Hi, we prepared for the NVC process a long time ago by getting a marriage certificate, a police certificate, and a birth certificate. Just wondering if NVC cares about the dates of these documents, seeing as we requested them a few months ago, they will probably be 6 months old by the time NVC wants them, is this a problem?

Marriage Certificate and Birth Certificate are non-issue items.

PCC will have a validity of 1 year, 6 months, 3 months and even 1 month depending upon the Consulate.

So, what is validity? It is the time period between the issue date and the interview date.

I have a quick question. I am currently in the process of filing the Affidavit of Support (I-864) for my wife. Unfortunately, last year I did not meet the yearly earnings requirement, so my mother is going to co-sponsor for her. My question is, does she fill out the I-864, or the I-864a?

I initially thought the I-864a, as my mother is NOT a household member. The checklist here confirms this:

However, on the actual I-864a form, it specifically states: "Form I-864A, Contract Between Sponsor and Household Member, is an attachment to Form I-864, Affidavit of Support Under Section 213A of the Immigration and Nationality Act. It is an optional form, completed and signed by two individuals: a sponsor who is completing Form I-864, and a household member who is promising to make his or her income and/or assets available to the sponsor to help support the sponsored immigrant(s). The combined signing of this form constitutes an agreement that the household member is responsible along with the sponsor for the support of the individual(s) named in this form."

So, I'm hoping someone else here has gone through this and could shed some light on these contradictory statements for me...My mom is a Joint Sponsor, NOT a household member. Any idea?


Since your mother lives at a different address, she will file I-1864 with your I-864.

Did she or you claim the other as dependent in the last year tax return?

Fianally I was able to talk to someone after several attempts at the Consulate and the lady looked up our case number. She said his visa is now ready for pick-up that they had some delays the last couple of days..Their office is now closed so he can come Monday at 3 to pick it up. I told her about no green slip for approval and she said it's ok, he will not have to have it. He can just show his ID card. She assured me that the Visa is definately there today.

If you live in the U.S and file with USCIS, I-130 goes to Chicago Lockbox.

If you call the USCIS on your 150th Day of NOA1... does it even have bearing at all that they will process your paperwork to get your NOA2 because you made the effort to remind them that it's been 5 months since they looked at my petition? Is it just a waste of time, speech, frustration, being on hold or at least I cared... *sigh* Any light at the tunnel can be helpful to make sure I'm going the right direction so I won't stray?

Good topic. Me and the wife talked about this and concluded that it was not needed to change her passport from maiden to my last name. Is this ok to just leave her passport like maiden? Or is this a must do for the process of gettting her home?


Changing maiden name to married name does not do anything in terms of visa processing.

It is the personal choice, that's all!

Though my wife wanted to change her name after our marriage, I advised her to keep her name. But we will do it when she naturalizes here. This is just to please her :star:

I have almost all of her original documents in hand (including photocopies of her passport with maiden name). The only documents that I didn't have was an NSO copy of our Marriage Certificate (I have a certified true copy from City Hall). Yesterday she mailed me (via FEDEX) the original NSO marriage certificate ( along with some other goodies :D )- I should get it by Monday.

I was surprise too when she told me DFA gave her an appointment date of Oct. 28th - they must be really busy. She told me that she must appear in person (they will not even let you thru the gate without an appointment & application). They told her to bring her current passport (which will expire in 2014) & her NSO/CTC marriage certificate. We will go for the expedite which will be 10 days (20 days for regular) - it is only 250 pesos more.

I think that she will get the amended passport before the interview stage, my question was will it be an issue since I will send everything to NVC in her maiden name & then she goes to the interview with an amended passport (different from what was sent).

You can fill DS-230 with her maiden name as in the 'current passport' and submit to NVC.

Later, when she will have the new passport with married name, fill a new DS-230 with married name as the main name and maiden name as 'Other names used' and submit to the Consulate at the interview time. Obviously, the visa and GC will be issued as per the current passport, which will be her married name, by then.

I went to a hospital and they keep referring her to a hospital somewhere else that handles stuff for new zealand australia etc, What do i need to do and what exacly do i need to ask for? does anyone know a hospital in Hyderabad? what am i supposed to do?


A blood test by a thrid party physician will list all the vaccinations available in her body. Panel physician will mostly accept this letter.

Adding a new drive above age 26 will not have much premium impact.

When you show your status from single to married, premium will come down based on risk assessment (They think now you are more responsible driver)

I am not the first, I know some of them here in VJ who have also done it :star:

First of all, you won't get ITIN if you request it stand alone.

Since you are married this year, you are qualified to file Married Filing Jointly (MFJ) in the year 2010.

Most (may be all) of the online tax filing software will not e-file with blank SSN column.

So, you need to file your 1040 MFJ by mailing it to Austin, Texas Address:
Internal Revenue Service
ITIN Operation
P.O. Box 149342
Austin, TX 78714-9342

Her SSN column will be blank in 1040.

Include completed and signed W-7 form with supporting documents such as her passport copy etc. along with 1040.

Don't forget to include her foreign income in 1040, if any. For MFJ, worldwide income must be shown.

Joint tax return is a toughie if your spouse has never been to the US. ITIN is almost impossible to get. I looked at that one...it's really hopeless...not impossible, but I've yet to read from anybody who's gotten it to work.

The insurance sounds like a good one...I need to do that soon, not just for USCIS but because I want to make sure she has something if anything happens to me.

Money sent to your spouse through Western Union and other services.

Chats via Skype, telephone (the phone cards you used up), text messages, IMs, etc.

Proof that you have included her in your health insurance.

These are just a few.

And we can see that some filers think it is best to send in an enormous amount of documents, like 5000 or 7000 pages note booked, stapled, paper clipped, glued, sealed, and tabs at one end or another. Can you imagine how much time it would take a Visa worker to scan 5000 pages into a computer?


They may review few pages and keep it in the petitioner's file :) . If they think that is too much, some of them will be trashed.

Thank you so much guys, i think my concern is it might be declined. I would be more than content to wait if there was no emergency but Im afraid this is. In laymans terms my wife is bedridden with a lung disease and severe anxiety depression is making it worse. Dr's have diagnosed her health as 'dire' and have requested an expedite in their letters. In addition my wife is/was her 92 year old grandmothers sole carer - she needs daily care too as she is housebound. There is no-one else to look after my 2 loved ones, so Im extremely worried and anxious right now. We have a pulmonologist letter, psychiatrist letter, therapist letter, dr's list of medications she is on and also her grandmothers dr letter attesting to the fact that my wife is her only carer.


This expedite will be approved.

i need to get transcripts from IRS.

My understanding is - I need 1040 and W2 .

Now...

I was just about to send form 4506-T to IRS when i noticed this print on the form: " CAUTION If you need copy of Form W-2 YOU MUST USE FORM 4506" !

When i look at that form (4506) it says to send 46 $ money order for each copy i request !??

I cant do this over the phone because i moved recently so i need to write my new adress on the form i send , this can not be done over the phone.

So my question is - Which IRS form i have to use to get transcripts for last 3 years???

And.. can i simply go tu TURBOTAX and find that forms there? Is it easier?

You don't have to pay money.

Call same IRS# and ask them 3 years tax returns to fax it to you.

Other alternative is to visit the local IRS office and get the trancripts from them.

Hi all,

My Wife and I are starting the process of applying for a IR-1 visa for me to move to the USA.
I'm Irish and we've been married for just over 3 years and expecting our first child November :-)
My Wife (US Citizen) is living with me in Ireland so we will be doing a DCF in Dublin.

I previously held a Green Card which I got in 1995 through the "Diversity Visa Lottery Program"
I lived in the US for 6 years and returned to Ireland in 2001. Last year when I was visiting with my wife the US to visit her family I got stopped by immigration and was asked about my Green Card and where it physically was! I said it was probably some where at my parents house but that it had expired in 2005!. They made me fill out a form to formally give up my Green Card and gave it to me. I'm looking for this at the moment but haven't been able to find it so I'm not sure what it was!

Questions!
1)Is the fact that I previously held a Green Card and gave it up have any effect now?

2)Do I need a copy of the form I filled in?
It will be useful. When my wife surrendered her previous GC, now she has I-407 copy.

2)When filling out the I130 it asks for both (9)Social Security Number and (10) Alien Registration Number.
Should I give my old SS number and Green card number?
We provided both while filling this time. SSN will never change once assigned. So, you need to use the same SSN.

4)Question (16) "Has your relative ever been under immigration proceedings?" how do I answer this? Was giving up my green card a "Rescission"?
We filled NO.

5)Does the copies of documentation we will be including (Passports, birth-certs etc.)have to be notarized?
NO

We have a joint sponsor which has 7 in Household including me ... His total income in 2009 is insufficient to complete what is required. I want to know if my husband's income would be counted to reach the requirement?


If your co-sponsor is your husband's household (same living address or dependent in tax filing), your husband's and co-sponsor's income will be combined.

Otherwise, co-sponsor alone must overcome the poverty lines. If not possible, find out another co-sponsor.

Go to the USCIS website. Click on Sign-up for Case Updates.

Create an account and follow the directions for registering your NOA1 receipt number(s).

Set up e-mail and/or SMS updates; take note you will only receive updates based on major milestones in your application, like card production ordered, approvals, refusals, case transfers, etc.

There is a column there called Last Updated. Every time the date changes, it means your application has been touched; you will not receive e-mail or SMS alerts for touches.

My wife and I have maintained a shared blog since March 2009, over a year before we got married. We are preparing our documents for the I-130 packet, and I had the idea of using the blog as evidence of a bona fide marriage / a real relationship. Could I get a notary public to witness that the blog exists, is evidence of a relationship, and pre-dates the visa application? Is it a useful form of evidence?

Any thoughts are appreciated!


Just alone this, is not a secondary evidence. You need lot of other secondary evidences too. No need to get it notarized.

It's been a while since I posted here. Hope you are doing well.

I filed the I-130 petition on April 16, 2010 and got the NOA on April 23rd.

It's been 5 months and we're still waiting for the approval from USCIS. This is taking way too long and I'm wondering why it's taking so long.

Has anybody else filed in the same month and received their approval? Or are you still waiting?

Should I call the office and find out what's going on? What's the best way to get through?

Currently, CSC is processing April cases. You will hear "good news" in a week or two.

Mine is getting close to 180 days, no word yet... when i call they say you are still within the processing time..not sure what's going on...freaking out now!


It is time to:

1) Call USCIS
2) If it fails, Call/email Senator/Congressperson to check the status

hi vj i am waiting for uscis to send noa2 its already that will be 5 mounts october 3 my wife call the uscis(who is us citizen) she were calling everyweek.this last two mounts... my wife called the uscis today and my wife asked them about our i-130 the lady there she answered her october 3 that will be 5 mounts for our i-130 but its sunday the lady there she asked my wife and said u call us again october 4 monday. now i just want to know whats ganno happen next. do u think that they are ganno approve our i-130 or they just ganno make it long the last touched was july 23 after tat never touched again....please write something to me its realy hard to be faraway from my wife.i miss her.please tell me something ok thanks anyway thank for help

Currently CSC is taking that long. Since you are now 5 months after filing, you should hear approval stuff in another 1 to 2 weeks time. Stay tuned.
