Since your BIL lives in separate address, your wife will file I-864 and BIL will file I-864. BIL is going to entirely sponsoring you, without combining your wife's income. Any sponsor must be domiciled in the U.S and must be at least 18 years of age. That's why a passport, GC, birth certificate or any other document that lists his age and address would be suffice. Loto Yet not welcome if they enter study intending to stay on after end of study? Right? Yes, student visa is non-immigrant visa. They have to move out once the expiry is reached. However, if they get a job in the U.S, they can do Adjustment of Status and live here permanently. As I say, it doesn't make a lot of sense. The lady on the TV (indian doctor) was being sent packing. She may not have job and may have non-immigrant visa that may be expiring. It was a feature on how the NHS need for doctors is in direct conflict with UK immigration law. We are sending home professionals in fields that this country does not produce enough of. I am guessing the USA may be doing similar things. I agree with you. We are already Married	Yes I know that, but I'm still allowed to disagree with them and say so. This particular one - "US educated foreigners not welcome to stay" hurts my brain. I know they do it here too, and UK degrees are only 3 years long - quite a few countries don't put much stock in them unless you go to somewhere prestigious. We are sending just graduated doctors back to India et al and consider this a right thing to do, seems like only my brain is screaming from the stupidity of it. US educated foreigners are definitely welcome in the U.S, if they get a job here after their studies and do the AOS. We are already Married	I sincerely don't know why it is judgemental to think that students with an interest in studying in a foreign country should not be discouraged, nay BANNED from staying in that country "on purpose." Any particular reason for thinking that work in said country and a future, settling down and eventual citizenshiop would not be the NATURAL goal of anyone wanting to actually study in that country? I mean a US degree is worth more in the US than it is in the UK, for example. And I wasn't kidding when I said if I went to Japan to study Japanese and gained a degree there, then AOS to work visa would be considered a natural thing, and completely allowed. I was looking at that route before. We're talking a country that let me AOS to a marriage based visa from tourist visa via marriage to a man with work visa (not permanent residence.) And I completely planned to marry him from the get go and told every government employee who asked about the whole plan. UK doesn't even LET you AOS from tourist, US lets you "if you had no intent." And should this be sufficient for my wifes I864? i just want to make sure when I send the I864 there is no delay thank you Schedule SE is Self Employment Tax. Self employed people will pay 2*(6.2%+1.45%)=15.3% of FICA taxes. Then half of it can be deducted while computing the AGI. Attach all the paperwork done in your 1040. I'm always nervous about mailing out original documents to a "processing center" ... in case they disappear into a blackhole But y'all have sent beneficiary's original birth/marriage certificates to NVC before, right? missads, Yes I sent our originals in the last time. Certified copy is the "extract from the respective issuance agency" in their business stationery with the seal or signature. It is NOT photocopy and notarized. She has recently made enough for the 125% but just recently her job cut back her funds. Now we will lack between 2k and 6k to make the 125% on our own. there are no other ppl we can ask to co sponsor at this time due to their lack of funds or they already have other i 864 is process for other family members. She has 2k in savings and has assets only with a 401k worth 65-68k. She has 3 girls and herself to support so on the i 864 she will be supporting a total of 5 with me included. She needs to make above 32k but as i mentioned she lacks now between 2-6k. Will her 401k work to be able to plead our case easily? As soon as i come I plan to work which is why we wanted the CR1. She also has child support she will use but it is already included in our budgeting.... anyone that can tell us how or what is best please tell us...it's urgent...i need to be with her asap You are all set. There are still a lot of marriages happen as arranged marriages in India, Pakistan, Bangladesh & other similar countries. Same true in my case. I was planning on telling the truth & if asked was going to say that our marriage was an arranged & it was arranged by family members. So we met when marriage happened. This might eliminate the need for 12 months bank statements. I think CD and bank checking a/c assets are treated same. But OP may be in a good position due to relatively good income this year. However, you may specify in the cover letter or so about this recent bank a/c open thingie. Can't we just request a bank letter saying there is that much into the account? Then you crossed the poverty line threshold and may not need a joint sponsor. But she has to show last 12 months bank statements (it is a requirement), particularly highlighting her deposits, withdrawals etc. Your portion of the account also will be considered. I thought I will find the answer to my question already answered somewhere, but I couldn't so... I am on a F-1 Visa studying and maintaing status. Recently I married an American citizen and started gathering the necessary forms for submitting my documents for change of status and green card, but I have the following problem. On Form I-864 my wife (also the primary sponsor) should list her current household income, currently is $29,000 per year, which is above the poverty line. She also needs to submit her last 3 tax returns, but the thing is she started this 29K job a month ago and although her current household income is above the poverty line she was making $17,000 on her 2009 tax return and similar to her other two tax returns, which is below the poverty line. So my question is should I be looking for a joint sponsor or it is enough that she is currently making $29,000 although it is not visible from her tax returns. Thanks for the help! Todor Does your sponsor have any other assets like bank deposit, home etc. other than the car? You are good in the current year, but job with $29K started recently. Last year income is $17K, but need $18,212 to overcome the poverty line for your household of 2. Difference is $1,212. Some people only get stuck in the name checks and for them there is no other way around until the name check has been cleared. I hope this thing will happen some time in the future. IR-1 / CR-1 Spouse Visa Process & Procedures	Petitioning for better USCIS service	You guys mean a detailed tracking such as Fedex or DHL provides :-) When filed, when notice date issued, which adjudicator handles it, while pile/bin it is, where it stands with FBI, whether name check cleared or not, any other potential issues, RFE or not, if yes exact details, if it is touched for what reason, approximate but legible completion time etc. I would love it to see. Indigo I am also ready to work with the USCIS if they pay handsomely :-) But generally, govt. employers are the lowest in terms of compensation, but they do provide some good benefits. Anyone out there had to wait like that? First NOA2? There is only one NOA2. After NOA2, there is an NVC process which could be done in 1 to 2 months. Follow all the instructions in the RFE letter and send ONLY to the address in that letter. Package must be highlighted with "I-130 RFE RESPONSE". Probably, you may need to include the copy of the I-130 receipt notice as well with the RFE letter copy. They replied friday saying: " Your husbands case has been forwarded to an officer for review. As soon as a decision is made, we will contact him immediatly" Well good news I guess? At least its not in AP, I think? Is this a good sign? How long should I wait to email again if I don't get a decision? Not trying to be pessimistic but I think I got used to getting bad news..
