Thank you that is good to know as I am looking to start everything as soon as possible....Is one week ample time to file with USCIS in the states or would I be looking at having to stay longer. I have bank accounts back in the states, drivers license, start a job again in May, but have never had a rent lease....Is it a good idea to have a Co-Sponsor and if so does that slow down the process..


If you file I-130 with USCIS, you can go the post office/courier office on the same day you land here, provided you have all the required documents.

Co-sponsor is not an issue at all. It won't delay anything. But it is part of the Affidavit of Support in the second stage of this journey, called NVC stage. This stage will happen when your I-130 is approved.

Yes, I have stamp for entry in Brazil,but no stamp for entry in Uruguay. You can travel from Brazil to Uruguay without having your passport stamped. One side of the road is Brazil and the other Uruguay.


Ok, I think you better handle your case as suggested in my above post.

If you qualify for DCF, file I-130 in foreign Consulate. Else file I-130 IR1/CR1 at USCIS here.

As someone, suggested provide the ties to the U.S to prove the domicile, if you do DCF.

OP, if you qualify for DCF file it in your Consulate aborad.

If you don't qualify for DCF, file I-130 petition in the U.S.

After being denied a tourist visa twice (My wife).....and posting about wanting to try a 3rd time.We have decided to go the CR-1 route. I am a USC by birth and she is a citizen of Uruguay. Also have a 2 month old baby. Is it possible to file directly at the consulate in Uruguay or do I have to return to the states to start the process.I have been out of the states for a year the 1st. of Dec. I don´t have such documents that would prove residency. Only a house in her name that was bought after we were married. Also you don´t need a visa to visit Uruguay. Has anyone been in this same situation.

Any info is greatly appreciated.


Even if the visa is not needed to visit Uruguay, don't you have a passport stamp such as entry/exit?

If you don't have any other dependents, I assume your household size is 2.

If so, your wife's 2009 income is good. Also, get an employment letter that shows entire 2010 annual salary and input this number in the annual income of the current job.

Then you'll be all set.

Basically, you are half completed NVC and the rest in the Consulate.

Consulate will provide up to date details to proceed further. Be careful and follow the instructions to file proper forms and pay the fee too. It is DS-230 for your IV application, not non-immigrant visa forms in the packet3 link here.

Hello,

Our CR1 case was expedited to Paris and we are wondering what is the next step? The embassy said that they are mailing an "instruction package". Does anyone know what is in this package? We have not turned in the AOS or DS230, so I assume that this package includes these forms and requests that we complile the necessary docs (marraige certificate, police records, etc). Also, has anyone gone through this process in Paris? How long does it take to get an interview?

Yes, you need to complete I-864 AOS, DS-230 forms etc. Also, whatever fee you haven't paid, will have to pay to the Consulate. You're semi-NVC guy, I know.

Follow the instructions properly in the packet from the Consulate in order not to jeopardize your case.

Your bank should do it or you can find a notary to do it. The person who writes the document must be there in person to sign it in front of the notary, that is the whole point of having it notarized. Check with your specific consulate to see if notarization is really necessary though. In some cases it is not.

I know there is a small glitch in the ATTN part for AOS and IV, if you put both packages in an envelope and mail it.

I did mine in separate packages.

I think you can use the address above as you mentioned, but highlight outside the envelope, both AOS and IV packages are in the envelope. It is basically 2 departments within NVC.

It all depends on the officer who reviews it.

Your goal is to get the visa.

May be without sending paystubs, but with your employment letter, it will be approved.

If you can get a document that secures your visa, why do you want to take a chance?

I know I make much bigger salary than the poverty line, but I included my employment letter and all 2010 paystubs with last 3 years tax transcripts. If they don't want my junk, let them trash it.

"Why he DIDN'T" file taxes is not good enough. The explanation must be for why he was "not required to" file taxes and it must cite the IRS rulings to support the reasons. If he WAS required, then he must file even if no tax is due.


Either way is good. OP must have an answer why he didn't file taxes for prior years, if it was asked.

Unless your husband did not work while living in Canada then he definitely is required to file U.S. Income Tax returns. U. S. citizens are taxed on their worldwide income. If he worked while in Canada he might not owe any tax on his U.S. tax return but he still has to file to claim the foreign income exclusion. I recommend you and your husband read IRS Publication 54, Tax Guide for U.S. Citizens and Resident Aliens Abroad. Here is a link to the publication:

OP, your sponsor is good to sponsor the beneficiary alone, without the co-sponsor. But make sure the written explanation why he didn't file the taxes or start arranging to file the prior year taxes after consulting a CPA.

Absolutely fine. In fact it could help, as it shows you are committed to a life in the USA.
We transfered all of our savings ahead of the interview, and bought a house with much of it once transfered. As we were doing DCF, this helped with both the I-864 (sponsoring on assets) and the domicile issue for the USC husband.

If you ship prior to arriving with your visa you will most likely have to pay taxes on the value of the goods. If you wait until you arrive with your visa then you declare the goods that are being shipped with the immigration office and are allowed a one-time exemption of taxes on household goods. I think I got her and hubby on the right track via personal conversation. Just a not for everyone...there is a service called counter-to-counter courier service where you actually take the document or package to the airport and deliver it, and it catches the next, direct flight out and can be picked up at the airport on the receiving end. I use this in my business at times when next day just won't cut it. Expensive? Oh, yeah. But when it absolutely, positively....well, we know.

I would say instead of scanning and faxing - Petitioner download the original form from the USCIS site, fill it and sign it, fedex to the beneficiary, if you think you have enough time. This is just my opinion.

I think better you follow what your attorney suggests.

If you have already completed NVC process, next timeline is for the interview. It depends on the Consulate. As per Debby (VJ member whose hubby's interview at Nigeria), it is taking around 3 months time.

Other Nigerian friends will have better answer for this.
