Hello all, I just filed my I-130 in July and have no received confirmation from USCIS that they have it via email and I have a receipt number, which I can check online. Now do I just wait and prepare for NVC? Should I call USCIS and ask about my petition every day? Just wondering what people do at this stage, if anything. Regards, and good luck to all.


Good to know that you're in USCIS loop. Now it is waiting game of 4 to 6 months for your I-130 approval. Once you are approved, NVC steps will be started. Now you can start collecting NVC documents slowly.

Calling USCIS everyday is not useful at this stage. You can call them if your petition is not approved even after 6 months.

Cool but i have a question here, in the USCIS website, they say that initial review process is where they do the background checks for the petitioner and the beneficiary too, so is that true or they do the beneficiary background checks after they forward the case to the respective consulate ?


Samoray, As per initial review notes, USCIS can do the background check on applicant/petitioner.

Kruz, I think they don't provide name check clearance details over the phone now-a-days. Only way is fill their form, pay the fee to get the details by mail and it takes few weeks as well. Again, anybody in the USCIS petition pending need NOT to go for this step. This is just another method to know if one is really stuck in the name check. If yes, they can get a copy of their own records from FBI and feel that you are innocent, then consult and attorney to clear this bad remarks from your file.

I know sometimes, the last name of an innocent person might match with the FBI wanted list and they will be in the long wait or even halted in this process. Hope this helps out!

If I am not wrong, than this name check by FBI will be only answered for US CITIZENSHIP cases......


Wherever the biometrics (fingerprint) happens - it could be N-400 finger-print, GC Adjustment of Status within the U.S etc.

Did you call? Give some idea what did you ask and how did you talk?

Also, who calls ? Petitioner or beneficiary ?


I called them 2 years back and they clarified me that our name check completed.

I called today morning as well and was told they don't disclose the name check details other than fingerprint results or so.

Alternatively, we can order our own records from SBI by completing the form and paying the fee, just to make sure. But this is not need to all. If you think you're stuck in name check and want to exactly know the reason, this path would be good.

It is difficult to get your son's original BC back from USCIS. Call them and check with them. If not, better get another original.

Having copies of an entire package is optional, but it would be helpful for any back reference in future or to submit to your beneficiary later at his/her interview time, just in case.

I got told there was an RFE cause on question 30 there wasn't enough space for me to fill out all the places my wife has lived since 16 so they said I needed to fill it back out and attach another sheet of paper finishing it (on the phone) so I filled it out and sent it in express mail with a letter stating what it was for and everything. Should I have waited for the letter? Wasn't sure but I didn't want to wait another few days to get it and then miss the next scheduling time....Thanks for any help!!

Zeban is soooo correct, start ASAP, some countries it can take a long while to obtain. Also check with embassy of where interview will take place, most accept them 6 months to 1 year old, but NEVER take any chances in this immigration process, read, read, read.

Hello, I am new here, my friend is really shy to ask but I was wondering if anyone can give me some insight on this issue he is having. Many ppl have told me different things.. I figured since this forum is dedicated to these kind of issues.. someone could chime in.. .thank you in advance.


1)My friend married a woman in China.. the wife has a child that he wants to bring over. The million dollar question is does the "father of the child" have to sign some kind of "release form for the child ( 14 yo)? This is in preparation for the CR1 filing.


If they have divorced legally, she will know who has the sole/joint legal and physical custody of the child. If she has the sole legal and physical custody, that agreement suffice. Otherwise, she should obtain the "authorization letter" from her ex-husband to take the child with her to anywhere in the world. This has to be executed legally by the court or any other legal system in your country. This is just my opinion.

Somebody from China or experienced this situation will give more detailed info here.

I dont think mine will be done in 3 weeks. Lately its been taking 6-8 weeks for SIF after submitting the DS230. At least according to the latest NVC thread.

Also i didnt submit the PCC, so now im waiting for the RFE so i can use the checklist to obtain it. Hopefully its not another 6-8 weeks once i submit the PCC to NVC.


If you haven't submitted PCC as part of IV package, yes, it is going to be 2 months NVC process for you. It looks like NVC is clogged now-a-days :-)

When did this whole payment portal start?

You mean NVC online payment portal? If yes, it started back in April 2008. I was one of the very few who used this system in April 2008 (or should I say test their online payment system? :-))

Even before that, it was complete mail based, check payment system and used to take at least 3 months to clear NVC. James' shortcut was the first one to overcome this mail delay, but still it used to take 2 months to clear NVC. When the online payment system (with email correspondence) started, it cut down further to 1 month.

We cleared our first GC process in 6 months time from filing to Interview and being lucky in that (3.5 for I-130, 1 month in NVC and 1.5 month until Interview)

Based on your timeline in NVC, you should be done in 3 weeks.

In India, there are still some places where you can 'please' them to get your documents ready. It is not called bribe :-) It is a mutual help so that they can spend it for their day-to-day expenses and our things would be faster as well :-)

I was so surprised to get a PM from my old friend Bani today. She was with us during the immigration journey (I-130) in 2008 and is from the state from Gujrat.

I think she had problems with the PCC from there during that time.

Also very important I have read that you must put NVC number in top left corner is this true? Is there anything else I should put there besides the NVC#?

As Bobby said, cover letter is optional to NVC. But it is a good practice to organize the contents in the cover letter. Just NVC Case# on "top right" (not top left due to stapling issue :-)) of every page of the document is more than enough. Again, this is optional. Sometimes, there will be multiple set of documents for more than one beneficiary. Then it makes sense which document is whose.

will do so, just have been little busy and never got chance to fill the timeline, but my case got a little delayed as I was out of country when my case got approved at USCIS.
After I sent all the documents to NVC it took approx 5 weeks for log-in to fail, I have not got the interview date at embassy yet.
In meanwhile I have applied for B1/B2 which got approved, so might be travelling to US before CR1 is approved. :)


That's great news, Harsh! I am still WONDERING how you got B1/B2! But, congrats you are most lucky charm in B1/B2 case!!!

My wife's B1/B2 rejected last month - 214(b) potential immigrant. She had surrendered her first GC before she went for B1/B2. Now we have started second GC.

Congrats again and utilize B1/B2. Also, please make sure not to overstay your visit in the U.S.

I called the NVC and talked to a lady and she told me the case was complete and now waiting for embassy to schedule the interview.

If not, get your personal record from FBI and see any adverse information is present. And if you feel that this record is wrong, you have to clean it up.

Hello! I am wondering how to track my papers via DHL if I do not have the reference tracking #? I am waiting for the last 8 days since my case got completed but I still do not have my interview date and my case is not appearing on the Manila USEM appointment list. I am thinking that my papers are already in Manila... (crossing my fingers!).


There is no individual DHL tracking. Read my post above in this thread. NVC collects one or more completed cases and sent by DHL as a batch. Normally, Consulate will receive it in 7 to 10 business days and they will add it in their monthly appointment list. Some consulates will create the monthly list once in a month, may be 3rd week of the month for the coming month's list.

You don't have to call NVC now. They will email/mail details to both petitioner/beneficiary.

You can track your case in the above Manila Consulate online link as well.

Normally, 1 to 2 months after NVC case complete.

There are 2 ways you can track in addition to NVC notification.
1) http://manila.usemba...v/wwwh3238.html Check with your NVC case# daily.
2) Tracking by DHL

Listen to NVC's AVR message, it will clearly say “Your case is completed and forwarded to the embassy or consulate in XXX on MM/DD/YYYY…” Once you hear this message, immediately go to DHL Tracking by Reference and track your shipment. For example, if NVC's AVR says your shipment date is 06/05/2008, NVC actually called DHL one day before this date to pick up the shipment. So your reference date is 06/04/2008. Then enter EXP 04 JUN 2008A as your reference in the above DHL website. Then scroll down to your consulate link.

To be sure you can try a date range between 06/03/2008 to 06/06/2008 in the date range.

USUALLY, if you see 'Texas Service Center' in the TIMELINES grid, then
either
--the VJ member did NOT pick a service center (leaving the default 'Texas' data bit there) or
--is a 'Direct Consular Filing' case, not filed to the lockbox in Chicago (is some VJ data error, too, alas).

About the timing - if the Nigerian PCC is only valid for 3 months, when would be the right time for my husband to go get it and mail to me so that I can mail to the NVC with the DS-230? I just am afraid it would expire before the actual interview took place!


I am not sure it is valid for 3 months only! Normally 6 months or 1 year is the PCC period.

If you think it will expire in 3 months, your best bet would be when your case is transferred to NVC. Also, if it expires on the interview day, Consulate might ask for another recent one as well.

In India, to get medical appointment, the interview appointment letter, passport and other details are needed.

Just a note to Debby - Don't open the medical envelope - submit to the Consulate as is, if you are not aware of it.
