Please can anyone tell me if I can go and visit my Husband now my papers have been sent?


I didn't have any clue if you are petitioner and beneficiary and which papers sent. I am fortunate to have a glance at your timeline in VJ and concluded that you are the beneficiary in London and filed your I-130. Yes, of course, you can visit him, but don't overstay here. You need to leave the U.S before the visit visa or any other visa expires.

Hi Everyone,

My husband is French, but because of his age did not have to do the mandatory military service. I think a few years before he turned 18, France stopped requiring military service. We've asked for proof that he did not need to serve, but the government office keeps telling him that there is no document available. Has anyone else gone through the IR-1 / CR-1 process in France? If so, did you need the military cert? I'm stressing a little since he doesn't think it's big deal.

Is there any problem giving her magic jack? I ask because Magic Jack is likely not registered in the name of the foreign beneficiary, it is in the name of the US Petitioner. So when you submit phone records they will see you are calling a phone that is not registered under the beneficiary's name.

I'm not sure if this is an issue or not, but just something I have been thinking about.

I gave my wife magic jack too - but for some technical reasons it froze her computer, so she gives me missed calls and I call her back.


Bobby, USCIS is not going to look at this minute details :-) If they start investigating all these, I will be approved after 2 years :-)

I gave her Magicjack. She calls me from India to my cell#. I call her using my Reliance line. She initiates most of the calls.

Very similar story to mine.....except I use magic jack......and calls on her cell in usa. (we have 5 our choice of no. free when we call that no. or we receive call from that no. in our cell phone plan)

To use magic jack you need the following:
1. A computer with internet conneciton (DSL/Cable/T1 ect...). This mean that you're most likely use magic jack at home or a place where you can hook your laptop/desktop to the internet.
2. Magic jack connect to the computer. You'll have a local number. You can take magic jack where ever you go (national/international) and you'll still have this local number and you can make/receive calls to this number and it's like a local call.

Hope that help.


Magic Jack device costs $20 and yearly you pay $20 unlimited calls from anywhere in the world to U.S/Canada number.

The source side must have a faster internet connection (DSL/Cable etc.) and the destination can be any phone#.

We use it and it is very clear. Only problem with this is - it is not phone to phone. The source side person must be in the internet to make or receive calls.

Hi LOP - Darnell is right. We have not yet filed for anything in the US for me. We have only filed for him in my country and they denied him because he's not a Schengen zone resident. We didn't think of filing DCF until it was too late (ie. he was already on his way back to the US), besides.... we didn't expect it to come to this. It was never the plan to live in the USA to begin with.

If I understand correctly - doing the AOS being on a tourist visa can be bad IF they deny it, then there's no way to appeal right?


Since you didn't do DCF, your best bet is go for IR1/CR1. But you can visit your husband under VWP as many others did here. Do not overstay and return back to your country while immigrant visa is pending.

he came to her country, applied for immigration status in her country, to be immigrant in HER country, and was denied.


Darnell, From OP, it is not clear if her USC husband filed DCF to bring her to the U.S or they filed for him to immigrate to her country :star:

Hi everyone

I have tried to find posts that outline a similar situation but haven't been successful so far.

I married my US husband in May 2009 in Michigan but I entered the US on a WWP (as a tourist). We did it like this because we never intended to stay in the US. He then entered my country and we started the immigration process here (which is a little different from the US one). He stayed here and worked while his application was being processed. Then after 7 months he was denied and has since gone back to the States. So I guess we have to go to plan B, which is to live in the US.

So I'm wondering what you guys think? Which is better, the K-3 route or the IR/CR 1 route? I also have a daughter from a previous relationship (which was the main reason we planned on staying in my country, in order not to uproot her). So my question is, which route is the better one in your opinion? I just want this to go as smooth as possible and without future problems. We are used to being in a long distance relationship (we've been doing it since 2004) so 1-2 months longer or shorter isn't really the biggest issue. The biggest thing is to do everything the proper way.

Would it be best to have our paperwork from here translated so we can show that the marriage on the WWP wasn't so that I could get a green card or something? I realize that looks kinda bad but we didn't expect him to be denied here :(

AuroraBorealis, Can you please share why his petition was denied when he filed for you in your country, which is basicaly DCF (Direct Consular Filing).

Your best bet is IR1/CR1 filing in the U.S. This is my personal preference.

You can of course visit your husband under VWP as many did, but don't overstay. Get lot of proof handy including return ticket as a backup for any questions at POE. Even if you are denied at POE, you can go back to your country in the next available flight.

Though AOS after coming here in non-immigrant visa category is little troublesome, there are people who did. But, still I don't recommend it.

hi friends, i am waiting for my visa fee letter of $400.I have posted my DS3032 15 days ago.i want to know how much time will NVC take for my visa fee letter.also,after that how much time NVC will take to refer my case to Indian embassy.how much time is left for my interview.plzzzzzz reply me as soon as possible


As per DOS, new IV fee is $404 and domestic AOS review fee is $88.

Once you completed entire NVC process, you will be notified about the Consulate interview. Typically for India, it would be 1 to 2 months. Once you have appointment letter, you can proceed for the medical as well.

I have my DS-230 ready to go. But I noticed there is nothin on the form that allows them to match my form to my case number.

My wife printed out a bar code thing which she has to put on the front of her Affadavit of Support. Should I be printing this out too?

When you pay IV fee, did you get a chance to print out the barcode sheet for this? This is another barcode sheet than AOS barcode, though the NVC case# is same.

IMO, technically all forms starts with 'I' or 'N' are USCIS forms. Forms start with 'DS' are DOS forms. But the fee for I-864 is collected by NVC as per I-864 instructions.

If USCIS asks for AOS fee, then send it as per their instructions. But are you sure it is $70? New fee is $88.

hey guys i got interview letter today for september 7th 2010 at mumbai embassy 7.30am,but my interview case no donot appear on mumbai embassy website.ya i got 2PCC ONE FROM c.i.d Office from chruchgate and for passport office clerance u will get it from passport office worli,passport office celerance fees is RS 300 and they five you in 2days but for police clerance they take lot of time.hey guys if u have any questions i can help you.

Normally they will publish it in the 3rd week of previous month.

I already mentioned that I didn't send my irs tax transcript because of I filed a tax amended 4 weeks ago. IRS cannot issue a new transcript until they have completed processing, which will take atleast 12-16 weeks. Yes I have sent my W2 along with 1040( included bank check image which showed that IRS cashed it). I have sent it 2 days ago. I called NVC today and check the status of my wife case whether they have receive my I-864 or not. They informed that it will take atleast 5 business days to get into their system and told me that my DS3032 havent accepted yet. She said by next week I will hear from them.


If you have sent 2009 W2 and 1040, you are good to go!

OBX & Lotto - how many photographs did you submit with your I130 petition?

The question I have after hearing your responses is why did you choose to include only a small portion of evidence in the I130 petition? In other words, why did you choose to back-load the petition with evidence, and not front-load it.

If you look at the Evidence of Bonafide Marriage Guide, you will see it says to include as many as apply to you.

Would there be some potential problem or issue with putting a heavy amount of evidence into the initial I130 petition?

I put a decent amount of evidence into my I130 petition - including Affidavits, Marriage Receipts & Invitation, & Boarding Passes & Photographs.

In other words 40% of the evidence I have was submitted to the I130 petition and remaining at the interview.



When I applied I had not found VJ yet. I read the I-130 instructions and since none of the other suggested pieces of evidence applied to us (no joint accounts, no children together etc.) I chose only to send the affidavits. In addition with Canada not being a high-fraud country I did not anticipate any difficulties and there were none. In fact none of my 10 years of evidence was even looked at at the interview! You need to send what you are comfortable with and each country will present specific challenges.

Agree with Loto; there isn't anything that will come from USCIS to the beneficiary. As soon as your petition is approved and the case is transferred to NVC you can contact them. You may be able to get through to USCIS but I wouldn't have much confidence that they will follow through. Good luck!

Hey there! My husband and i filed our papers, I'm the petioner and my husband in Canada is the benificary. When we filed for the I-130 he used his sisters address because he knew he was moving shortly after. He is now at his new place and we want to change the address. I went to the USICS website logged in and went to the "change of address" link but all the info on that page seems to be for changing address for petioners. I did see something about the AR-11 but it asks about alien # but he dosen't have one...so im confused. ThankYou! :star:

When your husband reaches the NVC stage he can put his new address on the DS-230.

Thanks for your reply guys. When I check on uscis site my status always says "Intial Review" for past 4+ months. Where do I see the status "Touched"?

The wiki says:

"By logging into the account, take a look at the date that shows next to your case number. If it's changed, you've been touched. "

I did create an account at USCIS.Gov to alert me of any status updates but I did not see anywhere it says "Touched".

You need to create an account, sign up for case updates and add your receipt number. Then any change in the date "last updated" would indicate a touch. This is different from simply putting your receipt # in and checking the status.

I'm new here. I see that lots of people who posted their I-130 processing times have something called "Touched". Just wondering what does that mean? And how can I find out if my case has been Touched? Mine shows "Intial Review" status from last 4 months.

Also, does anyone know which month is currenlty being processed in California Service Center for US Citizens who filed I-130?

Sorry to be the bearer of bad news but an October interview is not likely at Montreal. Waiting times are currently 3+ months post NVC completion to even get a date! You can check out this thread to find others that you can commiserate with while you wait.

As far as the medical goes, in Canada, you will need your interview letter before you can book your medical and there are only 4 panel physicians in all of Canada that you can choose from. One in Vancouver, one in Toronto and two in Montreal.

Yes you can hand write information on the I-130, as long as it is legible.

Yes, you can write on the photographs with a pen; I used a felt pen and pressed very lightly to prevent anything from marking through to the other side of the photo.

I am a Canadian citizen who is on an H1-B visa on till the end of this month, but I recently got married to a USC and filed my AOS last month, I received my EAD Card today but I might have to travel to Canada next month. I heard that I need to file an I-130 to get back in the US, my questions are:

Is it worth it filing a I-130 or should I just wait for my interview to be approved for the Green Card?

If i file the I-130, how much will it cost?

How long does the I-130 take to get approved?

I believe you would need to file the I-131 (Advanced Parole) I-131 Instructions

I do not know how long the process takes but I believe you could ask for an expedite (see instructions) if you need to travel shortly.

You definitely do not want to leave the US while you are in the process of adjusting status.

I am sure someone with more experience with AOS will come along with more detailed info; alternatively you can post this question in the AOS forums.

My husband and I barely set foot home so I have a cell phone long distance plan with ATT for $4 a month, they charge about .18 cents per minute to call him on his cell. We are using it as a "need to" resource but my monthly bill still comes out to about $80 on long distance calls.

We talk on MSN, cell, forums and e-mails continuously during the day. I probably call him about 5 times a day, and he calls me about the same for short times. Spend an average of 3 hours on MSN per day. I send him text messages for free to his cell phone too. And of course there's Facebook we live there at night trolling/laughing with our friends and exchanging pictures and such.

We are both active members of at least 3 common forums (he doesn't use VJ though lol)
