Vasani - Thanks for the update. It feels good to hear this from the congressman. I truly believe that this is it. The time has come before we start seeing approvals left and right.

Whoever read this thread - I request you to be optimistic as your positive thoughts will create positive energy which will only help. I read somewhere that positive thinking gives rise to positive energy and vibration. More the better smile.gif

I am positive too !! I'm positive the squeeky wheel gets the grease. and I'm very sure the approvals are soooo close. but if you want your petitions on top of the heap, you better make a little noise for yourself. you are your best advocate. don't go overboard with the calls and letters to your senators and congressmen. but make sure they know who you are and the pain you feel. our congressional inqueiry has already been made. we'll let you know how it turns out.

Yes and yes. If there are no others, your household size would be three. You are sponsoring two intending immigrants.

thanks for your response pushbrk, I have an 8 year old at home, so household size is four.

You can legally marry in any country, as long as you meet the requirements of THAT country (needs to be individually investigated)... Some allow destination wedding (1-3 day wait on a license)... Others may have a paperwork or other beauracratic requirement.....

You may be referring to the 6 month requirement is for directly petitioning for a visa at the foreign consulate rather than a stateside USCIS service center... Since a K-3 cannot be petitioned for at the consulate, it will not affect you. A K-3 can be interviewed at the consulate in the country of the marriage. So a wedding in Spain could have the visa interview in Madrid, etc.....

So if i were to fly to say Dominican Republic to marry, i couldn't have my visa interview here in england?

Thats correct. You would have the interview in the Dominican Republic, if thats where you got married.

K-3 Spouse Visa Process & ProceduresVSC - New Processing times
hey guys, print the page with the processing times before they change it on us !!! then get all your paperwork in order and contact your congressman and senator.. this is what we have been waiting for. they can no longer say we are inside the processing times and we have to wait. I do think they realize this and they have a lot of petitions ready to approve. there is a chance they were giving the embassey's a chance to catch up. they are trimming time off in different areas like the doc verification in manilla. lets hope they are done regrouping and are ready to work now. I have contacted a congressmans office last week and I'm waiting for a reply. but now I will contact another and a senators office. remember to print the processing times before they change it. and good luck to all !!!

are the checks direct deposit, or at least deposited in an account every month around the same time.. If so get a bank statement which you will need anyway. also a notorized affidavit saying the income is steady might work.

K-3 Spouse Visa Process & ProceduresIncorrect middle name for beneficary on I-130/129F form
QUOTE (Y_habibitk @ Oct 27 2008, 11:09 PM) <{POST_SNAPBACK}>
My husbands name is mispelled on his passport, but we used that name as not to cause any issues. I emailed the embassy and they said that he could change his passport and they would issue the visa based on the visa name.
I guess my question is this...
Could changing a name on a pending application effect background checks, I wonder?
To the OP, if you do sucessfully change it on the petitions, let us know please smile.gif

Lisa

Maybe I want to use that typo error trick anyway wink.gif

is the name on the g-325 correct ? if so I would try the typo trick. it worked for us. I would think the background check would have a lot to do with the info on the g-325 and birth certificate. if those two are correct, I think you will be fine. and also it was my wifes middle name that was not correct. good luck and remember I am not a lawyer, I'm just telling you what worked for us...

K-3 Spouse Visa Process & ProceduresI134
first, if you have a corporation, why are you getting 1099's ? the people you work for should write a check to your company and you should be paying yourself a salary. I would write a letter stating the date you started the business and the nature of your work. explain that it is a full time business (if it is ).and what your salary is per month or year. then I would gather your last tax return and include it with your I-134...make sure its signed. make sure you include a letter from your bank as descibed in the instructions for the form.

well, I believe its the signature that is notorized. so if he can get his employer to have it notorized than thats great. if not he might want to add a short note stating,... K-3 Spouse Visa Process & Proceduresemployment letter question
QUOTE (jodette @ Oct 31 2008, 01:11 AM) <{POST_SNAPBACK}>
Hi. We were asked by US embassy to submit my husband's employment letter and have it notarized. My husband has just finished studying and now just got a job. My question is, Is it ok to submit the employment letter to US embassy even if he just started working? Consul said that it should state when job started and how much is salary. Is it ok to put the annual income even if he just started working? Can we also put the yearly income on the I-134 even if the yearly income will still be generated next year? Please share some advices.. thanks so much...

Yes, I would submit the letter.with the start date, monthly salary, what the annual salary will be. and make sure the letter states the job is a permanent position. doesn't say anything about the letter being notorized in the instructions though, it just says to put it on company letterhead. but if they ask for it to be notorized then I would do it.

K-3 Spouse Visa Process & ProceduresVSC Approvals / Touches - Week of October 27
Hey guys, We wish speedy approvals for everyone waiting. I also think you need to write a letter to anyone that will listen. especially your congressman. what we did was ask for a "service request" for a small typo error on the I129 & I130. they were happy to help, and I surely believe it got our petition to the top of the pile. after that I waited a week and wrote a letter to my congresman ( faxed it ). and also called his office. I followed the call up the following week. hope this helps and good luck to all....

K-3 Spouse Visa Process & ProceduresLetter from my Congressman
Personally, I think you did the right thing by contacting your congressperson. I would give it two weeks and do it again. next time I would explain how the present economy along with the slowdown at VSC is forcing you to make choices. whether to support your familiy in two places or pay your mortgage. therefore causing you severe financial loss. setting you up for an expedite if needed. nothing ventured, nothing gained.

K-3 Spouse Visa Process & ProceduresDid any of you have your congressman help you?
well you can contact 2 or 3 congressperson's, but depending on where you live. you will usually only get help or response fron one. you will live in their district or area. there seems to be a big coincidence with some people contacting their congressperson and the approvals just seemed to happen that week with no real tie as to whether the congressional inquiry helped or not. it takes no longer to write a letter to them then it does to post here on VJ. and although you have just a very small chance with the congress office helping- your post on VJ complaining will get no results. think of all the negative effects of waiting this has posed to you and your family and make them aware of this. ( lack of concentration at work, severe financial loss suporting your family in two countries, etc. ) let them know who you are, and the pain you feel.

K-3 Spouse Visa Process & ProceduresDid any of you have your congressman help you?
if its in their hands now, then it will only be a few days.. I think you did the right thing. you must be proactive in your immigration procedures. you are your best advocate !!! don't be afraid to follow up with a call to your congressmans office again.

K-3 Spouse Visa Process & ProceduresSending a Group Letter to Four/Five Congressman Who Oversea USCIS
QUOTE (esmatsgirl @ Oct 17 2008, 09:05 AM) <{POST_SNAPBACK}>
Wow...this is something that has needed to be done for a long time now. yes.gif Thank you for volunteering to lead us and write the letter.

The most frustrating piece for me was being misled to think that the K3 would get my husband here faster....and in the end the I-130 was approved before the K3...now that is just ridiculous....the K3 is supposed to be a fast track...to reuniting families and the system is completely failing. Actually I think if they just stop the K3 process then the system would be relieved from so many petitions it may actually improve I-130 processing time!!!! Telling people they can file the K3 to get their spouse here faster makes them all file it....who wouldn't? And now they not only have the I-130 but also the K3....double the work. And in the end the I-130's are done first....how can that make one bit of sense? Why isn't anyone doing anything to fix it?????? It IS a very logical question.

Then we move onto the NVC...who did a noble job with processing our petition really fast but then when it came time to getting scheduled for our interview it took over 3 months!! That drove me insane. To finally be through the NVC...after my long frustrating wait at USCIS in Vermont....case complete...and can't do anything....still in the water...nothing....for over 3 months just sitting there waiting for an interview date......and this is not just with Amman....its with many other consulates as well.

Its strange, its mysterious and I am sick of being held outside of a giant steel door of the immigration process. There is no doubt it needs improvement and major improvement. Everyone in the US focuses on the immigration problem we have with people crossing over to the US from Mexico and bringing a boat from Cuba, etc...but I NEVER hear anyone in any political realm discussing how awful the actual immigration process is...how long it takes, how inconsistent it is, how unfair it is, mis-managed and absolutely inexcusable!!!!!

You got my vote, my signature...I'll even take a trip to Washington if I have to....I can see all of us protesting by the Reflection pool holding signs about these issues, maybe we can get it on the news...haha...ROADTRIP!!!! kicking.gif

I will start working on the draft letter and upload by Friday. If you, or other VJers have additions, just respond, and I'll get them. The point, I think, is to have a letter that several of us send to the members of Congress who sit on the "oversight" committee for USCIS. There is such a committee, and they should know that we followed the guidelines for submitting our petitions very strictly, respecting the work of the USCIS and putting faith in our government's systems. We believed that we would be treated fairly, and that our spouses and children could come here to the United States legally. Most important, we had faith that the process would be humane in terms of the time frame. So far, many of us have seen others get approvals/responses in general, faster than what they assert is their normal, just order--"first in-first out" and therein lies our deepest fears and roots of frustration. Sorry to be long-winded, but I get this way when I think of how long our separations have been. All the best--Amor1

I was thinking of incorporating a spreadsheet a couple of us are maintaining to show the inconsistencies.
It clearly shows CSC is speeding right along while the VSC is laaaaaging.

The fee is waived for FILING THE I-129 after the I-130. so no harm in filing it. you can always choose the path you want to take later. ...also, are there kids involved and if so, did you file an I-130 for them too. that also makes a big difference.

stands to reason, you will need to meet the p.g. for the address you use when you file. if that will be in the lower 48, then use those P.G. it won't matter what state you work in. what matters is the state you live in.

Dear members ...
I want to ask about something i couldn't understand , My US wife Received I-797 c notice of action at 23 july 2008 regarding to our case I130 which we applied to get an action in 1 April 2008 , when i go to the official website of USCIS they say within 6 month's everything should be done and since last Sep my attorney always telling me its nearly done ... this week , Next week ...and nothing appeared yet !!!
Last time i called my attroney was before one week and he told me within 2 weeks i must hear anything from them !! .

Now i want to ask we are in nov 2008 and we applied to take an action of approved case I824 in 1 April and we received Noa I-797c at 23 july and till now nothing appeared !!! is that normal ??
2- how long shall i wait to received the Noa2 ??
3- im out of the timeline ?? i mean i waited more than 6 month's ??
if yes what shall i do now ???
Thank you !!!

I got my NOA1 on April 1st as well and have only one touch since then and am not approved yet. you are not outside timelines yet for I130. According to USCIS they are working on Feb 08 now. According to VJ which I think is more accurate they are working on March. Hang in there hopefully it won't be much longer fpr both of us.

actually he got his NOA1 on july 23 08. and april is when he filed ..it is supposed to be 6 months from the date on your NOA1. So that would be Jan 23 for your case, and even then you have to wait 30 days after from the time you reach 6 months.that puts you at feb 22 2009. now to answer your questions
1. yes it's normal to hear nothing.
2. is there an option other then wait ? patience & waitng is the biggest skill you will need on your visa journey
3. as descibed above. you are not out of your timeline

as things are right now, you have approximately 74 days before you can do much about it.
