I am filling out my DS-230 form. I have a question about #33 - list below all educational institutions attended. What if you have not completed your high school? (OSSD in Ontario) What would be the best way to answer "course of study & degree or diploma?"

You could put the dates you attended, the course of study and then under degree/diploma "incomplete." IMO won't be a big issue. Good luck.

I answered the question properly based on the information given. She does NOT have immigrant intent since she intends to return to the UK due to "work and property commitments". Besides, if you reread my post, you'll see I said it was perfectly legal to enter the US, get married, and leave. Please read the entire OP and my response. Further, not once did I say she should lie or misrepresent herself - please do not imply that I did.

Lots of people have entered the US, married and left. I don't know what they all said at the border since I have better things to do with my time than take a poll

Yes, as long as you leave, it is perfectly legal to use a tourist visa or the VWP to get married. I wouldn't volunteer the information to immigration, but if they ask, do not lie.

You can visit eachother after marriage; you should bring proof of ties to the UK when you do so, such as a letter from your employer, to show you will return (but on the VWP, you might never even be asked for it); also bring your visa paperwork once you start the CR-1,l to show you intend to do things legally. He can visit you too.

I agree with both of the above posts. :thumbs:

If the beneficiary is still in college but has not yet completed their degree put the appropriate dates then "IN PROGRESS"

If the beneficiary attended but then left college without completing, again put in the appropriate dates then "INCOMPLETE"

IMO it shouldn't be a problem. Good luck!

Hello all,

I am in the midst of filling out my DS-230 form. Question 35 states : List all previous visits to or residences in the United States. Give type of visa status if known. Give DHS "a" number if any.
I do not have a record of EVERY SINGLE time I have entered the USA from Canada the last 23 years of my life. Does anyone know the correct way to answer this question??????????

I think OP is asking the originals submitted to NVC will be returned after the Consulate interview. It that's correct, yes they will be returned. Wait until the interview is complete. If CO forgets to return it, just remind him/her.

Any originals submitted to USCIS (other than RFE response) will be part of your file. Then you need written request to return it.

Denial from London was that due to the serverity of the incident at the border I would need a wavier, they gave me the 601 papers and said I would now have to leave the Embassy, no further action would be taken on my case until the 601 and hardship form were recieved. I received no official refusal from the embassy.


If you got 601, file I-601 with the U.S Embassy in your country with a fee of $545 to overcome this situation immediately.

Hey VJ:

Got a question here. Almost 2 years ago my wife was attempting to come visit me as she had done many times. She was denied entry to the U.S. on the basis of I-275-TOR/PFI 212 (2) )7) ( A ) ( i ) ( I )

From what I understand this basically means she wasn't able to prove strong ties to Canada for her to return to, thus making her an immigrant. Having the wrong Visa to enter the country, since she isn't a tourist. My question is this, will that notation on her passport affect our I-130 approval?

This notation carries no ban.

Any help would be greatly appreciated!

Chennai Consulate is better to get interview date in 1.5 to 2 months time after NVC completion.

Hi All,

I have a couple of questions. Please advice:

(1) Is it a good idea to contact consulate via Email a few days before the interview to ask them if all the documents that they received from NVC are OK & if there is any additional specific documents that they think I should bring to the inteview? You may contact, and they should reply with the standard checklist.

(2) Are US citizens allowed to go in the consulate with the Spouse at time of interview? Is it even a good idea to go in if allowed? Some consulate allows, so you can check with them. In my case, they don't allow. But I will lit in the lounge.

Just to expand on some things. I met wife 1 in 1998 and she was here on a finance visa sponsored by another man and he didnt want to marry her. I have no association with this man. I lived with wife 1 for 1.5 years had a child with her. I sponsored wife 2 as a finance. We lived together for 3,5 years and finally divorced last year. I was unable to find her for several years. I was have never been convicted of anything. I am thinking of consulting a lawyer. the only problem is to find a lawyer that is worth half of his fees.

Yes, you should talk to the lawyer. Start collecting all the documents since the beginning to prove the good faith relationship. You will not be denied under criminal base since there is no conviction. Arrest, restraining or protective orders are fine as long as the court does not find you as guilty.

It looks like your first wife's case is also slightly complicated. The person who sponsors a fiancee is supposed to marry her within 90 days under K1 visa. Another person cannot marry her. If the second person wants to marry her, she had to abandon K1 visa, leave the U.S and come back in another K1 fiancee or spouse visa. Did you marry her in an entirely new K1 visa sponsored by you?

Ya, but the thing is - this is a different visa category. That's a plus in his favor, from the 'counting guidelines'.


The similar category I meant is bringing wife or finance(e). One failure with a husband/wife would be ok, but 2 or more failures will definitely a questionable thing and it has to be proved that it was 'good faith marriage'.

Even the reason for CR1 category creation is to prove that the couple has lived in 'good faith' for at least 2 years and remove the condition together at the end of 2 years. Otherwise they could have used only IR1 category for a married couple.

Here in OP's case one incident was in 2000 and the second in 2005. Five year span between these 3 cases which is reasonably lengthy time. But the divorce/separation happened in both cases in less than 2 years time. That's why second wife had to file I-360 based on VAWA act to remove her GC condition alone. First wife's GC is still unknown. This 'short period' of living together in both cases has to be clearly convinced that both were in 'good faith'.

It is definitely a 'red flag' to bring many alien beneficiaries under the similar visa category within the short period of time and lived together only short period of time.

Only way to overcome this is the petitioner has to prove that the marriage was in 'good faith', but ended it unfortunately in a believable manner with extensive evidence. Just a listing of prior marriages are not sufficient. The good faith has to be proved. Otherwise, it can be treated as evading immigration law.

That's why, since it is little complex, consult with an attorney and discuss and draft the letters accordingly.

You may pull FBI record, but it is not needed as long as you are sure that you are NOT convicted.

But it is a good idea if there are any adverse info sitting in your file that is incorrect. So, you have a chance to clean it up, if it is wrong.

Yes, brought both on K1. Not sure if wife 1 had GC. Wife 2 did have a GC. Wife 1 was the worst. I was not convicted, I had the protective order reversed by appeal, and have my record expunged of all charges. Actually, my criminal record is sealed. The pressure of the situation and constant litigation from wife 1 caused so much pressure and stress that wife 2 became weary of her immigration status and dissappeared. I assume that she self petitioned as an abused spouse because she knew all about the procedure from experiences with wife 1 while she lived with me.

There are some issues here:
1) Criminal background (you are not convicted is good)
2) Bringing foreign aliens - this is going to be third time

You should proceed through a good attorney so that they can submit proper documentation to all queries from the Consulate.

Hi Everyone,

I am a US Citizen that works in Ukraine. My Ukranian girlfriend and I want to marry and in a few months my job will end and I will return the states. I have had 2 previous I-129F's and the marriages ended in my wives making false claims of abuse and gaining citizenship as abused spouses. All of this has happened about 10 years ago. I had the protection order overturned on appeal and I also received an expungment of my criminal records because I am innocent and I proved of the claims. My ex's recived their immigration benefits anyway. I dont know how USCIS could do such a thing. I was completely barred and the I-360 process although I did send in the results of the protective order appeal and my expungement.

Excuse me, I digress. Now I have found a very good woman and we want to marry. Will my previous history preclude me from succesfully immigrating my future wife via an I-360 petition?

So on yesterday, I went to the sign in page just to see :innocent: if it showed failed. To my suprise it did!! So I start doing my dance, but then realized I didnt receive an email from the NVC to tell me the case was complete so I called the AVR which says when the last date the received my infor and it would be 6-8 weeks. What??? So then I call to speak to and operator and she then tells me that the case is in its final review. Thats all she said! Am I too anxious or is this normal?


Final review with NVC now. In 1 to 2 weeks, your case will be 'completely' closed.

Great. Another question I had is we have two forms of our marriage certificate. one what they call a long or a short. The short is just a summary basic certificate. While the long contains our best mans and maid of honors signatures.


More detail is always better - so the long form would be better.

She or you will submit her original BC and a photocopy to NVC. She will get the original back at the Consulate after the interview.
