IR-1 / CR-1 Spouse Visa Process & ProceduresRFE red. August 14

Hi All,
I rec. an RFE for more original documents. I sent the originals to USCIS when I applied for a K-3. Since the I 130 got approved first, they dropped the K3 and kept the originals. I'm going to have new original copies back to the NVC next week. I'm wondering if they still have my case on the top of the pile or do I have to start the wait time again?
I've submitted everything and am just waiting for NVC approval. I really want an interview date. Does anyone know what I can expect.
Thanks for any encouragement, this is painful.

If you have submitted another set of originals to NVC, it is fine. NVC needs ORIGINALS + 1 set photocopy of all.

You can also request your originals back from USCIS, just call them to send them back to you.

USCIS translation requirement doesn't say who will translate it, but it says the translator must be competent to do it.

But OP's concern is correcting the wrong date of birth and marriage date. It has to be corrected by the issuing authority.

Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.

The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:

We are getting ready to send in our I 130 and have noticed on her birth certificate that her mothers age at the time of my wifes birth is incorrect. And the day of our marriage is May 21 when it was really the 24th. Being that the documents are stamped by an official translator, will this have a negative impact on us?

Why don't you correct it and send the forms with the corrected values?

IT job market is picking up (you know it, right?) from this year onwards, rates are not caught up as in 2006/2007 levels generally. But in some areas, it is still lucrative. If you are near RTP in NC, there are big shot companies in that area.

ok cool...thanks for info Loto. im the petitioner. i went ahead and typed in all the information that i can type in on the DS-230 and got a couple of copies printed out. i just need to send them to my wife in the Philippines so she can look it over and add any other information that i missed. i also indicated on there that i helped completed the form by typing in the information (like it typed because it looks much more cleaner). will that create a problem?

It will NOT create any problem at all. This is what I also do :star: Mostly (not all) the beneficiaries are not really aware of USCIS and U.S visa procedures and chances are there to enter wrong information. Be safe always! Yes, we have to enter our name and details where it is asking "Anybody assisted to complete this form?"

darnell, i am not sure if you are agreeing with me or not, but maybe i was not clear, I agree with you, there is no need for any original documents at until the interview stage, which is why the beneficiary should keep all original documents.

Gnasher,

If your beneficiary would like to keep the Original documents, you can send all CERTIFIED TRUE COPIES of ORIGINALS + 1 set photocopy to NVC.

Some people prefer to keep originals, just because of the fear if they are lost in the mail.

I would send my wife's originals to NVC and I have done in the past. Nothing was lost. However, we had kept complete set of photocopies for our records.

hey Loto,

im starting to get all the forms (ds-3032, ds-230, I-864) completed and to send to my wife. do you recommend that i print out multiple copies of them to send to her so she'll have original sets to keep for her records?

TravellingNomad, Who's petitioner?

Petitioner will entirely complete and sign I-864. Beneficiary will fill DS-3032 and DS-230.

To speed up communication with NVC, petitioner in the U.S may be "Choice of Agent" assigned by the beneficiary. Then beneficiary can complete above 2 DS forms and mail to the petitioner along with beneficiary's all required original documents. Petitioner will forward them to NVC and beneficiary can collect all those after the interview.

um are you sure his wife sends him the original documents loto?, surely she will need this for her interview, and that link you sent, is what you need to be prepared for the interview, so really she needs to keep all the originals. I am pretty sure she won't need to send her police cert to her husband either.

All he would need our photocopies of the originals, or certified copies.

someone please correct or share there thoughts.

I could be wrong, but i thought the next stage is the usc preparing his tax returns etc, to show he can support her, and he only sends that when they write to him, he will need to pay some fees before sending this. once there satisfied he can sponsor her, then all the information will be sent to the embassy of his wifes home country, where she will attend an interview with the original documents to support her application.

Again someone please correct me if i am wrong.

Rumba, Gnasher has explained about COA. Thanks Gnasher!

Gnasher, NVC will accept ORIGINAL + 1 set photocopy of all the documents from the beneficiary. The other option is TRUE CERTIFIED COPY OF ORIGINAL + 1 set photocopy of the beneficiary's documents. Originals are preferred by NVC. NVC will forward all these documents to the Consulate. In either case, all the documents will be returned after the Consulate interview.

The above documents include PCC as well.

One other thing is, get a complete set photocopy of what you sent to NVC for your records, which can be forwarded to the beneficiary, just in case.

Hi Guys,

I've sent i-130 recently. I know it's to early for this question, but I want to
be prepared for the future. When should I ask my wife to send me original documents
for NVC stage? I'm so confused with all these procedures  I read the link about NVC,
but still a little puzzled.

Also, does police certificate should be from different locations where she was living before?
The one we got just says "Her name" "Does not have any criminal records in her country" It was
issued by the ministry of internal affairs of her country and notarized.

Thanks a lot!!

Your wife elect you as "Choice of Agent" in DS-3032 when you enter in NVC. Normally, everybody does this to speed up the communication. Then, your wife can send all her originals to you.

Here are the list of documents including PCC: http://travel.state..../info_3741.html

What's it like being with your wife for two weeks straight, knowing you won't have to part with her for extensive period of time after another two weeks? It must feel nice.

Most people allow for a month until the welcome letter. USCIS is extremely busy. By the same token, I think State Department is also busy. I'm not sure which one sends out the welcome letter. But good luck, bruv.

2 weeks passed since wife's POE but no Welcome Letter or SS yet :( Any idea how long does it usually take to receive welcome letter for new immigrants?

Many Thanks

2 to 4 weeks. For SSN, you can visit the nearest SSA office to apply one by filling SS-5. You can wait for plastic GC for SSN.

Don't forget to fill out I-865 by the petitioner and AR-11 by the beneficiary, for any change of address till the beneficiary naturalizes or abandon the GC.

Hello everyone

1) Pictures - how many do you think are enough?
2) Regarding joint finances: when he was living in my country his name was on the credit card statement. Is that enough?
3) We lived together here and the address where we lived together is also on the credit card statement.
4) I have a print-out from the national registry here that he was living at this address - but it's just a print-out from the internet. Should I include that?
5) Is this part just a matter of "the more the better"? Or should I keep things moderate?

All the best to everyone - this immigration stuff is no cakewalk :|

Keep in mind that it may very well depend on the country of origin of the beneficiary. Some filers are fine with a minimum amount of evidence, saving additional proof for the interview stage, others do better front-loading their application.

Have a read through this recent thread, some excellent points made here. Evidence package

Also if you complete your profile information you may receive more "country-specific" information and :time:

I meant a long RFE after filing the I-130 can't remember what thread it was in. What I basically meant to ask was regarding photos at a civil wedding and my family not being there but his being there if it is ok. Sorry if I was confusing.

IMO that situation is not unusual at all. Many filers have a simple wedding with few people in attendance. We were in fact married by a local magistrate and had only 4 other people with us.

IR-1 / CR-1 Spouse Visa Process & ProceduresAnother pedantic I-130 question

That bolded part basically sounds like an RFE. If they decide they need the originals, they will send you an RFE to request them. But an RFE is up to an 8 week penalty in processing. More reason to send the originals and keep copies, I think. But, now that I think about it...if I send originals and one copy each, maybe they'll keep the copies for their files and send the originals along. Either way, I've got copies, both alone and as part of the total package copies I'll be making.

I interpreted that to mean they would indicate in the I-130 instructions that the originals were required, but I do see your point. It makes your head spin trying to interpret what USIC really wants. :)
OBXFemaleCanada2010-08-19 18:16:00
IR-1 / CR-1 Spouse Visa Process & ProceduresAnother pedantic I-130 question
I-130 instructions state:

[Copies.
If these instructions state that a copy of a document may be filed with this petition, submit a copy. If you choose to send the original, USCIS may keep that original for our records. If USCIS requires the original, it will be requested.

We did send the originals of our affidavits, however, and never did receive them back. Luckily we did not need them at any other stage in the process.

Good luck!

I agree with canadian_wife! You can wait for your SSN but the DS-2230 "check box method" is reliably unreliable!

Take your wife's passport, birth certificate and filled in application ( SSN Application ) to the local office 3 weeks after POE if her card has not arrived.

Within a few weeks of her POE she should receive a Welcome Letter which will have a receipt number that can be used on the USCIS site to follow the status of her green card production.

Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresEvidence of a Bonifide Marriage???

In all honesty, the only piece of evidence you need for a CR1 visa will be your marriage certificate. If you want to make your case stronger send a couple of pictures and a couple of affidavits from people who know you both and who can say that you have a bona fide marriage. I only sent a copy of our marriage certificate and two affidavits, one from my mom and one from my sister. And no, they don't have to be notarized nor apostislled. I left all other evidence for the interview.

Diana

I agree with Diana.

When I sent it in the past, I just included the copy of our original marriage certificate and 2 notarized affidavits from my parents who attended the marriage ceremony.

Wait a second.. I put question 20 as N/A because Spanish uses Roman letters.. Could it be they wanted me to write the address anyways? The example form had it listed as N/A for her husband.

I left 22 blank... As she is not in the USA

Just put her name for question 17...

19 is see attached...

Q. 15 see attached.. Not on my see attached sheet... This is it huh! Aw damnit!

RumbaBumba, you have so many flaws in your I-130 form. Once you correct all of them and re-send it, you should be fine.

As a general rule of thumb, avoid unnecessary attachments as many as possible and try to squeeze everything in the form itself even if there is little overflow!

Another rule of thumb, answer each and every question in all USCIS forms. If some are not applicable to you, N/A, NONE, UNKNOWN etc. must be used based on the question. Also, though they may not explicitly say it, use all caps. One officer may be ok if one does not follow these guidelines, does not mean other officers would agree with it.

i am in the same boat, just received my rejection notice because of section C: address... the address is there. i don't know what to do.. the only thing i can think of is question 21. i marked N/A since i've only been going there on vacation and not actually live with her. maybe i shouldve put that instead of N/A. sigh. i honestly don't know what to do. so frustrating

What's your timeline?

Yes, you should never write N/A on Q# 21. You should have written the last address that you lived together, even if it is for couple of hours. Any married person will have an address where they married at least, right?

LotofPatienceMaleIndia2010-08-04 20:25:00

On the I-130 Form, I wrote "See Attached." And I wrote the complete Address on the Attached form.

Oh yes, I have the entire packet in front of me as we speak. I am planning my next move so I can move into as what i see can be a VERY LONG Journey!

Your attached sheet format looks great, nothing wrong in it. But usuaully, attachment sheet is used for multi-line items that do not have the space in the main form.

So, I would recommend to create a new I-130 form, fill everything as you did. On the address part, using a black ink (in Capital), write by hand all the details. Even if it overflows, it is ok. My G-325A had overflows like this and had no issues.

Hope this helps you. Since there is no other issues, you can include the entire set back to USCIS. Also, take a second set of photocopies of the documents requested and include with it. The same photos and the check would be ok, as long as they have not yet crossed anything on it.

Good luck!
