IR-1 / CR-1 Spouse Visa Process & ProceduresCurrent Fiscal Year?

Guys,

I am kind of confuse about the employment template on visajourney wiki My link. I understand that I should put 2010 next to current fiscal year but what should I put for salary? Should I put salaries for the past 7 months or the salary til December? Thank

You don't have to exactly follow every detail of the template.

Get a regular employment letter from your employer on their business stationery (that has their name, address, contact phone#, fax# etc.), showing your full name, job title, hiring date and annual salary. Then it must be signed by somebody in HR. That's it.

Every employer has their format to prepare this letter.

Lol too late I bugged the irs however they guy was nice. He told me they don't create that from, I thought it was weird that the irs would make it. Ill email uscis and just use the old edition and see if a newer one comes out befiore my interview. Its there fault if its an expired form.
Thank you

If you carefully review the below link (http://www.uscis.gov...00045f3d6a1RCRD)

you can even use this edition created on 10/18/07. Also, you can even use its previous edition created on 01/15/06. But older editions that are older than 01/15/06 will not be accepted.

You don't even have to bother USCIS on this matter. Sometimes, they will extend the expiry date automatically on the same edition unless drastic changes occur in the same form.

Hope this helps out!

Canadiandggal, why do you bother IRS for a form that is created by USCIS and reviewed by NVC.

The I-864EZ form that you have is the latest and use it. Don't worry!

i have been waiting for 7 weeks now.. nothing yet.. they got my docs on Jun 21st, and its Aug 4th.

Jimmy, based on your timeline (07-16-2010 - DS-230 Received at NVC; Entered AVR System), after submission of your IV packet, it has been only 3 weeks.

6 to 8 weeks by AVR is after submitting the DS-230 package and it is the standard message as well. However, it looks like they are clogged too.

Regards and Good luck!

They received all our papers at the end of may, we received RFE one month later and immediately sent what they needed and now we're also still waiting...this doesnt make sense anymore...

That's correct.

For income, enter Line 22 amount (Total Income) of your husbands last tax return form 1040 (hoping he has not filed using 1040EZ last year). This is the income before taxes.

IR-1 / CR-1 Spouse Visa Process & Procedureshow early can NVC documents be requested?

As per the US Embassy in Manila: "For immigration purposes, an NBI clearance is valid for one (1) year from the date it was issued". Not sure about the Police Certificate. Also my wife have never been/live outside of The Philippines.

Then you should be all set. The way you cruise, I have a feeling that your entire immigration journey will be faster.

I am early in the stages & my wife got both her NBI & Police Certificate last week. Hopefully they will still be valid when the NVC stage start rolling.

As Darnell said, in most consulates PCC is valid for 1 year. You have to make sure the elapsed time between the PCC issuance date and the Consulate interview date is less than 1 year. Also, please check with Manila consulate as well just to make sure 1 year or 6 months is their cut-off.

police certificate? Those have a 'validity' of 1 year, but that varies by US Consulate.

Strongly suggest you 'get it' or 'apply to get it' on the day that you KNOW about the I-130 approval, NOA-2.

The flipside of waiting, is that you have some time to save up for the fees.

Darnell, I liked your phase "on the day that you KNOW about the I-130 approval" :-)

OP, since you have received your NOA1 a month ago, please wait another 2 to 3 more months (one month before your KNOWN I-130 approval) and get the PCC.

IR-1 / CR-1 Spouse Visa Process & ProceduresBirth Certificate and wedding certificate

Should i be worried?

On the birth Certificate of my beneficiary... The person typing it in, left a pronoun out of the official province. Whereas the Marriage certificate utilizes the pronoun.
So in my case the I-130 follows the bith certificate CIudad La Habana.. But the the official title is Ciudad de la Habana (as listed on the wedding certificate)... Will this matter to the USCIS?

One of the solutions was to put as listed in the translations, HAVANA..

I am worried because I heard they must match exact. Id just die if I got the petition rejected again.. Is using the translation again a suitable fix for this situation?

Rumba, normally people would use the name in the Passport of the beneficiary in the forms.

I hope it should NOT be a problem, but we never know this USCIS. Even if any damage happens, it won't be the rejection, they might ask for additional evidence at the cost of time. Then you can deal with it at that point of time.

Good luck, Rumba!

It is a journey of the ship in a large ocean. When we see the shore, our journey will end with the approval with a smile on our face! Right now you (and me too) are little bit stuck due to a large iceberg in front of us. Since we don't have the captain's wheel, let's hope captain (USCIS) will control the ship and lead us in a proper way. We can pass the message to the captain to bring us to the shore soon. How? Talking to the captain. Sometimes captain will be busy as well. But let's hope he would listen to us!

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview Paperwork

Thanks for the link Loto,

My wife and I are in the U.K and have applied directly to the U.S Embassy in London and not the NVC. Everything has gone very smoothly and feel We have everything ready (apart from the photocopies) .

Within the link you have provided there's several mentions of supplying personal photo's as evidence of our relationship, this is the first I have seen of this for our CR1 application.

It States "The questions below are directed toward people who have applied for the CR-1/IR-1 visas with the beneficiary living abroad" at the start.

So am I right in thinking these requirements are not relevant for our situation?

Kind regards...

Mark

Yes Mark, this guide is for CR1/IR1 filing with the USCIS. However, for the interview preparations, questions that they ask etc. would be more or less same. Since yours is DCF, as you said, carry photocopies of all the documents, your wedding album, medical package etc. Also, study I-130 and DS-230 carefully whatever filled inorder to avoid discrepancies in the form and the conversation.

Interview is just a cake walk :-)

Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresWorried about I-864

My wife sent our I-130 package to the chicago lockbox so now the wait begins.

With the help of this site we are trying to do as much prep work as possible for all the stages we still have to come (what fun!)

Everything seems to be okay but for one thing I am worried about and it is this that I hope you guys can help me with:
Last year my wife only worked for a short period in the US (she is the USC). In january she came here to the UK with me for a period of 5 months and it was during this time that we became married. She did not file a federal tax return last year, I do not really understand the US tax system. She says that because she did so little work and was unemployed for probably 10 moths that it was not necessary, she knows that she does not owe anything and she does have the W-2 (whatever that is).

My wife's father will be our co-sponsor and we will be living with my wifes parents for probably the first year after moving there. She says that it was okay that she did not file the tax return, but as I just do not understand the US tax system, will this be a problem?

Thanks

Andy

She is correct. If she makes less than 'certain amount' based on her filing status, she is exempted to file the taxes in the U.S.

Having said this, if I were she, I would have filed the taxes every year for a clean image with the IRS and it would be helpful if you later want to pull IRS tax transcripts for whatever reasons.

Has anyone ever thought of creating a forum and securing a location maybe once a year for reunited couples to go and for single people to go and meet the people that actually helped them out from this site? Just think, we could fill up the hotels, campgrounds and convention centers if we all got together once in a while and met each other that helped us along the way.

I would love to, KBcrand1! Being you my neighbor (CT), it is definitely possible. Keep in touch and we can have the party when our spouses are here.

I think as I told you before, I have been in CT from 1999 to 2008 before I made the move to NY - near White Plains area.

Ok I am confused. Why are you sending the 1099 and the W2 forms if you are sending the Tax Transcripts?

On Page #8 of the current I-864 form it discusses

25. Federal Income Tax Information

If you provide a photocopy of your tax return(s), you must include a copy of each and every Form W-2 and Form 1099 that relates to your return(s). Do not include copies of these Forms if you provide an IRS transcript of your return(s) rather than a photocopy.

I was planning on only sending my Tax Transcripts and no other supporting tax information. Why is there a need to send both the Transcripts AND the W2/1099 supplemental information - especially if the form is saying not to?

You're right, Bobby. I sent only tax transcripts, employment letter and cuurent year paystubs in AOS package.

NVC will dump those unwanted papers to the trash bin, so there is no harm as well :-)

IR-1 / CR-1 Spouse Visa Process & ProceduresWhen does my husband need to apply for SSN number?

Hi there,

Let me apologize first if this seems like a stupid question, but I am a bit unsure of the whole process, so I might as well ask.

My husband is currently applying for his green card and we are at the point where we are about to send back the DS-230 form. We currently reside in Canada and will be moving to the United States shortly before his interview.

Obviously, you need a SSN number to work in the U.S. and I want to make sure that as soon as my husband receives his IV, he is able to work in the United States (i'm unsure if I can support him for an extended period of time by myself).

Thus, I am wondering at what point he should be applying for his SSN number. Should he be doing it now? How long is the whole application process? I'm assuming it can't be nearly as long as the process to obtain a green card.

Thanks in advance,

- Sam

I am wondering how it is you both will be "moving" before the interview?
