If you have not filed the taxes, you will have to explain it in a letter why you didn't do.

IMO, 401(k) has cash value and considered as asset. So, it must be fine.

But, I would pull the people in this thread, who have done this in the past without any issues.

Yes, 401(k) amount's cash value of early withdrawal is:

Early withdrawal penalty - 10%
Withholding Tax - 20% (This is just withholding, not the actual tax)

So, you ultimately will get 70% of the distribution.

I withdrew my 401(k) long time back when I changed the employer. Other hardship withdrawals based on your plan is "extreme financial need".

Prepare a statement from your 401(k) plan based on the above.

I am currently working on I864 as a petitioner for my husband. I have all of the tax returns for the past three years. Currently, I have had a very good and well-paying job since February of this year and have saved all of my pay stubs and got a letter from the HR. For 2007 tax return, I lived and worked abroad in Korea for most of the year. My total income for the year is 43,000 dollars, which is way above the poverty limit. But my adjusted gross income is 14,900 dollars, which is below the poverty limit. This is because my foreign income was not counted in the adjusted gross income for 2007 tax year because I filed 2555E along with my tax returns. Now, do any of you know if the adjudicators will count 43,000 dollars as my total income? Or will they count my 14900 dollars as my total income? I am a bit concerned about this.


You are all set. Their main review will be the last (2009) tax return and the current year (2010) income potential. You made a progressive income growth. So, you are absolutely good with I-864.

Adjusted Gross Income is gross income (combining from all source of income) and subtracting the income tax code's enumerated deductions.

Personal Exemptions, Standard/Itemized deductions etc. are subtracted from AGI to compute the taxable income.

On I-864 when they want Annual income , is that the Annual income without taxes taken out?

Also I didn't make any income before 2009 and I just started this new first/job in June 2010, I got tax transcripts as proof of non-filing so do I just leave it blank where they ask for income for last three tax years? I figured writing "see transcripts" in red ink would suffice?

Annual income in other words is the "Total Income" is the entry in I-864. This amount is basically without any deductions and taxes for 1040 filers. So, you will have to enter your pre-tax annual income there.

It will be good to attach last 3 years tax transcripts. Don't leave it blank. Enter the year and $0. Also, write an explanation in the cover letter or so why you didn't file taxes in the prior years.

As a first job (may be after graduation) is ok, but "may be" questionable. Very high income in this year "may" offset that negative part. However, I suggest you to do the below, if possible:
1) Add a co-sponsor if found
2) Add US petitoner's asset (33.33% of total will be considered) or intending immigrant's asset (20% of the total will be considered)

This is why I always suggest to mail only IRS tax transcripts with the AOS package.

You should include all the schedules since they are requesting it. Plus include tax transcripts too.

Temporary job may be questionable. Why don't you add your mother as well as a joint sponsor to make the AOS stronger?

When your husband arrives in the Green Card, he can start working immediately in the U.S.

Since you would be married less than 2 years, you will get CR1 GC. That's why Condition removal is needed. So the second guide would be useful 21 months after his POE in the U.S with CR1 GC.

Affidavit of Support Fee - $88
Immigrant Visa Fee - $404

So I received my NVC case number today and called NVC to give them our email addresses and I asked the Rep on when I could send the email version of the DS-3032 in. She told me it would take four weeks. So I said that I thought it would take four weeks if I wanted a mailed application. She said yes that the only difference is that now since they have our email addresses they will send application electronically instead of snail mail. This doesn't seem to jive with what I have read from looking at people's time lines and the Wiki shortcuts on sending email of DS-3032. I didn't really want to argue with the person so let it go after I didn't seem to be getting anywhere. Can I send the email as soon as I get the message that my file has been manually uploaded (which is what I thought) or do I need to wait for some message from NVC?
Second question since you are all here, do I call the phone number to see if the AOS bill is ready to pay or do I wait for an email? The Rep said again that I just wait for an email.

Since you have NVC Case#, you can email DS-3032 now and also try to get IIN for AOS & IV payment too. It will land in your inbox sometime soon.

I'm in a similar boat. My case number was assigned 10/18 and I have yet to recieve ANY emails from NVC. My husband (beneficiary) emailed the DS-3032 10/19 and only got the standard reply. Haven't heard anything else and I haven't received the kit. My AOS was invoiced today and I paid it today. I called the NVC this evening. Same old story, wait two weeks.

I have read both the EZ Guide Spouse and LingChe NVC shortcut. According to the latter, the NVC won't do anything with the emailed DS-3032 until the NVC has generated one, however EZGuide says to email after you receive your case number. Not sure which is the correct way?

Anyway, I guess I will go ahead and send a hard copy 3032 tomorrow as well. Hopefully the NVC will get the ball rolling.


If you see AOS invoiced, shoot another DS-3032 email. Everything is same as the first one except prefixing the email subject with "ATTN: Supervisor Sue" and let me know the result.

In reference to questio 35 on the form, it requests dates to and from the usa incl visa type.

my question is, do they request exact date and month and year, or month and year - will that suffice.

Ive been to the US around 10 times incl a previous K1. Some of the dates I can remember as its marked in my passport, but some are a big vage re the exact date of arrival or departure. I dont want to misrepresent anything, or miss a visit out - god forbid, I want to be as honest / accurate as possible on the form.

In reference to the location - is that POE or the City I stayed.
An I assume Id attach an addendum for further visits on a seperate piece of paper?

what is dcf meaning?


DCF is Direct Consular Filing.

Some petitioners if they live in the beneficiary's country for some period of time, they are eligible to file I-130 petition at the U.S Consulate over there, rather than filing at the USCIS in the U.S.

For DCF people, I-130 will be processed at the foreign consulate, no NVC involvement, and interview at the Consulate. It is much faster and all the steps can be completed in few months time.

So line 21h would be total 2.

If you have any specific situation such as dependents or sponsored any other persons in the past, the total count will change.

Yes all are correct!

Both PP office PCC is a must with DS-230 IV packet for all Indian applicants.

Police station PCC is also needed with the IV packet (though some had no issues with local police station PCC)

Thanks very much Loto, i did just call and spoke to a T2 - obviously they cant give me specific info, i was checking to make sure they hadnt looked at the case again and denied it or something!! but they said in that short space of time its highly unlikely.

The T2 said they usually allow 30 days for notices to be received - and they have 90 days to send the case to the nvc (wow - didnt know that)! And if it doesnt arrive within a reasonable amount of time eg. 2 weeks we can request a duplicate copy.

So my thinking is that the last updated status of oct 26 was maybe when they generated the approval notice and / or mailed it out?


10/26 may be the file transfer to NVC.

30 days, 90 days etc. are all their standard message. It will arrive in 1 to 2 weeks time.

So the approval date is 10/22, since that was a Friday, probably the mail must have gone out the early next week. So, I fee you will have it tomorrow or early next week.

If you are worried about expedite, you can quote the same Receipt# of the NOA1 to NVC. Because NOA1 and NOA2 case# are same.

hi guys, our petition was approved on oct 22 and sates online that an approval notice was mailed out that day.
Its now a week and hasnt arrived yet, is this normal? I looked at our case status online and our case was touched on Oct 26. Any ideas why that may be -
Generating and sending out the NOA2 then (on oct 26) OR
Sending the case to the NVC on that date?

Im impatient as my wifes health is deteriorating so its quite a worry, we have letters to move forward hopefully with an expedite at NVC level, but obviously we need the NOA2 before we can procees through this difficult time.

Status means "Decision", "Post Decision Activity" etc.

It is normal for a notice to arrive wihin 1 week, sometimes upto 10 days as well. Worry starts after 2 weeks, though.

If she is pregnant, you will need something form her doctor proving that she is pregnant. Also saying that she can't have a chest x-ray or such and such vaccine. Without proof, I don't think they will believe you. :thumbs: You should be fine though. Most people are understanding. :star:

You will get an email from NVC around 2 to 3 weeks after the NVC Case# generation with a PDF file that will have IIN, AOS fee invoice and "bar-coded DS-3032". You can use it. In the meantime,

if you are worried that is a long time to respond, the guide here has DS-3032 email template, that can be filled out and emailed.

Still worried - you can use that DS-3032 form without barcode, but write NVC Case# and CIS Receipt# on the top to deliver by mail or scanned version by email.

If all fails, shoot another DS-3032 email with everything same as DS-3032 email template, but prefix the subject with "Attn: Supervisor Sue"
