Taken from the instructions on page 2 of the I-864EZ:

How Do I Count Household Size?

Your household size includes yourself and the following
individuals, no matter where they live: any spouse, any
dependent children under the age of 21, any other dependents
listed on your most recent Federal income tax return, the
person being sponsored in this affidavit of support, and any
immigrants previously sponsored with a Form I-864 or Form
I-864EZ affidavit of support whom you are still obligated to
support.

To me, it doesn't sound like you would include your cousin in the household size.

The list is good.

You don't have to prove the relationship. It can be anybody based on the above criteria I mentioned.

You will file I-864 and your cousin will file another I-864. Send both packages together in the AOS package.

It could be. But that wasn't my intention.

In this thread I was responding to the question of why it was suggested that the nonsponsoring spouse would need to file an 864A. There has been evidence here that supports Pushbrk's recommendation.

In the other thread the OP was working through having a joint sponsor who is a business owner and I suggested that a joint sponsor with just wage income (in that case the proposed joint sponsor's spouse) could be a cleaner solution. There could very well be a request for the nonsponsoring spouse to submit an 864A as well.


So I can conclude like this. If I miss anything, please let me know.

Even if the petitioner wants to show one of the joint sponsors' I-864A (because this one joint sponsor/household member makes enough income), it is recommended to include both the joint sponsors' I-864A (husband and wife joint sponsors in this case) so that each joint sponsor is aware of the other joint sponsor's contractual obligation.

Pushbrk is passing along the right cautionary advice. Why not be prepared and avoid the RFE?

Over the past year (or so) there have been directives sent out to the field (embassies, consulates) regarding 864A's from the spouse of married joint sponsors. This is resulting from the economic problems and wanting the non-sponsoring spouse to be aware of the joint sponsor's commitment. By having the spouse of the joint sponsor submit the 864A it demonstrates their knowledge of the commitment.

A few VJ members have also mentioned this being required of their joint sponsors. I can't point you to the cite right now. The info is here on VJ.

I have a question too on this subject :)

My wife has not worked due to her illness. I'm assuming she completes the I-864 as usual?

We are using her father in the same household as a joint sponsor so I know that he must complete the I-864A form. I am unsure if he needs to include W2's and 1099's along with the IRS transcripts?. Does he still need to include these even if the transcripts are originals? How many years should he include?

There's what seems like conflicting info on the I-864 and I-864A instructions.

If your FIL filed the taxes separately, last 3 years tax transcripts plus his current year income proof (employment letter, paystubs etc.) is good. Otherwise, I would suggest to include FIL's W2/1099 with his tax returns 1040 and its schedules for the last 3 years plus current year income proof.

Petitioner's and the household member's(dad) combined income is above poverty guideline, any other household member's income is NOT needed.

Show dad's personal income if they have married filing jointly. If dad has filed taxes separately, it is even easier.

ok so my wife and her father are filing out the sponsor and co sponsor forms.

i dont have them in front of me so please bear with me while i try to ask this question on her behalf.

as she is on disability nd makes way below the poverty line - she doesnt file taxes, so a letter from herself explaining why so is needed to accompany her i864.

at her parents house is my wifes father, mother and my wife. that will also be my residence when i return. when filling out the forms - do they both put a household size of 3 - wife,mom,dad. or do they include me as a fourth? im thinking just 3 right?
also my wife said does her father include his wife on the 864a or is it just about himself?

Take care of and local requirement for leaving the country: CFO stamp, exit clearance, etc.

Make travel plans to the U.S.

Arrive in the U.S. and process through the POE.

Wait for your Social Security Card and "Green Card" to arrive in the mail.

SS typically takes 2-3 week and "Green Card" typically takes 4-6 weeks.

If you don't receive your SS card in a timely manner, visit the local SSA office and fill out an SS-5 to apply for an SSN.

At the 21 month point, submit the proper documents to file for removal of conditions and receive a 10 year "Green Card"



At least those are the plans that my wife and I have once she gets her visa. :thumbs::innocent:

This is exactly we are also planning, except few additions.

After she and daughter arrive here, enroll them in a health insurance plan.
Since it is winter time, buy some winter protection dress as soon as possible.
Also we are moving to a new home as well. So, I'll file I-865 and my wife will file AR-11.
We have tons of files (Thanks to USCIS and NVC!), so it has to be safely buried somewhere.

couple of questions if you dont mind.

if uscis refuse an expedite for arguments sake, but you have a real genuine emergency can you refile a service request or appeal against it with more compelling evidence?

also officially how long do they have to inform you of their decision? ia there an offical or suggested time limit or scale?

ive a feeling the longer the expedite request and documentation supporting it is at their end in their hands under review then the less likelehood of an approval? as they may not say it meets their criteria so why rush it?! unless they are snowed under.

your thoughts would be appreciated

If the USCIS denies the expedite, you can approach the congressperson to pressurize the USCIS again.

My congressperson asked me to provide a medical letter for our daughter that she needs a "better" medical care in the U.S to forward to the USCIS. But I didn't provide it since she gets medical care in India.

Thanks for that Loto. For us its 15 calendar days since my wife first contacted the uscis and placed an expedite request.
8 days since we had the email similar to yours. She also had a request via mail for further info (that repeated the email request she had been sent a few days before.

So, from what you're saying LOTO...when the Tier1 quoted the target and fulfillment date of 10/03..the decision was made and after that date it was mailed out...so there's a good chance, if they didn't screw it up totally, that I might get something in the mail middle of this coming week. Am I following you correctly? The Tier1 one said it was odd that they hadn't emailed or notified us...as in your case..you just got a hardcopy. Guess we'll have to see.

My letter in the mail arrived 8 calendar days after the SRMT was opened.

Funny thing is, the Tier 1 said that a decision had been made..but he didn't have the result, I assume the fulfillment date means the case was completed on 10/3..but yet no email, phone call..perhaps something in snail mail. Loto said his just showed up in the mail, he didn't receive an email, no webpage update or anything..really quite odd.

This is how expedite works. You initially talk to USCIS customer service center to request the expedite. Then they (Tier1 normally) open a Service Request Management (SRMT) inquiry number. Once it is created, it is automatically notified to the service center. In your case, CSC. CSC will review your expedite and casefile and notifies you by regular postal mail. I got a postal mail 8 calendar days after the SRMT was created from VSC. So, check your mail in another 2 or 3 days time.

In my case, I even sent an email to VSC after the SRMT was created. But the email response back was NOT useful to know the decision was made. The text is quoted below.

The "decision was made" could be an expedite approval or expedite denial. The letter will explain it. USCIS website may not show up the up to date status for all.

My wife called yesterday and they were totally rude to her, telling her not to call back and that they would notify us of a decision by email, regular mail or a phone call..I take it this was a Tier 1 person..she was a total ######. Last week when she called they told us to wait 5 days and if they hadn't hear from us to call them back, which we tried. The lady yesterday said, well that was a mistake..dont call us, we'll call you.
is that typical of Tier 1 people? And should she try to call back today or monday?


Some Tier1 are like this. Don't give up, try on Monday. Another one would be good!

My girl had the Interview, Dec 2009, denied. What I think is important is that my girl needs to understand everything I submit for the Visa, and knows how to explain the answer, not just give the answer. The question was asked, "what was my job title". My girl said, "sales". I was a supervisor for a Sales Company. The Officer was looking for the word, "Supervisor". My girl was well aware of what I worked at 28 years. Question #2 that was asked twice was, "how many times I sent money". Answer given, "5", which was correct. I had sent 1 wire transfer, and 4 Western Union. I believe the Officer did not see the receipt of the wire transfer, only the 4 Western Union receipts. Giving correct answers is not always, just enough.

Follow the timeline of NVC Oct guys. Call NVC right away, get NVC Case# and register both email ids with them for further steps. Otherwise, you will be done NVC in many months.

Yesterday, I faxed my senators and congressman my privacy release form with supporting documents. About an hour later my case had its very first touch. Later that evening, I received the approval email. :unsure:

Like others have said, it varies. Some cases get touched everyday, while others have no touches...then their NOA2 shows up in the mail.
But if your case is nearing the 5-month mark, I highly recommend you contacting your senator or congressman.

That's a prefix. Yes, It should be as is. It follows your NVC Case#, Beneficiary name and DOB in the subject line.

I just got the NVC letter in the mail with the DS-3032 and the AOS invoice bill and I want to email the DS-3032 I think it might be a bit quicker than snail mail anyways, they included a DS-3032 already and I wanted to know do I have to use this one with a barcode on it and our case number or can we use a general one from the website as we already filled and signed one from there.

Need a quick answer as I'm planning to email this tonight
