Hello again. Have been away for a while but am back asking questions!! And, as always, feeling the support of this forum. Thanks to you all.

OK. Have applied using the I-130 route (i.e married to an american citizen). Have reciept dated June 2010 so expecting the next step very soon which I believe is the I-864 Support forms.

My wife has earned very little in the last 3 years so am worried that we are not meeting the minimum poverty requirements.She owns a house, a car and a business in the states (loss making hence the worries).

I earn good money here but understand that that is not relevant.

Are there any workarounds to the income requirements? Would it help if I got a letter from the business explaining that I am going to work there for a salary of more than the 125% poverty line? Does having property in another country (Lima, Peru) help? Is there a sum of money that I could show as being in the bank which would be an accepted alternative?

Sorry for the questions but know that someone will know and be able to help.

Some of the things will help you. But you need to do a computation based on your household size, income and asset.
1) Petitioner's asset (house's equity = current market value less mortgages) will be considered at 33.33% if USC petitioner
2) Intending's immigrants asset will be considered at 20% of the total value

If the intending immigrant can prove that his/her current income will continue even after the immigration to the U.S, it may be considered. For example, if my wife gets a good rental income in India and I am short of my income, I may add her rental income to mine for AOS purpose, because her rental income will continue even after her migration to the U.S.

If nothing meets the poverty line as depicted above, you will have to find out a co-sponsor.

Wow Loto I think you are super good luck, this morning I woke up and looked at my emails and in it was a letter from the NVC with my IDNumber, I logged in and will quickly pay the $88.00. Now what???

Thanks Loto I tried the Attn: Supervisor Sue thing..nada. I have now emailed them 4 times with my case #, attached DS form with barcode as shown on your tips, nada...I was approved Oct 20th and I called the NVC, they even had both our names, dob, email addresses. We have mailed in a hard copy of the DS form..nada. How is that some people can fly through this process when we can't even get them to answer and email..guhhhhh :P


I think Sue now setup a spam filter when the subject meets the filter rule :D

Try this - Attn: Pl Supervisor Sue and attach a scanned completed DS-3032 too, obviously with NVC Case#.

Yes, they need some time to enter your details in their system, that's why it is getting rejected.

Some people have good luck to get these things done in a flash time.

NVC email system is really clogged.

-For employer address, the city/state/province will be ok, but if you want to make sure everything is full, you can attach a paper to the G-325A form referring to applicant's employment and listing your employers with their full addresses.

-Third party like friends that knows both of you, family members on both sides.

-Other relevant documentation like a

joint bank account statement showing both your names on it
a rent that has both your names on the lease
pictures of you together
letters
emails
hotel bills has both your names on it
and anything that would establish that you have an on going relationship and you have actually met in the 2 years previous to the petition, etc ...
For sure a child that is born to the marriage is a big plus, so if it is applicable, include a copy of the birth certificate.

Oh, now I got it. It is the printing issue of the entire page of I-130.

I though form was incomplete. Make sure there are no blanks in I-130 and if not applicable, enter N/A.

LPR - Legal Permanent Resident - Green Card holder.

If its to a us citizen, there'l be no questions. If its to a foreign national - you may be asked a question or two, along with your 'new partner', but it shouldnt be a problem.


Let me elaborate it.

As per USCIS manual, LPR sponsor needs at least 5 years gap before another application for the next spousal beneficiary.

USC sponsor can re-marry and file soon, it should not be an issue.

Which category OP belongs to?

I was USC petitioner, I re-married 3 months after my divorce and filed my wife's I-130 petition one month after our marriage. There was no issue at all.

Thank you everyone!!! I did sent it today, they will get it tomorrow!!!! This time I typed the G-325A and made sure everything was filled out. Even sent two copies. I hope it won't be delayed that much. On my timeline it says that my I-130 should be adjudicated between november 25 and December 6, so crossing fingers!!!! :)


Since you are an early June CSC filer, I believe your approval would come before the end of this month.

it's not a big deal if it's your wife's address as you gonna go through NVC after USCIS and there at the NVC you gonna fill forms for yourself, and your wife as well is gonna fill forms, however like the later poster mentioned you can wait until they receive your case if they have not yet and call them and ask to add this information.

If your household is 2 (or even upto 4), the 2009 income looks above the poverty line. She has to get her 2010 employment letter and paystubs too. Also, she has to mention in the letter the same you told here - why she didn't file taxes in 2008.

If you paid and status shows "PAID" in the payment portal for AOS, print out the barcode sheet and mail the AOS package.

Once DS-3032 (it may take some time) is accepted, you will be able to pay the IV fee.

I filed CR-1 application for my wife, and now our I-130 has been approved on 10/15/2010. Since we are qualified for Electronic Processing in GuangZhou consular, after reviewing some very helpful Wiki sites I learnt from this excellent FOrum as well as from NVC official website, my wife sent an email to NVCElectronic@state.gov attached with signed DS-3032 document on November 02, 2010, to request for opt-in. However, till now we still didn't receive the confirmation email from NVCElectronic.

Could somebody help to tell normally it takes how long for NVC to approve our Electronic Processing request? And do we need to anything else about it?

We do appreciate the help!

I read the shortcuts like lingche and jamie shortcuts. I am confused by reading those. Is there anyone who has followed these shortcuts and can you walk us through the whole process?

I undersatnd the part that Aproved i-130 will go to NVC from USCIS. NVC will generate case number. Then spouse can email DS-3032 to NVC using that generated NVC cse number. Anyone can send ds-3032 by email without requiring barcode.Am I right?

I am confused afterward. Can my wife(she is outside u.s.a) send me DS-230 with other documents to me and I sent them to NVC? First thing, do i require to generate barcode? 2nd thing, Does my wife must send DS-230 to NVC directly? 3rd thing, do we have to send original document like birth certificate and marriage certificate to NVC in both scenario?

It would be awesome if anyone who has gone through all the process and almost finished in NVC, guides us the rest? I would appreciate for your help.

Just had a quick question about labeling the passport photos that we include with Packet IV (DS-230). We write the name on the back. Is there anything else that should be included in the labeling(NVC case number? social security number? date of birth?)? I believe this should be written lightly with pencil or pen and put in a plastic bag. I would appreciate any thoughts or recommendations.

your wife is the main sponsor regardless of whether she is only or co sponsor. she fills out the i864. and whoever you have as a co sponsor fills out the i864a. they need copies of the last 3 years tax returns ( whatever that is, ive never seen them lol)


If co-sponsor (her mother) is household member (living with your wife), then MIL will fill I-864A.
If co-sponsor (her mother) is living at different address of your wife's, then MIL will fill I-864.

Your wife as the main sponsor will file I-864 always.

OK, so what's up with this BARCODE stuff? my attorney says we can't pay until he gets the BARCODE or whatever from NVC?


NVC will not send you barcode.

When the invoices are ready to pay, pay it.

In 1 to 2 days time, the status will show as PAID. Then print out the barcode cover letter from the payment portal.

That's what I told them, that we'd get all the expedite documents scanned in as well in PDF form..so I'm pretty sure she understood what I meant. Hopefully my wife gets her butt in gear and gets the required stuff..good thing we got a scanner at her house..I can do all of that next week when I'm there. Or the lawyer will do it..I'll bust his butt too, if he slacks.

Call NVC and get IIN. That's the next step. Once you have it, check the payment portal (it is different payment portal that we used) if the invoices for AOS and IV are ready.
