I am not 100% sure that the co/joint sponsor can be any other third party, but I MAY BE wrong as well. That's why, please pull other expert opinions as well.

As per I-864A, the co/joint sponsor must be a household member as defined below (So how can a friend be a household???):

1) A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling;

2) A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at the same residence as the sponsor;

3) The intending immigrant - if the immigrant can show their income/asset that will still be continuing even after migrating to the U.S

Based on your and your parents' in-consistent income, it would be hard for you to qualify.

Look for any other assets or other strong financial sponsor.

125% poverty line for the year 2009 is $32,237 for household of 5. You should look for a sponsor who makes more than this.

Keep in mind that 2010 poverty line may be little higher than this number.

Nir2, You should ALWAYS focus on Total income (before tax income) in I-864 which is the basis of the poverty check.

The below are the quotes from I-864.
"You may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income,or income from any other source, you may also include evidence of that income."

Since you are sending those, you are all set. And I am confident that you are perfect now.

My husband doesn't make $22k ,he makes 16k in his salary and gets 6k in VA disability,so the total is $22k (sufficient for a household of two) but I am just not sure they want $18,212 in salary or VA disability compensation and they don't accept combination of sources of money like 16k in salary and 6k in VA disability compensation? They RFE'd us because we forgot to send pay stubs,employer letter or they just don't accept combination of incomes.?

We sent them IRS transcript for 2009 and VA letter stating disability compensation while initial submittal.Now this time we're sending pay stubs for last 6 months,letter from employer and bank statements for last 12 months to show direct deposit of VA disability compensation.

I'd have to send bank statements to show direct deposit of VA disability compensation but I don't have a lot of balance left on my bank statements.Would it cause some problem ?

If suppose ,they won't accept combination of incomes,would they RFE us one more time or they would just deny us ? We don't have money for a lawyer,Plz kindly help us...Thanks in advance...


This is the BEST RFE example if one doesn't send employment letter or paystubs to prove the current income.

Nir12, I don't think your bank balance matters as long as you provide all the documents requested in RFE. Based on your total income, you are qualified I-864 candidate. Nothing to worry, just respond to the RFE.

Hi i'm getting my 864, 230 and 3032's ready for the NVC process and have a couple questions. My DH recently visited me in the states and I had him fill out the 230, and 3032 here pre NOA2 and sign them and have some questions about that as well as the 864:

1. Is there a specific way he needed to fill out the 3032, 230?? i.e. blue/black ink. On the 864 instructions it says to use capital letters if typing responses and my husband didnt do this for the 3032,230. On areas that didnt have enough room for typing he printed out in blue ink. Should we be okay here?

2. On the 230 one of the questions asks to list the previous visits to the United States and my DH listed the most recent visits however he has visited several times before those. Does he need to list every single visit from birth to now??
Yes, he should. Additional paper is needed if the space fills up.

Copies of paystubs are fine.

5. I make about $200 in cash tips each month. How do I go about proving this since it does not show on my paystubs??
There is no way. If you show it on W2 or paystub, it would become taxable.
Other option is put this money in the bank. Then 33% (assuming the petitioner is USC) of this cash asset can be used in I-864.

That's correct. Make sure you put delivery confirmation for proof of sending it.

USCIS will send you I-797C Notice of Action, which is the receipt notice of your I-865, within the next 2 weeks time. Keep it for your records.

In i-865 we have " Your new home address"

and "Your New mailing Address" and I have a question : I want different home address ( because probably new home address will be permament address because we rent house) and different mailing address. Mailing address will be my old address ( because in my old address live my Father and it is constant address).

So in New mailing address I should put my old address ?
- You can put old address as mailing address and change just the new address

What is mean " C/O ( in care off ) ?
- "Care of" means any person in that household who also can receive your mails. In this case, your Father's name is apt in C/O.

So Petitoner should change address ? Petitioner is USA Citizien. I think USA Citizien shouldn't change the address.


Petitioner has the commitment to protect the beneficiary until:
1) Beneficiary becomes USC
2) Beneficiary cancels the Permanent residency
3) Beneficiary earns 40 credits (10 years work) etc.

So, even if the divorce or any mishap happens, the USCIS can legally go against the petitioner for any public charge of the beneficiary.

This is one of the main reasons, people are reluctant to be your Sponsor or Joint Sponsor.

Until the commitment is over, US Petitioner has to file I-865 for any change of address. Otherwise, it is punishable by the law.

You can do it ONLINE. If you mail it using regular USPS mail, address is on the left side. Address on the right is for overnight delivery.

Name of Airport and City would be fine.

As a beneficiary, you should file AR-11. Petitioner must file I-865 for any change of address.

I'm ready to send I-130 for my wife, but I'm confused with photo dimensions. I-130 instruction guide states that "dimensions of full frontal facial image should be about 1 inch from the chin to top of the hair" but this specification http://travel.state....%2010-01-04.pdf asks for 2" x 2" picture. My wife and I got passport style photos (or so we thought) in Bosnia, but these are about 2" x 1.5" and frontal image is 1" chin to hair, as asked for in the instruction guide for I-130. I don't know what to do now... Do I have valid photos or not? do I send these photos, or do I have her take new photos and have them mail to me which could take 10-15 days :(
Anyone had similar experience?

I am a US citizen and I went to my home country in march of 2010 got married and filed an I-130 for my wife that was received by USCIS on April 16th.I understand it takes 5 months for processing,so technically I should hear something by sept 16th.Is it possible that I don't hear anything by that date?My wife and I are also expecting a baby by mid Dec.What will be the status of the baby if she gives him birth while awaiting the visa?


5 months is average time for I-130 approvals. There will be couple of months +/- in this process. Also, your wife needs to complete NVC process and Consulate interview (another 2 to 3 months). Since you are expecting for a newborn, your wife will not be able to travel (most airlines will NOT allow after 7th month of pregnancy) and the consulate interview is during the delivery time, you will need to re-schedule the interview as well.

Since you (At least 1 parent must be USC) are USC, it is very EASY for your newborn to be USC, provided you have been physically present in the U.S for at least 5 years.
After child birth, get an appointment with your U.S Consulate to register child's birth (called Consular Report of Birth) and apply for U.S Passport and SSN. It should be ready within 1 to 2 months time.
Also, take child's local birth certificate (both parent's name is important) and all hospital records to the Consulate and required documents.

Turns out my fears were true. I got rejected! On the basis that my application was not fully completed! This sent me into a tizzy because the information is included! -Part C Address is not complete!
When I look at the I-130 Form it is clearly written See Attached!

Then in the following paper I have

Form I-130, Q. 2: Beneficiary's Address (information about your Relative)

And listed perfectly is the address
I am so pissed I can barely contain the rage right now.

ON top of that.. My whole packet got returned to me heavily stapled with a tad of numbers written on the side. And on the I-130 page in question there is a long pen line drawn down the bottom.

I am not sure if I have to make a new packet or what!


On top of that they gave me a receipt number. And returned my check to me.. I cant believe this..

On top of that they kept my passport photos! son of a..


Oh, this is not a good news at all!

If I were you, I would have completed the address in the original I-130 form with all supporting docs and created a second set of I-130 with all copies of the docs and mailed them back ASAP.

You were my land mark in NOA1. Now I started worrying!

So really, not every petition application would go into the same queue, correct? Because if it did, you'd still have to wait the same time (i.e. 4 months) to reach both petitions and THEN the UK one might move faster than the Yemen one. I don't think we have the full picture. It's really a lot of logical conjecture on our parts. What would be the point of priority dates than?

I was following through this thread. Nobody knows what is happening inside the USCIS (At least I do NOT know :-)). All the comments here are logical thinking and assumptions without the concrete factor.

Only thing I know (another logical thinking!) is - there are many USCIS officers in one building. They are like machines. Chicago lockbox dumps the enevelopes (some sent by express mail, others priority mail etc.) to these machines. Some machines are so slow because of age factor, dull factor (whether they had fight with their spouse etc.) etc. compared to some fast machines. Do you need solution how to improve the speed of this slow machines? One is to provide them commission based income - more package processing more commission :-) Another external delays also exist such as background name check etc. No idea whether these packets are added at the end of the queue or in the queue that are processed based on priority date or was it added to the slower/faster machines' queue. My imagination grows at this point of time :-) But, before that let me get some responses from you :-)

Hello,

My wife is currently filling out the DS-230 Form to submit back to the Canadian consulate after she is finished. At the end of the form, there is a section that states not to write below the following line. It looks like she would sign and check off what type of immigrant she is. We need to mail in the DS-230 form to the consulate and i'm just curious if she really needs to leave this blank before we mail it in. If so, does anyone know when she would actually sign the form?

DS-230 Part2 should NOT be signed by your beneficiary. At interview time, CO will ask her to sign on it in front of the officer.

I just noticed on the states website that you have to send in the Employment Letter. So, I got it drafted last night and having my HR dept put it on with company letter head, sign it and than send it back to me. I will go ahead and submit my last 6 mos pay stubs with this too. Since, I have it.

Just the PCC that we are experiencing some difficulties in India but we will get it if not now than when they send the RFE.:-)


Yes, you need to send employment letter. What I mean is State tax record is not needed for I-864, Federal tax transcripts are enough.

Are you from Gujrat? They have PCC problems, as far as I know.

I am from a different state and we didn't have any issues in the past. From the SP office, we got the clearance in 3 to 4 days time (we knew the person in the SP office) and from the Passport Office, we got it on the same day.

Yes, thanks. Actually, I decided not to sent the Birth Cert. So, I sent the I864 (ofcourse signed and dated), tax transcript for 2007 & 2008 and full 2009 info (Federal and State). So, hope that's enough. Just sent out this morning VIA FedEx they should have it tomorrow before 8.30.

As per the instruction, you are NOT supposed to send State tax details. Please let me know how your I-864 goes without the employment letter and current year paystubs.

However, You need to include the beneficiary's original/certified birth certificate in the IV package to NVC.

AVR is 'Automated Voice Response' system. Or you can talk to NVC live operator or email them.

Since you are in NVC stage right now (as per your timeline), you have NOT yet assigned visa#. You have only NVC case# which is your reference in NVC and the Consulate.

Try to give them your and spouse's email ID to the NVC operator, so that they MAY email you the updates. To get the operator over the phone would be slight difficult. But you need to keep on trying until reach one of them.

Check AVR or talk to NVC operator if your case is completed. Also, after 1 week or so, check your Consulate's immigrant visa section (online or by mail/call) if your beneficiary's interview is scheduled or not, by referring NVC Case#. Typically, Consulate will send an interview package to the beneficiary.

You are almost completed and don't have to worry about. Based on your timeline, your AOS and IV packages are reviewed by NVC for a while. Did you get any RFE in this NVC final process? If yes, what was it and did you respond back to NVC? Please update us to get better idea.

Basically, RFE means that you haven't convinced the INSTITUTION that you have a genuine relationship and they need more proof... Since ur past that stage - no worries! :)

RFE is not a pleasant thing in immigration process.

Let me explain with an example. Suppose, you missed to bring your flight itinerary and passport at the airline counter before an international travel.
Person in Counter (PIC): Sir/Madam, we cannot check you in?
You: why not?
PIC: You didn't bring your passport and itinerary.
You: What's your problem? I want to travel now. Travel is my only intention.
PIC: We need some documents for you to travel.
You: I am here personally to travel, then why the documents?
PIC: Can you please step back at the end of queue.
You: you did - this is first RFE

After some time, you reached the front of the line again
PIC: Where're your documents?
You: I don't have any. It is at home
PIC: Please bring them and come back.
This is second RFE. And you lost this flight as well.

Next day, you brought your passport and new ticket along with your physical body.
PIC: Show me your documents
You: Showed them.
PIC: Now you are all set.
Now, you cleared your RFE.

In this process, what did you learn?

I doing this for my stepdaughter so she can come with my wife. She sent me photos for ds232 but its a dress with open shoulder.


USCIS doesn't enforce the dress code in the photographs (Rather they enforce not to wear hats, head-cover, glasses etc.). So you are all set to go.

However, USCIS encourages subject to have a natural expression. Photos may be rejected because of too much smiling and the exposure of the teeth.

Ok, I just want to reconfirm a point that I have seen on this forum a few times. Even though the answer seems consistent amongst all VJers I want to ask it a different way.

It seems that if you are using ONLY the petitioner's income to satisfy the Affidavit of Support requirements, they will compare the petitioner's current income with the Poverty Line for that household size.

The question I have is whether they will use my GROSS income (income before Social Security, FICA and Medicare taxes) or my NET income (income after all taxes).

The more detailed or focused question I have is what document or form or website released by the USA government does it mention that they will explicitly use my GROSS income for purposes of sponsorship requirements of a Family Based Visa?

I am able to "glean" the answer by reading the I864 form (since it mentions AGI more than once) but still I want to see confirmation as plain as possible that they will use GROSS income, not NET.

Did you read the instruction of I-864 completely? It has clearly said that "For purposes of this affidavit, the line for gross (total) income on IRS Forms 1040 and 1040A will be considered when determining income. For persons filing IRS Form 1040 EZ, the line for adjusted gross income will be considered."

Now there is no question of Net Income. If you file your taxes using regular form (which is 1040), use the gross income.

Some people will use 1040EZ to file for their taxes. For them, AGI must be used as Annual individual income. AGI is Adjusted Gross Income which is NOT net income.

You don't have to exactly follow every detail of the template.

Get a regular employment letter from your employer on their business stationery (that has their name, address, contact phone#, fax# etc.), showing your full name, job title, hiring date and annual salary. Then it must be signed by somebody in HR. That's it.

Every employer has their format to prepare this letter.
