So am I right in thinking the address she must put for her residence on the I-130 is her current apartment address? Or her parents address? Do I need to include a note to tell USCIS where to send mail if it is different to her current address? I didn't see anywhere on the form for a mailing address.


She may put her current residence as long as she is sure she would get USCIS communication by mail. There is only one address in the form, yes. I am not sure the letter would be good enough to inform them.

Hello everyone!

This is my first post and my first experience of immigration :)

I recently married my wonderful USC wife over in the good old USA before returning back home to the UK. We have both decided we don't want to be apart any longer than we have to and so she will be filing the I-130 to bring me over to the US soon.

I do have a couple of minor concerns. Firstly, she has just recently moved out of her parents house and has taken up a years contract in a student apartment (we figured we'd allow a year before the CR-1 visa would be issued). Does correspondence from USCIS etc have to be sent to her current address? (address she will have to put on I-130). We would rather have mail sent to her parent's house (Her permanent address)

Secondly, I understand USCIS must know where I'll be living once i arrive in the US. We have worked out I shall stay at her parent's house while we find an apartment for the both of us. Will this be a problem? Do we need a tenancy agreement for the both of us in place beforehand?

First of all, good luck for I-130 filing!

Second of all, you don't have any problems where you live, but make sure your wife gets USCIS mails. That's all. You can live wherever you want.

If there are no wages earned then the OP just needs to be sure that the complete return (including a schedule C) is submitted as a self employed person. The numbers that the OP states look to be good. But only the adjudicator's opinion counts.

Each case is different. If the CO wants to see more, they will request more.


This is what I am also thinking. Even though NVC passes it, CO is the one who makes the final decision.

no wihholdin taxes or ss taxes for none of us, on line 22 of our 2009 tax returns says that I have 16348 while my sister have about 11513 dollars!
together they equal more than $27,562. I think I'm safe! this affidavit of support is the hardest paperwork for the whole journey!!!

Do you have any other assets such as home, bank deposit, stocks etc.? You definitely will be needing this year's employment letter from both of you and your sister for sure. It has a specific format that must outline "Dates of employment, the nature of the job, wages or salary earned, number of hours/weeks worked, and prospects for future employment and advancement. It should be sufficient for the employer to say that the employment is of indefinite duration or words of similar effect." and it must be signed by the employer with complete details of the employer.

If you and your sister have filed IRS form 1040 last year, check Line# 22 of it for both, total it and see how much is the combined total.

yup! my sister's orderin her birth certificate! and yes it's a i-864A! she has a daughter as a dependent but only me, my husband, and my son and of course my sister count! we are above 125% of the poverty line! everything's ready! just waitin for the dang NOA2 now! Couple of things for you:

1) Your sister's dependents need not be entered as household. Only your sister will be counted in your household + you + your beneficiary + your any other dependents
2) Your sister's proof of age (birth certificate, passport copy etc.) is a MUST. A sponsor or co-sponsor must be above 18 years old.

thank you! both of us have employment letters (i have a self employment letter I'm a nanny that makes about 16 thousand dollars in my last tax returns) and my sister have a self employment letter as well (from her boss statin that she gets paid about 13 thousand in cash and 300 dollars as monthly bonus.

I suppose that's enough?


Then you are all set. Provide the employment letter as well.

You will execute I-864 and your sister will execute I-864A (Hope both are in the same address). You can combine both persons' income to overcome the poverty line threshold. Household size will be you, your dependents, your beneficiary, your sister and her dependents.

What does a strong income mean? And what is a weak income in contrast? Do I have a strong income if I made the same amount for the last 4 or 5 years?


Strong income means the income very well above the poverty line thershold of one's household size.

NVC isn't the biggest worry. It's the CO that will be conducting the interview and evaluating the Affidavit of Support. Depending on the cosponsor's level of income shown on the 2009 tax transcript/return, they may want to see proof of current income for the cosponsor. An employer letter may be helpful.

With the current economic downturn the CO's are being more vigilant regarding sponsorship.

You should seek input from other members that have petitioned for spouses at the Tunis embassy.

theladynthetramp, as part of initial submission of AOS, you may exclude the pay stubs, if your last 3 year taxes are super strong. However, if the last 3 year taxes are little shaky, they might issue an RFE to produce the pay stubs and the employment letter.

I am preparing the affidavit of support, I have my tax returns, but as I am self-employed I don't have pay stubs. the joint sponsor is my sister, and she gets paid in cash as wlel, but she has her tax returns as well with no paystubs either. is that gonna be a problem at NVC? or I should just write a letter explaining why there are no paystubs?
did anyone send the affidavit of support (I-864) without paystubs and got his completed with no RFEs and no problems? do you know anyone who did?


theladynthetramp, how strong is your and your sister's last 3 years income? If it is really strong, current year paystubs and employment letter may be optional, as per the Adjudicator's Field Manual for AOS.

BTW, Do you or your sister withhold the quarterly income taxes? Some self employed folks do this.

yeh, he's workin on gettin the doctor's letter from his country! but obviously he cant do the medical treatment unless he is in the US, and he needs me by his side right after he goes through the surgery! maybe i should contact the national service center number? we are just paranoid about the interview! you know he has to go through a medical exam and all..I'm afraid they would tell him he needs to have his surgery at his homeland before he is given a visa..what do u think


USCIS wouldn't advise anything. They may or may not expedite your case. That's all!

My husband (who is the beneficiary) needs to have a surgery on his back, after this surgery, he needs to rest layin on his stomach for 3 months, therefore he can't work and he would need me to take care of him! does any VJ members think that we can qualify for an expedite? and if yes, would his medical condition affect the interview? affect him in a way that it would not allow him to get a visa because he would need a surgery first?


You may try with sufficient documentation. Why don't you try like this? Get the doctor's letter from his country and do the medical treatment in the U.S using your health insurance. Sometimes, it works!

Not your wife's brother also.

Other people of beneficiary are beneficiary's minor sons and daughters that could be her child(ren) in your wedlock or her child(ren) in her previous marriage

jjjdddlll - you cannot add your mother-in-law to the petition. In fact, you cannot petition her her at all. Your wife may petition for her mother when she becomes a citizen!

Yes, you can file your mother's I-130 exactly same like your wife. Write a special note when you filing I-130 for your mother's to process with your wife's. USCIS may or may not combine both.

It is totally a separate petition, not within your wife's I-130.

Filing CR1 will take only mailing time.

After filing, the ball park of the timings below for most of the case:
USCIS - 4 to 6 months
NVC - 1 to 2 months (if proactive)
Consulate - 1 to 3 months

USCIS VSC told me I do not qualify.

My criteria was:
1) This is my wife's second I-130 (she had GC before through me, but surrendered sometime in the past due to her long absence in the U.S)
2) Our new born USC daughter needs better medical care including vaccinations here in the U.S

Opening SR is really good if one is passed 6 months timeframe. It wouldn't slow down anything. Since you filed on 03/30, your chances are very very high to get approved in couple of weeks time. Engage a congressional enquiry as well.

There is no such trick :star: If we see some more approvals from like this, we can conclude.

Currently CSC is handling bulk load of I-130 petitions. VSC handles very very few I-130s and I think VSC more concentrates on other types of petitions that include TPS, EAD etc. If a person is really lucky enough in VSC with the right I-130 adjudicator, the miracle can happen.

I mailed mine into CSC 105 days ago and I am still waiting. Yesterday I started a discussion about why some petitions are approved quickly and others are not and if the country of the beneficiary matters. I would gladly pay a premium to have a decision now.

What are the factors in getting a speedy or slow decision?


Unfortunately premium processing is available to some employment visas etc. :star:

Even I pray for USCIS to introduce I-130 premium processing soon :lol:

Generally upto 3 to 4 months, there are no factors. After 4th month onwards, it depends on luck!

Thanks guys. I will ask my husband to take all the items listed above to VFS office (copies only) and VFS will take and forward whatever they deem necessary. Also, my husband will bring originals on the day of interview. I guess this will be the logical thing to do.

I don't think VFS will take all your documents and forward them to the Consulate.

They just 'review' them whether all are good to go for interview, especially verification of the appointment letter, validity of the passport and NVC checklist. Most people, the medical is done after VFS phase. In our prior case, we submitted all the originals to NVC. We didn't have any certified copies of them, except the full set photocopy of I-130, AOS and IV. And my wife explained to them originals are with NVC. They said ok.

Also, they collect a fee to return the passport back to the applicant by courier. The fee is most important to them :star:

Nope.

In the month of July 2010, how many they received (this is July filers) and how many pending and how many they completed. 'How many completed' is for prior months.
