IR-1 / CR-1 Spouse Visa Process & Procedures	July 2010 CR-1 filers	Oh no! sad to say I'm still here in the Philippines, because of the RETROGRESSION on EB ( third preference). Currently they are only processing priority date April 2005 and my priority date is NOvember 2006, so i was stocked here. I think I'm done with USCIS and half on NVC, my Visa fee bill is paid already but they weren't able to transfer my papers to the Consulate due to the retrogression. CR-1 = i'll be going to US with my marriage less than 2 years b. IR-1 + i'll be going to US with my marriage more than 2 years Questions: What if i will be able to go to US using CR-1 , then after 2 years of stay i'll have my adjustment of status. When can i apply for citizenship? Will i count since i moved to US (3 yrs of waitng) or since the adjustment of status ( 5 years of waiting ) ? Coz i think if IR-1 i don't be needing adjustment of status and automatic after 3 years of stay i can apply for citizenship? **** I know this is to early to ask but i just want to have an answer to all the questions on my mind now. If the length of the marriage is less than 2 years between marriage date and POE, it will be CR1. If it is greater than 2 years, it will be IR1. In both cases, your naturalization paper work (N-400) can be started 2 years and 9 months after POE, if you have sufficient physical and continuous residence in the U.S. In CR1 case, you will have to do Removal of Condition - ROC (Not Adjustment of Status - AOS) after 1 year 9 months of POE, but before 2 years of POE, by filing I-751. IR-1 / CR-1 Spouse Visa Process & Procedures	July 2010 CR-1 filers	Hi LOTO, Its me again cutiezoe I have a question, am just concern with my situation as a beneficiary by USC husband. I have a previous/pending US immigrant petition (Employment third preference), I am already approved by USCIS and and with a priority date of NOv 2006. Also my employer/agency already paid the VISA bill and i have a VISA number or MNL number actually I'm just waiting for the interview, but because of the RETROGRESSION that's happening on the employment category everything turns to what i didn't expected. Currently they are only processing priority date of April 2005 and I've already waited for 3 years or since 2007 for the NVC so i decided just to dumb it if ever I'll have my turn. But my question is will it affect my husband's petition (1-130 )? Will the USCIS and NVC and US embassy or consul consider my previous petition and deny my? Actually we've argued this before and my husband told me it wouldn't affect because it's a different petition. BUt am just worried with all the delays that's happening on my papers am becoming paranoid now. Thanks cutiezoe, Your hubby is correct. Since one is EB and other is FB, it won't affect each other. My wife got here on Dec 3rd we had a wonderful christmas and new years. she was going to go back on Jan 10 but since TSC is taking so long she has extended it to Feb 27 as she has a 90 day visa. We have just gone ahead and started our life together, we found a house and are in the process of buying it, should go to colusure on Jan 31. and we are just enjoying being together. wife and stepson are loving the US though and he has already made some friends. IR-1 / CR-1 Spouse Visa Process & Procedures	July 2010 CR-1 filers	Loto, Our application was also transferred to TSC on November 18. I received the Snail Mail before the E-Notification. So we're at TSC with everyone else. It happened while I was visiting my wife. So with the 3 week visit with my wife over, and wishing that I could have just brought her home with me when I had to leave on the 21st, I'm just waiting on USCIS and the TSC to let me know something. Loto So what does that "post decision activity" really mean? Does anyone know? I know what USCIS says about that but really those who got a notice saying that, were they approved or not? Anyone knows? "post decision activity" means case is made a decision and in further activity such as sending to NVC etc. It is an indication that the decision has been made by the USCIS. Does the NVC will give it to me and will just fill it up and send it with the other requirements.... We are still waiting for the approval but we are on our way to our 5 months that's why i want to prepare myself for the process. Those 2 barcode cover sheets will be printed out from the NVC payment portal after you pay AOS fee ($88) and IV fee ($404). Not now. Prepare all other documents handy before entering into NVC. Would like to ask Lotto if he knows how long will it take for us to get a copy of tax return from IRS once we call them ( actually my husband has a copy of his tax returns but the one who made it was his accountant where he's paying every year just to compute his tax and i'm not sure if NVC will accept that or it should really be coming from IRS). If you don't see a touch, it doesn't mean your case is not being processed. It is the technical glitch in their web site. Some people are lucky to see the touches throughout their process. I have seen many who got approval even without a single touch. When my case was approved, it still showed "Initial Review". And almost a month after, the status moved from "Initial Review" to "Post Decision Activity". My case on the USCIS website still says "initial review". The letter was from the Texas Service Center. The Notice Date is November 23, 2010........wonder why I got touched on the 24th and 26th? By the way, I am wondering how many touches it need to get approved? Initailly, I was worried about not having touches at all. Now I am kinda worried if it will draw RFE. I hope not. My 5 months mark is appraoching. I read from others in another link that special cases are transferred to USCIS and the transfer is not normal. I am kinda worried about my case right now as it has been transferred from TSC to USCIS. I have not wanted anything so bad than approval in my life. God help us all People are not working on Sunday.
