Its been over 8 weeks since I paid the bills.

Now K3 and IR1/CR1 takes more or less same time. Since you have sent I-130 petition, it is IR1/CR1 now.

Wait for I-130 approval (around 4 to 6 months), then your case will be forwarded to NVC. By the time, you need to file AOS and IV packages with them.

Also, read guides in VJ to be familiar with the process.

I thought if the child is born with one USC parent he is an automatic US citizen as long as his birth was reported to the US embassy. Adet, maybe you can check about this information that way you don't have to worry about the I-130 for your child.


That's correct, if the USC have lived in the U.S for at least 5 years before the child birth.

In reading the various posts, on how people filled out the Form I-130, and what items are missing or what should have been answered; and comparing to my form, I realized on the above question, I (USC citizen)answered with my name but left off my children, which would be my husband's (beneficiary) stepchildren. :bonk: :angry: :blush:

My question is...should I worry about this, try to fix it (if possible), will this cause a RFE once I have to fill out the I-864? Any suggestions?

Technically, your husband's (beneficiary's) child(ren) has/have to be listed there. If no RFE, it is good. You can talk to USCIS live person and discuss it.

As soon as your I-130 is approved, follow Ling Che shortcut or the guide I created (http://www.visajourn..._live_in_the_US) to speed up your NVC process. Also, gather all the required NVC documents right now, such as PCC, beneficiary's originals, completed and signed forms etc.

I have applied CR1 visa for my husband in April 2010, received NOA1, waiting on NOA2. I am currently in USA, my husband is in India and planning on staying with my husband in India.

Can someone please let me know if I plan on staying with my spouse, will it affect or delay in visa processing?
Can I change the address of Visa process to India?
What is the form that I need to fill out for the change of address?

Can someone please suggest, if it is possible.

If you don't abandon your U.S address and if it doesn't affect your AOS in NVC process, yes.

Do you have anybody in the U.S to get your approval notice and to proceed all NVC papers? Is your trip for a short term?

What I feel is you are due for your I-130 approval. If you carefully follow through NVC, it is damn fast as well. So, when your NVC steps are done, you can visit your husband and come back together.

But it is up to you.

I am the petitioner.

Question 17 says Information about the alien relative (continued). The way the answer is on my I130 form it says the name of the beneficiary.

This form was filled out by my lawyer (sigh) and now that I read it again I think you are correct. This must be a mistake on the form when I filled it out.

I don't know if this will create much of a problem or not, but the person applying for the visa is my beneficiary so hopefully the DS-230 form will make that clear.


Now you know these lawyers' are smarter than us :-)

If you are the petitioner, Q17 would be your name and details. "It is the husband/wife and children of the beneficiary".

Thanks Skynaut...but I believe there are already threads for May and one for June (I'm in this one), and in my opinion it's best to keep the different filings separate (for CR-1/IR-1 & K-1) since they are different and it might confuse people since different forms, etc. have to be filed for each.

Maybe someone more experienced can comment...If not, well I be posting updates here :whistle:


I saw there are sub-forums for May and Jun IR1/CR1 filers.

I asked moderators to merge the main and sub forums for July filers. Otherwise, there will be 2 separate set of groups for the same month.

Somebody in May and June can do the same.

Well he's not sure about using his sisters address, some trust issues that came up.........but if he can't change it right now, I suppose everything will be okay. I think i'll call USICS on Monday and inquire.


First of all, your beneficiary won't get any correspondence from USCIS. NVC is the one that starts the correspondence to the beneficiary. So, when your case is approved in USCIS and transferred to NVC, you can contact NVC and update the address in their file.

Better talk to USCIS as well.

Hey there! My husband and i filed our papers, I'm the petioner and my husband in Canada is the benificary. When we filed for the I-130 he used his sisters address because he knew he was moving shortly after. He is now at his new place and we want to change the address. I went to the USICS website logged in and went to the "change of address" link but all the info on that page seems to be for changing address for petioners. I did see something about the AR-11 but it asks about alien # but he dosen't have one...so im confused. ThankYou! :star:


AR-11 is used for change of address of the beneficiary after reaching the U.S, if I am not wrong.

During I-130 process, if the beneficiary changed the address, you don't have to notify the USCIS now. When you fill the form DS-230 as part of NVC, you can include the new address.

If the petitioner changes the address during I-130, call USCIS and notify it. (After your beneficiary reaches the U.S, petitioner has to file I-865 for any change of address until your AOS obligation is over. Beneficiary will keep on sending AR-11 until he/she becomes naturalized citizen)

The spelling of my wife's father on the Birth Certificate is Sudesh.

However, everywhere else (G325a, DS230, Passport, Marriage Certificate) - the name is spelled Sudhesh.

Is this something that could cause problems at the NVC? There were no RFEs for the I130 petition at the USCIS, but I am wondering if this is something NVC will ask about.

Accompanying here is "not applicable" to you. I had put NONE and had no issues. Even if you put your name, it doesn't matter.

Hyderabad doesnt process the IV visas only Non IV. My brother got his Visa from Hyderabad.

But my wifes is chennai. OK

Apparently effective august 16th you have to pay VFS a courier charge of 387rps because the chennai consulate will no longer send back Passports in hand with the applicants. That sucks. It sucks!

But aside from that, last question, the RPO has MEA on it, should i get it on the LOCAL pcc too? Need local PCC. and no attestation to the BC right? either of ours? Not needed if readable and original agencies.

I have a quick question, my original and my wifes original birth certificate is torn up and super fragile, i know we have to send those in, do we need to get those attested/ notarized etc?

How about the PCCs do we need to get those attested/stampled?

If not, im going to have my wife send this out tonight.

Torn up is fine as long as it is readable. Both BC and PCC do not need attestation since they are from the proper agencies.

Hope you would get it back in the same shape after the interview :-)

They also told me if i leave the US they would consider me abandoning my I-130 thats why i need this travel permit


What you are talking about is K3 path. What you heard is correct.

Here you come as non-immigrant in K3 visa. Then adjust the status by I-485. Now you can't leave the U.S. Along with I-485 filing you need to file I-131 to travel back and forth. That's correct.

That's your another option.

I think you are confused.

I-131 is the advanced parole or travel document that's filed as part of Adjustment of Status (I-485). This is nothing to do with your CR1 filing.

see thats what i have to find out this visitor visa you mention must be the declaration form i fill out when i travel into the US but how long does it last before it expires but I only have to be there until I get my k131 so I can travel back and forth so they dont think i abandoned my application

CR1/IR1 is designed such a way that the foreign spouse to be in their country during the process and complete the interview at their country before reaching the U.S.

However, some people will use other visas such as visitor visa to come to the U.S for a temporary visit and they have to go back to the country before this temporary visa expires. If the foreign spouse overstays in the U.S, your permanent visa can be banned for the life time.

Nope.

CR1 is immigrant visa. K3 visa was created to bring the spouse faster. But now both CR1 and K3 takes same time.

People familiar with the travel between U.S and Canada will answer it. I think you need to use some visa waiver program to travel, but can't work in the U.S.

I-130 is filed after your marriage.

99.9999999% your immigrant visa (Green Card) will be approved.

You can work only after getting Green Card.

The below is the fastest timeline.
1) File I-130 with USCIS and get approved (4 to 6 months)
2) Complete NVC process (1 to 2 months)
3) Consulate Interview (1 to 2 months)

So, you (beneficiary) are targetting to be in the U.S anytime between 6 to 9 months timeframe to start the work.

I-130 is the common petition for CR1 (Conditional Green Card for 2 years, if the marriage is less than 2 years) or IR1 (Unconditional Green Card for 10 years)

Hi I think I need help to determine the right form to use..I'm getting married to a US citizen in Oct and a few years back I was engaged to get married so I went to see the USA immigration people and from what i was told there was that i had two options 1 I could do the fiance form but I wouldn't be allowed into the USA until it was approved which they said was a min 90 days or 2 I could get married while there apply for a K3 and have to stay there until it was approved or apply for a travel permit that would take 30 days to get but what i can see this is illegal and may cause problems if I left to get back into the USA then I read on another forum that they don't like you doing that but they won't deny your k3 because of it so is there anyone out there that has gone through this thanks

Call NCSC 1 (800) 375-5283 with your Receipt# and talk to a live operator. They will tell if your I-130 is approved or not.

Yes, you can show child support as your regular income. But the evidence is required.

After a few delays on some documents I needed I am finally ready to send all to NVC.

DS-230--- On question #32 I put N/A.. I did this because on form G-325 (I-130 packet) I put N/A for when they asked for employers name for the last 5 years. I want to be consistent in all the forms I am filling out. Does his employment matter at all? he is not bringing that salary here. Really stuck on that!

I'm sure there is something else I just cant remember now LOL:bonk:
