I don't have any lawyer. I refer here and USCIS/NVC/Consulate sites for all the information. It has been 11 years to go through this USCIS process such as H1B visa, Employment based Green Card, Naturalization, sponsoring spouse first time, now for the same spouse second time :star: I love to donate fee to USCIS :lol:

4. We need to send her picture? How much? Include one passport style photo of her with G-325A.

Hullo! Any and all help would be greatly appreciated! I'm Canadian and my husband is American. We met online in 2007 and we met a few times in Canada before the year was out. At the beginning of 2008 I went to see him and before you know it, shucks, we got married at the end of 2008. Our plan for quite a while was to move to Canada - we secured an Immigration Consultant, had most of our paperwork together, on the verge of filing. Of course, life's always changing and my husband suddenly got an incredible offer through his work, to have a place in California, on the beach they help pay for. So suddenly we're scrambling to reverse the course of our Immigration. I'm in Canada and haven't been out of the country in about 13 months. Which form do I use and where do I begin the process?

After successful interview, the visa will be pasted on the passport. This is just to enter the U.S, normally within 6 months. At POE, they will put a I-551 stamp which is 'temporary green card', most probably a year or less. Your status as Permanent Resident starts from this point. Then within a month or so, you'll get plastic green card.

Update: Your question is regarding Naturalization (N-400) and not the CR-1 Visa. Based on your status it is possible the steps I told you are not correct as I am not sure what documents or proofs you have to submit for the AOS for a Naturalization case.

Wait for others to respond with more specific information regarding an AOS for a Naturalization case.


No, they completed Naturalization, filed I-130 for beneficiary and approved.

There is no AOS for Naturalization.

I spoke to an immigration attorney as some have asked me to do & she told me that she often hears about these kind of cases being returned back to USCIS after they have been already approved. I informed her of my background of how I met my husband online, marrying him after 1 year of communication (first trip to Egypt & I married), our age difference & she said they cannot deny the petition based on that alone. That they would have to prove that my husband is ineligible for a visa, like having a criminal background of some sorts...She also said, that I can sue them? ?? That she has yet to see a case where she has sued on her clients behalf, where USCIS has not back down...But when I asked her about how much this would cost me...her answer was anywhere between 10,000-15,000. WOW!

Needless to say, she told me that it is a good idea to have my Congresswoman step in if USCIS does not give me their decision on my case review. In the meantime, I have been printing months worths of chat logs, email messages, and cell phone bills to show our continued relationship/communication. I do wonder though, do I need to print every single chat I've saved in my history starting from the first day I met my husband? Do you think this will be necessary??? That will be so much printing & the pounds of paper I will have after that. :wacko:

Yep, SIF = Sign in Failed; apparently it can also mean Shipping Information Form, which is also good news...i.e. the form that's used to send your docs to the consulate. Yes, Zeban's case is unique for now I think. I read today someone else got their case complete in 3 weeks. I am expecting the same. So end of next week, sometime for me. Except next week has a holiday...so maybe early week after...

I totally agree with Kaash on the above post.

In most of the cases, the beneficiary will have their passport issued more than 6 months and need local PCC and PP office PCC.

Now how do we calculate this 6 months timeframe? It is the time difference between the Consulate interview date and PP issue date. By the time most of the people get the interview date, this 6 months will be very well elapsed :-)

And now let me tell you a fact!

We had local PCC from SP office and other one from PP office. You know why?

As per the police records guidelines, the PCC must:
Cover the entire period of the applicant's residence in that area
Be issued by the appropriate police authority
Include all arrests, the reason for the arrest(s), and the disposition of each case of which there is a record.

The one from PP office doesn't state all of those. But the one from the local police station clearly specified all of those and even affixed my wife's picture on it.

It says just the local one. Im still going to get the local PCC, ive come this far, might as well.


Now you know the discrepancies between NVC, New Delhi and Chennai :-)

Of course, it is NOT NVC, the Consulate issues the visa after verifying their local requirement of documents. Otherwise, they will put in AP (Administrative Processing).

Since your case completed today, Consulate will receive your case in 2 weeks. Normally, they publish the October list in the 3rd week of Sep (there may be a second revision of the list in the last week of Sep as well). Meanwhile you'll have NVC notification. Beneficiary will get the notification as well. As soon as you have 'appointment letter', you can proceed with the medical. Visit VFS office within 10 to 15 working days of the interview date.

by the blessing of God my NVC case has completed. I sent in all the documents on August 24th, and case was completed by September 1st (alhamdulillah) They said that i wont be scheduled for an interview in august but to check back after the 2nd week of september if i will have an interview in October. They said Chennai Consulate is a limited capacity consulate. So i dont know what that means. anyone?

It is not limited capacity issue. Since your case completed in the beginning of Sep, your scheduling will be in Sep for the interview in October. They want to make sure within this '4 weeks time', they and NVC has to send out all the documents for medical and interview to both the petitioner (if P is COA) and the beneficiary. Then the beneficiary has to approach VFS and then complete medical before the interview. That's all!

Your interview date would be the first week of Oct, most probably. Do you want to bet me? :-)

Gosh, I wish it was that simple with my Husband. I actually think his whole office thinks it's this easy. It would've been so if friend's did not take forever to get me their affidavits and then send things to me. I swear it feels like this whole package has taken 5 years to complete on its own! Ahahaa! It's so very discouraging and I'm worried I won't get to see him at all until this whole ordeal is over. It's comforting to know I can come here for help though...

You guys have an open option to visit at least and the cost to travel between Canada and the U.S is pretty cheap as well. :)
Think about others who are in a distant country, no visit visa and stuck for many more months to meet their beloved until IR1/CR1 completion. :devil: Only option for them is the petitioner to take the vacation and visit them in their country :star:

Hi fellow VJ members, April 8 was our NOA1 date, which means September 8 will be the 5 month mark. I believe you can start to inquire about your case at that time as that is the average processing time that is listed on the USCIS website). Does anyone have any advice on what to ask them and/or which number to call at USCIS?

We are also thinking of contacting my husband's congressman to see if they can help expedite this case for us. My husband has been Active Duty Military for 23 years; he is from Illinois but currently stationed in Texas. Should we contact the Congressman in Illinois seeing as that is where he holds his voting status thing?

Any suggestions or insight would be much appreciated :)

Clair, Then why didn't expedite your I-130 approval? Since he is in 'active duty' in military, you can expedite.

Call USCIS customer service# at 1-800-375-5283 and try to expedite.

Hi Everybody:

just to update you on my case. My case was transferred to SF Valley regional office and as soon as i got the letter from them i book an info pass online to go downtown and find out whats going on and when will be the interview. encouraged by Loto i shook off the unesiness and birocracy fobia and just went there by myself. as i arrived they made me wait few hours in room 101 and was watching cnn and play w my iphone. so they call me to the window around noon and tell me what alredy states the letter ive got. i tell them ill be leaving the country and i dont want to miss my interview and been waiting and so on..

so they make a phone call and lady says you want to upstairs now? i say sure why not. i want another 2 hours there and was alredy afternoon had to call work to take whole day off. then an officer comes out and i go in and gee raise the hard swear tell nothing but truth and i was in the middle of interview..

was not pleasant in any way. many questions dated like years ago go and forth some things i could even remember anymore clearly. why it was quite intense and exhausting they didn't really cross any lines and be insulting in anyway. the problem was apparently that i got married to quckly after the divorce was told at the end and my I-1330 got approved. ill never forget that day. was almost 4pm, didnt eat the whole day was sent home in the mid of the day to get more evidence etc..


anyway, case was sent to NVC god bless. i am traveling to phils on 10/08 hope i can finish NVC part by then. shouldnt be a problem we have the original docs and i have a job taxes are paid.
