Let me just do a small write up for IR1/CR1 folks to prove the bona-fide marriage relationship.
All are welcome to add their own points here. Some items listed here may not be applicable to everybody.

Primary Evidence of the bona-fide marriage

Original marriage certificate between the petitioner and the beneficiary issued from the official agency of the country

Secondary Evidences of the bona-fide marriage

1) Documentation showing joint ownership or property
2) Lease showing joint tenancy of a common residence
3) Documentation showing co-mingling of financial resources
4) Birth certificate(s) of child(ren) born to the petitioner and the beneficiary
5) Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship
6) Any other relevant documentation to establish that there is an ongoing marital union

1) All the trips of the petitioner and/or the beneficiary to meet each other - like passport stamps
2) Auto Insurance Policy under both the Petitioner and the Beneficiary names
3) Health Insurance Policy under both the Petitioner and the Beneficiary names
4) Life Insurance Policy under both the Petitioner and the Beneficiary names
5) Will prepared by the petitioner and/or the beneficiary
6) If marriage happened in prior year, income tax filing together
7) Pictures together - Before marriage, Wedding Album, pictures taken in every occasion
8) Marriage documentation in the religious ceremony such as from church, mosque, temple etc.
9) Phone logs
10) Chat logs
11) Emails
12) Greeting cards, Marriage invitation cards etc.
13) Hotel receipts, Rental car receipts, Gift receipts or any other miscellaneous receipts of the expenses incurred between the petitioner and the beneficiary
14) Money transfer documentation that includes spousal support

@Loto - this is Matt.

We've asked about the passport multiple times, politely, and we've only ever gotten back a form letter saying that they're in the process of reviewing the documentation. I filed a immigration case assistance request with a Senator, partially because of the time it's taking, but mostly because of the passport issue. It's definitely THE most frustrating thing, is that to us it's a serious issue and they really could care less.

It is a good option that you proceed currently. Just try the option that I have outlined as well. You should hear something to that email in a day or two.

Also, provide the address in the email to mail the passport back.

Plus, specify to complete the case since it has taken long time now.

Considering what everyone has said (thank you for the advice) I won't file the expedition request.

My wife has been a strong proponent of me staying with her in Brazil. Not only do we love the country, but being apart is especially hard on her. However, after hearing what people wrote and combining that with her frustration with the NVC, she actually suggested I head back to the U.S. and take a job to ward off any potential, real, financial problems.

We'll see.

What I am thinking, since you mailed your original passport to NVC, it is kinda hold now. Address that problem and try to get it from them, if you haven't received it back.

Hi Everyone, I am little worried about this, we have forwarded I-130 in July, and now it's about 4 months since we have received NOA1 that time we really didn't know about the procedure then we forwarded I-129, my question is as I am near to hear something and Petition is already entered in 5th month of processing will I- 129 going to effect on I-130 processing time or not, as I have read that they gonna approve them on a same day, and 129 will administratively closed after the approval.


Every case is unique. Some cases take little longer than others due to additional background checks or whatever.

Since you are within the officially posted timeframe of the USCIS, you don't have to worry about now. If it goes beyond 6 months, yes, you should worry about and get the help of congresspersons to enquire.

If still it persists at the medical, do the following:

Normally, they will be "more worried" about the communicable disease of public health. But, if they say you need a medical waiver, they will advise you.

If you have paid everything at NVC, there is no fee at the Consulate.

Good. If NVC requests it, you're ready. If not, make sure the beneficiary has it for the interview, as the Consular officers tend to be more strict than NVC.

I got a tip today for proving your case with USCIS/NVC.

It's a really good idea to write a letter of your own (as the petitioner) about your reasons why you CAN'T go live in your spouse's country. For me, it is because I have to live here to pay off my student loans. Also, having to take care of someone with medical problems is something that convinces immigration services to let your spouse come live with you here.

Though most consulates allow the petitioner to be in, some will not.

I check with my consulate and told me I will not be allowed to be inside the consulate.

So, it is NOT required. However, if one can, it is good and will have some added advantage.

My husband is a disabled veteran. He gets paid trough the veterans affairs tax free and makes well over the amount
needed for income level. He doesnt file any taxes because is all tax fre, do you guys know if they would give us any issue for that and if we need a co sponsor. as I said he makes way over the income level that is needed.

You are fine since he makes well over poverty line.

When you file I-864, just write a letter along with it - to show why he was not required to file the taxes, as you mentioned here.

The AVR as of Friday said "Case complete as of November 18th. Please allow 8 weeks for further instructions." (along those lines.) Thank you all for your wonderful support on this specific post. It really helped to set things at ease. On monday I got through and just double checked to ensure it was indeed there (my IV package) which it was.

If N/A is not an acceptable answer, what about Question 11 on the I-134 Affidavit of Support - what should be written there?
One poster said that we should write "N/A - K1 visa process for permanent residence." This is one of the examples given in Visa Journey guides. If I don't put "N/A" then do I check the box I intend or the box I do not intend. - I think it partly boils down to an interpretation of the phrase "specific contributions". Hope this doesn't feel like I am hijacking the thread, if so, apologies to the OP.

But, I'll answer to your question here. You need to check "Intend" and write a short explanation how do you intend to support the fiance(e). If you decline this Q#11, basically you are proving that you are NOT going to support your fiance(e).

The "ez" guide was helpful. I printed out I-130, G-325A (filled out as beneficiary), and G-1145.. the others I'm filling in as much as I know on his part, just so I can see where I'd need more information, etc. A run through brings up lots of helpful questions :)

*UPDATE* SO I managed to get a hold of my 2007 tax returns which is great but now because of getting it, it represents another problem. Its a 1040X, the amended return. The reason I filed this is because my ex-wife filed before I had a chance to and I wanted to file jointly to maximize the refund so we went back and did an amended return. I have my 2007 W-2s and such but I do not have hers nor can I get them. We do not speak anymore. Will this create a problem or can I submit this and NVC will know what to do? The numbers will not match up on the amended return because I am only providing my W-2's :( How to proceed?


First of all 2007 tax return has no much weight and are optional too.

Heavy weight is current year (2010) and just previous year (2009).

Submit only your W2 with amended return and enter only your W2 amount in 2007 column.

Since no one has answered this one yet, I'll just be sure here....I can, once fully assembled of course, send the whole I-864 packet without waiting for NVC once I have paid the AOS fee bill correct? Or do I have to wait for something from them?


Once the status shows PAID, you need to print out the barcode cover sheet from the same site and mail the AOS packet with this in the address specified in it.

The same exercise will be done for IV package too.
