I wouldn't worry so much about it. At least at the interview in the UK, so long as you have a cosponsor who has three years worth of tax returns, you should be fine. For instance, I am the USC and I was a student at the time and never filed for taxes in my entire life. So obviously on my end, I didn't have any taxes at all to show them. This was completely fine, as I brought in a lettr explaining my situation and also let them know that my cosponsor at least had her taxes. It was all fine. They questioned nothing.

I would supply what taxes you can, make sure your parents provide their taxes, and if they ask why you're missing one year's worth yourself, just explain it to them. They know everyone's situations are unique and different.

I am the USC and at the time my husband and I applied to have him come to the UK on a K-1, I was actually living in the UK with him and had been doing so for the past year. I put my home address in the States down as my current address, despite the fact that I actually wasn't living there at the time. This was not a problem, but I did include a note in one of my packets that explained my situation and that I was living abroad for the time being. This didn't seem to be a problem at all, and I would suggest letting them know as soon as you can.

I was also a student and hadn't worked a day of my life, so also had no income or taxes or anything at all to show them. My aunt was the cosponsor and they looked only at her documents and didn't bother with me, because of the situation. They were extremely understanding about that.

It's not up to an individual clerk or state to verify immigration status. Chances are good he has SOMETHING to prove his identify and if not, clearly he needs to get something. If everything was stolen months ago and he has NOT yet replaced his identification, I would very seriously question the entire story.


To the OP, re-reading this story, I think it's all bullsh!t. Who does nothing when their visa and "all his paperwork" were stolen? His "work visa" ran out? Who sponsored his "work visa"? Is he still working? Did he report the theft? Did he make an infopass appointment to see how he could replace the visa? Did he go to the Mexican consulate in the US to request assistance with replacing his passport/ID/etc?

Smells like an illegal entry and there is no way he can adjust his status in the US.


It's not actually. My family would never pull an illegal entry after all the help they gave in helping me with my LEGIT marriage.

This man is 25 and has dreamed all his life of being a musician in America after getting fairly well known at an early age in Mexico. He befriended a US woman last year who worked as his sponsor and brought he and his other musician friend into the country to make music, because she had her own recording studio in Chicago. A fight broke out however between his friend and the woman sponsor about 3 months into their stay. With the help of her husband she took their visas and their passports and a great deal of their belongings after the fight and tossed them out of her house. They could never get them back.

They moved from Chicago to Washington when a friend offered to help house them. They have been here ever since even though they no longer had their visas in hand anymore. My sisters boyfriend never once tried to work illegally or do anything that he is not welcome to do. His friend went back and my sisters boyfriend stayed because he met her and they had started their relationship. My sisters boyfriend has a passport, he has been to the Mexican consulate several times, he has copies of all the paperwork he ever needed of his whole visa process, he just doesn't have the actual real copy in hand. That was stolen.

He IS legitimate. But he doesn't understand the whole visa process that well, USCIS has been giving him conflicting information every time he calls (as they ALWAYS do), his English isn't 100% so he doesn't understand a lot of the things he hears from them and then he hears a different story when he goes to the embassy.

He fully intended on moving back to Mexico a few months ago, but after talking to his family they have agreed the relationship is important and that he should carry on the relationship. The only reason he doesn't want to go back to Mexico is NOT because he's trying to smuggle into this country, but because he's afraid that since he overstayed his visa that they won't allow him to marry my sister and come back to the US and he will lose EVERYTHING he cares about in the process. So he has just frozen himself here, not wanting to do anything until he gets some advice. It doesn't help that he has not worked in months after his visa ran out so he has no money to GET back home even if he wanted to.

I am smart enough not to put up a bullshit immigration story on an open, often watched forum. What's more, I don't support the fake marriage of illegitimate immigrants because it's for that very reason that REAL genuine cases of marriage have to go through all of this frustrating process. I myself have been going through it for years now and if my sister or ANYONE I knew was ever trying to pull a fast one like what you accused, after everything I myself have gone through, I would never support it nor try to help. In fact, I would probably report them.

This man is my family, like a brother to me, and I don't appreciate any accusations of his legitimacy when I am coming here for some true, honest help.

Okay guys, I have a weird scenario to let you in on. I am hoping that someone will be able to offer some guidance and honesty.

My husband and I did the k-1 visa and now he's got his 2 year permanent resident card and everything is good.

But now...it's my sister's turn for a journey! But she has a very odd case.

Her boyfriend is from Mexico. He came here to America on some sort of a working visa. He's a musician and he came here to play music. I believe he was on a 6 month visa or something. However, a few months ago his visa and all his paperwork were stolen. He no longer has anything of the sort in his possession. Then, his visa ran out like 2 months ago and he is still here in the US now.

The reason why he did not leave is because he was in a legitimate relationship with my sister and did not want to leave. He was frightened that if he left, he'd never get back here. But now she is ready to marry him and is eager to get on the process so they can start a life together.

Our concerns though are:

1) He overstayed his visa and never left the country. They will probably want to deport him as soon as he attempts to marry my sister.
2) It will probably appear that he wants to marry my sister BECAUSE his visa is up, and this is simply not the case.
3) They are frightened that if he goes back to Mexico, it'll be hard for him to ever get back into the country and they will lose eachother.

What is your advice? How should they start this process if they can at all? What visa would this be categorized under? Should they appeal for a marriage here or does he have to go back to Mexico first?

This seems like a confusing case.

.... ok so finally my petition is approved from USCIS and NVC by May 2008 and they sent over the case to Bombay (wrong consulate) they reschedule our interview at the right consulate, Delhi. My husband went for his interview in July 2008, after the interview they gave him a 221g AP for more proof such as a family tree, addresses and phone numbers of all relatives, guest list, emails, phone records, voters card ok so we sent them everything to the VFS office with his passport. They sent back his passport with no visa. They said its in Administrative Processing....

its been 7 months and still no word. I went to my Congressmans office and they gave me the same response. I call DOS and they give me the same response "221g administrative processing, etc"

I went to a lawyer and the lawyer said theres nothing he can do for me.... I cant file for the fiance visa because they will reference this case and it will be the same problem....
I have went to India 3 times and Im going this 4th time for 6 months... the first time i went was for 3 months second time was for 5 months and the third time was for a month and now im going to 6 months.

what else should i do ? im soo sad....
Does anyone know what i should do now besides wait?

My husband had his interview in Delhi and got a 221 g show more proff and list if relatives family tree etc... we did everyhing... we sent them all pictures... and now i don't know what to do its been 4 months since then and still i have not heard anything... i contacted my congressman and he said he contact the consulate and he will let me know what they say..... i don't kno w what else to do? should i get a lawyer?

What did you submit with your I-130 & DS230? Is your husband faimily related to your family in any way?

What exactly did they ask your husband? How long was his interview? Did you go with him to the interview? Did you submit marriage photos, marriage invitaiton card, showed them gift/card exchanges, Your e-tickets or your passport arrival stamps.

I am not sure if staying in India for a long time would help or hurt your case because of affidavit of support.

Have you tried to get information under FOIA act on your case. I am not sure if FOIA will help but you will know what information is in your file. Maybe other VJ members may have more insight into it.

Hi master mind... ok well i submitted emails and photos with my I-130 and DS230. My family is related but very distant.. my cousins married his uncle... we are distantly related. I did not go to the interview with him as I was here. The interview was very short; they only asked one question: How did we meet and my husband said it was arranged by our family.
They gave him a 221g even though he had more things with him at the interview he would not take it. We submitted marriage photos, invitation cards, wedding videos, gifts so many tickets and notarized stamps from my passport. Notarized statement from my mom and his mom on what they think of our marriage, family tree, voters card, list of weddign guests and how they are related to me.

I have never heard of FOIA? Can you please explain to me on what this is?
im leavign to India in 3 weeks so now i won't come back until i am with him. I left my job for him because we started having lil arguments and frustrations b/c of distance.

He had his interview in August 2008 and received a 221g administrative processing... they asked for proof of relationship and we sent them loads of pictures, emails, my passport to show i live with him for 6 months..... and went back and forth to India 4 times..... All relatives names here and India....
we sent them everything.... and still we heard nothing it's going to be 4 months and I don't knwo what to do what lawyer to go to ? if a lawyer can do anything??? I went to my congressman and she said she will find out for me....
I am living in NJ and cannot leave my job because i used all my vacations days....

Ok, my question is this. How much time can someone with a CR-1 Visa travel abroad?

Here is what happened -

Wife came to US on a CR-1 Visa, but then 1 month later she had to return to her country because of a family emergency.

When she left the US to go back to her country, her greencard was in the mail, so when I got it a few weeks later, I sent it to her, so she has her greencard. She also has a Social Security Card, and even a US Military Spouse ID. To note, I remember at the airport, since she didnt have her greencard, they put a strange stamp in her passort.

Anyways, my wife for some reason thinks that she has only 6 months time to be absent from the US, and if she doesnt return before the time is up, she won't be allowed to enter the US. I have read these forums and searched elsewhere but I just wanted to come here and ask you all, because you have always been so helpful in the past.

Please, anyone know the answer? :(

You should not be required to present a waiver. Unlawful presences starts accruing only after your 18th birthday and you're only banned if you have accrued 6 months or more of unlawful presence. So since you left 2 weeks before having 6 months of unlawful presence you should be fine.

I would be the first to admit that I did all the paperwork on my own by reading the guides and following directions on this site.
Unfortunately I still don't know how successful I am in filing since I filed on February 5th and I haven't even received NOA1 yet crying.gif !

First of all I have to say thank you to everyone who has provided so much information on this board.
I have a rather quick question.
I sent my 129F package on Feb 5 looks like it was delivered to VSC on the 7th.
I do not have signature by mail for delivery confirmation yet.

My question is will I get NOA1 receipt via email + mail or just via mail only?

Just want to pinpoint to the rest of the community there are absolutely no NOA2 approvals issued today... Looks like they are doing maintenance.

I wasn't counting on that...... I thought I'm in a clear now. Damn it. Now I have to make correction to my finance arrival time frame...
Anybody else has an experience with NVC administrative review and how long it took?
