So, i'm very happy because my I-130 was approved :yes: , i got my NOA2 today. But i would like to know what i have to do next. I'm not sure of the next steps and i certainly don't want to miss anything or delay this any longer. Do i have to wait for NVC to send me something or is there something i can do first?

I really would not worry what is stamped on the back of your check.
If it is cashed by USCIS, that is what matters. If USCIS rejected your payment and/or your petition, they would not take your money.

Employment letter need not to be notarized. It must be on employer's business stationery with HR person's sign and date. That's all.

Hi guys, I have a friend and they just got married. Her husband is a foreigner from US and shes from here in our country. The problem is after her husband went back home to US, he just suddenly stopped talking to her. One day, she received an email saying he wants a divorce. No explanation. After that, she cant contact him anymore. No divorce in this country and annullment takes so long to be processed (u need finance to be able to do this). My question is..... "Is there anything she could do to make this guy pay for everything that she lost? Can she still go there to US even she still havent been there yet?" Any advice you can give will be highly appreciated. Thanks!

But she can't go to the U.S on "spouse visa", because he "had" to petition for her.

Hi everyone!
i filed i 130 for my wife about 2 years ago when i was LPR about 5 months i become citizen and i upgraded our case by phone and i sent to uscis a copy of naturalisation , number receipt and copy of passport then we didn't hear nothing from them i called them many many many times they tell me the case is in process that's so frustring also my status doesn't changed yet from LPR to Citizen
. my i 130 doesn't approve yet and i'm tired of waiting so i made an infopass .when i went there they didn't give me any good information .i asked them why my case took that long time they told me because they are so behind and they asked me to be more patient .
sincerely i can't stand waiting.
anybody have had the main situation can answer my question please:
How long does my case take to get approved after my infopass?

No.

A lawful permanent resident (LPR) is authorized to live and to work in the US of A. He is also required to live and to work in the US of A.

Of course, even a resident is allowed to take a vacation abroad, or visit friends and family in his home country, or take care of some business or relative who may be sick. There might be a temporary assignment from the immigrant's employer that requires the Green Card holder to stay in another country for a while.

But . . . a permanent resident cannot move back to his old country and live and work there for a year or longer without jeopardizing his Green Card. Another point to consider is that an immigrant with a 2-year Green Card will have to file for Removal of Conditions before the card expires, which requires him to show that he and his wife lived together in the USA.

The only exceptions to this rule is when the LPR is in the Armed Forces or a spouse of somebody who is deployed overseas.

You can apply for a reentry permit which lets you leave for a two year period. Yes, you can work abroad, but you must report your income and pay taxes on it if needed (usually if taxes are paid in foreign country taxes are not owed here, but you must file your tax report regardless).

If you re-read your electronic notice of receipt email, you'll notice that they suggest waiting to check the website until you receive the hardcopy NOA1. Also, be certain you know that you I-130 has not been "approved", it's just been accepted for processing.

I am confused as to what should I and my cosponsor say for this one. Are we both considered join sponsors..or I am just the petioner sponsor and he is one joint sponsor.


In your case, you have only one joint sponsor. So, you both can skip the YES and NO boxes.

But, check first box in Q#8 - "I am sponsoring the principal immigrant named in Part 2 above"

Based on the Indian marriage culture, Consulate may be expecting a large party at wedding ceremony, to confirm the bona-fide relationship.

I am hearing it for the first time, though.

IMO, you need to list a few parties who participated in your wedding ceremony, that's friends' friends, relatives' friends etc. A detailed autograph, in general. Include few relatives' autograph too.

Which Consulate is this? When was the interview? Did they hand over any slips? Please let us know more details.

I guess this will be my stupid RFE. I read the bold faced part of the instructions, wrote N/A because it didn't apply to me and then went on to #23. Oh well, we'll see how it goes.

I think some people have successfully went through it without proper answer here. Based on the address of the beneficiary in the form, NVC will try to locate a closest Consulate for the interview. So, if prefix of the NVC Case# is good for you, just leave it at NVC stage. Otherwise, request NVC to get the proper Consulate.

Thank you for your response. Forgive me if I say that I see it in a little different way. I would like your comment of where I am wrong.

The question explicitly asks for information if your relative IS in the US. If your relative is in the US, there are two cases. One is that your relative will apply for adjustment of status. The other case is that you relative is not eligible for adjustment of status and therefore will apply at the consulate abroad.

Nowhere is asks for information for the case your relative is NOT in the US.

And so I am confused with the answers in this topic, as well as with the sample I-130 referenced from this site.


Not eligible for Adjustment of Status means the beneficiary attends the Consulate interview abroad.

I am confused about this question as well. The questions asks to provide information if your relative is in the US. The second part of this question asks for the foreign consulate if your relative is in the US but not eligible for adjustment of status (for example came as a visitor?). That's how I understand it. Per this understanding all four fields of this question should be marked as "N/A" if your relative is abroad.

I would appreciate comments. Thanks.

Second 2 fields, if your beneficiary is outside the U.S.

Hey Loto, how were you notified of the interview? Did you call them about it or what? Just want to know for future reference :thumbs:


In normal path, NVC schedules the appointment after the NVC case completion and will be notified by email to the petitioner.

In my case, the case was expedited and forwarded to the Consulate. So, the Consulate gave me the interview date. Yes, they notified me by email too.

Aren't you going to be in the interview with your wife in Chennai, because i see that your wife's interview is on Dec 02 but you are reaching India on Dec 10.
Is it necessary for the petitionar to be with the beneficiary for the interview.

I checked with the U.S consulate in Chennai. They don't allow the petitioner to be inside the Consulate.

But, if you can get into, it is not bad.
