I would not put that as umeployeed, just put the starting date and end date of each jobs.

Only if CO would ask wht were u doing between this time then you can tell him u were unemployeed.


Though there is no clear instruction if you can leave the gap or not in the employment history on your DS-230, it is ALWAYS better not to leave the gap.

Some officers may be rigid and others may be flexible!

For example, some people have got RFE leaving gap while filling other USCIS forms. One example is below.

Should this include periods of unemployment too? When the beneficiary was "between jobs"?

23. List below all educational institutions attended.

Should this include "in between" periods as well? For example, if there was a 2 year break between the bachelors and masters degrees, does this need to be filled out in #23?

Now I think I have naturalized in the past WITHOUT the direct interview. I had special consideration and we talked over the phone to naturalize. I forgot to hookup the video tape at my end.

Get your marriage Certificate as Primary document. Get couple of affidavits from third parties who attended the marriage as secondary document. That's it!

Then over a period of time, collect phone history, chat logs etc. and those can be produced at Interview time with your wedding and and other pictures.

When I applied I had not found VJ yet. I read the I-130 instructions and since none of the other suggested pieces of evidence applied to us (no joint accounts, no children together etc.) I chose only to send the affidavits. In addition with Canada not being a high-fraud country I did not anticipate any difficulties and there were none. In fact none of my 10 years of evidence was even looked at at the interview! You need to send what you are comfortable with and each country will present specific challenges.


Exactly what OBX said is what I too followed. Primary evidence was Marriage Certificate. As per I-130 instructions, secondary evidence was one OR many of the secondary list. Only applicable from the secondary list was Affidavits for us. That was more than enough if your application is crystal clear and from a country where the fraud is very less.

At the interview time, my wife had taken wedding album, photos together, chat history, phone details etc.

Anyway, this time we had one more secondary evidence as a concrete proof. It was our daughter's birth certificate.

Only the beneficiary is required to attend. Many filers interviewing in Montreal have attended alone and had absolutely no issues at all. Certainly if the spouse wants to attend they can. My husband (the US spouse) came with me, they allowed him into the interview room and asked him a few questions as well. So if you would like your spouse there for moral support it's fine but not required. Good luck!

My wife lives in Colombia, i am currently residing in Colombia with her, but permanently in Colorado

1.The fee for the I130 is $355.00USD Cant seem to get ahold of anyone who can tell me what i should do as far as the payment because the currensy is different.

2.Anyone know if the meeting I have to have with immigration services could be arranged at the Bogota embassy, or atleast in texas so i could save money on flying.

3.Can pictures for proof be on CD for with the forms that we send in?

I was little worried since it went to the third week for NOA1, due to the below reasons:
1) Complicated I-130 filing since it is for the second time for the same beneficiary
2) Recent address (PO Box) change by the USCIS and I thought I messed it up with some old PO Box
3) My 2.5 years old photograph and I worried if they match it with my 2 year old I-130 file with them
4) Didn't include beneficiary's passport or birth certificate copy as per VJ (my beneficiary had used other names even before the marriage)

Other than that, the application was perfect. Now I am all set with NOA1 and waiting patiently for another 4 to 6 months time, unless there are further issues.

This time, I am little pessimistic than the first time!

It was super clean for the first time with 3.5 months for I-130 approval, 1 month for NVC, 1.5 months to complete Consulate interview - with overall time of 6 months from I-130 filing to Interview.

Normally 1 to 1.5 months for you to get the interview date after NVC completion.

You can check your U.S,Consulate site for immigrant visa appointments or talk to them with your NVC case#, 1 to 2 weeks after NVC case completion.

I have and I-864 question too! I just received my NOA1 and am getting prepped for the I-864. I actually am in the process of filing my 2007-2008 tax returns because I was living/working abroad full-time and was not aware I had to file in the US. Long story short, my income in 2007 and 2008 was less that $15,000 as I was a student back then. But in 2009 it was well above the 125% line and I can get an employer to type up a letter stating how much I make per year, plus I can print off all my paystubs.

Will they have a problem with the fact I made barely any money in 2007/2008? I am also worried my tax returns won't be processed by the time I need to send in all the info, then what? I won't have W-2's because I didn't work in the US, so all I will basically have are my canadian tax returns in which my income will match what I am filing with the USA. Am I over-thinking this?


You should state (also file 2007 and 2008 tax returns. For NOA2 and NVC, you have another 4 to 5 months time from now onwards unless any magic happens) you were student during that period and provide 2009 tax transcript, employment letter and paystubs. Then you should be all set.

If tax transcripts are provided, 1040 is not required. For current year, include employment letter, paystubs etc.

That's sufficient with your W2/1099, employment letter and current year paystubs.

But best documentation is IRS tax transcripts, employment letter and current year paystubs.

I dont think it matters. But why dont u just request your transcript as it is free and then you can send the tax return just as a FYI kind of thingy.



johndoe12 is correct. Get last 3 years IRS transcripts for free and submit to NVC along with other documents. You should get transcripts by mail in less than 2 weeks. If you are in emergency, IRS will even fax them to you.

What story are you writing in the cover letter?

The cover letter, signature on it etc. are all optional, but it is a good practice to highlight the summary in a page called cover letter.

So, you may sign on both the pages, if you wish.

That's what I make at my job, so it's my own income. I get paid bi-weekly, so I figured it out by multiplying my hourly pay x 40 hours to get the weekly amount. Then weekly amout by 52 (weeks in a yr). I am due a raise in March, and that will put me in the range where I wouldn't need a co-sponsor, but I'm sure my fiance' will be going for his interview before then.

I also wonder, since he's only beginning in his working career, he's been at this job for almost a year and this will be his first time filing taxes. Will the fact that he's never filed for taxes before be an issue? I only ask this because I know they ask for previous tax returns.

Anyway, you are showing your last 3 years IRS transcripts, so NVC can see that your son was dependent in it. It should not be a problem, even if your son has only the current year return. Some kind of explanation on a separate paper would be handy to them along with AOS submission.

2009 I-864P states $27,562 for household of size 4. The difference is $2,415.
You have 2 options:
1) If your 20 year old son makes more than $2,415 a year, it is good enough.
2) If you are US citizen, you can show your asset value 3 * $2,415 = $7,245 to qualify.

When the time comes to do the financial proof...do I include my fiance' in my household size (he would make us a house of 4),or just myself and my 2 sons since he and I aren't married yet? Curious to know in case I need to get a co-sponor because I was only figuring in myself and the boys.

I don't know I-864 is the form for K1 process as well.

If yes, your household will become 4 in I-864
Part3, Q# 8 - Yes
Q3 10. 01
Then in Q# 21, it will be added to make total 4.

However, I will pull other's expert opinion on this matter.

Yes, but the co-sponsor in OP's case will be filing I-864, not I-864A.
So she OP is not claiming that the co-sponsor is a household member at all.
And in this case the co-sponsor can be any USC or LPR, 18 or older, and does not have to be related to the main sponsor (OP).

One sec - Wait for other expert answer as well.

I am not 100% sure that the co/joint sponsor can be any other third party, but I MAY BE wrong as well. That's why, please pull other expert opinions as well.

As per I-864A, the co/joint sponsor must be a household member as defined below (So how can a friend be a household???):

1) A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling;

2) A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at the same residence as the sponsor;

3) The intending immigrant - if the immigrant can show their income/asset that will still be continuing even after migrating to the U.S
