10-31 14:31:00
IR-1 / CR-1 Spouse Visa Process & Proceduresi-864A current income question

Excellent idea, LotOfPatience!!

OK I will do this.

The ASSETS section says "Complete only if necessary" - so should I leave this blank,
and simply attach a covering letter explaining that the asset and deeds documents are included if
they want to see them? The reason I ask is that MIL's income is sufficient on its
own, so really the assets aren't necessary; I'm just putting them in for extra safety...

Mike,

If MIL and FIL's total income of 2009 is way above the poverty line with your wife's, income alone is sufficient.

Declaring asset is then optional. But if they declare it, AOS gets even more stronger.

Now the household size will be 4, if there are no other dependents or they or your wife has not executed AOS for any other persons in the past.

IR-1 / CR-1 Spouse Visa Process & Proceduresi-864A current income question

What does this mean? I don't understand this last part of your post? Sorry about this...

In 2009, your MIL and FIL filed the taxes jointly. Your FIL is currently unemployed.

So, prepare one I-864A by your MIL and another I-864A by your FIL. In this case, they can show the combined "Total income" of 2009. Also, your wife's income also can be added. Plus put their asset - land. If the land title will be under their both names, the combining method above will not ask to split the value of the land as well.

IR-1 / CR-1 Spouse Visa Process & Proceduresi-864A current income question

Hi there,

Yes - I am submitting all the relevant schedules (such as Schedule C - profit and loss)
as well as the documents prepared by her tax guy that show her exact personal income.
We are also including the IRS transcript along with these - all of this is for 2009.

This area is not the problem for me - it is mainly trying to figure out how to
calculate the 'current income' box. Currently I am using 2009's income as this figure.

If worst comes to worst I have an appraisal of land she owns (worth a lot of money)
with deeds - maybe I should just submit these because these alone would cover us. And
then maybe add a covering letter to explain that they are included if they would like
to use them???

-Mike

An Anh Map suggested, that's a cleaner method - FIL's income alone suffice and FIL is the joint sponsor.

Mike, If you still want to use MIL as joint sponsor, you need to separate her personal income out. Of course, MIL can declare her asset such as land in the asset class with the latest appraisal report prepared by the licensed appraiser.

Another and last option - If MIL and FIL do not have issue to show the combined income, the complexity can be reduced.

Loto

btw - the item and form that shows how much my MIL and FIL earned individually is the:

Federal adjusted income [2009] (box 1) on the Individual Income Tax - LONG form.

There was no item 22 on the 1040 that I could find?

btw FIL does not have sufficient income thanks to the recession - currently unemployed...

Which federal income tax form your MIL used in 2009?

IR-1 / CR-1 Spouse Visa Process & Proceduresi-864A current income question

Hi All,

My mother-in-law is coming in as a HOUSEHOLD MEMBER, as it turns out her personal income is enough to help meet the poverty guidenlines. She files her taxes jointly (Married) with her husband, but we have the tax return info to show what she earned, so lucklily we have no need to bother him to file a i-864a also.

HOWEVER...

The form asks her 'current income' - unfortunately she is a business owner, and has no idea what her 'current income' is until the taxes are done at the end of the year. So I have put in the figure that is her most recent year's earnings (2009 income).

Do you think this will suffice? I am not really sure how to get around it. It's one of those situations where I hope they look at the forms, see the business docs (profit and loss etc) and her income for 3 years and apply a little common sense.

However if anyone has any ways I could help the people at NVC with the info, please let me know?

Thank you,

-Mike

Since she alone satisfies to be the co-sponsor (joint sponsor here), it will become little complicated in your case. The reason she has to separate out her income from the recent tax year. It would have been easier if it was simple cases in W2. But, to add the complexity, she is self employed business person as well.

Here is the deal. She needs another work out from a CPA such a way that:

1) List all her income from the business and other sources
2) Prepare a profit and loss (Schedule C) statement
3) Derive the total income (Line 22, Form 1040) just for her alone.

You need to feed this number as her individual income in the Affidavit of Support.

Also, you told, she is household member. So I assue MIL lives with your wife (petitioner). Your wife will file I-864 and MIL I-864A. In this case, both the persons income can be combined to meet the povertyline.
