Also remember guys....I am still in the F2 catergory meaning a numerical limit. Until they upgrade me to immediate relative, i can't receive anything yet. I still have to kinda wait for my priority date...thats why the upgrade is necessary....Hope i'm a bit clear

You are correct. Without they upgrade your petition to "immediate relative" category, it won't move faster. So, keep chasing them until this one is upgraded.

IR/CR Visa Petition (I-130) doesn't ask about petitioner's criminal history. IMBRA doesn't apply if you're already married so US Embassy probably won't ask.

I was convicted of a felony years ago and it was never mentioned in the process.

I (petitioner) had been arrested and had received the protective order and later this case had been disposed (not convicted) off.

During I-130 process, it was not an issue.

Arrest is not at all an issue unless convicted. Even minor convictions (unless it is for moral turpitude etc.) are non-issue sometimes.

Cause we prepared a love story long time ago. Just in case it is a requirement cause the one who adviced us to make one but she was on a K1 visa. We will be sending the expedite letter and supporting documents which the USCIS asked us to do on Tuesday. We might send along the love story thing. Haha.


We didn't submit our love story :D

We submitted ONLY the below as secondary evidences of the relationship:
1) 2 notarized affidavits from my parents
2) Our daughter's birth certificate

However, we will backload more evidences at the interview time, just in case.

If the brother's income is enough then he does not have to include his wife's income via the I-864A.

Filing joint tax returns does not matter if he qualifies on his own. He would use the joint tax return/transcript but only include his income on the I-864.

It looks like Teya is correct.

Your wife's brother's wife makes an household contract (I-864A) between her and her husband. So, brother's wife and brother's income can be combined in the co-sponsorship to overcome the poverty line threshold.

Since your wife's brother resides at diff. address of your wife's, he will file I-864 with your wife's I-864. Your wife's income in this context is not counted anywhere.

As Teya told, your wife's brother's and brother's wife's income can be included.

Your wife will file - I-864
Your wife's brother will file - I-864 (assuming he lives in different address of your wife)
Your wife's brother's wife will file - ??? (I don't know if it is I-864 or I-864A)

Since they (brother and brother's wife) are combining income, it seems I-864A.
But since brother's wife has different address of your wife, it seems I-864.

It depends on the adjudicating officer. If they want more info, they will notify as an RFE to provide further details. Otherwise it will just go through.

Hi, I have just completed the G-325A and a supplementary page which included my employment for the past 5 years. However, there are many gaps in this timeline. I during the past 5 years I have studied twice and have several periods of unemployment.

Is it a problem that I did not include these in my timeline?

You can fill the gap with unemployed, studies etc. Basically, they want to know what you did in the last 5 years.

Based on previous timeline, i am thinking that i should be approved by Dec - January 2011, and I think i might need a co-sponsor and want to know how long does tax info, etc valid for as i am wondering if i can gather relevant info by November 2010?

Would this be too early and become obsolete within a 3-month timespan?

IRS tax transcripts never expires. You can get 2007, 08 and 09. Be prepared for 2010 too if the AOS review happens after Apr 15, 2011.

Here's another one: How recent does the passport picture have to be of my spouse? If he had one taken a few years ago and he doesn't look hardly any different, can he just use one of those??

Since I mail the packet in myself, and he still lives out of the country... can he just fill out his g-325a and scan it for me and I print it out and send it? Or does it have to fill it out and mail it to me (meaning we wait 2 weeks for the mail to arrive)?


Photo must be taken within 6 months time. But I used my photo taken 2.5 years ago.

Signature on G-325A by him must be the ORIGINAL.

You are right; it was not lawfully executed in a court. It is just that she has been raising the child without the father help for the last 6 years. So I take back the part about having full custody.


Based on this scenario, I feel that your wife needs ex's legal permission to take the child outside her country.

no worries, I made mistakes on the G-325A as well, I corrected the mistake on the Ds-230 and it was a non-issue. You might want to make note of it in the interview just to be sure they have the correct info

Not necessary as the immigration physical includes an x-ray which screens for any changes in the lungs caused by TB. If he wants to go ahead and have it done anyway that's fine but they will still require him to have the x-ray. Good luck!

As posted above, to be able to work as soon as you enter the US you want to follow the IR1/CR1 path.

Unfortunately there really isn't a "fast" way to get through the process. With the wait for interviews at Montreal you are looking at approximately 8-12 months as canadian-wife posted.

Read through the guides and familiarize yourself with the process. Unless you have a complicated case it is certainly possible to navigate the process without a lawyer (most of us have :) )

Yeah OBX....that link you gave me , her story was crazy. But i kind of think they are looking at a 17 yr old and think she is more likely to smoke again because she is young and undecided in life. Versus a 31 yr old who is a law abiding citizen. I'll hope for the best.

You won't get denied for smoking pot. They are not going to check your hair follicles! In many states, marijuana is legal for medical use. This site breeds paranoia... I know it's a really scary process, but the medical doctor is not going to be unreasonable or play god with you. He/she is there to make sure that you pose no threat to the population. You can't try to game the system, just be honest, and it's not so bad or unreasonable as some people on this site think.


While the end result may not be a denial the filer may indeed have issues if they do admit to previous drug use as the link I posted illustrates. Granted in the OP's case the use was years ago, so while I agree that it should not cause any problems I don't think it's wise to tell the OP it definitely won't be a problem.

I put "NONE" and had no problems.

I would recommend avoid stapling or punching holes in any documents. I would use ideal clamps to hold large amounts of documents together. In my case, I just stapled the check to the I-130 application.

I mailed my I-130 package via USPS Priority Mail Flat Rate. The cost was less than $6, including signature confirmation. It seems to be the most affordable of the options.
However, if you're more time sensitive, you may want to try FedEx or UPS.

According to the NVC instructions re:photographs if you normally wear glasess you should wear them in your photographs. NVC Photographs

That being said, I wear glasses but all of my submitted photographs (and my passport) were without and I had no issues at all. Good luck!
