K-1 Fiance(e) Visa Process & ProceduresTo be or NOT be at the K-1 Visa Interview

Hi folks, just trying to get a pulse here. I've heard mixed messages. I have heard some say that you NEED to be at the consulate interview or others state not necessary. I just called the Ecuadorian consulate and they told me I do not need to be there. I will call again tomorrow to ensure I get the same answers.. And curious to others experience. Kindly share :)

I think the overall consensus is that the american citizen is "not required" to be there. Most consulates specifically state that the american citizen isn't even allowed to attend and won't be allowed into the consular section. I was there for Ben's interview because I chose to be and wanted to be, and actually made it into the consular section (how I managed this...I have no idea, the guards are just really, really nice :) When the employees inside the consular section saw I made it that far, omg, they got extremely pissed off, lol, and asked me to go and wait outside. So, it all depends on the country, consulate, personal finances, etc. My personal opinion is that it's better for the couple to be together, but again, sometimes that isn't always feasible. If you can be there ~ by all means I think it's for the best all the way around.

K-1 Fiance(e) Visa Process & ProceduresFiance backed out from interview
IN JUNE OF THIS YEAR
While on Filipinocupid.com I had a scammer take me for $ 150 and I put her story, name and picture on dragonladies.com. I almost forgot I did that and last week a guy contacted me about a girl of the same name. He said he was shocked to find her name on dragonladies.com and he told me he had drained his bank account and sent her over $ 20,000 this year. I told him I was positive the woman was a scammer but he still believes she is not and is planning on meeting her in December. He has only seen her on cam once but talks to her everyday. I am positive it is a scam but I can't convince him because he is in love :bonk:

My mouth fell to the floor when I read this....that's terrible! Wow, $20,000?? They say love is blind, but... I'm shaking my head...

You see? :) This was very positive, even in the face of what might devastate a guy of lesser caliber than you. It's the beginning of better things to come.Super! This will give you closure, which is never to be underrated.

I can tell you that there are a LOT of sweet, beautiful Ecuadorian women who will NOT take you for a ride (their culture is not geared toward that), and who yearn only for a guy who will treat them with consideration and respect. They'll return that loyalty a thousandfold (I speak from experience). When you're healthily past this current episode and you're completely in a position to look ahead, holler to me to get you set on the path, si man.

Awww, how nice of you TBoneTX, I'm smiling :D

K-1 Fiance(e) Visa Process & Procedureshow can this be passible?

Even though this is the first time in my life that i hear about that, but that would be such great news

Oh my goodness...it happens to many people here on VJ....read up on it, you can see for yourself...it's happened for many! :D

What I am saying is that we were never called for an interview. How can they give her the card with no interview?

Not everyone gets interviewed. You were approved without an interview - which happens for many people. Congratulations! It's a great thing. You are very blessed. There's absolutely nothing to be concerned about. You're good to go and should be extremely grateful

K-1 Fiance(e) Visa Process & ProceduresK1 or CR1?

So confused you all. My FI and I would like to get married now...but we would also like to have a small ceremony here (U.S.) with my mom, sister and brother present. But I don't know which would be faster because that is the MOST important thing. Having him be here by the end of 2012 God Willing and if possible? He's in Ghana and I know that he comes from a country with higher "fraud" rates and etc. So what would you VJ's recommend for us? Wait to get married here (U.S.) and do a K1 Visa or get married now like we want to and do CR1 visa? I'm trying to look at time frames.
Thanks In Advance for your time!

Hello, how often have you visited him and how long were each of the visits? How long have you known each other? These are also things to consider. A spouse visa takes longer to process and you wouldn't have to adjust his status like you would with a K-1, but depending on how often you have seen each other, could raise a flag if you have only visited once, and married on that first visit, etc. If you can provide a little more information, we can help you more.

Good luck on the interview!

She should not need that...but it's good to carry it in her carry on bag. Ben did not need his, but the embassy told him that he would...he didn't. I had it with me just in case. You shouldn't have any issues with that. Be blessed.

K-1 Fiance(e) Visa Process & ProceduresConfused with I-129F

I just talk to a buddy who did K-1 visa and he said that I should send I-129F right away. I did read guide and from my understanding I need make complite packages. Photos, copy of passport, letter that we will marry in 90 days and other documents.

So do I fill out I-129F and send it or I need get all documents first like my fiance need send her documents to me?
If some one can clarify what is the first step actually is?

Do i need send original copy of airline tickets or I can send a copy? Also other tickets where we went toghether.

You need to sit down, take some time, and review the guides...you are no where near close to sending anything. Take some time, read the guides, and you can't go wrong.

K-1 Fiance(e) Visa Process & ProceduresRetrictions on Date of Signing g-325a and Letter of Intent

We have been planning on submitting the Fiancee Visa petition for a long time.

Our g-325a's and Letter of Intent were prepared and signed one year ago.

Can we still use these? Or must we provide new signatures and dates?

What is the maximum time difference allowed between the dates the g-325a and Letters of Intent
were signed, and the I-129f can be submitted?

I would absolutely, positively not send in either of these...I would complete an up-to-date G-325A and redo the letter with the current date. I would never risk such a thing. This process is complicated enough...this would only complicate your life. Do it the right way.

K-1 Fiance(e) Visa Process & ProceduresNeed Your Opinion
Sadly enough, five months is "still within normal processing times". Our petition took almost 6 months. You can call, it doesn't hurt to do so. I called three times and finally was able to put in a service request (after I started to cry, LOL). After that request, our petition was approved three weeks later...not sure if that had anything to do with it or not. I think not as it was close to 6 months. Hang in there, it will come. Good luck with everything.

K-1 Fiance(e) Visa Process & ProceduresFront & BACK??? copy of birth certificate??

No. Copy the back, write on the blank paper "copy of back of birth certificate" and include it. They do not KNOW it is blank unless you send a copy of it, if they do not have it you will get an RFE for a blank piece of paper. THAT would be stupid.

Follow the directions, RFEs and denials come from NOT following the directions

I completely agree. I couldn't have said it better. Way to go.  :D

K-1 Fiance(e) Visa Process & ProceduresInterview ?

Thanks guys for the help will do that

Hi how do i find those embassy reviews i have looked for them didnt find them please help thanks

At the top of this website, click on "Reviews: Embassy/USCIS & POE" and scroll down to Kenya. Here's the link to the Nairobi Embassy Thread:

http://www.visajourn...-embassy-thread

Good luck and stay blessed.

In general, even if you're not allowed into the interview or the consular building, being "on the premises" for the interview NEVER hurts and may help.

It scores big points in the mind of the CO about the legitimacy of the relationship if the beneficiary hands the U.S. citizen's passport to the CO and says "He/she is waiting outside."

I completely agree with TBoneX...I was there with Ben ~ even though the CO clearly stated to Ben after he told her I was waiting outside ~ "that makes no difference to me", LOL, but I knowww it helped, but even if it didn't make a difference to the CO...it helped US...she was just cranky, haha.

I don't see why having a baby with someone else would make her ineligible. Granted, he would have to petition for the baby as well, which won't be an USC, but it isn't impossible or unheard of.

I understand ~ was only giving my opinion as the Nairobi Embassy is not an easy Embassy to go through.

K-1 Fiance(e) Visa Process & Proceduresmet fiance while still married but divorced now

why would i petition if she is pregnant by another man? because i love her ?
relationship does not seem honest? what relationship is 100% honest and how many people that are married cheat? 55% ofr americans have cheated on their spouses.

but all in all i am ready to move to kenya to be with her if she gets denied. nothing can stop us from being together nothing

I am not sure how far along you are in the process...it would be helpful if you would please fill out your timeline :time:
Just a thought...how pregnant is she??? Will her interview be scheduled BEFORE the baby is born? (highly unlikely if you just started the process) If not, what are you going to do if the Nairobi Embassy makes her take a DNA test and they find that the baby is not yours???? Do you think she will be granted a visa to the US? There is no way that will happen if the baby isn't yours. Just something to think about. I apologize for being judgmental, but I have to agree with Rebecca616.

Also, one more note...."what relationship is 100% honest"...just the simple fact that you said that isn't good. Relationships should be a 100% honest...and nobody should cheat on anybody, everrrrrrr.

K-1 Fiance(e) Visa Process & ProceduresNOA2 Question

hi Members
well i received my N0A 2 on feb 23rd and there it says its between feb and june 2012 so my question is what does this mean ? does it mean after june 2012 it will expire and have to reapply or what ? am sure someone knows please inform me about it thanks

You should email the Nairobi Embassy at this point asking them whether or not they have received your petition. You should also go to their website and read the instruction packet for the K-1 visa. You have a lot more paperwork to complete. Good luck with everything...and like I said in a previous post...read the Nairobi Embassy Thread. It will help you a lot.

another (silly perhaps) question.....when i finally get my green card, does this automatically give me the right to work? I read somewhere that at the same time i can file for I-765 for EAD and maybe get a work permit much earlier than my green card.....

thanx again
G

You should apply for AOS/EAD/AP all at the same time. You will get your EAD/AP approved before your AOS and your EAD will allow you to work while you are waiting for your AOS. Once you receive your two-year green card, that replaces the EAD/AP card.

thanks again for all the info guys......my most honest wishes for health, love, tolerance and prosperity for all of you

K-1 Fiance(e) Visa Process & ProceduresLegal Pain or Valid Counsel?

Thanks for sharing, that is really encouraging especially to hear about someone who has gone through it with the Kenyan embassy. Your timeline seems about right to me. Guess I will just have to watch and wait. Did the embassy contact Ben when they were ready to process his visa or did he have to follow up on his own? Just not sure what happens in Kenya once the case is transferred to the embassy, if they contact you or you have to be aggressive about things and follow up. Would love to hear more about your experience with the embassy for future reference.

Hello again :) Once your petition leaves the National Visa Center (you will call the center to see when they sent it to the Embassy) you should email the Embassy inquiring about whether or not they have received your package. The Embassy will eventually email you, but you will wait longer. Don't wait for them, just email them as soon as you know your package has left the National Visa Center. If we had waited for them, we would have waited almost three weeks longer...no sense in that. They are very good at responding to emails. I encourage you to read through the entire 'Nairobi Embassy Thread' from beginning to end...it's chock full of advice and tips to surviving this Embassy, lol. Looking back, our experience was good "overall"...considering it's a very tough consulate. I'm not going to sugar coat it and say it's easy, because it's not; however, if you front loaded your petition with supporting evidence, if your pre-interview paperwork is organized, thorough, and efficient, and if you are properly prepared for the interview, you'll be just fine. People don't realize a lot of things when they go through this process and think it's really easy and it's just not so, then they get blind sided during interview time. You cannot submit an unorganized petition, fill out your pre-interview papers half-@ssed, then show up for the interview unprepared for the questions, etc., and expect to be granted a visa. The Nairobi Embassy will look for "anything" and I mean "anything" to deny you a visa and people need to realize this. The smallest mistake could cost you dearly.

Ben was interviewed by the infamous "blond woman" lolol. She is very well known here on this website and yes...she is very tough. She was not nice to Ben AT ALL. When Ben walked up to the interview window, he noticed his paperwork was stamped "approved" before she asked him one question. I firmly believe the interview is a formality, and that your visa is granted or denied before you even step foot into the door. Our petition was very organized, thorough, and had enough supporting evidence of our relationship...our pre-interview paperwork was the same way. I feel this is the reason it was approved before Ben even had his interview. Like I said previously, doing your research on the Embassy, reading through the Embassy website visa section, etc., will prepare you for what's ahead of you. Ben and I read, and read, and read, and sat and did all the paperwork together so he knew it front and back and upside down, and I am not kidding. We brought further supporting evidence to the interview just in case (and I encourage everyone to do this), but he was asked for nothing.

You will be fine as long as you are completely prepared. I also want to mention that plenty of people have gone through Nairobi without a hitch saying the interview went lovely and smooth and the Officer was very nice, so please keep that in your thoughts. "Jay and Maureen" had a lovely time surviving the Nairobi Embassy. I suggest you read his review as well. He stated that this Embassy is one of the toughest in the world, however, if you are prepared, if you have a legitimate relationship, and you are organized, you are treated with the utmost respect, and he's right for the most part. However, Ben was not treated with respect, but that all depends on who you get as the Consular Officer. :D

I hope this helps you, and feel free to ask anything during your journey. Stay blessed.

It's been 4 months and 1 day now since we receive our NOA1 then my Fiance didn't get a chance to call for follow-up, sometimes it went to arguments for us if we talk about it.Just to share how frustrating it is when you don't know when is it coming my friends who went thru K1 advice me to follow up and ask to USCIS but my Fiance always busy :( :( :(

Many people are also waiting for their NOA2 for a very long time now, including us.We are on day 169 from our NOA1 date and still nothing. My fiance calls USCIS regularly to follow up our case too, but they always say the same thing..."Currently processing March 15 filers".It's upsetting to wait for this long already specially that the holidays are coming. But Thank God I have a wonderful fiance. He makes everything okay and makes me feel better all the time.No matter how long this wait is,I always think that this is just temporary and we both will be together soon and this time it's gonna be FOREVER

Be strong, support each other, pray hard.It will happen soon at the right time. :) :) :)
