Attempted entry was 31/01/2010 and I-130 was filed in London on the 23/02/2010 if it is more than a simple denial I have no idea why but I'll find out when the CBP records arrive.



After speaking to my wife Looks like she was turned away on 212(a)(7)(A)(i)(I)
Which basically means

Section 212(a)(7)(A)(i)(I) basically means, "Immigrant without an immigrant visa." Apparently, whoever you're talking about was found ineligible for the TN classification and was properly found to be inadmissible under 212(a)(7)(A)(i)(I). The purpose of her trip was to work in the U.S. She was not qualified for any visa classification that would allow her to work in the U.S. Therefore, she's a 212(a)(7)(A)(i)(I) case.

So it seems its a little different. I do not believe she needs a waiver for this.

I wonder how long between the time he was denied and he applied there was. So far it seems things are processing smoothly for us. I think by now we would of gotten the Denial IF there was going to be one.

Hey VJ:

Got a question here. Almost 2 years ago my wife was attempting to come visit me as she had done many times. She was denied entry to the U.S. on the basis of I-275-TOR/PFI 212 (2) )7) ( A ) ( i ) ( I )

From what I understand this basically means she wasn't able to prove strong ties to Canada for her to return to, thus making her an immigrant. Having the wrong Visa to enter the country, since she isn't a tourist. My question is this, will that notation on her passport affect our I-130 approval?

This notation carries no ban.

Any help would be greatly appreciated!

Great. Another question I had is we have two forms of our marriage certificate. one what they call a long or a short. The short is just a summary basic certificate. While the long contains our best mans and maid of honors signatures.

No. If you had prepared at NVC stage, it is not needed at Consulate interview. NVC will forward all visa related documents to the Consulate.

My wife finally got an interview date at Islamabad Embassy in October. I searched through the forum and found that some people were taking copies of forms submitted to USCIS and NVC, such as DS-230. Is this really necessary? It is optional, but is a good idea. NVC has the history to lose the documents.

I'm thinking of having my wife take only the most essential items, such as: photos, telephone call records, financial support, passport sized photos, copy of marriage certificate, and copy of birth certificate. Anyone who has been to Islamabad Embassy for an interview please share your experience and what you did to prepare for it and what items you took to the interview. All documents not written in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations.

Tax transcript will have same line of details as your IRS 1040 form. If you have filed 1040 last year, check Line# 22. This is the amount they look for qualification.

I presume your household is 2 - you and your beneficiary (and you don't have any other dependents), you live in the mainland of the U.S and not employed in U.S military. If yes, your Line# 22 of 1040 must be above $18,212.

Art, some more additions.

Since you are in the initial stage of I-130, why don't you get an original IRS tax transcripts by mail for the last 3 years. It won't take more than 2 weeks to get it. Fax is good, but original is better.

As Anh map said, they would consider the most recent and the current year income more closely.

On top of I-130 and G-325A forms, if you have any other govt. agency issued certificate for the name change, please include it as well.

Include child's I-130 with yours.

Since your husband file's the petition for you and your child (for him, the child is step child), the below are needed for the step child:
1) I-130
2) $355 fee
3) G-325A with passport size photo (may be optional, but no harm to include it)
4) Copy of the marriage certificate of the stepparent to the child's natural parent showing that the marriage occurred before the child's 18th birthday
5) Copies of documents showing that any prior marriages were legally terminated, that's child's mother's - you
6) Copy of the stepchild's birth certificate

Hi,

Im new to all this so i'm sorry if these questions have been asked before. Myself and the hubby are trying to gather everything we need to send in the I-130. I have a few questions that I can't find the answers to.

1. I have a child who is 5 years old and born in Scotland, UK. Do we have to file a separate I-130 for him or do we just add him to the one for myself?

My other question is for later (I'm trying to be organised) My childs father is not my husband,there is no fathers name on the birth certificate and he has no contact with his child, I don't know where he is. I have had my childs name changed on his birth certificate so he now has my husbands last name. I could have his name changed as his father has no parental rights or responsabilities. Am I going to have to have a solicitors letter to confirm this?

Thank you to anyone that can shed some light on these.


You need a separate I-130 petition for the child.

I don't know how the child custody works in Scotland if one of the parents is unknown.

We don't create the sample PCC. PCC is issued from the agency (normally your local police station in Brazil) and they have their own format for this.

NVC will not provide the format as well.

Ok...you said he went to the Caribbean right?...well...if its Jamaica,Haiti or the Dominican Repbulic, the U.S. consulates there take a more deeper look than other countries due to the high fraud, PLUS the waiting list is ages for an interview for one of those reasons of fraud. Sad but true.

I understand he is trying to help her out, BUT to do it that way is not the right way. He should wait until he becomes a U.S. citizen, and then petition for her, even though it might take longer, but hey, at least the both of them wont have to be looking over their shoulder everyday for the rest of their lives.


Other option is visit visa for her for a temporary period upto 6 months. If she gets 10 years multiple entry visit visa, she can come and go as many times as she wants.

If your boyfriend thinks that it is not a big deal to marry his sister for immigration purposes if I were in your shoes I will have second thoughts of having a relationship with him. That is just illegal and immoral in all aspects of it. I hope he re-considers his decision/action.


There is no moral character in the boyfriend's character. His idea was to illegally help the family.

But OP, try to convince him and have a nice relationship with him, if possible.

I am in a mix of emotions. Last August my boyfriend (perm resident) went down to the country where he's from in the caribbean. His mother and sister live there. His aunt that lives in America sent him down there to marry his own sister (she used a dead person's birth certificate so her name was different) so she can get a green card because she dumped her kids on another family member in America (through adoption I'm sure) and she wants to see them. I understand, but I think it's a really immoral thing that the whole family condones the marriage between sister and brother just for a green card. My boyfriend says he knows a lot of people that did fake marriages and it's no big deal and he wants to help his family. I understand his concern but I don't like the idea of it, and I am afraid something bad might happen. Every day I'm really angry about it, but emotions aside and logistically speaking is there a chance of being caught? I'm not familiar with the process at all, but I have no good feelings about this situation, and I want to know what the risks are. I tried talking him out of it, but he keeps saying it's no big deal. He has nothing that proves their marriage is legit, no shared accounts/lands, he just wired over $100 to her name that's it. I really don't know for sure if he started filling out any immigration paperwork. I'm worried sick over this and I'm not sure if this is no big deal like he says or if there are major roadblocks or possible criminal charges that can happen? PLUS him and I live together and I cosigned a carnote and also have a joint checking account together, will they research that and find out?

Since your mom is not residing with you, you will fill I-864 and she will fill I-864 as well.

For you, 22&25 are empty. 24b will be your mother's income details.

For your mother, fill 22,24&25 appropriately. Include mother's passport copy as well to prove her age.

Did your mother provide you as dependent in her tax return for the last year?

You need to create an account in the USCIS site with your Receipt# and see "Last Updated Date".

It is not very important to see if there is any touch or not. But it is a good indication that some thing is working on your file.

In any case, you just point out the same to the CO (if interview time) or POE officer with the marriage certificate.

Some people has got CR1 even after this 2 years thingie, may be, they must have been quiet about this matter to the officer at POE.
