My husband and I barely set foot home so I have a cell phone long distance plan with ATT for $4 a month, they charge about .18 cents per minute to call him on his cell. We are using it as a "need to" resource but my monthly bill still comes out to about $80 on long distance calls.

We talk on MSN, cell, forums and e-mails continuously during the day. I probably call him about 5 times a day, and he calls me about the same for short times. Spend an average of 3 hours on MSN per day. I send him text messages for free to his cell phone too. And of course there's Facebook we live there at night trolling/laughing with our friends and exchanging pictures and such.

We are both active members of at least 3 common forums (he doesn't use VJ though lol)

Basically what i did and how i figured this is due is by going to check my online payment, it said PAID
then i clicked view receipt and i emailed myself the AOS barcoded cover sheet. I now just filled out the i864.
Now on the i 864 i can write the current annual household income with the same amount as on the original employment letter correct?
i am submitting the tax transcripts, should i write the mdr number on the originals as well?
on the w2 and everything? literally everything?

Answer:
AOS review payment sheet is the print out of your online payment to review the AOS. It must be included.
Yes, you should write MDR# on top of EVERY document including originals and copies, except the barcode sheet.
Yes, your total household income on 24c will be same same 24a since 24b is NONE

24 d/e are completely blank since 24 a is already filled out. Write NONE on 24 b if you don't use it. Fill up 24 c with total Household Income.

I think I included all my current year Original paystubs and retained the copies in my personal records.

Did you write your NVC Case# top of all the papers including I-864, except the barcoded sheet, AOS review payment sheet and the cover sheet?

If a person provides service for free for full-time (not after retirement, he/she made enough money at their young age itself) like non-profit organization, because of his/her interest. Now he wants to sponsor his spouse. So will he/she write the occupation UNEMPLOYED, CHARITY SERVICE, N/A or NONE? I believe all options other than Charity Service is truthfully lying to the USCIS, even if the person is not paid. And as per USCIS guidelines, any mis-representation to the USCIS could fetch the ban in the immigration process. So scary!

Either way, Sounds like you gotta provide tax reform information for when you declare employment during your affidavit of support form. Does this mean the USCIS understands the definition o employment to be services rendered for pay?

oh no, his entire family is there already. since the 1990s, his dad and mom were the ones who petitioned him and his brothers :)


Ok. Then he needs to meet the below conditions to get naturalized.

Continuous residence - 5 years as permanent resident without leaving the U.S for trips of 6 months or longer
Physical presence - 30 months (2.5 years)

Since he came back in 2009 as you told, he would be eligible to get citizenship in 2014.

So, your best bet is:
1) Get married
2) File your I-130 (somebody told now-a-days it takes 2 years, but this timeframe can change based on visa availability)
3) If your I-130 is not approved, apply his U.S citizenship in 2014 and upgrade your petition
4) You will have GC in another 6 months time after the upgrade, based on the current timeline

This immigration process sucks really. If one spouse is in non-immigrant category such as H1B etc., he/she can bring the spouse immediately with him in H4. Best priority for non-immigrants! If he/she is a USC, he/she has to wait at least 6 to 9 months to bring the spouse. If he/she is in GC status, forget about it. Really sucks!

Yes, he needs to count from 2009 since he had out of U.S status for more than 6 months in re-entry permit.

Is he eligible to apply for it already? He stayed there only for good since 2009 but since 2005 he got his greencard already. he studied nursing here in the Philippines. In order to file for citizenship, does he need to stay in the US for 5 straight years? Please enlighten me because I am not sure of such policy. Thank you so much!

Also, watch out if there is any change or expiry of DS-230 form at the time of actual submission. Some form's prior edition may be valid, but some may not. Watch out that as well!

I believe you are the beneficiary to receive the green card based on your sponsor. I understand like this.

If yes, you can't live in the U.S forever with the visit visa. Your sponsor can file I-130 petition for you. But you need to return to your country before the visitor visa expires. Otherwise, you will unnecessarily complicate your I-130.

Sorry to hijack this thread - but no sense in starting a new one if my question along the same exact lines as the conversation.

I submitted my wife's photograph to the I-130 essentially in April 2010.

Now the NVC stage is here and I will be sending some more photos in the IV package around August 20 2010.

Should I get her to send me updated photos to send to the NVC ? Is there a chance of RFE for this?

Also, for the remaining steps (VFS submission and Interview) will using the same photos submitted to the I-130 petition be acceptable? Or should she get updated photos for sure at that stage ?

You can submit the same photographs. I didn't have any issues in the past since your entire process is around 6 months timeframe.

My concern was I submitted my same photograph with this new I-130 that was same as 2007 I-130 petition. Would that be an issue if the USCIS scans my old file and matches the this photo? I hope not.

My suspicion was slightly different for photo RFE. Anyway, it is ok now, unless they dig my old photograph and match with this one :-)

Your hubby (CR1 holder) needs to file AR-11 within 10 days of move by online or by regular mail.

You and any other sponsors (USC) must file I-865 form by mail and get the Receipt notice by mail back and keep in your file for records.

With regards to Affidavit of Support assembly, James Shortcuts say to put the I864 Cover Letter first, followed by the barcoded cover sheet.

However my barcoded coversheet says: "Please attach this page to the front of the documents for this case
and mail to ..."



What is the correct order?

I know James Shortcuts were created in the past, so it is possible that the order has changed.
I do not want to put the Cover Letter in the front of the package (Page 1) if the Barcoded Coversheet needs to be Page 1 instead.

Does anyone remember what document they put first ?


I put barcoded sheet on the top, followed by invoice payment proof (optional), then the cover letter and the rest of the documents.

When you mailed on 7/26/2010, USCIS must have received it on 7/28/2010. So, you're ok with it. I would say by the end of this week or next week, you will have receipt# aka NOA1.

Don't worry sandipdesai. USCIS changed the new PO Box effective 08/03/2010.

Whoever sent before that is fine. This was my biggest worry, but few other people confirmed it. You know what I got email text today that my application received and got receipt# after slightly longer wait.
