IR-1 / CR-1 Spouse Visa Process & ProceduresInconsistent use of beneficiary's middle name

Thanks so much for your input! I've been going back and forth in my head about what to do, and it seems that the best thing is just to make sure to put his full name with middle name (under "other names used") on any other forms going forward, like the DS-230, and prepare new I-130 and G-325A forms for us to hang onto in the event of an RFE and for my husband to take to the interview.

 Sounds like a good plan. Trying to submit additional information to USCIS after the submission of your petition can be difficult. In the absence of an RFE it becomes very difficult for the information to make its' way to your file to be properly matched up. Make the appropriate corrections on all forms submitted to NVC and any discrepancies can be explained at the interview or dealt with at the NVC level if necessary.
Good luck.

IR-1 / CR-1 Spouse Visa Process & Proceduresbirth certificate problems

Hello all,

Im a bit confused on what to do, so would like to ask for a little help. I had sent in my Ds-230 with my original birth certificate, a few weeks later i got a email check list saying I need to send in my birth certificate, I then reolize that the one i sent in is a small version with no parents listed on it, Iv ordered a new long version but my father is unknown. will this one work? Do i have to send an affidavit saying who my dad is signed by my mother? if so how do i do that?

My official long-form birth certificate had both of my parents listed as UNKNOWN and it was accepted wthout issue by both NVC and the consulate at the interview.

IR-1 / CR-1 Spouse Visa Process & ProceduresDoes the NVC read VJ?

I was just sitting here thinking and wondering if the NVC has ever read about us here at VJ? Do they know about our long waits, do they care? We are real and genuine and want to do everything the legal way to be with our loved ones. We are rare, but our resolve is strong. How many other couples do you know that have to wait so long to live with their wives and husbands? It is tough, but I was just scratching my head hoping they understand us here and well..I'd rather they be working on our case than reading VJ, but hey...everyone one has "some" spare time... :P

I don't know about NVC, I would hope they are busy processing files!

However, I can tell you that some consulate officers at Montreal do read VJ. A filer last year was complimented during their interview on how well organized they were and they credited it to VJ. The officer then mentioned some details of another poster on VJ and their comments about the consulate. :o

IR-1 / CR-1 Spouse Visa Process & ProceduresEmployment change during USCIS processing

When I talked to my wife this morning, she said that she had been offered the equivalent of her dream job, Assistant to the Foreign Affairs Director of a very prominent conglomerate in UB. Combines her fluency in English with her business degree and a much higher salary that she had earned teaching English.

Question is, what effect will this have as her biographical data in effect will change between our filing of the 1-130/G325 and approval? Is there any supplement or anything that needs to be filed?

I hope that taking a better job for the short term will not cause problems or delays in the long term.

In the mean time I will wade into the USCIS/DOS website and look for the answer too.

Thanks so much friends!
Eric

Nothing to worry about at this stage. Simply put the corrected employment information on her DS-230 at the NVC stage. Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC AOS and IV package

Hello..
Ok, I'm very confused (as usual!) and this website has always helped me with my other questions so apologies for this one aswell!
We sent off the DS-3032 to the NVC on 26th October 2010. My husband (my choice of agent) in the US hasnt had any paperwork through regarding the AOS fee so I called the automated number this weekend. It says the letter was generated on November 6th - I wondered if it should be with us by now as its been 4 weeks?
I logged in online and it said that payment for the AOS and the IV application was awaiting (and did give me the option to pay online then and there) but i thought we had to wait for written instruction to do this. Has anyone else's taken this long to get your AOS fee bill through the mail?
Any thoughts would be so helpful, thank you in advance.
Joanne

The key to successfully navigating NVC is to be proactive. If your fees are available to be paid online then do so. Once the payments have been accepted you can print out the bar-coded cover sheet and mail your packages in. When we navigated NVC in 2009 we did not receive anything in the mail from them until our case was completed!

Have a look at the following links to familiarize yourself with the process. Good luck.

I'd give it 5 business days then start calling. Don't freak out if you get a false RFE, common with NVC. It means they've entered your AOS ahead of your IV (or vice versa) and technically they are 'missing' something. Always speak to a person and don't rely on the AVR

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview Schedule at NVC

Last week when I got my CC at NVC I asked the operator about when they schedule the interview dates. They told me they schedule interviews during the second week of every
month.

my question is, is this week of 6th-10th the second week of December? Should I expect to get an interview date this week?

It will depend on how busy your particular consulate is. If it is not a particularly busy consulate you may well receive notification in December for a January interview. Some consulates (like Montreal) are severely backlogged with filers that have July NVC completions STILL waiting for interview dates.

I'm sure someone from your location will have more detailed information for you.

BTW the "We only schedule during the second week" story is the standard NVC reply; we received notification the last week of the month.

The harm it can do is at least two-fold.

1. Too much extra can obscure information that's actually important.
2. They could find something to question or a red flag in something that to you looks harmless.

If it doesn't help and CAN hurt, leave it out.

You don't send any relationship evidence to NVC either. Take it to the interview.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling for I130 in October?

An interview in 30 days? I've never heard of that, even with expedites

You're looking at a 5 month wait for petition approval - at least - as your petition is in California. Then a few months to get through NVC, then another month or 2 for the interview to be scheduled.

So if you filed in October, look at a summer interview

What you're going through now, the petition sent in October and nothing since the 20th, is normal

good luck

I believe the documents they ask for are of the beneficiary. You should have submitted that during your 130. Now all the info is about your beneficiary spouse, i.e birth certificate, police report, etc, if your spouse has been divorced then yes the spouse would have to submit it.

the DS 230, is an immigration visa application that you technically your spouse (beneficiary) is submitting and attaching supporting document.

That is my understanding, wait and see what other have to say.

IR-1 / CR-1 Spouse Visa Process & ProceduresCriminal Records for Consulate Interview

Good Morning!

I am anxiously awaiting the checklist from the consulate on what to bring to my interview. Once I have this I just need to check off the materials and send the list back and my interview will be scheduled. To get ahead, I am already trying to obtain as many docs a possible.

I DO have a question, however, and maybe one of you could help me out:

On my I-130 I had to list my official residences of the past ten years. I DID put down the four years I spent in the US getting my Undergrad degree on an F-1 student Visa.

NOW: does this mean that I have to obtain my criminal record from the US as well??? I maintained primary residency in Germany (I am German btw) the entire time. But the requirement for the interview is to obtain criminal records from all the places I resided in for more than a year over the past ten years (which also includes Morocco, but that's an entirely different headache) and I DID put the time I spent in College on the I-130.

Thank you for your help, and to the others who have to obtain records from abroad, I found this immensely helpful:

Good luck to all of you!!!
