I had a similar situation when I sent my application to Chicago lockbox. People used to get NOA1 in 2 weeks and it went to the third week for me. I sent and email to Lockboxsupport@dhs.gov with all the details (obviously without the Receipt#). On the day, I received the email about acceptance of I-130 since I had completed the form G-1145 with I-130, check cashed next day and got hard copy of NOA1 3 days after it. This week, I got the response from Chicago lockbox to my original email that they are unable to locate my application. I just 'laughed'.

As Darnell said, there is a 'procedural glitch' with Chicago Lockbox. The reason was they changed their P.O Box on 08/03/2010.

I'm always 'stuck' about G-325As for children - sorry, no help there :(


I know it is an old post, but may be useful to others.

It says G325-A is needed for the spouse. But there is no harm to fill it out and if not needed, USCIS will trash it.

For child in the wedlock the below are also needed.

A child and you are the mother: Submit a copy of the child's birth certificate showing your name and the name of your child.
A child and you are the father: Submit a copy of the child's birth certificate showing both parents' names and your marriage certificate.

I think in the OP's situation, he can continue filing I-130 and expedite or go for CRBA if USC parent has lived at least 5 years in the U.S and OP prefers to make the child USC as well.

NVC doesn't mandate this document in their checklist. You 'may' produce it to the Consulate.

I am not sure about if the father is NOT listed on BC. Contact your consulate about this issue by email. Follow what they advise and keep a copy of Consulate's response as a proof as well.

Technically, you need the "sole physical custody" of the child in the "divorce decree" or "court order" or "executed by the other parent legally", to take the child anywhere in the world.

Loto, why do you have to sponsor your daughter on a CR-1. Is it not possible to do Certificate of Birth Abroad ?

Anyhow, its funny I was actually reading this document over the weekend. It has a lot of good information. I will probably take my wife to all the places listed in this guide (library, etc) after she reads it so she can get a feel for things.

Oh girl, those clips are really optional. USCIS is NOT going to deny your application, if you don't bind it using those clips

I used regular paper clips to combine everything, individual multiple page forms/docs were stapled together.

WOW!!! ok, I will put NO. on question 16, first page of 1-130. I figure that proceeding must mean something else.
Would my alien # be on the old passport visa? There is a number there. I abandent at the Maine border. I turn the card in because the guard told me I had to, because I was going in Canada to seek medical help. You cannot have two addresses to use the medicare card, it is called fraud. We are hurrying before the year is up. It will be one year on November 13,2010 since I left the USA.
If you don't mind me asking, what happened that you and your wife is going through the same thing. I truly understand how hard it is, we are in the same boat. I hope we can help each other.


The number on your passport is NOT A#. You will have to check your welcome letter etc. to spot this A#.

My wife was also in CR1 in 2008. She was with me in the U.S for over a year. She wanted to do some higher studies and left to India. We didn't take the re-entry permit as well. She abandoned her GC at the Consulate in India. Now she is ready to come back. So, we are filing an entirely new petition. I know it is a painful process to re-start again.

It was a CR1, my interview was in Montreal sometimes in April 2009. I entered the USA on July 19,2009, I left and abandont on Nov 16, 2009. No, I didn't take a re-entry because in Canada you cannot have two adress to use the medicare card. I was explain that at the border when I cross over back in Nov, 2009. My husband and I file our first 1-130 back in June 28, 2007. We married in the USA on June 16,2007. We had no problem being approved.
I do have the old passport with the old visa in it. It is expired for sure. I cannot remember my alien resgistration number which was given in the mail sometimes in August of 2009. Is that enought?


You are in perfect position like us! You also abandoned the GC same like my wife.

Now your petitioner has to file entirely new I-130 form. Never put YES to Q#16. You should put NO.

Section D: Q#2: YES. Name of the beneficiary, place is which service center. Filing is previous I-130 filing date. Result: Approved.

You need to somehow retrieve your previous A# which may need to be filled in G-325A.

Where did you abandon it? At border or in the Montreal Consulate? Did you file I-407 as part of the surrender? Did you get a copy of it?

I think you also had previous GC.

Questions:
1) When was it issued and expiry? Is it CR1?
2) Did you take re-entry permit?

I was process in Montreal, is that what I put and the date of the interview? Q#16 is such as removal, deportation etc. of the beneficiary. If that's not the case, put NO (very important)

It was approved, do I check-mark the approved section? Also second page section D other information question 2. The answer is yes, place? and the date of filing and results? What is excactly the date of filing mean? Date of filing means when the first I-130 was sent to the Service Center.

If she didn't have the intention to marry you while entering in visit visa, she may do adjust the status. Check the I-94 stamp and the expiry date. When you file I-1485 (AOS), the overstay part is over and I-94 is immaterial.

BTW, as kruz said, how did you get U.S passport without Naturalization certificate, if you are not a natural citizen.

- To proove our bonafide marriage, we will have pictures, chat logs, emails, phone and restaurant bills, plane tickets, our marriage certificate but we have nothing in common like bank accounts or property since we never lived together. Are our proofs sufficient ? Can our case be denied because we never lived officially together ? We really don't want to have any issues.

Get as many documents as possible to see the evolution of the bonafide relation. Prepare 2 notarized affidavits from the third parties.

However he can provide all the W2 he have and his bestfriend agrees to be the co-sponsor. Will it be a problem ?

That's not a problem. He will file I-864 and his friend will file another I-864, provided his best friend should be able to entirely overcome the poverty line including both of you and him and if he has any other dependents.

I spent almost an hour doing the post mortem of my I-130 Receipt#, but failed to pin point it. Any experts here to help me?

It is EAC 10 903 N XXXX

EAC - It is Vermont Service Center prefix
10 - Fiscal year 2010 (Oct 09 to Sep 10 is fiscal year 2010)
903 - Julian date starting from Oct 01, 2009 of any working day (no holidays, no Sat&Sun)
N - Constant based on LAN, Mainframe system etc.
XXXX - Serial# of the case on this day

My Filing date is 07/21/2010. Notice Date is 08/09/2010.

In any case 903 doesn't match either Filing or Notice date.

Is this notation applicable to I-130 cases?

- LPR Applies for I -130 for spouse
- I-130 approved
- LPR becomes USC.
- NVC has not acted upon approved I-130 because of lack of Visa number.

Don't we have to upgrade with NVC to have the approved I-130 treated as Immediate Relative of USC ?

If you become a U.S. citizen while your relative is waiting for a visa, you can upgrade your relative’s visa classification and advance the processing of that petition by notifying the appropriate agency of your naturalization. When you are a U.S. citizen, your husband or wife and any unmarried children under age 21 will have visas immediately available to them.

If you become a U.S. citizen after your Form I-130 petition is already approved and it has been forwarded to the State Department’s National Visa Center (NVC), you should notify the NVC that you have become a U.S. citizen. Requests to upgrade petitions due to the naturalization of the petitioner should be sent to:

I understand that I have to file separate I-130 forms for my wife and her child. The question is what do I include in the Childs I-130? The checklist says to include the payment, cover letter, I-130 form, G-325 forms for me and the child along with passport type photos. Do I have to include my marriage certificate to her mother, my divorse decree and evidence of a bona fide marriage since this is already included in the mother's I-130?

In addition to all the above documents add:

Submit a copy of the child's birth certificate showing both parents' names and your marriage certificate.

If your petition is based on a stepparentstepchild relationship, you must file your petition with a copy of the marriage certificate of the stepparent to the child's natural parent showing that the marriage occured before the child's 18th birthday, and copies of documents showing that any prior marriages were legally terminated.
