K-1 Fiance(e) Visa Process & Procedureschat logs - do read each bit of it, or just skim it?

It wasn't you I was responding to there, it was Vanessa and Tony. Sorry for the confusion. Just some people like to jump on other people right away and they don't know the full picture. I just don't appreciate someone telling me 'You need to do' such and such, as though I need some sort of adjustment. Things can be said a bit more tactfully. I don't try to tell other people what they NEED to do. I have been studying the Casablanca consulate for the past two years and have read varying reports about the use of chats. In some of these instances, it has harmed their cases. I wanted to act on the side of caution in this regard, that is all. I don't want to give them things, that they then can bring up, which we might have discussed more than two years ago and have little memory of. That was my intention. I will more than happily provide them some chats at the interview. I just didn't want to blindly send a bunch of chats, that even I have a hard time remembering the situation, the context, etcetera, and then have them throw those back in our face.

We haven't even had an interview yet, so to suggest a Stokes Interview was a bit of the cart before the horse.

Also, you might be a little testy too if you have been fasting all month.

I understand...I think when people respond that they don't mean to sound "this way or that"...sometimes the comments come across sounding harsh when they are not meant to be harsh at all. For the most part, people here just really try to help one another. It's a longggggg road, and it's hard no matter where you turn. And yes, I have to say...if I had to fast, I'd be somewhat of a crank pot, LOL. Things are hard enough! Hang in there!

Jeesh. You are way ahead of yourself. I am prepared to do what they ask, however I will not give more information than they ask for, and I will not put myself in a situation, like some people in the Morocco forum, who have provided chats, only to have them used against them. If they ask, I will provide. Until then, I will wait to see what they are requiring. I don't need to get over anything. That is your presumption. I am well aware of Casablanca's reputation. I have nothing further to discuss here.

Only trying to help you. :wow:

You need to get over this way of thinking. They are entitled to pry into your personal life because you are asking for a privilege and they want to make sure you aren't going to abuse that and to make sure you're good people.

 Agreed. It's not easy, but we all have to do it. It's only for a short time, and when it's over...it'll all be worth they're "needling and prying"...it's all soon forgotten.

K-1 Fiance(e) Visa Process & ProceduresWill it be an issue if my fiancé buys a two-way ticket?

Why on earth would they charge me if I don't call to cancel? As you said - they already have their money. They can't charge me for not giving them the chance to resell my ticket and make even more money. The jerks make enough money off of people like me.

In any case, he's probably going to pay for the flight then cancel the bank card before he leaves anyway. They can't charge a card that no longer exists.

I'm only telling you what I know and trying to be helpful. But, to answer your initial question, it's not an issue to purchase a round-trip ticket. We did, and his return was to London...not even Kenya and they didn't question a thing :)

K-1 Fiance(e) Visa Process & ProceduresWill it be an issue if my fiancé buys a two-way ticket?

I used a two way ticket when I entered on a K1 and I didn't have a problem. Some airlines will charge a fee if you don't use the return portion of your ticket so you might want to check this out. I used AA and didn't have any issues at all.

The airlines will only charge you a fee on the return portion IF YOU DON'T CALL TO CANCEL THE RETURN. Just trying to make that clear. If you just don't show up and don't bother to cancel, yes, they could charge you. If you call to cancel, they will NOT charge you. I do lots of travel - trust me, I know. I am just trying to help. :)

Its not an issue for K1 / CR1 all these visa immigration does not care what kinda ticket you buy.
Buy whichever is working out for you.

Upto you u might want to cancel or not show up at all, now days some airlines would even charge you to cancel ticket why bother in that case.

We purchased a round trip because it was less expensive...it's not an issue. But, PLEASE cancel the return - it's really rude not to because someone else might really need that seat on the plane...you never know, it could be a visa journey member  Plus, I have never in my life heard of an airline charging a fee to cancel a ticket...why would they? They already got paid.

K-1 Fiance(e) Visa Process & ProceduresFinishing Touches on I-129F Packet...

Hey VJers,

I have really appreciated the support this site has given me throughout the process. I have read the directions many many times on the USCIS site and have also asked and looked at questions and comment from here. I am ready to send of my packet and just want to make sure it is ready.

I used an ACCO fastener to put everything together.

The packet looks good. I paper clipped the G-1145 on top just before the check and cover letter.

The packet is not long 35 pages, mostly being 20 pages of proof of having met and ongoing relationship.

I have included my info page from my passport and the various pages with the entry stamps to Mexico. (This is not to proof citizenship. I have attached a copy of the front and back of my birth certificate.) Should I draw an arrow to the correct stamp on the pages. (I have several stamps on each page.)

Also on the bottom of the G-325A it says to print your name. Is it ok that I typed it in?

Anything else you can think of?

Thanks so much.
Luke

You can highlight the correct passport stamps with a highlighter; that would probably be better than drawing an arrow and look neater. And yes, it's OK you typed your name at the bottom of the G-325A. I did and I had no issues. Good luck and God Bless.

K-1 Fiance(e) Visa Process & ProceduresPlease help. Got our NVC Case Number today, so what's next?

NOA2 Approval was last Aug 10. I called the NVC today and got our NVC / MNL Case Number. Yay! What are the next steps?

Are these steps correct:

1. Pay the Visa Fee of 350 USD at BPI
2. Schedule for an interview.

Questions are:
1. What form(s) should I accomplish so I could book for an interview? Do I need to accomplish / submit DS-160 online?
2. What's the best way to book, via call center or online?
3. Do I need to wait for the Packet from US Embassy before booking for an interview?

Please help. Thank you so much guys :)

You need to complete the DS-160 on-line (FYI~it requires uploading a photo) and pay the fee before you can schedule the interview. I would book your own appointment on-line by yourself - the call center isn't always "on top of things" so to speak, and they don't know the answers to a lot of questions. When you book the appointment yourself, it gives you the capability to print the confirmation...I just think it's better to do it yourself. As far as the Embassy question, I will leave that to someone else who knows more about that Embassy. Best of luck!

Hey guys, how much detail did you guys provide for the how you met letter? I can be very long winded. Did y'all pepper it with how much you love each other and such?

I was precise and to the point...and I didn't require anymore space than what they provided on the Form I-129F, #18. I feel they just want to make sure you met in person as that's the requirement for the I-129F, I don't know that you need to provide the "mushy" stuff  , but that's certainly up to you. I did not provide the "mushy" stuff at all, and I had no issues. :D

K-1 Fiance(e) Visa Process & ProceduresMoving along K1 process.

Hey all, well fiance' sent me her docs, etc, today via FedEx, should be here on friday.

I have completed the G325A and the I-129F, still have to do the 'how we met letter', I followed the pre filled suggestion on question 18 and will use blank sheet and attach it. For fiance letter of intent to marry, the USCIS address, what to put there? The next place where it shows United States Department of State
United States Consulate, [name of country where Embassy is located]

[Embassy Address]

My fiance is Filipina and lives in Manila, So would the area in red be Philippines and the US Embassy address in Philippines? Rest I think I can figure out, lol.

And I also guess the I-129F cover letter as well? Sample letter explains it pretty well except for address of service center?

Thanks, you guys have been a vast help so far.

Hey jetdoc3037 - For my Letter of Intent to marry, I addressed the letter to:

United States Department of Homeland Security
U.S. Citizenship and Immigration Services
Attn: I-129F
2501 South State Highway 121 Business
Suite 400
Lewisville, TX 75067

I had no issues. At the interview stage, you can do another Letter of Intent dated closer to the time of the interview and then address it to the Manila Consulate at that time (that's what I did, but the Nairobi Consulate handed the letters back...they didn't require them).

I used the same address for the I-129F Cover Letter. I sent it Fedex that's why I didn't use the PO Box address :)

K-1 Fiance(e) Visa Process & ProceduresFiling i-864 Help

Hello,
Thanks for your reply... but I am still a little confused. I thought the i-485 form only cost $985.00... where does the extra $85.00 come from? Thank you for your help!

Karen

The extra $85.00 is for the biometrics fee. If you go to www.USCIS.gov and click on "Forms" in the upper left hand corner of the screen, it will list all of the immigration forms in a table with a fee column right next to it with the fees associated with each form. :)

K-1 Fiance(e) Visa Process & ProceduresFiling i-864 Help

Hello VJ community,

I am filing my husbands AOS forms and have a question regarding the Affidavit of Support. I am unemployed and have no income, tax returns from the last year etc... with that said my father will be our joint sponsor. Am I (as the petitioner) requiered to fill out the i-864 with an attachment describing my situation or is it sufficient to just have my father fill one out?

Also, in regards to filing the i-765 employment authorization form, is there an additional fee? I read that if filing this form together with the i-485 you do not need to send in the extra $350 fee... is that correct? Or does it cost $350 in addition to the $985 fee for the i-485? Im a little confused and frustrated that we may have to pay more for his work authorization while we wait for his adjustment of status.

Thanks for any help!

Karen

If you file Form I-765 (EAD) with Form I-485 (AOS) there is no additional fee. The total amount for AOS, EAD, and AP is $1,070. You're good to go. Hope this helps :D

We went through the Nairobi Consulate...not the hardest Consulate, but certainly in NO WAY, the easiest. I was worried sick about the same question...I'm 8 1/2 years older than Ben ~ I can still have children, BUT I already have a 23 year old daughter. Ben has no children. I even got a note from my doctor stating that I could still have children just in case. I was very concerned. The Nairobi Embassy is known for giving people a really hard time (especially CR-1 visas, for some reason) although ours was a K-1. They never even asked the question. Over prepare yourself, and hope and pray it won't even be an issue. God Bless your journey.

I agree that the visa will be issued shortly because they kept his passport and the CO gave him the info for DHL. That's a good sign. It does sound like the CO is on some kind of "power trip". We go through enough during this process and it kills me, KILLS me the way these CO's behave. Ours was awful....and I mean awful. I can't even post the things she said to Ben and it's a good thing they made me wait outside because if I was inside with Ben and heard her "yip yap" I think I would have tried to punch her out, LOL (not literally, but that's how nasty she was...unbelieveable). I don't know how these people sleep at night. Keep checking the website for the DHL status. God Bless and hang in there. Lots of love.

I think what typically happens in cases like these is the NVC will forward your petition to the nearest Consulate that does process K-1's. For example, people who live in Mauritius, the US Consulate there does not process K-1's either, so those are all processed at the Nairobi Embassy in Kenya...same as Uganda, those are processed in Nairobi as well. I really don't think you need to worry too much...I'm sure they will forward it where appropriate. Your fiancee may need to travel to wherever it is sent for her interview. Someone can correct me if I am wrong. I'm sure all will be fine. Good luck with everything and God Bless.

K-1 Fiance(e) Visa Process & ProceduresNVC K1 Processing Times ??

Thanks Ben and Jill! The NVC moved very quickly for you! I know we just need to be patient (like we haven't perfected that at this stage of the game so far! LOL) It's just you tend to get a little "antsy" after waiting for the "longest stage - the NOA2 approval" along with everyone saying it moves much faster at this point ~ which I guess is all relative :P

We will sit idly by and .... wait and wait and wait
:hehe:

Yes, the wait is really, really hard. I think back about the whole process and I feel the waiting for the petition approval is the worst part...it just feels like foreverrrrrr. Dan and Jenni made a very good point...if it's been logged into the system at the NVC, you should have your case number :)

K-1 Fiance(e) Visa Process & ProceduresCan I do a fiance visa and then marry my fiance in her country and then in the USA?

My fiance and I are about to fill out the fiance visa; however, she would like to get married in her country, and so do I. Is it possible to fill out the fiance visa, and once approved, get married in her country (Taiwan) and then come back to the USA on a fiance visa and get officially married here?

We have thought about filling out the spouse visa, but then having to wait 8-12 months for us to be together after getting married would be extremely hard on us to do.

Another option would be to get the fiance visa, get married here, and then wait till she gets her permanent residence status, and then fly back to Taiwan to get married.

I guess the best question is, if we want to get married in both countries so that both families and friends can see us have a wedding, how do you do this and what is the best option?

You cannot get married in her country, and then have her enter the US on a K-1 visa....if you marry in her country, you will have to file a spouse visa. You can do the K-1, get married here, and then later on fly back to her country and have a ceremony with her family to celebrate (even though you are already legally married)...but you can't marry in Taiwan and bring her here on a K-1. Whatever you decide, good luck and God bless your journey together.

K-1 Fiance(e) Visa Process & ProceduresHelp - SSN and ID card in California challenge.

Hello VJ Community!

I'm a little confused on wether my fiancée whom came via k-1 (wife now) can get a SSN and ID in California.

I read the SSN web site it it states that unless my wife has a work permit, she can't get a social security number.
I read the DMV web site and it states that I need a SSN number for an ID card but if I eligible for SSN, the SSN requirement for ID.

I need the SSN to open bank account and for insurrance purposes. How have you handled this before? Any information would be greatly appreciated.

Thanks!

Yes, she can get a SSN without her work permit because she came on a K-1 visa. The people at the Social Security office should know that, but sometimes they don't. Bring all documentation with you when you go to the Social Security Office...passport, birth certificate, everything. It's better to have it all then have to go back again. The bank should open up an account with a K-1 visa as well, as long as you bring your wife's passport, and something that shows proof of address. When we applied for Ben's SSN, they printed out a receipt that had our address on it, and we used that at the bank and they had no issues with that and opened up the account with no problem. I hope this helps you, good luck with everything.

K-1 Fiance(e) Visa Process & ProceduresK-1 timing question?
As far as being able to visit while the K-1 is pending is also totally dependant on the country. Canada and the UK can get a visitor's visa fairly easily...Africa...you can completely and totally forget it...it will never happen. It also won't happen in any other MENA country either. It's not even an option. If it was that easy, that would be wonderful...but for most of us, it's not.

K-1 Fiance(e) Visa Process & ProceduresK-1 timing question?
And Mapletree has made an excellent point...it is country dependant, and in some cases it can be shorter or longer...it just depends. But, the average is the average, unfortunately. Our process ran pretty smooth and the longest and hardest part was waiting for the petition to be approved. After that, it moves a lot faster. We were able to schedule our interview rather quickly too, and some Embassy's take a long time - it all depends on their schedule and how backlogged they are.

Yes, you are understanding that correctly, unfortunately...unless you are one of the lucky few who get their petition approved in 5 days, lol (and yes, that happens!). We filed our petition on October 11, 2010, and Ben stepped on American soil on June 19, 2011...yes, that's about how long it takes. It's not easy, but worth its weight in gold along the way. :)

K-1 Fiance(e) Visa Process & ProceduresRFE - Help needed
Well... now you need to go out and CREATE opportunities to have proof! And quick!

What I mean is you have to go to unmistakably Mexican locales and have someone take a picture of the two of you together there. Like under a "Welcome to Mexico" sign, or in front of a famous landmark. Pictures celebrating birthdays and holidays with family work well, too. Don't worry about photos being imprinted with the date, just write the date and a description on the back of the photo. That's what everyone does. It's great if it is obvious what the date is in the photo, like holding up a newspaper, or standing by holiday decorations or a dated sign. Go to events where you will have ticket stubs and receipts (concert, movies, show), and take pictures there. Or stay one night in a hotel. That way you will have paper and a photo (and it is important to have paper). Even brochures or menus with a photo of you at the place can help prove you were there. You may have to spend some money to go to places or events that will give you tickets or receipts, but its just what you have to do at this point.

And at some borders, if you ask nicely the US Officer will give you a souvenir "Welcome to the US Customs, whatevertown, USA" stamp, since people collect these. :)

Let me remind you now that when it comes to to Adjust Status after you are married, you will have to show proof AGAIN that your marriage is legit. So always be on the lookout for "photo & proof opportunities". Wherever we went, Hubby and I had a lot of fun with our "Visa photo op" moments!

Don't miss your RFE deadline, and don't even THINK about photoshopping!!!!
