The amount is basically before taxes as on your employment letter. I hope you are in W2.

I know you are filing for your wife. So your household is 2. You need to show the income above $18,212.

Since you are the beneficiary, 'Status as Permanent Resident' is also correct. My wife filled it like you. No worries!

Your husband need to check 'Others' and specify for wife's I-130.

You are a May 2010 I-130 filer. Get the apprvoal first, finish NVC stage and then the interview. It is really not as 'ugly' as you think.

What was the crime? If it falls under 'moral turpitude', then you need the waiver. I had two DUIs over the course of my life (young and stupid) and, although they are a criminal charge in Canada, they did not fall under moral turpitude and thus I did not have a problem, other than needing to get the court documents.

We are in the middle of preparing the waiver because my husband was convicted of a crime three years ago, so we know he will be denied. And yes, we are hoping to have it all done in time for the interview, so that we can then hand it over right then and there. My lawyer confirmed what I had already researched - that the hardship must be on me, and in fact, my circumstances are quite difficult. He sent me to the forensic psychiatrist to have a report written to support my case. I can't explain why at the end of the appointment the psychiatrist suddenly decided it was necessary for him to do an in person interview with my husband. No mention of my husband having mental problems because he doesn't. So, it seemed very sureal at the time, and I certainly also got the idea that he was looking to have a nice little trip on my dime (my last one in fact!) - or as Neonred said, "a new Beemer."


Yes, then you need a I-601 prepared for his interview.

Hardship waiver is prepared by you (petitioner) and has to clearly show that you can NOT leave the U.S AT ALL and his visa denial will separate the family apart.

You need to list your strong points very clearly on this hardship waiver letter.

I don't understand why forensic psychiatrist needs to visit him. Try talking over the phone would suffice. Otherwise go for another guy.

I am still in a bit of a shock after meeting with a forensic psychiatrist the other day. Made the appointment at the instruction of my immigration attorney with whom we are preparing an I-601 Waiver application. The result will be to prove extreme hardship when my husband's visa is denied. Bad enough that it cost $800 to have this guy write a report, but at the end of the appointment, he suddenly determined that he should fly to the UK to interview my husband and do a detailed biography on him, all for the "low" sum of $7500 plus airfare and hotel. Holy cow! This will wipe me out completely and I seriously doubt the necessity of it. Has anyone felt simalarily taken advantage of by one of these "experts?" I told him I would discuss it with my attorney. Thanks.

Did you or your attorney mention in DS-230 that your husband (beneficiary) has any psychiatric problem?

Hi everyone,

Its nice to know that we arent the only ones in limbo or on forever waiting mode. Its been to long for us since we have gonne an update. Both of our applications have gone past the 5 months processing time and still no approvals for either. What most worries me is that the I-130 was transfered to a local office (Oakland Park, FL)when most cases get approved at the California Service Center. Anyone has heard of this or in the safe situation as us? All replies are greatly appreciated.

He has a job interview this week and we are wondering if he is okay to apply for or accept the position if he has not received his social security card yet? Also, is there any additional documentation that a CR1 visa holder needs in order to be employed?


He needs to fill out I-9 form. He can just convince the employer after the interview about SSN will be ready soon and to wait.

Today is my and my hubby's final reunion here in USA! We haven't seen each other in 5 mos so I can't wait to see his face at the airport and kiss him.And most of all-start our life together like everyone else,without cameras,messengers etc

Nope, however, if you want your green card in your married name, change your passport. Green card will be issued in the name on the visa, the visa will be issued with the name on the passport

if you intend on changing your name, doing so (with your passport) with save you headaches, additional fees, time if you do it in your home country vs. in the US

They should know :wacko: but they will also likely ask you of your marriage date at the interview. They asked us and at the time my husband and I both thought they were just testing us. However, after the interview I figured they were double checking whether we were CR1 or IR1 eligible. You can always confirm with the interviewing officer at your interview if they do not bring it up. Yay no ROC and $$ saved. Good luck!

Hello All!

My case has been completed at the NVC. I got the email stating when my interview has been scheduled for. I have not received the instruction packet that states what documents the Embassy will need, but I found the form on their website and basically all I'm missing is my medical. My interview has been scheduled for late October, but their website says that if you have all your paperwork you can call them to let them know. I plan on calling them to ask if they can move my interview. What I want to know is: do I HAVE to wait for the packet before going in for the medical? Or can I go in for the medical eventhough I don't have the packet? I asked someone who has taken the medical and they say it's pretty much the same for everyone.



Not sure if it is different for your particular location but all I needed to book my medical was a copy of the interview email. Good luck!

The Newark transfer is strange. I assume you are a USC, not a green card holder? Is there anything strange about your case, so that they may want to schedule an interview with you, the petitioner, first? Such as criminal convictions, previous filings for spousal visas etc...

The only other thing I can think of is that they somehow think your wife is in the USAbased on info you submitted...


Yes, I am USC and no prior convictions or filing for spousal visas.. I think I better call them. I am thinking the same thing that they somehow think my wife is in the USA even though I haven't submitted the form I-485.

I am new to this forum I need your help with something. I got the following message from USCIS for the I-130 petition I submitted for my wife who is never been in the states;

"On February 4, 2010, we transferred this case to our NEWARK, NJ location to conduct the interview that is a standard part of processing this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. You will be sent a notice when the interview is scheduled, or if the office needs something from you"

Don't they suppose to send this to NVC instead of Newark?? Is this a normal procedure and what interview they are talking about? My wife is in Turkey waiting for the approval.

They requested the missing documents with email, they did not return the whole document


Then you can send only those missing document completed. Please make sure the right address and a covering letter explaining the situation. Don't forget to highlight NVC Case#, your I-130 Receipt# and any A# if applicable. Also write the full name, DOB of both the petitioner and the beneficiary.

Check with them exactly what it is for. APs will normally clear in couple of months and some have taken up to a year.

Since they have collected your passport, it may be a good sign and shoudn't take much time.

Do you have any agent in the Consulate to send the passport and visa back? If yes, talk to them and pay their fee to return it back.

Howdy Everyone,

My husband and I are filling out the I-130, but we have a few questions regarding Question 18: Address in the US where your relative intends to live.

Brief Background: We currently live in Scotland and have for over two years. Before living in Scotland, we lived in Washington, DC for approx. three years. My husband was on a work visa when we lived in DC and when it expired we decided to go to Scotland. While living in Scotland, we returned to my home state, Texas to get married. I am a resident of Texas, therefore all my mail, etc. goes to my parents house in Texas.

I have two questions:
1) We were hoping to move straight back to DC, but I have to prove "domicile." Does this mean we need to enter my Texas address for Question 18? I feel like that might be the safest bet, but is there any way we can move straight back to DC? We have friends who have offered to let us live at their place when we move to DC and find a place of our own. Is it feasible to put their address down too?

2)If we have to go to Texas first, how long must we stay there before we can move to DC?

You can put Texas address. There is no restriction where you actually live. Make sure you get the GC and SSN at an address which is reliable. Also, change address (both petitioner - I-865 and the beneficiary - AR-11) with USCIS whenever you move.

We filed our i-130, i-485 and related forms as a package on 08/12/2010 and received the letter saying that they had been arrived at the Chicago Lockbox. We're currently waiting for our biometrics and interview times. My husband travels for work and needs to know in advance how quickly he'll need to be back here at our Service Centre for the interview. How much advanced notice will they give us for our interview?

(i.e. will they tell us a 3 days, or 3 weeks before when our interview time will be?)

I have a question regarding Immigration and Taxes.
I was married June 24 to my Senegalaise husband and am filing the I-130 for him now. I have begun to gather the info for my affidavit of support.

My past history:
I was previously married and my divorce decree was finalized early this year 2010 after a 5 year separation. I lived alone supporting myself as a teacher, yet I still filed my taxes with my ex husband. My ex claims his elderly mother whom he cares for as a dependent. We are in the process of filing our 2009 taxes jointly now (all be it late) since we were still considered married in 2009.

My question:

Is it putting things at risk to still file my 2009 taxes with my ex husband? Nope. As of Dec 31, 2009 you were married with him.

It is legal and lucrative but I'm not sure how it will fit in with my petition when the G-864 comes around. You can pull Tax transcripts from IRS for the last 3 years. It is free.

If I do file with him, how can I clarify that his mother is no longer a dependent under my financial umbrella (since they do ask about dependents per question #21e)and that he is not a factor in my annual income? You file I-864 this year. So his mother will not be your dependent.

I have been independant for several years and hope to convey that I am responsible for the support of my new husband.

I would appreciate any help or direction you can give me in order to resolve my concerns.

Why do you have to send a copy of the passport with the I-864 ? I thought this was only required when you have a joint sponsor, but not required if you are the only sponsor.


Bobby, the copy of U.S passport is completely optional.

But the guide says the sponsor must be at least 18 years old. So I though it wouldn't harm to keep a copy of it. Basically, it makes most sense for the co-sponsor who has to prove this 18 years of age.

You don't have to send the form. It is waste of one mailing to IRS.

Call their number at 1-800-829-1040, then follow the AVR. You will have all 3 years transcripts by mail in 2 weeks.
