Ok I think I'm following now, thanks everyone! Good, hubby has no record.

I thought that once I received NOA2 it would say that EP is an option and I could opt-in. But I guess either way I have to wait until my case gets transferred to NVC so I can get the NVC case number then file/email the 3032.

I think I'm going to be spending a LOT of time on here. :hehe:

Hi Everyone,
I'm in the same boat, so rather than starting a new thread maybe I can just tack onto this one. I've read LingChe's Guide and have it "favorited" on my browser and will print out out. I received my NOA1 a few weeks ago and am also working to prepare for NOA2, and am hoping to be invited to "opt-in" for electronic processing. I have been trying to figure out, what is the difference between the police certificate and biometrics? I thought the police certificate was part of the biometrics.

I am the USC and doing the research for my hubby, so I have to relay the info to him as to what he needs to do in the meantime to ensure there's not a lot of lag time. If the biometrics are police certificate are not the same thing, should I see about him getting his certificate? I couldn't find anywhere how long it's good for, but I'm guessing about 6 months.

Biometrics generally refers to fingerprints which will be taken at your husband's interview in Montreal, so nothing for him to do ahead of time. (Very occasionally they are requested of the US petitioner as an additional security check but this is not the norm.)

If your husband does not have a criminal record a fingerprint check is not required as part of his police certificate. See this link and scroll down to "Police Records." Police Records - Canada

Generally NVC will accept police records that have been issued within a year but IMO it is better to wait until you have your NOA2 before getting the certificate. If you husband only requires a certificate from Canada (and not a fingerprint check) they are available fairly quickly. That will ensure it is as up to date as possible by the time you need to submit it. Good luck!

Steffi, no offence but the hiring of an attorney to file a simple visa petition is a waste of money, if you can read you can do it. You already said you know what forms to file, just do it.

The process is pretty forgiving as, if you make a mistake they will simply ask you for a correction.

If you have special circumstances like past immigration issues, or law enforcement issues then by all means hiring a lawyer makes sense, but if you are just doing a straight forward visa petition and application you can do it yourself as the myriad of VJ'ers in the past have done. Don't let the process intimidate you, it really isn't hard

^^ Agree. If you have no extenuating circumstances, can understand and comprehend all of the information available online, the process can certainly be completed without a lawyer. You need to assess your situation and decide accordingly.

I just tracked it.. Got a delivery confirmation on July 13 to po box 60680 Chicago Il.. Everything seems in order. On the bright side, If there were something wrong.. Everything would have been returned right?



If there is a problem they will return it. However, it is possible that even though your package has been received, it hasn't been processed yet. Give it a little more time, keeping checking to see if your cheque has been cashed. Good luck!

We already applied for the Social Number on our DS-230 form and the USCIS and POE and CDP told us it was automatically going to be mailed to us...no need to go into the office.



That's what they "say" but the reality is many filers don't receive it until they submit an application at the local office. Good luck!

Hello,

My wife is currently filling out the DS-230 Form to submit back to the Canadian consulate after she is finished. At the end of the form, there is a section that states not to write below the following line. It looks like she would sign and check off what type of immigrant she is. We need to mail in the DS-230 form to the consulate and i'm just curious if she really needs to leave this blank before we mail it in. If so, does anyone know when she would actually sign the form?

I disagree with OBX, this is a very simple situation. You were told to stay for 2 weeks so you stay for 2 weeks. It is not worth it to mess up your future.

Since you told them you only planned on staying for 2 weeks, I'd really avoid any indication of misrepresenation. As in why did you tell them you were only going to stay for 2 weeks when you planned on staying for 6 months?

Where you given anything in your passport?

It is totally not worth it, stay for 2 weeks and head back to Canada.

Better safe than sorry I would say go home after the two weeks - you don't want to cause problems at a later date.



I would agree. Despite not stamping your passport they may have noted your expected date of return on the system. There is no way to know for sure so you have to decide if you want to take the chance that it will not be an issue at your interview, which hopefully will come in less than 6 months (which is your allowable length of visit time as a Canadian.)

Tough decision, let us know what you decide and how things work out.

Wheww!! after constant email follow-up, I finally got a human response and according to the email, they noted my applications and will reschedule my interview appointment as soon as a new date is available. My daughter will not lose out of the IR2 visa category when she turns 21 considering that the petition was filed before her 21st birthday.

I am extremely happy that it was duly noted. I don't see any 5 months or so wait times to get rescheduled.

On my G-325A I ticked Naturalization on my husbands it is ticked as Status of permanent resident...Did we do it correct? Or am I letting the mind monsters control me...LOL



Both G325A forms should be ticked "Other" then specify I-130.

That being said we filled ours out (prior to discovering VJ) as "Status as Permanent resident" and were fine. You cannot do anything about it now, wait to see if they send you a RFE. IMO it will be obvious from the forms you are submitting what you are petitioning for, I think you will be fine. Let us know how things turn out. Good luck!

I see that the only form to fill out in all caps is the I-864.. The others don't say anything, so I am guessing you do not have to write all caps on DS-230



I filled out all my forms using CAPS but if it doesn't specify you should be fine; as long as it is legible. Good luck!

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:
1. Documentation showing joint ownership or property; or
2. A lease showing joint tenancy of a common residence; or
3. Documentation showing co-mingling of financialresources; or
4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or
6. Any other relevant documentation to establish that thereis an ongoing marital union.

Then after the 17th he should go back to the office. I see your POE was fairly recent, they do need time to enter his entry into their system.

I'd go back and just simply apply for a new card (not mention the DS-230 at all)

I applied for mine 3 weeks following my POE. I mentioned nothing about the DS-230. Just provided them with my birth certificate, passport and filled in application. ( SSN Application )
I had my card 6 days later.

Hello all, I have a question regarding

On my wife's I-130 and G-325a, it says my wife is currently unemployed but now because of our current financial situation, me being the only one working at a low paying job.

Will this Effect anything in the future as far as her DS-230 or anything else? I'm asking this because I heard or read somewhere it has to be consitant with her all her paper work... but i'm thinking it's just my Job status and my Affidavit of Support.

I hope this is understandable and again, thanks for any response.


I'm not sure if I am understanding your question but if your wife is the beneficiary her employment is not an issue. Any discrepancies between the initial I-130 petition and the DS-230 can be explained at the interview; if it even comes up. Good luck!

well....you don't need to because you don't have another step , its the last step at the embassy so even if they took it , it wont be a problem because you wont need it anymore . but if you are so worried so just copy it so you wont be nervous at the interview

I agree with Sam, if you are going to worry about it copy it. I took multiple copies of absolutely every piece of paper I had sent to USCIS and NVC to my interview. I needed none of it but it did make me feel better. :lol:

Local police station in Baroda will issue the PCC within minutes. So that wont be much of an issue to get. its the PCC from the AMD passport office that is the problem.


I have heard from the beginning onwards that Gujrat PP office will ask purpose of the PCC in a written form such as NVC documents etc. Is that correct?

If yes, one from Gujrat needs to enter and collect the NVC details as well.

Please let me know if it is correct or not.

Of course, you should get it now. Normally to get PCC in India would take typically a couple of weeks to a month or so. Indian PCC is valid for 6 months from the issuance, I think.

By the way, anybody tried writing with hand or typing in lower cases? whats ur suggestion? Its the block letters that we key in that makes me run of space..


Never write in lower case, make all entries in UPPER case. Use additional sheet unless it fits.

If you have 5 years or more IN THE USA as a US Citizen, then you qualify to file a 'Consular Record of Birth Abroad' for your child.

As for the rest, assuming she's in Canada - file the I-130 to the lockbox in Chicago for her, and for yer son if YOU DO NOT QUALIFY as a US Citizen.

Is possible, if you live in canada continuously for 6 months prior, to file the I-130 directly to a US Embassy/Consulate in Canada.

Review the guides section here for both methods (train yer eyes UP, look for the word GUIDES, and click it).

Regardless of where you file the I-130, she'll need a Police Clearance Certificate from the UK and Canada, for the DS-230.

Let me give you a small correction in "If you have 5 years or more IN THE USA as a US Citizen, then you qualify to file a 'Consular Record of Birth Abroad' for your child"

It must be min. 5 years of stay in the U.S in any status - USC, GC holder etc. I did "Consular Report of Birth" to our daughter and I didn't even have 5 years US citizenship at that time.

I am a CDN born citizen, with US citizenship via military service (a dual citizen).
My wife is a british citizen (CDN permanent resident) and we have a CDN born son.
We are entertaining the idea of moving to the US where most of my relatives live.
I am not sure where to begin.
I can go into the US no problem because I am a citizen. But I am not sure what
to do for my wife and son.
Does my wife fill out some form or something?
Does she have to have offer of employment before she can apply?
What about my son? What form do we fill out for him?
Since my wife is a British citizen, it is between the US and England and with my son
it is between US and Canada.
Can anyone offer some advice on how to go about this or do we just go on a long term visit of 3 months or so
and then just "decide" to stay ? Any info would be greatly appreciated

I assume you work and live in Canada for more than 6 months. If yes, you can file your I-130 with the U.S Consulate in Canada, called DCF (Direct Consular Filing). DCF is the fastest way to immigrate them to the U.S.

I'm a USC and my wife lives in Mexico. She has two girls (ages 10 & 11) and I am petitioning for all three. I would think that USCIS will suspect she was previously married, but she was not. How do we prove this?

1) Get a notarized letter from your step-children's father that he and your wife not married.
2) Get a letter from the city or the government official who does marriage registration that the above marriage was not registered as per their records.

Most likely we will be going to Thailand - but I am really just trying to clarify what the Embassy may ask for and what to show them if they ask.

I know that some VJers have in fact traveled with their beneficiary to a third location or country before the interview, but I am just staying on the side of caution to make sure I take into consideration what my friend mentioned.

My real concern is simply that the Embassy will want to establish intent and ask us to describe our trip to Thailand.

I know I am probably reading into this way to much - but the Embassy cannot verify what we did in Thailand - and we cannot obtain a police clearance from a third country like Thailand for a 10-day trip. So I posted my question to get an idea of how to present and establish intent of our trip to Thailand.

All of your suggestions make sense - and actually I would not have thought to save the Travel Brochures or Maps as an evidence to present.

It should not be a problem if you stay less than 6 months there. PCC is required if you are in a country for more than 6 months.

During our previous I-130 process, my wife had been in Malaysia and Singapore for vacation. There was no issues during the immigrant visa processing for her.

In fact, you can get an employment letter now since you are very close to I-130 approval time. Typically, it is ok to have up tp 3 months old documents such as employment letter etc., since you will have the latest pay stubs from them, any way.
