in 2009 i worked for only 3 months as i moved back to ohio after my stay in china in 2008 to see my wifes world...and i have been working since april 2010 to present and yes i do make over the poverty limit..thx


It looks like your 2009 income is lower than the poverty line (worked only 3 months).

Current year income is just above the poverty line.

Now, you need a joint sponsor, as pushb said.

I think somebody 'confidently' said (don't remember the name), the current year income is enough and past year income is not needed. This is the best example for them. If one just passed the poverty line for the current year, last year income also has the weight.

What I feel is - Did you file "married filing jointly" taxes with your ex-wife last year? If yes, they need your W2/1099 with 1040 and schedules separately rather than IRS tax transcripts to separate your income out.

Hmmm this worries me. I put down all the places I stayed in the US when there for three months to visit the hubby. I figured this would prove to them that I have lived with him and help with proving bona fides.

I figured the would have been more specific if it HAS to be places you pay rent etc (for example, i lived with parents on and off during university - never paid rent there!)

Did he maintain a residence in his native country? If so I would not list the US stay since he was technically on holiday. I could not find where a "length of stay" translated into a residence but a residence is clearly defined as the place a person is domiciled at (receives mail, rents, owns, etc.).

I have a quick question. My husband and I are filling out the G-325A Biometric form. Under the list of the residence of the last 5 years, he lived kind of sort of for 6 months in Los Angeles, he had a tourist visa at the time. Should the address where he stayed there be put on the form?? We are kind of confused, because he really wasn't a resident, was just here as a tourist but lived for the 6 month stay he was allowed. Since it says "Applicant's residence last 5 years", yes, he needs to list it.

Hello,
It has been more than two months since my wife and children have sent their passports to Montreal for visa issuance. The interview was done on June 15 but the visa was refused because we were a couple of documents short. After sending all the documents, the Montreal office asked us to send the passports which we did promptly but after that there is no response from them and upon calling Washington, I get a cold reply that Montreal office has a huge backlog.
I was wondering, since I'm in Houston, can I make a request to transfer my family's case to Houston instead. My family can travel from Canada to Houston on New Zealand passport on three month visitor's permit while their processing can continue in Houston.
Can anybody please advice if this is possible because we're fed up of waiting.

You need to complete the immigrant visa process at the foreign consulate. It will take little longer time since Montreal is backlogged. But, if everything is ok, you will eventually clear it up :thumbs:

Hey Loto!

Yes, sounds very similar to ours. My husband's medical consisted of:
1. Lab work (blood)
2. Physical check up
3. Medical history info
4. Thoracic x-ray
5. MMR / dT / varicella immunizations

Ours cost $158. They gave us the x-ray CD and the immunization ceritificate to take to the Consulate while the Hospital itself sends the lab work and check up info directly to the Consulate.

We just had our medical in Panama and the three basic shots that we were told you need to have are:
MMR (measles, mumps, rubella)
Td (tetanus, diphteria)
Varicella

I don't know if it is useful to the OP. But let me explain the medical my wife did 2 days back in India.

She had all the vaccinations taken before the medical.

U.S panel physician provided:
1) Lab work
2) Physical checkup
3) X-ray
4) Blood test
5) Provided 3 vaccines - DTaP, Varicella and MMR

She collected the report yesterday. Cost around $105.

I know the appeal process is TOO LONG for the 3 year bar. It could take up to 24 months, the best course of action is not to appeal the only way to win it is if USCIS made a legal error. The better alternative is to rework the I601 packet, beef up the evidence and resubmit. Most overseas consulates are processing I601 applications in less than 6 months.

It is certainly not impossible, comparable to an English Comprehension exam. Just need to do your homework, or employ someone who has.

IR / CR -1 get the green card in the mail. Same for SSN. If the ssn doesnt show up you need to go down to the office with her and apply for it.

Bring her passport and greencard proof of residence and her other driver license down to the DMV tell them you want to change her other license to a state license.

GC normally arrives in 4 to 6 weeks time after POE.

If you haven't received SSN within 3 or 4 weeks time, visit the SSA office, fill SS-5 to apply one with the documents. Documents needed are in SS-5 instructions.

You were a US citizen when you daughter was born?

You've lived at least 5 years (as a citizen) in the US with at least two of those after the age of 14?

You are her biological father?

If you can answer yes to all of those then your daughter should get a CRBA and a blue US passport.

I believe the State Department(only at overseas consulates) handles CRBAs and they have nothing to do with the USCIS. I'm not sure why they would have even fielded that question directly instead of referring you to the State Department/overseas consulate.

What George said above is correct, except a small change.

At least 5 years U.S residency of the citizen parent can be in any status like USC, LPR.

When we did CRBA for our daughter, I had around 2.5 years USC status and the rest as LPR. Rest all conditions I met.

Based on OP's feedback, your child looks qualified for CRBA. You need to apply in the foreign consulate's ACS section and both parents must be present to do it.

I think we got U.S birth certificate and Passport in around 1.5 months time.

I don't know the issue of your taxes.

But, other reason (not standing close enough in the pic) does not seem to be a real denial reason to me.

Somehow, contagious disease happening in their country :P
Somehow, the petitioner's or beneficiary's health becomig weak :P
Somehow, natural disaster (flood under knee level or below!) is happening in beneficiary's country :P

I had some other qualifications, but they were only in our situation :P
