We got our text and email receipt number now the official i 797C Notice of Action came in today but for whatever reason we can't get it to work on the USCIS site. Any ideas?

Hi everyone, this is my situation. I hope you can help me out.
I am filling the I-864 for my wife and my stepson, however my last 2 taxes from 2009 and 2008 are pretty low because I was a full-time student. I got a job in june this year and now I fulfill the poverty requirement for 2 dependents. Do you think a employer letter showing my actual salary will be enough for them or they will need previous taxes from me to qualify as a sponsor?
In that case, do you think I should get a join sponsor?

NOA1 is not applicable to NVC. That's the term used in USCIS - Notice of Action about I-130 Receipt.

NVC is averaging about 11days to enter AOS package into the system and two week for IV to be entered.

Petitioner must have income above the poverty line for the last and current year of AOS execution.

If not, other options are:
1) Co-sponsors
2) Petitioner's asset
3) Beneficiary's asset
4) Beneficiary's income if it still continue even after beneficiary's migration to the U.S.

The way I am reading Tabta's question is will she have to pay the difference in fees at her interview if she does not have the Visa by Nov. 23. She is all ready at NVC stage according to her timeline. Would she and also me (why I ask)have to the pay difference. It seems to me that it only applies to new I-130 cases postmarked November 23 or later.

IMO there should be no additional fees owed if you have already submitted your petition and it is past the approval stage.

When we filed, the processing times were about 6 months. We got our RFE close to the 6 month mark. I know it is frustrating but there is really nothing you can do at the moment. Sending anything in now is not a guarentee that it will be matched up with your petition

It's fine to send both IV and AOS together as long as you print up the NVC AOS and IV coversheets that have case number and barcode on them. They can be printed up in the payment portal below where your AOS and IV would show paid.

Assuming you were not given an I-94 restricting your stay, you can simply change your mind and stay - no one to notify. Since Canadians do not require visas, no visa extension is necessary.

Be cautious not to overstay your 180 days that Canadians are allotted

IS OK to send both together.

From what I've been studying here at VJ - this actually removes much silliness.

--false RFE not done
--not have to track 2 packages
--no seperate queue waiting
--updates to casefile status seem faster.
--less postage to pay

So - what is it, really? It's about 2 to 3 weeks after paying the AOS fee bill, that IV fee bill show up, because the DS-3032 was added to the casefile. IMO, (NOW, actually) no need to sling the AOS and IV as seperate packets.

That was our reasoning as well. Sent them both in together, had no issues at all. Luckily for us when we navigated NVC in 2009 our invoices were available to be paid within days of each other so it didn't slow us down at all. Good luck!

You should fill in some information on your profile and a timeline and we may be able to answer you more specifically. If you fly through NVC then it all depends on which embassy you are sent to...some are backed up 5 months and some are wide open...depends on country.

Montreal is the only place that does CR-1/IR-1 and generally Montreal is backed up. EP will get you through the NVC faster but you will still end up waiting for an interview date.

Earlier, i have sent the choice of agent 6 times, now i am getting these reply emails from NVC for each email i have sent, stating that my choice of agent has been received, and the IV bill is due to be payed, we paid IV bill last night, will send the IV package this Friday, would these emails that i have sent several times affect the case or i just ignore them.

Thank you for your input, but I am unsure on the following:

Do I need my bank records if I have had direct deposit?

If you have paystubs, include those with the employment letter.

The child support for the past two years have been irregular, but not included in my total income. This can add maybe $1K to my gross income. Since the child support is irregular and low, if I send those printouts from the family court, would it cause a red flag?

If you don't have regular child support income and if it is minimal, don't include them.


You will qualify I-864 if you meet all the 3 below points.

1. You are the person who filed or is filing the Form I-130, Petition for Alien Relative, for a relative being sponsored;
2. The relative you are sponsoring is the only person listed on the Form I-130 petition;
3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former employer(s).

How do I know if I need the I-864EZ or the long form? I have no equitable assets to add to income.

I have the following:

My tax transcripts for 2008 and 2009 and W-2 and IRA 1099 for 2009. I have been consistantly employed for the past 5 years.

All my 2010 paystubs along with a letter from my current ewmployer to validate my employment.

Do I need anything else?

My gross income was above the poverty guidelines since 2008 by $5-$8K. So even the poverty level increases in January, I feel comfortable that my income is need.

That's a great list Loto :) I have a question....we still haven't received our NOA2, but should my husband be filling out those forms and sending them to me? The forms that go to NVC? Or does he need to wait? I don't know about timeframes, and if they matter. I'm totally clueless as to what happens after the petition is approved. I do have my transcripts for the past three years, and I can easily get a letter from my employer and pay stubs (he doesn't give them to me every week but can print them out for me). I've been waiting to do that, because again, the timefame....I don't want to have anything that's outdated, or have to get it twice. Thanks!


Since your husband is the beneficiary, he can mail you all his original civil documents including Police Certificates with signed copies of the forms etc. to you. So, you will not lose the time when you are in the NVC stage.

Note that Police certificate has an expiry. Check with the Consulate site. Most will have 1 year validity, some will have less.

Read the guide and start collecting them in advance.

I am already pretty sure you're right about that...I am about *this* close to firing him....I feel like this all would go a lot faster if I did it on my own. I spend a good part of the day lurking here, and have learned a lot :) I haven't really jumped in too much because I was waiting until he filed the I-130 and we got NOA1, but in order to save my sanity, and to hopefully make a few friends that are going through the same thing, I'm starting to ask questions. But I do believe I agree with you...the lawyer might not have been the best idea...but we'll see. :unsure:

Military record - I am not sure you need to provide the exemption letter. NVC site is generic one and as per NVC it is not needed if you haven't served in the military. However, it is a good idea to check with the Consulate. Sometimes local consulate ensures much finer detail than NVC.

Ok, simple question..how long after your NVC file gets put into the system does it show up on the payment portal for your AOS and IV bill to be invoiced so that you can pay? Our info was put into the system on Nov 8, this past monday. I have the NVC Case # and the IIN #.
