Could someone explain this: " For these employees, when a holiday falls on a nonworkday -- Saturday or Sunday -- the holiday usually is observed on Monday (if the holiday falls on Sunday) or Friday (if the holiday falls on Saturday)."

Does it mean that if a holiday is on Saturday, they do not work on Friday? I am confused...Posted Image

That's correct skynaut.

Example - Jan 1, 2011 is on Sat. So, they will have holiday on Dec 31, 2010 Fri.

I'm calling the NVC right now - LOL, just in case we have been approved...(unlikely), but how the HELL do you get through. It's either engaged, or just rings out then goes dead. Is there a trick to this? :bonk:

Some times you will get into NVC system/operator on 157th try and sometimes on the 2nd try.

When you hear the "busy tone", just hang up and redial immediately. Keep this in a loop until you succeed.

After getting the line, you can immediately access the AVRS.

But to get an operator, it will take another 20 to 45 min. So, if you really need to talk to an operator (because urgency to pee and bladder is full :star: ), just press the Haiti line and an operator will come in a second and proceed in normal way :bonk:

This has been told many times :star:

USCIS site is not reliable to everybody. If you don't see a touch, it doesn't mean your case is not being processed. It is the technical glitch in their web site.

Some people are lucky to see the touches throughout their process.

I have seen many who got approval even without a single touch.

When my case was approved, it still showed "Initial Review". And almost a month after, the status moved from "Initial Review" to "Post Decision Activity".

So, stay tuned and I feel approvals will start flooding any time soon

The latest touches and messages that it moved to USCIS office are all positive signs that they are actively looking into the petition.

I still believe few TSC approvals will show up before Nov 30th.

i am confused...if VSC is faster dan y most of da ppl apply in CSC...is dere any states requiremet?
its also 4 months 3 days from my NOA1 today...

People do not apply in CSC or VSC.

Chicago Lockbox is the address to send the I-130 petition and they route it to the Service center based on their own criteria.

2 years back, it was not the case. Chicago Lockbox used to route to the proper Service center of the petitioner's state of living. For example, if the petitioner lived in the East Coast, it would have reached VSC. Similarly, west coast people's petitions used to go to CSC. Now it is not the case.

Loto,

Our petition was sent to VSC, but the NOA1 came from CSC. We were transferred to TSC on November 2 and since then we are waiting, today are 4 months and 2 days since NOA1.

Cip.

Thanks Cip clarifying it. So, originally you are in CSC (Receipt# starts with WAC) then. Now in TSC :)

So no TSC approvals today? Man this sucks!

I have a question. When you're counting how many days you've waited so far, do you count from the date on your NOA1, or from when USCIS received your package? I'm just preparing myself for when I can complain to USCIS about my over 5-month wait time.

If I count from when USCIS received it, in a week it will be 5 months. So sad. And I no everyone says that touches/no touches don't necessarily mean anything but I haven't been touched since 7/26! Not even for my TSC transfer! I didn't get an email nor text even though I am subscribed. :bonk:

Clock ticks from the USCIS receipt date.

I agree that approval will come in random order. What do you think about other messages which some people got? I mean about "was transferred and now in the office". Is it possible that they are transferring our petitions further to local offices?

Based on this message, it is in the TSC office.

hey Loto, give us prediction when wait the hardcopy letter with news from uscis? you are lucky guy, who knows...
and when will be first approval from TSC in our thread?

@skynaut, Thank you (F)

@Timol, TSC had received and processed very few transfers (just double digit) in the prior months. So, the recent bulk transfer to TSC is good in the sense there is a high chance to review the transferred cases immediately. Since data is not very clear, I don't have an estimate. But what I feel is a very high possibility for a mass approval before the end of this month, and that too in random order (Based on VSC experience, applicants are lucky if their petitions go to an officer who does speedy approval, eventhough the priority date is the first queueing preference).

So, hang on there, next 2 weeks are the real patience test :)

IR-1 / CR-1 Spouse Visa Process & ProceduresStart Process From Canada or the U.S.?

Great, thanks for the info guys. We live in Montreal so that's a big advantage. Does the fact that we've been married for almost three years make any difference? And that my wife has been living in Canada for about five years?

Being married for three years qualifies you to receive IR1 status on entering the US after you receive your visa. That means you receive a 10 year green card and do not have to worry about ROC (removing conditions which saves you money and paperwork in two years).

If your wife is currently living with you in Canada you may qualify for DCF filing. Check out the DCf forum, there is a pinned topic dedicated to DCF petitioning from Canada.

Good luck.

Just saw your second post. You wife is a permanent resident of which country?

IR-1 / CR-1 Spouse Visa Process & ProceduresStart Process From Canada or the U.S.?
With current processing times for spousal visas a summer moving date is unlikely as Inky posted. Read the CR1/IR1 guides and get started asap. You can visit while the process is underway but you will need to show strong ties to Canada and can only stay for the permitted time (for Canadians 180 days). Keep in mind admission is never guaranteed and always at the discretion of the CBP officer.

IR-1 / CR-1 Spouse Visa Process & Procedures212(g) Annotation on Immigrant Visa

you have 1 year to cross the border...processed at POE..that's what that means...then she gets her real GreenCard in a few weeks of crossing at POE..at home address in USA.

Actually you have 6 months to POE..not a year. As Loto posted the visa is stamped at POE and is valid for a year which acts as the temporary green card. This allows you to travel freely until your actual green card is received.

OBXFemaleCanada2010-12-06 10:09:00
IR-1 / CR-1 Spouse Visa Process & Procedures212(g) Annotation on Immigrant Visa
If you and your wife have been married two years as of the date of her POE she is eligible for IR1 status which means she would receive a 10 year green card.

If you have been married less than two years at the time of POE she would receive a 2 year green card and be required to remove conditions prior to its' expiry. The 212(g) annotation generally refers to vaccinations that are not age appropriate and should not have any bearing on removal of conditions on the conditional green card.

IR-1 / CR-1 Spouse Visa Process & ProceduresLiving together I-130?

Hi everyone! Now its time for me and my husband to send our first package.

I am a little concerned about one of the questions, and Ive seen some different answears about it. What do UCSIS define as "Living together" ? I have been at his place in US and he is now here in Sweden, he is staying in my apartment and he is here on a tourist visa. He still got his other apartment back in US, which is the one we have been writing on his information.

Should be write something like "We have visited but have not yet resided in the same country." as an answear on their question? Should we right my adress here, even though he is not a resident and still have an apartment in US? or should we simply write "none" and that we have not lived together?

Help appreciated!
Emelie

You could answer as you have posted or put "NONE." Visiting is not considered "living together." This also came up in a similar thread and pushbrk has answered it well. See Post #9

I had a very nice surprise waiting in my mailbox today......I-797C APPROVAL NOTICE!!! My case on the USCIS website still says "initial review". The letter was from the Texas Service Center. The Notice Date is November 23, 2010........wonder why I got touched on the 24th and 26th? Now on to the NVC stage. Thank God, and hoping all June and July filers receive their approvals THIS WEEK!!!

Great news! Congratulations.

Wondering, is there any point to me calling USCIS right now and inquiring about the status of my application? Because I'm assuming they won't have any more info then what is on the USCIS site. Let me know if any of you have done this yet and if it's worth my time.

Thanks!

As a July filer they will have no information for you at this point as you are still within their processing times. Unfortunately it is still a waitng game. Good luck!

IF you move to the US on a visitor visa and over stay, you will get a mandatory ban, and you won't find out about it until your interviewed and they tell you not only are you denied for your visa but that you have a ban to enter the US. Do not OVER STAY ever! It isn't worth it. Just like EVERY other person has to do, you have to wait it out in your HOME country while the visa processes. You can visit the US but you CANNOT go to the US with the intent to immigrate with out the proper immigration Visa. PERIOD.
