I dont think N/A is appropriate as the father, or mother for that matter, does indeed have a birthday. USCIS also is clear not to use N/A if the answer could be none, I would assume that to be true for UNKNOWN as well. I would go with UNKNOWN.

Would an i-130 filer get an RFE for G-325A if he didn't write his father's birthdate even if he doesnt know it? Anybody who knows anyone who got an RFE for incomplete/missing date of birth of father/mother on G-325A?


If parent(s)' DOB is not aware of, don't leave it as blank. Write 'DO NOT KNOW'.

Technically, ALL the fields in ALL the forms of the USCIS have to be completed. Did I mention ALL in capital letters? Then, by default all entries must be in CAPITAL as well, unless otherwise states to write in lower case.

You can try for visitor visa, Kev & Aki. Visitor visa denial should NOT affect the immigrant visa processing. If you can get B1/B2 visa, you will be so lucky, otherwise you will just lose the visitor visa fee, that's all.

Thanks for the reply! Thats helpful. I would edit my original post to emphasize how it would be for my spouse visiting on a tourist visa. Not so much live together yet of course. I wonder what ramifications there may be for her visiting on a tourist visa. For those of you who are married to a foreign spouse and waiting on immigration, are you similarly living in separate countries, until the CR1/IR1 is approved?

99.99999999999999% (That's close to 100%) the visitor visa will be rejected.

My wife is another victim. Even after surrendering the previous green card, my wife's B2 visa was denied - 214(b) - potential immigrant.

Our logical thinking was NOT correct. GC surrender means she didn't have any intention to live here permenently, right? That's the logical temporary intent!

But once they have any entry like 'IMMIGRANT', non-immigrant visas will be denied, and mostly forever.

Wow, that is a lot of information and a little difficult for me to understand since I am not into all of this business stuff at all.

It is a Sole-proprietorship.
Which (if understood right), can be claimed as an asset, right?

Does anybody know how long it takes to figure out the value of a business?

My husband makes enough money to sponsor me, but due to backtaxes we thought we would put the business on the I864 and have a co-sponsor just to be on the safe side?
Or is that over-doing it? :unsure:

I would strongly suggest you to show your husband's regular income to support you, after making back tax payments to IRS or any arrangements.

CPA is just good enough to evaluate your business asset. They would be completely unaware of immigration stuff. If you still would like to pursue this way of sponsorship, talk to both CPA and an immigration attorney.

Since you have specified it is Sole-proprietorship, your chances are high to qualify.

If your business has any value and it is a Corporation the value of the business is an asset of the Corpaoration and does not transfer to you personally. You as a director or officer of this Corp. have voting rights to sell or borrow for the business but the asset belongs to Corp. You should be filing a Corporate tax return and a personal tax return. If you are a S Corp. the adjusted gross income on your schedule C flows through to your personal tax return and taxes are paid personally by you not the Corp.

Your business may have value but probably not considered a personal asset but an asset of the business. Ask your CPA he will have your answers.

Thta's why I suggested "sole proprietorship". Because your SSN is tied up with the business entity and the business parties have the interest on your personal assets, if it goes wrong.

S-corp on the other hand associated with FEIN (Federal Employer Identification Number) and separates the business asset and liability from you personally.

Both type's income/expenses flows through Schedule-C of 1040.

JuneFirst, make sure it is "sole proprietorship" and check with your CPA as well. Also, if you qualify business asset and short of $10,000 to bring the financial resource above the poverty line, you need 3 times (assuming the sponsor is USC), ie, $30,000 asset.

Business is not asset, it is an entity.

Business will have asset and liability aiong with income and expenses. At the end of the year, net income/loss will be transferred to profit and loss account. This account's money (full or part) can be distributed as dividend to the shareholders or to the owner. Some can be re-invested to the business expansion. Ultimately, business will have a balance sheet where it derives the net asset.

If you or your spouse is the owner of this business and under the sole propreitorship, you can prove it as your asset.

Bobby, Any status is fine. At least 5 years residency of the parent in the U.S is mandatory.

When I did for my daughter, I had only 2.5 years residency as USC and before that it was GC status.

Do you mean fingerprinting?

If yes, NO. This will be done at the interview time in the Consulate.

Fingerprint is for the beneficiary. And the beneficiary is NOT in the U.S.

Also, there is a second fingerprint at Port of Entry (POE), just to make sure the same person who got the immigrant visa has landed here.

PS:- I read in VJ thread sometime back that a person at interview time had long hair. At POE, he had cut it short. Then posted here, will that be an issue? That's not an issue. But cosmetic surgery on the palms will be an issue.

Sorry, didn't see this til now. I work in Canada but don't make even half of the income requirement. Besides, my Canadian income would not be continuing in the States and I think, from what I've read, that has to be true. I can still DCF in Canada (I'm eligible), and I can establish domicile pretty easily, I think, but the income/asset thing is the real problem. This is one of the problems for DCF filers.

Many US citizens living abroad will not have a US-based income. Your foreign earned income can not be used to satisfy the I-864 unless it will continue when you are in the US. Your assets, and those of your spouse, can be used in lieu of income, or you may have employment in the US starting up. A Joint Sponsor may be the only solution for some families.

Wow, US immigration is quite a bit different from Canadian Immigration. It's really hard to even find a common point of reference. Seems they do everything differently. The only thing that seems to be the same is that a sponsor living overseas has to prove they intend to come back home and settle in order to get their partner status - and that makes sense. Other than that, it just boggles my mind.


If you (sponsor) work in Canada and makes enough money to prove your financial resources, why don't you do DCF in Canada and bring your husband and step-son faster here?

Thanks so much for the input so far - but what I was wondering is whether my husband's former employer can "sponsor" him to work in the States for him, and whether we could meet the income requirements based on the income he would be earning from that job? And, if he can get sponsored for a work permit (I know I'm probably talking "Canadian-ese here because I'm well versed on Canadian Immigration practices/procedures but not on US policies), is there any need/advantage at all to me sponsoring him? When his employer sponsors him, it will be under employment category not family based. I have heard employers can bring a person in Green Card if they can prove that the employee has exceptional skill and this skill is not available in the U.S. Couple of my doctor relatives came into the States in 1970s and 80s like this.

IMO, employer can sponsor the person in non-immigrant work visa such as H1 etc., provided employer meets all USCIS criteria such as min. yearly turnover (I believe it is $500K or $1M or more) and all.

I missed pretty much everything after the name section. What happened was when I was completing the forms for the petition package, I had printed out a copy with just our names on it filled in. I was thinking of handwriting the rest of the info in. But then decided to just email her the form so she can complete it, print, sign, and mail it back to me. Sooo....when i sent the package off after receiving the form from my wife, I had inadvertantly put the incomplete set with my package.

Didn't realize that's what I did until I got the RFE and double checked my files.

I received the RFE in the mail today. It is not good. They are asking for proof of legit marriage and it is the information I cannot provide since my wife has never been in the USA. They are asking for joint bank accounts, assets, or living together since marriage. It is impossible to get with someone who has never been in the USA and the thing is they stated in the letter I live in USA and she lives in Ukraine. Now I have no idea what to do.


Did you include bonafide marriage affidavit (that's notarized) that were executed by 2 or more elderly people who knew you and your spouse and about your marriage?

Also, was your marriage certificate issued from the official authority with the proper sign, seal etc.?

I filed the i-130 and received my NOA1 on March 18th. While waiting for an approval like everyone else and thinking it would come any day I received a REQUEST FOR MORE EVIDENCE.

I originally sent marriage license, pictures, and many many chat sessions via Yahoo, along with notorized statements from friends and family.
My wife has never been to the USA and therefor I there is no way to have a joint living place, bank accounts and assets together. I sent all I could other then resending even more pictures.

Hello all! Maybe one or some of you have some advice for us.
Short version: Me: Us Citizen. Husband (Canadian citizen) received his CR-1 August 27, 2008. We want to apply to remove conditions. Must file I-751. In the mean time we have moved (and we did file a change of address) and now his 15yr old son (Canadian citizen) who was supposedly just visiting now has to stay with us permanently - due to mom having hardship and moving back to her home country.

Do we say that his is living with us on the I-751 form?
Are we very late in applying to remove conditions?

We didn't have the best experience with getting the CR-1 - I just hate to have to go through this all over again. I read through all the info in the wiki area - but I thought I would just throw it out there about his son. If you have any other random advice to make the conditions removal process smoother - feel free to send it our way.

You have to include the children's details in I-751. If he is living with you in the right immigration status, there is no problem. Did he overstay with you?

You have to send the I-751 as soon as possible now, becasue you are left only one more month.

OKIE !!! FOLKS........

I read every posts above and found out that no one really knows about why local pcc is required.

You have to get local police clerance certi./district pcc first. Then only you can apply for passport clearance certificate. (you have to attach ORIGINAL police certi with passport pcc application).

Also, I would send a copy of local pcc to NVC. (ZEROX COPY - certified by same police station where local pcc was issued or any gazzated officer) so for now in NVC process they can have something instead of nothing, and I would also mention in cover letter that goes with DS-230 that 'we were unable to obtain passport pcc at this time, but therefore attached please find a certified copy of local pcc, but please send us missing cheaklist or interview letter so that we can present it to the passport office and get the passport pcc.

On the NVC page - Reciprocity by Country for India- it lists the following details about Police Clearance Certificates:

All Indian IV applicants aged 16 and above, residing in India, should obtain police certificates from the local Passport Office.

On that website it does not make mention of anything about the Local/District Police Clearance Certificate.

However on the Embassy website (at least for New Delhi) it still makes mention requiring the District PCC.

I must ask if anyone has noticed this - and deemed it to be a discrepency or a reflection of truth.

Does this difference mean that the NVC only requires one PCC (the Passport Office issued PCC) for its case processing purposes ? In other words you can obtain the Local/District PCC later and submit to the Embassy on the day of the interview ?

I ask this question not to confuse anybody - but because an NVC operator mentioned to me that the rules have changed for India regarding Police Clearance Certificates. She said that we only had to submit the Passport Office issued certificate and no longer the District PCC. Even Chennai U.S Consulate (http://chennai.uscon...terms.html#ERAS) also mandates the PCC from local passport office only. Nevertheless, I would arrange the PCC from the local police station as well, "just in case".

BTW, I have a question. My beneficiary has lived in the U.S for more than a year. Does she need to get the PCC from the U.S?

I called the NVC operator and he said that my wife should answer N/A since she has no middle name. He said everyone knows that N/A means it does not apply or exist, so they will not print it on the Green Card.

If the NVC data entry person is so dumb, then he/she will enter it as First N/a Last. Normally, it won't happen. To be safer side a small write-up will be good, may be in the covering letter.

My status was changed to Request for Evidence. Should i be nervous? i mean filed it through a lawyer and i sent in evidence from marriage CD, CD filled with bunch of pictures of us, marriage certificate, pretty much everything maybe even little more then what they asked i think. So my status being upgraded to Request for evidence has gotten me nervous. All tho i did not send in any email chats stuff because i never met my wife till i saw her at a wedding. A week after that we got married and week after that i flew back to USA. All tho we stay in email contact as well as talk for 1-2 hours a day which i can get print out online from vonage.


Other than the marriage certificate copy, did you send the affidavit of third parties who know about your marriage?

Chella, Follow what Freda/Alejandro has suggested. If you register your case# with the USCIS site, you may or may not see touches in your case. It doesn't matter. Many get approvals even without the touches.

BTW, What's your timeline? My beneficiary's consulate is also Chennai.

Payable to, right fee, your sign and date are enough. You don't have to worry about anything. Some people will write memo in addition just for personal record, but it is optional.

To my knowledge I filled out the forms correctly. I followed the guides.. I just sent the package in three envelopes through USPS. I just worry because I have no clue as to whether the fact i wrote I-130 petition on the memo of the check turned out to be a mistake. I'd hate to just have a month spinning on my wheels when i can just fill everything out again and send it all in.


What I understand from your post is you wrote a wrong memo section in the check. If yes, it should NOT be a problem. They want just your right fee (money).

My joint sponsor lives in another state she scanned her taxes and W-2 and also a copy of her GC...is this acceptable to NVC? The employment letter she will send to me by mail...

Emily, since copy of those are required, you should be fine. Where're her IRS tax transcripts and her current paystubs? Or are you going to stick with the above copies and employment letter?
