hi vj i am waiting for uscis to send noa2 its already that will be 5 mounts october 3 my wife call the uscis(who is us citizen) she were calling everyweek.this last two mounts... my wife called the uscis today and my wife asked them about our i-130 the lady there she answered her october 3 that will be 5 mounts for our i-130 but its sunday the lady there she asked my wife and said u call us again october 4 monday. now i just want to know whats ganno happen next. do u think that they are ganno approve our i-130 or they just ganno make it long the last touched was july 23 after tat never touched again....please write something to me its realy hard to be faraway from my wife.i miss her.please tell me something ok thanks anyway thank for help

i have just one (maybe stupid) QUESTION!

if i work full time job and get paid 11$ per hour, will that be enough for sponsoring my wife?

I was laid off from my long term job 4 months ago where i was making good money and i just recently got new job where i get paid "only" 11 $ per hour.

Last 3 years TAX transcripts are no problem,it will show i made enough money, but what about my current income?


It should not be a problem.

$11 per hour is also good to sponsor a household of 2 or 3.

Have been issued by the appropriate police authority
Include all arrests, the reason for the arrest(s), and the disposition of each recorded case.

I sent in the originals. Marriage certificate, birth certificate, police clearance certificate. It is not easy to obtain the originals again. If they ask me to sent in the originals again, i will be in trouble. I hope they recieved the documents. I will call them in 2 days.

QUESTION ON DS-230 (JUST PLANNING AHEAD)
I was just filling this out for my Wife... and wanted to ask couple questions.

Question # 1
Currently on question # 10 I have my current address... but on Question # 11 on where does she want here GC sent...
can I leave it blank? because I don't know where I will be staying when she comes to US, I'm planning on switching jobs hence I'm not sure.
I filled the same address in Q#10 for Q#11. At interview time, if it is different, complete a new DS-230 and submit to the CO.

Questin # 2
Regarding question # 22 & 27 - her parents addresses, well she lives with her parents...
so can I write "SAME AS MINE" or do I need to write down their address again
(doing this I will need to Attach Extra Sheet of Paper as it will not fit in the give space)
Write full address by black ink pen, so it will fit.

Question # 3
Regarding question # 43... Yes I would like her to receive SSN...
so will they send the SSN card to my address even though I'm planning to move...
or can I wait and apply for her SSN# & GC at a same time on later day.
SSN will be sent to the same address as GC. Normally, there is another form in Packet4 for SSN to fill up at the interview time. Again, any change of address can be mentioned in new DS-230 at interview time.

To clarify myself, the beneficiary is providing all of the information, but what I meant is that the person started but did not graduate (therefore, it is incomplete) from the program. So, should I:
a) Not include college education at all?
b) Include the information but in write "Incomplete" in the "Degree or Diploma" field to clarify that the person did not graduate?

Thanks for the tip.. I had the SSN field checked yes...now i changed it to NO. I wasn't sure if it is mandatory to check yes there...should i check NO for 44? I am filing it out for my spouse and email it so she can print and sign...


I filled YES in my wife's previous GC time and received SSN as per the timeline.

But recently, people has hard time to receive SSN after arriving the U.S. In that case, you can visit the SS office to apply one, irrespective of the checking YES and NO.

So we got the dreaded email from NVC,'RFE'.But I don't understand most of the things
they're asking:
1. Proof of sponsors relationship with household member..my parents in law both filled I -864A and hubby attached orriginal birth certificate showing both parents names
If your in-laws filed I-864A with sponsor's I-864, proof of same address of your sponsor is needed. Some examples - lease, mortgage, utility bills etc.

2.Applicant's birth certificate..mine {applicant} is missing but I got one from the national population which is the issueing body in Nigeria plus a sworn affidavit my mom.
I don't know why they missed it. Send one more.

3.Reason sponsor didn't file taxes in the last two years..He attached letter stating he's been in Nigeria all d while with us and he wasnt working.
I don't have answer to this as well. Write a letter again saying the same.

4.police report...I read that for Nigerians police report is needed at inteview stage so Y is NVC asking?
Original PCC must be submitted to NVC and NVC will forward it to the Consulate. Check its validity period with the Consulate.

During our first I-130 application back in beginning of 2008, we filed I-129F for K3 path too. It was taking an average 6 months for I-130 approval. But our I-130 was approved in 3.5 months time with I-129F.

Now the things are changed. No need to file I-129F now. Just I-130 is enough and that's what we did this time.

I was perusing some of the forums and found a post about Igor's list. I filed our I-129f in late July and got our NOA1 on August 6th. I know that the USCIS website and many others say to expect about 5 months for a NOA2. However, upon looking at many others timelines and also on Igor's list it looks like there is no ryme or reason to how long it takes to be approved. I see some that have been approved in as little as 30 days or so, and there are some that have took well over the projected 5 months. I can understand the approvals that took a bit longer maybe due to an RFE, or for someone who has a very common last name. So.... is there any chance that a person that has a obscure last name and a clean background to be approved sooner than 5 months ?


CSC currently takes 5+ months for 'normal' petitions.

There is a background check conducted during I-130 process. They will easily find out your previous petition. They might question where is the beneficiary now - in the U.S or not. And might trigger an RFE too for it. So, better explain it in detail with the proof along with I-130 package.

Putting together the I-130 Packet for a CR-1 visa. Here's the story in a nutshell --- fiancee came here on K-1, we married, very soon after a medical condition arose which necessitated the (now) wife to return to Russia to obtain treatment (she was not yet employed, had no insurance, it would have been very expensive to put her on my insurace, with a now pre-existing condition it would have been almost impossible and/or extremely expensive for her to get insurance on her own, etc, etc, etc.)

We now are preparing to go the CR-1 route so that she can return to the US.

Do we really NEED to outline/document the reasons she returned to Russia in the I-130, or should we simply keep this evidence to present/explain at the interview.

My personal preference would be NOT to include it in the I-130 -- first because it is personal medical information, but also, as such, the folks at USCIS probably wouldn't understand most of it anyway and it would probably be much easier to explain in person than in a written format.

But just wondering about anyone else's opinion or experience with a similar situation.


IMO, explain the situation to the USCIS at I-130 filing time.

Also, answer the same at interview, if CO asks about this.

I would put yes because thats what i did. But my case was diffrent because I filed I-129 and it got denied and when i filled the I-130 i put yes i filed for this person and it got approved. Now why my case got denied is because no physical meeting in the last 2 years. Its never a good thing to lie to a goverment agency.

Hey :)

It's about the online payment portal where you pay your AOS and IV bills (I'm assuming that you did pay them online ;) ). NVC doesn't have a website where you can check ur case status (like USCIS). So, when you get SIGN IN FAIL on the payment portal - that usually means your case is complete but most of the times still needs to go tru final review - so it's never a guarantee that you got CC but most of the time it's a sign that you're pretty much out of the NVC.

You would need a statement stating why you didn't file a tax return with the IRS, referencing the IRS rule that allows that).

You would also include 6 months of paystubs, and a letter from your employer (start date, type of employment, salary). (does your current job salary meet the income level needed?)

I would also suggest to include 2007,2008 tax returns if you have them. (to show employment previously)

You may also want to check your "CAPS" lock key - it appears stuck...

Wait for the GC. And see how it is. If they make mistake again, you need to replace the GC by filing I-90 form. You don't have to pay any fee since it is USCIS error.

Hello,
I am a Canadian who got married to a US citizen on June 21st 2010. We submitted our I-130 application on July 20th and received our NOA1 on July 31st. I noticed that under preference classification our case is categorized as "Unknown Classification" and my class is blank. I think my preference classification is supposed to be "husband or wife of US citizen, 201(b) INA" or something like that (as shown in this sample: http://www.visajourn...p_display_media). Presumably I am in the CR1 class.

I have asked my husband to contact USCIS asap to correct the preference classification if needed. I am concerned and am wondering if I am worrying needlessly or of this is indeed an error and it is likely to have delayed getting our NOA2. I suspect the latter.

I would be grateful for your perspectives and advice.

Hello, hope everyone is doing well! I had a question about the DS-230 part 2 . Question # 41 Have you every been charged, arrested, or convicted of any offense or crime? (If answer is Yes, please explain)
So my hubby in Canada got in a incident when he was 16 or 17 maybe 18 , he said it's been so long he dosen't remember. He did get arrested, he remembered being at a court but the case got dissmissed. Now we will be answering Yes to the question because it's true he did get arrested. He is now 31 so it's been awhile thats good. But we also got the police check and it came back clear. I'm just wondering if at the interview time they will request other paperwork, I read somewhere they request court records and so on =/ We just want to be prepared by then. Anyone have any similar situations or know anything, much appreciated.

Also I was wondering how do I know what service center we are.....I'm pretty sure it's California, Where can I find out, on the NOA 1 ? :star:


Sorry I can't help with your first question....as far as your service centre goes if your NOA1 receipt number starts with WAC it's CSC (California) if it starts with EAC it's Vermont. Once you move on to NVC your case number there will begin with MTL for Montreal. Good luck!

It just depends on what you request when you register your children's birth or later when requesting replacements. I requested both the long-form and wallet sized certificates when I registered my sons' births (but I'm going back quite awhile now :) )

Many people have visited during this process. The key is that admission is not a guarentee, each application for entry is decided upon entry. Bringing proof of ties to Canada will be essential - things like a lease/mortgage, job letter with an expected return date, school enrollment letter, etc.

Yes, the CBP can deny her entry for the reason she is married to a USC - because then there may be the presumption of immigrant intent. I, myself, have been denied entry twice.

My husband and I maintained a 'normal lifestyle' by rolling with the punches. No way we could have visited every weekend. Once a month/ ever 6-7 weeks was the best we could do. It was just our life for a year.

Also know that your interview will be in Montreal, it is the only consulate that does Cr-1 spousal visas

I am in the midst of filling out my DS-230 form. Question 35 states : List all previous visits to or residences in the United States. Give type of visa status if known. Give DHS "a" number if any.
I do not have a record of EVERY SINGLE time I have entered the USA from Canada the last 23 years of my life. Does anyone know the correct way to answer this question??????????

Thanks for your feedback and for the link. So that means that her CR1 visa is like a temporary green card. So I'm guessing that technically, she could leave the country for say a couple months if needed BEFORE she receives the green card by mail. Will this 'welcome letter' be given at POE or sent by mail? Good to know we get a receipt number that enables us to track the process of issuing her a SSC online.



As Darnell posted ( more clearly than I :) ) "a STAMP in her passport, that validates the VISA to be used as a temporary green card, I-551 document, with a new duration of 1 year."

There is nothing to do to start the production of the green card other than being processed at the point of entry. The "Welcome letter" will be mailed to your address; I received mine about 2 weeks after POE and the green card two weeks after that. I also received email updates.

That thing rarely works for spouse visa even if you check the box you want it sent to you - the system is just not connected to SSA and people wait and wait and wait and in the end finally go to SSA to discover they never received any info about them.

The best bet would be to wait 2 weeks after POE and then go to SSA office with filled out form, immigrant visa and passport.

I applied for my SSN 3 weeks after POE, took in my birth certificate, passport and filled in application ( SSN Application ) I had my card 6 days later.

At POE your wife's visa will be stamped in her passport. This acts a a temporary green card until she receives the actual card. She could still travel with that but the actual card should arrive within a month. Watch for her "Welcome" letter which will have a receipt number on it that can be used to track production of the card through the USCIS site. Good luck!

You could put the dates you attended, the course of study and then under degree/diploma "incomplete." IMO won't be a big issue. Good luck.
