I am pressing the issue with her until she gets clear answers from her lawyer on my behalf, I told her she didn't need a lawyer is not like they have any special issues...

My sister mentioned today that her lawyer told her the interview for her fiance's k-1 visa will take place in USA. Is that possible? I thought interviews for all visas happened in the US consulate abroad where the beneficiary resides prior to entering the United States. Her fiance is from Mexico... blink.gif


She says that her lawyer told her the interview takes place in Mexico only if she files for a cr-1 or K-3 visa wacko.gif , is there any circumstance where this is possible because otherwise her lawyer is so lost and it means my sister is giving time, money and trust to someone who will do more damage than good.

Welcome to VJ, and congrats on your engagement.

You have lots of reading to do but here's how i am going to do it, maybe will help give you ideas when making your own choice.


I am the USC, and my boyfriend has never been in the USA. I did lots of reading to see what was the best route for us since we had several choices:

1) Apply for a Fiance visa, once he gets here get married. (only citizens have this choice)
Ok it is faster but once he gets here on this visa we have only 90 days to get married, and he needs to apply for a greencard and the works (more money!) .... so pros: faster , cons: more money and needs to apply for permanent residence here... we decided to go against this choice...

2) Get married in DR, once I come back to the states petition for a spousal visa (both residents and citizens can do this but faster for citizens)... It takes longer for him to come but he will enter the usa as a permanent resident (conditional green card since the marriage will be young) and we just need to remove conditions of the green card later on... It is cheaper than the fiance visa but takes longer, since i am still in school and not ready to live with him just yet this is the way we want to go... Besides we also took into account the fact that his family lives there and cannot travel for the wedding, my family can just travel...(there is also the option of applying for a k3 visa if u go this way! read up)


3) there is also direct consular filing, dont know much about it because we already decided on the option above...


So for us several things came into play, family on both sides being at the wedding, money, and time apart... Our relationship is long distance and we felt confident that we wouldn't die if we waited just a bit longer by going the CR-1 route. Makes sense financially for both of us and the wait will give us time to save money for our home together.

My now husband legally has a coonfusing three word first name, but goes by a completely different nickname in his daily life. We simply listed his nickname as a previously used name, in case it popped up anywhere. Since it is a nickname, there was no documentation for us to send in.

As for your case, if you don't list your previous names, and the names do pop up during their background check (ex. the old name was once linked to your ss#), it may look suspicious.

I wouldn't worry about getting an RFE for now. If you do, then you deal with that when the time comes. Better to be upfront and not look like you are hiding something now.

In Nigeria situations like this are very rampant, one can work for a business solely owned by one person and don't get paid at the end of the month. They do not pay biweekly but monthly so some businesses due to not making enough money to pay their staffs do owe their staff salaries with the understanding that they will pay as soon as business picks up again.
I think his situation maybe when narrating his experience to his fiancee she may have helped out a few times and when his demands got excessive because believe me it does get excessive she might feel she is being taken for a ride by him.
Whatever the situation is, i hope they can work it out and if not it's better to have loved and lost than not to have loved at all. All the best.

I have been trying to check the status of our case since I got the NOA1 back in Sept. I was unsuccessful with the reciept number on the back of the NOA1 but recently I was able to aquire a copy of the check cased from my bank. THere were two numbers that started with EAC but only one had 13 characters. Both number didnt work. sad.gif Is it something I am doing wrong, or have they not touched our case yet? Its been 133 days and nothing from VSC. IS there something I am missing from this check number trick? Is it bad that its not working? sad.gif":(

So next month will be about 6 months for me . . . I hope I just get the NOA2 instead of calling them to find our some terrible news like they lost my file or something... But if not I will call next month. Thank you for your advice smile.gif

I was, "pretending" because originally I stayed hours on the phone trying to find out how to get in touch with an actual person. I asked here on VJ how I could get through to someone to help me and they told me to push number three on the menue and say that I am changing my address and then tell them your problem. Thats what I did, and I got through to a lady how transferred my call. So I didnt actually go through with the pretending, I told her I didnt know how to get to a human on that machine. And she didnt say that there is a way. I didnt explain all of this since I thought this was something common that all of us do since there is no other way to get in touch with someone.

Maybe you havent tried calling this number or maybe you havent had any problems seeing your case but maybe what you should do is be more considerate and put yourself in my shoes. If you dont have anything positive to say please dont say it I feel horrible enough already.

I wanted to complete our Affidavit of support asap, but as I was reading guides and previous discussion I read that its not a good idea to do it too far ahead of time... we just got our NOA2 and I also received a letter stating that our case has passed through the NVC and is on its way to Bucharest. Is it to early to put all the stuff together? SHould I wait untill I know the Interview date and then do it closer to that date?

I have a willing co-sponsor and I have filled out all his paperwork...Now I wanted to fill out my form and I came to this part:

7. I am employed as or engaged in the business of _____________________ with _____________ at______________________________

Since I am not employed what should I write there? None? N/A?

Then it asks about many other things including how much I have in my bank account; should I write how much I have even though what really matters is what my co-sponsor has? I only ask because i dont have much and I dont know if its better to write it down or not...

You want a tax return or tax transcript. The W2 is just one part of a tax return. Your mother is right, provide it's a complete tax return or transcript.



I am sorry to ask a dumb question but since I never had to file taxes yet, I dont really know what a tax return/transcript is or what it looks like.... Is that the form that you fill out to the IRS ? Please if you can elaborate so I can know whether she gave me the right papers...

I was trying to find out from our Embassy's website [Bucharest, Romania] whether or not it is necessary to translate official documents [because i am finding conflicting opinions and experiences-no hard feelings smile.gif] And I read this:

I want to know because the "Non-immigrant visa for a fiance" page says that official translations are not required....but it doesnt say specifically Fiance visas, it just says Non-immigrant... you see my dilemma?

Hey everyone, I'm going to be filing for the K-1 visa for my Moroccan fiancee. We met within the past 2 years (last fall while I was studying abroad in Morocco). I just had a couple of questions/concerns regarding this.

I don't have any ticket stubs left from when I was there as evidence (I didn't see any reason for keeping them at the time), however, I plan on submitting a copy of the Certificate of Completion I received at the university, proving I took classes there, along with my transcripts from the university, my passport stamps from entering/leaving the country via Spain, and a letter from my study abroad director stating that I was present during the fall 2008 semester. I also have several photos of myself and my fiancee together (they aren't dated though). I also have emails, phone bills, letters, etc to prove we have an ongoing relationship. Should this be sufficient evidence of having met there during the fall of 2008 or might I have a problem?

Also, for the affidavit of support (I-134 form), I know that I'll need to provide supporting evidence. However, I only recently attained my full-time position as a Counselor upon graduating just last month. Therefore, my tax returns from the previous year or two would not represent my current income which is approximately $25,000.00 per year (pretty well over the 125% poverty guideline for New Jersey). I plan on submitting a letter from my employer stating my position, status, income, various benefits offered (medical, dental, etc) and date of starting (May 2009), along with numerous paystubs up and to the time of the interview, which I assume will be at least 6 months from todays' date (I haven't sent anything in yet - me and my fiancee both thought we should graduate first this past semester and have me find a good full-time job first). I would also submit evidence that I was in school (like a copy of my diploma, transcripts, letter from professor) which is why I do not have tax returns and only recently attained my first full-time position making sufficient income just last month. Would the fact that I only recently started my new career position hamper my chances of the visa being approved, or am I safe with that amount of evidence? Any advice?

Hi all,

I'm filling out this G325-A form, and the employment history isn't agreeing with me lol. I just graduated college, and during the past 5 years of school, I've been in and out of temporary/seasonal jobs like crazy, at times having 2 jobs and other times being completely unemployed. The past 2 years are ok, but earlier than that things are a mess. I tried using my past W-2 forms to list all of the jobs but this still doesnt list the exact months worked. Theres no way I can figure out all the little times that I've been unemployed and when exactly I worked each job other than the general year. Any advice? Will it be a problem if I screw up the accuracy of this part? I'm obviously attaching a second sheet. I'm also including a note at the bottom explaining this.

no doubt. im even submitting facebook messages between nisrine (my fiancee) and my mom talking about our relationship and how much we love each other (amongst other things). my goal is to make it where if the CO decides to deny her the visa for "lack of evidence of a valid relationship," they will get fired. lol

hey, yeah i think i know what site youre talking about. she knows the site. she used it sometimes when i was over there. now she doesnt bother using it because we just always use msn, email, or the phone when we talk which is pretty much everyday anyway. thanks though smile.gif

Hi I have two questions about the phone bills we will use as evidence of our relationship.

One, is that my phone number, along with my moms, dads, and brothers are all listed on the bill as being under my fathers name. We have the family plan, so all 4 numbers are listed under the name of my dad. Should I/my dad write them a letter explaining this? Or would they just figure it out if I highlight the number thats mine and they see the calls going from that number to my fiancees country and I only hand in the call history of the number thats mine?

Two, is that my fiancee doesn't make much money at her job in Morocco to call me long distance, so all the calls are from me to her. Up to this point there is no record of her ever calling me (its been 6 months since I've been with her in person). Although now that it's summer and tourism is picking up she may be able to call me occasionally from a teleboutique. Is this going to be a problem at the interview if they see that there were barely any calls from her to me? Is there anything that I/my fiancee should do to prepare for this?

I plan on sending phone bills and emails with the original petition because I want the CO's to see stuff before they even interview her. But the only ones I have so far are just records of me calling her.

i personally feel you should elaborate a little for casablanca, because its a tougher consulate and they will want more evidence/explanation. thats what i plan on doing. mine is going to be about 2 short paragraphs like a really short story to help them envision our relationship better, but no more than a single typed page. i wouldnt make it longer than that.

well, we never had an official engagement party because we never had the time to prepare one, i had to leave too soon. we got engaged only a couple of weeks before i left. we do have a lot of pictures together though. but will that be a problem? we thought that we could just say that we were planning to have the engagement party when we returned back to morocco together after some time. also because we wanted my parents and grandparents to be at the engagement party as well (obviously they werent studying abroad with me hahah)

well, im not too broke, i have a little money saved, but more importantly i do have a full-time job making over the minimum amount, along with a part-time one as well for extra cash. so maybe itll be ok? i would think so right?
