IR-1 / CR-1 Spouse Visa Process & Procedureshow to apply my wife to go to us

i am sorry whats the meaning of usc?
another quesiton.
if i apply reqular in us . my wife will be interviewed in canada? how come? and how long it could take from the time i apply her until the visa interview?

thanx/////

She will interview in Montreal because she is residing in Canada.

The total time from the initial petition submission to interview date can be anywhere from 9-12 months. (Montreal has historically been a slow consulate as far as interview bookings go.)

IR-1 / CR-1 Spouse Visa Process & ProceduresCR1 February Interviews???!!!!

Hello all!
We are getting super close to our interview date..NEXT WEEK ON THE 15TH! Anyone that has recently been through the process have any tips/suggestions for the interview???

We have all of our paperwork together and pictures, etc. I am traveling to Montreal with my husband..will they let me go in the consulate with him or will I have to wait until he is done???

Also, I heard that they take his passport before he leaves..is this true??

ANY advice would be greatly appreciated!!!
Happy interviewing!!!

Searching through the Embassy reviews for recent Montreal interviews will give you an idea of what to expect. We interviewed in 2009 and my husband (the USC) accompanied me, even into the interview room. (My review is posted in my timeline.) Yes they will take his passport. The visa is placed into the passport and returned to you via DHL. Have you signed up for a DHL location? If not check out the Canada forum for threads discussing it.

Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresOK to marry in US on a B2 visa before filing I-130

I just wanted to say thanks to everyone for the help; my fiancee and I tied the knot over the weekend without any trouble in the US, and I'm going to file the I-130 as soon as I can get a copy of the marriage certificate.

After the wedding, se crossed back over to Mexico, and I told her that once the I-130 is in progress, it would be best to have documentation ready when she crosses that shows that she has income and strong ties to Mexico. She frequently crosses into San Diego to go shopping (as it seems half of the population of Tijuana does) so hopefully they won't hassle her too much.

Congratulations on your marriage and best of luck with your petition.

As canadian_wife posted, check out the Canada forum. There is a pinned topic that discusses the domicile issue. Read through it carefully as Montreal is very particular about this issue. Proving Domicile

I believe domicile is required for both visas; here is another thread that discusses this issue. K-1 Domicile in Canada.

IR-1 / CR-1 Spouse Visa Process & ProceduresMarried, and finally ready to start CR1 :D
Make sure you don't over stay. It will result in an automatic decline of your Visa at the interview. Also to Clarify in case you aren't aware. You can travel and remain in the US up to 6 months out of any CALENDAR YEAR. Some people are under false pretense that when they return to home country the counter resets back to 6 months. They keep tabs on how long you've spend each visit. If it tallies past 6 months you will be docked for an over stay and expedited removal will take place. You can avoid alot of heart ache and pain later by just sacrificing a for a short time. Hope it all works out!

IR-1 / CR-1 Spouse Visa Process & ProceduresConfusion on path. Please help!
After you have completed all administrative processing with the USCIS and NVC you'll have to wait for NVC to assign you an interview. Assuming all goes smoothly with your petition, it can take anywhere from a year or more. You are fortunate though because apparently the backup at MTL is being cleared away pretty fast, and they have been assigning interviews at a faster pace. So its very possible to complete this process in one year.

IR-1 / CR-1 Spouse Visa Process & ProceduresFees
All of this information can be found with just a little research on these forums. You should try doing a search before asking questions. Just a helpful hint! :)

Fees are charged for the following services:

Filing an immigrant Petition for Alien Relative, Form I-130
Processing an immigrant visa application, Form DS-230
Reviewing an I-864, Affidavit of Support (for petitions filed in the United States)
Medical examination (costs vary from place to place)
Fingerprinting fees, if applicable
Other costs may include: translations; photocopying charges; fees for obtaining the documents you need for the immigrant visa application (such as passport, police certificates, birth certificates, etc.); and travel expenses to go to the embassy or consulate for the interview. Costs vary from country to country and case to case.

I-130 = $420
DS230 - $404
I-864 = $80
--------------------
Total = $904

If you live in Nicaragua the price for the medical will vary depending on what you need. In Nicaragua the embassy is in Managua, and the doctors they use can be found here http://travel.state....N-0001-0808.pdf

Call any one of those doctors to get pricing on how much it'll cost for the general medical. If you also need additional shots it'll cost more money. So if you can get the required immunizations before the actual medical you'll save money.

This should get you started in what you need and what you need to do.

Hope the best for you!

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC Gives us SECOND RFE!!
Whats funny is people don't understand. The RFE wasn't for incorrectly filled out forms. (what the lawyer would do) Most of you have no clue about Electronic Processing which is a pilot program we are taking part in. For what ever reason my wifes Birth Cert. wasn't accepted in its Digital Format. Many of you are ignorant to the EP process so before you comment on it educate yourself first. You'd than understand why I am so upset about the RFE. It's basically bogus. The Digital copy they got was extremely clear and legible. IT also contained all information necessary on it. It's just upsetting because I'm finding out many people who are from Canada are getting the same RFE's. It's a stall tactic.

Also for those saying not to get upset with the Customer Service, I didn't up just over all upset. I understand how a call center works, its just frustrating when there is no communication between the adjudicators and the front lines who answer the phones. Either way, we are taking care of it, one of the pluses with EP, is when you get an RFE you can immediately take care of it instead of using snail mail.

p.s.
LOL at the dude in here who said if I had a lawyer I wouldn't of gotten the RFE. As many have said the CR1 visa is very straight forward, anyone even with a basic education and reading comprehension would be able to put this together. I'm also proud to say we got all the way to this point at NVC with no RFE's. While your spending thousands on a lawyer, I'll be sitting back counting my extra cash deciding what to do with it.
Matt n ShannonMaleCanada2010-11-23 09:52:00
IR-1 / CR-1 Spouse Visa Process & ProceduresNVC Gives us SECOND RFE!!
I'm so upset right now. I think the NVC is clearly handing out RFE's to stall the process. First they gave us an RFE because my wife listed all the addresses she lived since age 16, when they just wanted one address for a 6month period instead of multiple. Although they got the same information they sent it back. We call today and they tell us, my wifes Birth Certificate wasn't accepted. When My wife asked why, the person says she isn't sure. We spoke to a supervisor who than said it is most likely an error on their part. She said they don't know why it wasn't accepted but asked my wife, if it was the large Birth Certificate, which is printed on currency paper, with an official seal. My wife of course upset said YES OF COURSE IT IS!. She said was it properly scanned showing all border. My wife again upset said OF COURSE IT IS!. Im looking at it right now!. Supervisor said well Ill have to send an inquiry over to that group. It can take 10-12 business days before we can tell you why it wasn't accepted. She than proceeded to say, if all you say is true. They could of been having computer issues and downloaded the document wrong. How the hell does that happen in the 21st century? In this technological age, they downloaded the document wrong and so we get RFE'd? How is this even fair. These RFE's are bogus and BS. I just don't get whats going on with NVC right now. How can the people picking up the phone there have no clue or be unable to give us even any hint as to why it wasn't accepted or even know whats happening with our file. Now they are guessing what could be problem not giving us a clear shot answer.. Frustration is an under statement for how I am feeling right now.

Any Suggestions?

IR-1 / CR-1 Spouse Visa Process & ProceduresINTERVIEW QUESTION - HELP!

Hey yall,

3 quick questions. Going for my interview on Feb 18.

1) Do I need to bring my father-in-laws ORIGINAL tax papers (since he is co sponsoring me with my husband) or do copies suffice?
2) Typically, how long after the day of the interview is approved do you get your passport back with the visa? I wanna leave 2 weeks after the interview day to move to Chicago.

3) Read something about DHL courrier to deliver your passport back? WHat is this???????

any help would be great! thanks lovelies :)

Montreal Girl you should really post in the Canada section of the forums. MTL embassy uses DHL now as their courier it is the only way to get your passport back. You HAVE TO Register on this site BEFORE your interview and since its coming up soon I'd def hurry.

Go to this site
www.usvisa-info.com

select your country which is Canada. Click Sign in at the top and than you have to select the DHL branch closest to your home location. If you do not do this you will delay getting your visa back.

But it is entirely up to your decision.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestions regarindg G325a

1. None or n/a.
2. You should make an effort to get the date for her parents birthday. If you cannot, you can just write these years after you print the document. Be sure to write slowly and carefully and clearly using black ink (since most likely your printer will print the document in black and white.)
3. Yes. You should put the name typed out in English (i.e. transliterated.)
4. Follow conventional Vietnamese addressing scheme. Perhaps a Vietnamese user can chime on this. There are some here.
5. You don't need her parents' birth certificate.

Pro tip: Eventually, when you have to fill the DS230 in many months, you'll be asked for her parent's birthdays or essentially what's on the G325A form. Make sure you keep a copy of this so you can fill out the DS230 exactly like your G325A form.

IR-1 / CR-1 Spouse Visa Process & ProceduresRenewal of CR-1 prior to expiry?

Loto - this is consulate specific. He the OP should contact the consulate BEFORE the visa expires instead of playing a game with them and hoping an extension will come.

OP - do NOT wait until the visa expires. You may be stuck in UAE waitng for your spouse to file another I-130

Good luck

That's correct Canadian_wife.

OP, you should contact your consulate before your immigrant visa expires. If they don't extend it, you should be here in the U.S before its expiry.

IR-1 / CR-1 Spouse Visa Process & ProceduresRenewal of CR-1 prior to expiry?

I'd really appreciate further input from the rest :)

thebighash,

If an immigrant visa has already been issued and circumstances force the alien to remain abroad longer, the applicant should contact the U.S. consulate and request an extension of the immigrant visa's validity. If the validity of an immigrant visa expires, a new one may be issued upon payment of the statutory application and issuance fees. Also, provide adequate reason why the travel is not possible before the visa expiry date.

Hi Lotto:)

" Warning :ot: "

Because of what's happening with the July filers from TCS am having now hesitations to pursue it.
BUt anyways my question is what if i get pregnant and have a baby in my homeland Philippines, what will happen to the baby's citizenship? Can the baby acquire his father's citizenship (USC) or mine as a Filipino citizen coz the baby will be born in the Philippines?

Thanks

cutiezoe,

You are in the same boat of mine as well for baby's situation :star:

By birth, baby will be Filipino citizen (Get Philippines birth certificate and all the child birth records in the hospital including original ultrasound scans etc.). Then, you can make the baby the U.S citizen if:

1) One or both the parents is/are USC when the baby is born (in your case, father is USC)
2) USC parent is based in the U.S for the last 5 years before the baby is born in any status including USC, LPR etc.

If you qualify, both parents must be present in the Manila Consulate (American Citizen Service - ACS) with the baby to apply CRBA (Consular Report of Birth Abroad). During this appointment, you can file CRBA and apply baby's US passport and SSN.

SSN is free. But there is a fee for CRBA and U.S passport. Also, check with your consulate if the appointment is needed. Some may be just walk-in as well.

In India, we had U.S birth certificate and US passport for our daughter in 1.5 months time, I think. But, SSN took few months to arrive. If you are not keen for SSN for any purpose including tax filing, you may apply SSN after reaching the U.S as well. It is very easy in the U.S.

Good luck!
