Thanks for that Loto. I'm taking it all in. You are right that it seems that every case is unique...makes sense because a handful of people will be deciding your future. Everybody get's a different roll of the dice. I guess I'll sleep on in. I plan to send this package out, come rain or shine, next week. It's all just a roll of the dice though. If you win, then you did it right and if you lose, you did it wrong. That's pretty much how this process feels. Besides the obvious mistakes, there is just no way to know until you get the results.

USCIS has never asked wedding pics, photos of our gathering etc. and I have never sent them. But, I have seen for others, those are requested. So, it is case by case, based on how the the immigration officer is convinced in one's case.

We included the notarised copies of the affidavits with the English translations (originals we are going to bring to the interview!). For organizing the package we used the plastic folder where we put all our evedence in sections to separated plastic files (like this: Link). The total weight of the package was about 6 lbs! And we made it well through both the USCIS and NVC. :-) The best of wishes!

Thanks Loto...I just dread the RFE. It's a heavy price to pay (up to 2 months). What do you think of my idea about sending originals plus a copy of each affidavit? They should "theoretically" submit the entire package to NVC, minus what they need for their own records. I'm just thinking that if I meet their filing requirements by sends a copy along as well, those affidavits might just make it all the way to the consular interview.

Everybody's case is unique. We sent only the copies of everything including Affidavits from third parties while submitting I-130. We didn't have any RFE. However, at NVC stage, we provided all the originals (except beneficiary's passport) and got everything back after the Consulate interview. NVC will forward ALL originals to the Consulate. But I don't think USCIS will forward originals to NVC after I-130 approval. In their instructions, it says USCIS may keep the originals in their record, if you send the originals. It will be pain to contact them to collect the originals back. But, I think there is an option to request the originals back if you contact them.

Again, copies are enough. But if you have more than one originals of the same event (eg: marriage), you may send one of them.

That bolded part basically sounds like an RFE. If they decide they need the originals, they will send you an RFE to request them. But an RFE is up to an 8 week penalty in processing. More reason to send the originals and keep copies, I think. But, now that I think about it...if I send originals and one copy each, maybe they'll keep the copies for their files and send the originals along. Either way, I've got copies, both alone and as part of the total package copies I'll be making.


What OBX told is correct. You will need originals in NVC stage. So, if you have multiple originals of the same, it is ok.

Otherwise, IMO I wouldn't recommend to send the originals to the USCIS unless they requested. USCIS may not send back the originals, IMO.

It is the total personal income. That means your income after all your business schedules such as 'C', 'K' etc. If you are "aggressive" in business deductions, your personal income will be less and will be an issue for AOS.

I have a subsequest question. Since I submitted ALL the papers, the list does not have any document which has an "A" (A = Applicant must acquire this document and present it at the time of the interview.) in front of it.

But still I'm kind of worried about the Custody Paper of my Step Daughter. Although, I have submitted custody document (Stamp Paper Affidavit) which is not a court order though. This letter suggest that the custody paper is accepeted since it has: CUSTODY PAPERS=O & (O=The original document has been received and accepted as meeting post requirements".)

Is a document acceptance by the NVC is final & sufficient? or is the actual Consulate is expected/allowed to ask for additional documents like in this case, a "CUSTODY COURT ORDER" ?

Normally, the documents submitted to NVC will be sufficient to the Consulate. But, Consulate might ask additional evidences, if they want. So, be prepared for it.

If you have court order of your wife's divorce decree and divorce agreement, it should explain who has the custody of the child. If your wife has child custody, there is no problem.

My wife & daughter have been awaiting an interview for the Islamabad consulate in Pakistan fpr the immigrant visa. I just received emails from NVC about their interview date & the list of which documents are reecived & accepted. I am a little confused as far as if my wife & daughter should go ahead & proceed with the doctors appointment for the medical or should they wait until a letter is received from the Islamabad consulate about it? I don't know if Islamabad consulate would always send such letter or if the NVC has already send us the letter is sufficient?

NVC interview confirmation letter would be suffice, generally. Beneficiary's original passport size photos, interview letter, passports, prior vaccination records would be handy. Please check with one of the panel physicians over there.

Here is general ball park, unless there is RFE and/or complications:
1) 2 to 3 weeks to get NOA1 (receipt notice) after I-130 submission
2) 4 to 6 months to get NOA2 (approval notice) from the filing

I am in process of filing I-130 petition for my wife, in form G325-A it asked for employment history, she never worked in US but she did work in Canada for few per diem odd jobs through staffing agency from Jan 2007 to Jan 2010, again she may not worked total more than 6 moths in those six years. And she doesn't even remember the timeline of per diem jobs.

So my question is What should we mention in occupation abroad ? or Should we even mention it ?

Any help from guys with similar experience would be much appreciated.

Some people will have hard time with their IRS tax transcripts to overcome the poverty lines. VJ recommends 6 months paystubs and employment letter for those, as a general guideline.

Out of curiosity I have noticed that many lawyers recommend sending only the most recent paystubs with the Affidavit of Support package. In general I have noticed that they usually recommend using the last 3 paystubs - and then taking another 3 recent paystub set for the interview.

Here on this site however VJ generally recommends using about 6 months of pay stub history.

I just wanted to understand the reason why lawyers would recommend using only 3 paystubs for the Affidavit of Support ?


From Adjudicator’s Field Manual (http://www.uscis.gov...ppafm062706.pdf), the quote is below:

(2) Job Letters and Proof of Income. Pay stub(s) showing income for the most recent 6 months and letters from all current employers are no longer required as initial evidence. The applicant, however, may submit either or both of these items (1) in response to a request for additional evidence (RFE), or (2) with a Form I-864 if the applicant believes doing so would help establish that the sponsor meets the governing income/assets threshold. If submitted, letters from current employers should show dates of employment, the nature of the job, wages or salary earned, number of hours/weeks worked, and prospects for future employment and advancement. It should be sufficient for the employer to say that the employment is of indefinite duration or words of similar effect. Promises of future employment are not required.

It is on an average 4 to 6 months unless no RFE or complex case. You may start calling your Senator now and calling USCIS after 5 months.

This is more a hypothetical gotcha than anything else... and the no application fee doesn't help either

As per NVC guidelines, they will close if both I-129F and I-130 are approved together, and I-129F will be administratively closed. The reason was earlier, the people used to call them to close K-3 path when both are approved together. I was one of them in the past to call them many times to close my previous K-3. In the current trend, most (almost 99%) I-129F and I-130 are approved together. However, there are "very few" exceptions where I-129F is approved way before I-130 approval. For them, NVC will continue the K-3 path and they won't close K-3 path. That was my point.

hey missads, is there any documentation where it says I-129F filing will slow down I-130 path? I am interested to see it. You are almost near to your I-130 approval, missads. And I wish you good luck!

Having said this, I have NOT yet filed I-129F because I don't want to go ahead with K-3 path. It is really pain to adjust the status, paying extra money for it. Now-a-days, I-130 is not at all bad.

each case is different... some K-3's are being processed.
the timelines you provide are only VJ members, which is a small sampling of what is actually out there.

As for your 'bitter experience", you truly dont KNOW that you would have been processed any faster/slower without the I-129F. To compare your case with another who filed at same time, unless they have EXACT petition as you (i.e. same state/country/sex/jobs/ages/background and so on) is just not possible. It can give you a 'guideline' of "what to expect and when", but like I said, each case is different. Even different people handling the exact same petitions inside USCIS may not handle them the same.

Dont mean to ruffle feathers but felt i should speak because it's one thing to tell people the K-3 'may be' closed at NVC but quite another to tell them as 'fact' that it is a slower route to go.


I agree with nab. Mostly, both I-129F and I-130 will be approved at the same time and I-129F will be closed. However, there are cases where I-129F can be approved first. Then NVC will continue K-3 visa, based on I-129F.

Also, it is worth to note that there is NO FEE to process I-129F other than some photocopying and mailing charges.

Please ditch the I-485, it's only for ppl inside the USA (or K-1/K-3 visa holders) and it adds an inordinate amount of time to the visa journey.

Other non-immigrant categories with "dual intent" other than K1/K3 are H1/H4, L1 etc., but those are employment based categories.

As most employment based non-immigrants did, I came here in H1B visa, filed my green card (Labor Certification, I-140, I-485/I-765/I-131). That's a long old story :star:

You don't have to start all over again in NVC. If you want to remove attorney, call NVC live operator and remove him/her. It is that simple!

After getting IIN, your both invoices will be generated. Pay it online. In couple of days, it will become 'PAID'. Then you can print out the barcode.
