on the messages people are getting i.e. USCIS has rec'd from a State dept versus it's been transferred to a USCIS office for processing (even though the notice of transfer to TSC has already been sent)... i'm confused on what they mean. the latter (USCIS for processing) means they are just working on our petition and really isnt indicative of status (i.e. approved, denied, rfe)??

IMO, I think that is a software glitch from TSC. All these messages must be ignored.

Some people with "Post Decision Activity" by email might have already had a decision (a decision can be approval/denial, but most people will have APPROVAL). If they already approved and unable to track USCIS website properly or no clear emails, NOA2 will show up by regular mail in a week time. This is what happened to me. USCIS site didn't update properly and didn't have any emails too. But, within 5 days, I got a surprise NOA2 by mail.

Yes, your other point is valid too. For some (again some), they don't want to immigrate to the U.S, K-3 will give a non-immigrant residence for few years (I think 2 years).

we knew when filing that may happen but for some of us there are other factors and it's frustrating to be constantly scolded on VJ for choosing the K-3 route :bonk:


One of the reasons for few people choose filing I-129F with I-130 is:

If they get I-129F approved first, they can submit I-134 Affidavit of Support, instead of I-864 AOS at NVC, because the sponsor will be very tight to meet the poverty guidelines in the current and/or prior year. I-134 is little relaxed in the sponsorship than I-864. So, for them subsequently when they do Adjustment of Status in the U.S, they can build the finances properly to submit I-864 during that time.

Also, NVC journey is faster for K3 path and they will immediately forward the case to the Consulate, than IR1/CR1 path. NVC for K3 path takes around 2 weeks whereas NVC for IR1/CR1 path currently takes 1.5 months.

From my understanding, as long as the I-130 is not approved prior to the I-129F, and doesn't hit NVC prior to I-129F or at the same time as the I-129F, I can still do the K-3. That's the information NVC has told me, so, that is what I'm going with. But, thanks anyway!

"Effective February 1st, 2010, when both petitions have been approved by USCIS and sent to the NVC or when USCIS approves the I-130 before the I-129F, the availability of, as well as the need for, a nonimmigrant K-3 visa ends. If the NVC receives both an approved I-130 petition and an approved I-129F petition:

The nonimmigrant K-3 visa case will be administratively closed.
The application process explained below will not be available to the foreign-citizen spouse and cannot be used.

But most (I would say 99% or more) will hit with I-130 and I-129F approved together. Then NVC will kill K-3 path.

I am confused between all these departments and agencies :blink: . What is Department of State? The same USCIS or NVC or what?

Department of State
The Office of Visa Services, in the Consular Affairs Bureau, Department of State provides several functions:
We serve as liaisons with the Department of Homeland Security
We serve as liaisons between the Department of State and embassies and consulates abroad on visa matters
We interpret visa laws and regulations, and act as a point of contact for the public

NVC
NVC can be treated as a minor department in DOS. NVC collects and reviews the Affidavit of Support and Visa Applications and Schedules the Consulate interview by co-ordinating with the Foreign Consulate.

My husband just called me , he got this :

On November 23, 2010, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. It looks like (unless technical glitch) your case is already approved (just my opinion!). Call NVC# inputting Receipt# to verify NVC received it.

Our case was also transferred from CSC to TSC. When it first happened a few days ago before I started reading this thread, I sent an email to a friend of mine that specialized in immigration law. Here was her response:

"This is a good thing that your case got transferred to the Texas Service Center. In our practice, we see cases being transferred to another Service Center because the Center that has the case has too many cases, and they need to transfer cases out to another Center for faster processing. "

Additionally, I spoke with a USCIS agent at the local (Minnesota) USCIS office about a month ago and he explained that I-130's go through several departments for approval. I understood him to say that one agent doesn't work on an individual petition start to finish but that different departements review and approve different aspects of the petition/I-130 (i.e. one for citizenship of petitioner, one for fraud, one for legitmacy of relationship, etc.) The USCIS had received our I-130 about 2 months prior to this conversation and, at the time, the only posting on the USCIS website for our I-130 was the receipt date. There were no other indications on the USCIS website as to where our case was in the process or that it had even been looked at. The agent assured me that our case had already been reveiewed and sent on by 5+ departments and that these internal USCIS movements are not posted on the status screen that we (the public) can see.

The USCIS officer also told me the service centers are being pushed very hard to deliver within the 5 months window. As a result, they are pretty consistant about processing them in the order they were received so there is a better chance of achieving the 5 month goal for all. If you look at the stats onine, the CSC was waaaaaaaay behind and TX doesn't appear to be receiving or processing any I-130's.

Between the info from my friend (the immigration lawyer) and my conversation with the USCIS agent, I believe that CSC was way behind and transferred A LOT (maybe thousands) of I-130's to the TSC to speed up the processing. I also believe that even though we don't see any actions taken on the USCIS website, all of our cases (Jun, Jul, Aug, etc) have been reviewed by many departments and just need to continue to the end of the line (like an assembly line). The movement to TX was done to speed up the I-130's in process and it is a benefit to all petitions that moved and all that stayed.

as u have read that couple of people have gotten approved and they have not received email/Txt from USCIS...but their case was forwarded to NVC... and when they called NVC they found out their case was approved...
so what i want to know if i call NVC how/what do i ask them if they have received an approved file from USCIS..

JP, you can start dialing NVC Tel#. There is an option to enter either NVC Case# or CIS Receipt#. Enter CIS# and see if NVC has received it or not. Just another mechanism!

i just have to ask. . . about 2 years ago, my husband went to the States and petition me and my 1 year old daughter.We had a family emergency here in the Philippines so he had to come back and we decided that we'll just re-file again when he goes back to the States. after 3months I got an RFE (asking for a copy of my birth certificate), but then of course he's here and we've decided to not go on with the petition (we were like 21yrs old and not thinking if it'll affect anything in the future). So of course we didn't respond to the RFE, and as a result i got denied. Meanwhile my daughter got an approval (her case is at the NVC).So my husband went back to the States, got a job and filed a petition for me, (too late for an appeal on my old petition coz it expired). basically, all i want to ask is that will it affect my current petition?,
my daughter's case is currently pending at the nVC, we're waiting for my approval so we can process both mine and my daughter's case at the same time.
has anyone else went through this situation or in this situation? it's just really making me think and wonder.. .

It will not be a problem for your new I-130. As Penguin said, tell the same if CO asks about it. (This was my wife's second GC. At interview time, CO asked why the first GC was surrendered! She answered truthfully and there was no issues at all!)

I have another concern for you. Yours and your daughter's petitions had been filed 2 years back. How many months are passed now - your daughter's case with NVC? I think NVC will terminate the case after 1 year if there are no responses from the party. Check it out this, with NVC!

That's correct.

Employed person's will declare income based on employment letter or W-2.

Self employed persons will show the income in Line 22 or 1040. It is basically the net income after deducting all business expenses.

Thanks Guys. We have been married for over 2 years. Also on the visa it is written that at POE visa will be issued for one year, and asked to fill some form (some I5xx .. can't remember the number). Why did they write that visa will be issued for only one year? Are they referring to the green card stamp on the passport that they will put at POE and which is valid for 1 year?

POE stamp (I-551) is valid for 1 year, which acts as a temporary GC. But your actual GC will be for 10 years, since marriage is over 2 years at POE.

If you and your wife have been married two years as of the date of her POE she is eligible for IR1 status which means she would receive a 10 year green card.

If you have been married less than two years at the time of POE she would receive a 2 year green card and be required to remove conditions prior to its' expiry. The 212(g) annotation generally refers to vaccinations that are not age appropriate and should not have any bearing on removal of conditions on the conditional green card.

i've been curious about something.... if petitions are being approved in CSC in 2-3months and I-130 is stuck in TSC in a black hole, it's possible to get the i-129F approved for these people who have only a I-130 pending??


I believe (just my opinion) it is too late to file I-129F for those who waited 6+ months. Their best bet is try to expedite the process through congressperson. That should work. If they don't find potentially any background check issues, crossing 6 months of I-130 filing has highest chance of approval, through the expedite by the congressperson.

They don't allow to file K-3. K-3 visa is issued by the Consulate.

You will file I-129F after filing I-130 with the USCIS. But, it is too late for you to do it. Normally, people do it immediately after getting I-130 receipt notice.

Effective Feb 2010, chances of getting I-129F approved first before I-130 and pursue K-3 path is very remote.

Also, some people believe (just a belief!) that it might slow down IR1/CR1 path.

Your best bet is to wait for I-130 approval which is due any time now. It is the matter of some more luck!

K-3 will be closed AFTER both the i-130 AND the I-129F are approved together, or the i-130 is approved first, then they will close the k-3 and you will follow the CR1 route

If you are a July-filer at TSC and haven't heard any updates since November, please contact your congressman. We contacted ours and received word today that our file will be processed within 45 days and go to NVC in about 2 months.

In spite of all the email and letters from TSC, our congressman's office found that our file had never been touched. Thankfully, our case is now moving forward. If all goes well, I'll be able to move to the USA at the end of October - just as if we had applied in November instead of July.

Normally it takes few days for NVC to generate the NVC Case# after the actual approval date of I-130. so, now onwards, you may try reaching NVC# with your I-130 Receipt# to get NVC Case#.

Hello everyone.

I am new to this post but I read all your comments. I am in the same boat. I filed my I130 on July, 2010. My NOA1 says priority date july 6, 2010 and Notice date was July 14, 2010. My case was transferred from CSC to TSC in November 2010. The last update in my file was November 29, 2010. since then I have not received anything or my case has not been updated. My husband called since he is the petitioner and I am the beneficiary. They told us that it was outside the time frame and somebody was going to contact us within 30 days.. please advise me if this is a normal process because it seems that is actually outside of the 5 months. It has been 6 months already... what do I do? How long from Approved I130 to NCV To consular interview.. please help

After I-130 approval, NVC can be done in 1.5 months time without any RFE. (I think you have NVC Electronic Filing option, check it out)

Mexican Consulate - other people from your country will better estimate this timeframe. I think it is the deal of another 2 months time, but is an estimate.

Yes, I'm a nurse. I'm just not sure what form did they file for me but i think its EB I-140 Immigrant petition for alien worker.
So do you think it wouldn't affect my I-130 since it wasn't my fault that my EB was still pending and it is because of retrogression?


It won't affect. Both will go in parallel. But you will have to answer truthfully to the Consulate officer, only if CO asks about it.

Also, as I said, abandon the pending one formally after the GC visa is approved from the first one.

and by the way Loto, My employer applied EB ( third preference) and it was an immigrant visa. I'm just not aware of the forms they filed for me, but what I only knew is it is an immigrant visa. It was same VIsa my husband had before. He was also petitioned by his employer because both of us are nurses:)

Your employer applied EB based GC for you. These are the steps:
1) Employer will file a Labor certification for you with Dept. of Labor here first
2) Employer will file I-140 - employment based petition for you
3) Since you are outside the U.S, there is no Adjustment of Status. So, it will be routed through NVC to the Consulate for Consulate interview - EB based GC.

Since your PD is not current, now you are stuck in 3rd stage, but already completed first 2 stages.

Oh no! sad to say I'm still here in the Philippines, because of the RETROGRESSION on EB ( third preference). Currently they are only processing priority date April 2005 and my priority date is NOvember 2006, so i was stocked here. I think I'm done with USCIS and half on NVC, my Visa fee bill is paid already but they weren't able to transfer my papers to the Consulate due to the retrogression.


So, are you nurse and directly processing EB based GC from Philippines?
