I am not sure why they told you to count everyone in your home for this application. I think you are going to be just fine if you include just the people that are your dependents. Dependents are people you can claim on your tax forms and are solely or partially responsible for financially. I hope this brings some relief to you. Have a happy holiday season.

Hello,

I am just thinking way ahead at the moment and wanted to know if Guangzhou, China allows for both the man and woman to attend the interview jointly? I have seen other people in other countries recommend that both people attend the interview, but they also said that it was country or consulate specific on if they allowed this or not? Has anyone been through the interview process in GZ and had a joint interview? Does anyone also know where i can find a good list of sample questions that they might ask during the interview? Thank you for your time and help.

The bold above is a partial quote. The complete quote in context is...

Your household size includes yourself and the followingindividuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or FormI-864 EZ affidavit of support whom you are still obligated tosupport.

Nothing in the sentence indicates the reference to dependent children has anything to do with who claims the tax exemption on a tax return. Note the word "other" that separates the reference to children from mention of a tax return.

When you list a person as partially dependent, their age under 21 and as your child, the Conoff will count them as 1 household member not 1/2. While there is no place to state household size there is also no place to state whether the child is claimed on the sponsor's tax return, nor is there any "requirement" to provide a tax return.

The OP has four children. Any truthful I-134 he submits will be evaluated based on a household of 6, not 4. You can take it to the bank.


Very nice work! Not exactly the answer I was hoping for, but non the less, it is what i needed to know. :) I think now the important part lies in what areas of the process can i delay and are there any time requirements for submissions? We are in month 5 now and haven't received the NOA2 as of yet and no touches on the file on the USCIS site. I'm not sure why it is so slow, but i'm not as disappointed now about the slowness now that I need more time. From this point on is it possible to drag this out for 6 months until I can get my business up and running? Thanks again for everyone who has worked hard to help me find the answers!

Thank everyone for sharing their knowledge with me. I did notice that there were two different responses to if "All" my children needed to be counted as dependents or if 2 could be counted since I only have 1/2 the financial responsibility for them? Another quick question, since I am working on getting the business up and running is there anyway to delay or pause the K1 process to avoid getting a denied? If there was anyway to do this that would be great.

Hello Everyone,

I have a few questions for some of you seasoned VJ'ers. I just lost my job in the 5th month of my K1 process and this is really bad timing. They seem to be very slow on my petition so this may benefit us right now since we applied around Dec 1, 2009 and we haven't received our NOA2 as of yet. I have a few questions that I hope someone can help me with;

Question 1: If I have a co-sponsor for my I-134 at the time of filing can this be switched back to myself as soon as I make the required amount of money? Knowing this would make it much easier for me to get a co-sponsor since I should easily meet the requirements shortly.

Question 2: I am purchasing a franchise and it should be up and running in the next 6-7 months and want to know if they look at projected earning potential in any circumstances?

Question 3: I have 4 children and I support them 50/50 with my ex-wife. When using the I-134 I selected "partially" responsible for support. Does the USCIS still use all of my children (4) when making the %125 of poverty line determination?

Question 4: I am currently unemployed and would like to know if unemployment benefits are calculated into the picture when providing a Co-Sponsor. My Annualized Unemployment Benefit is $28,200 and should last until I find a job or for 6 months or longer with the present extensions in place by the government now.

I know there are some really bright people on this board so I am hoping someone has some words of wisdom.

Tax returns are OK. For GUZ - bring 3 years of stuff. Tax transcripts are available same day via fax, as well.

For 'totality of adjudication', GUZ IV also looks at 'current income' as well as 'prior income' -
so suggest you get a co-sponser (another I-134), and have co-sponser show 3 years of tax data as well.

OTOH, if you have sizeable 'cash assets' then can use those, as well. See the I-864 instructions for the computations (GUZ IV uses those computations for assets, on the I-134, on interview day).

Hello,

I would like to know if I need to request the official transcripts of my last 3 years tax returns or if the actual printed and signed copies of the tax returns that I sent to the IRS will be ok? One last question on this subject. Very bad timing, but i was just laid off from work and am currently unemployed and starting my own company now, but have no official job. I plan to get a co-sponsor to meet the income requirements, but with that said, do I need my tax returns still? Any insight on this would be great.

Hello, I'm doing a CR1 Visa, and have a question with the Police certificate.


Regarding the police certificate, I sent the ORIGINAL police cert of my wife to NVC who is going to forward it to embassy,

but on my interview letter I got, it says I need another one, does that mean I can show them a photocopy of the original I already sent or do I need to get ORIGINAL once again?

K'3s need EAD or a greencard before getting a SS number.....why??......who knows they just do! :)

You have to remember that you should not be filling out the applications for your wife....she is the one applying to adjust her status.......and she needs to complete the forms and sign them.

They will send em back....have her sign them then send them back in...........shouldn't hold things up too much.

The whole system is currently changing in favor of AOS, even some people who have already filed I130's are having to take further action to get their approved I130's sent to the NVC!

I'm pretty sure you cannot apply for an EAD before AOS if you are on a K3.

The only part I'm confused about in your post is about taking a receipt to the local office for a EAS? What's that?

You can apply for EAD..prior to AOS.

This was originally allowed to enable the K3 to work while waiting for I-130 approval

I just called USCIS and was told that because I'm on K3 I don't need to apply for AOS. I just need to wait for I130. Also if I did apply for AOS then I would also need to go through I130 as well as if the I130 was denied this would cancel my AOS.

He also said that to get Employment I don't need a copy of the AOS NOA ? I just file the i-765 to Chicago !

As is quite common, this fly's in the face of everything else I've been told and the information on this site.

Can anyone who has already been through this process advise ? I know from experience that the people on the helpline at USCIS don't always give you the correct info, but this is so drastically differnet that I'm now very worried.

I have K3 and will be entering US on the 14 where I was planning to apply for AOS, get the reciept and take it to the Houston office with the i-765 to get EAS... now I don't know what to do !

As a K3 you do not need to apply for AOS if you intend to go back to your country and interview for a CR1.

If you want to remain in the US you will need to apply for AOS after your I-130 is approved.

You can apply for the EAD on it's own....and apply for AOS later....or go back to your country to interview for CR1.


I applied for EAD earlier and have only just applied for AOS...

I had 2 medicals since my the one I had in Australia had expired by the time we applied for AOS.

In Australia they did a breast check along with the other stuff......so not naked..just topless.

The one I had in US was NOTHING....weighed and measured me....did a brief history.......TB skin test....checked vaccination records....and took blood. $125.00....and had to pay cash as it wasn't covered by my insurance.

Can they atleast request a female doctor? My wife and I don't mind getting naked and taking a physical exam, just as long as she can demand a female doctor and no males are present.


I am not sure about the Philippines....but I had female doctors both times.

My 2 good Finnish friends here in the US went through K1 and so did I. Are you guys doing K3? I'm guessing you're located somewhere on the east coast?

Yea, we're doing CR-1. We were going to do K-3 but lately they've been taking just as long with the I-129f as they have with the I-130s. Since the CR visa is the better visa and I live 45 MINUTES away from the NVC, we decided to take our chances with this visa in hopes it decreases the final amount of paperwork and government involvement in our lives.
And yea, I live out east now, but I'm originally from Kansas--my husband and I decided we wanted to live in NH and I moved out here as the "forward guard" so to speak :) But a lot of my family is from Utah--Provo and Ogden primarily :)

We would have done DCF, too, and we had an appointment for it on February 14, but thanks to the Adam Walsh Act, we found out on January 27 that we couldn't do that any more :( so now we're settling in for the long wait and it sucks because all the Finnish-American couples I know have done DCF too! So they can't really give me any advice or tell me what to do.

Another Scandinavian-American couple...or to be more exact, a Finnish-American couple :)

We just mailed off our I-130 petition (or rather I did, being the USC) so we've just begun this long trip. Sadly enough, I mailed it right after I got back from the Trip to Finland during which we had planned to file DCF in Helsinki :( Made the trip a lot depressing, but it was nice to see Finland in actual winter instead of the "spring thaw" of March. -25 C anyone???

I think I got the form number right ;) My husband, being ever so impatient, wants to fill it out RIGHT NOW and has some questions regarding some of the questions.

On 22, it asks where he plans on working in the united states, should he put actual job titles or just areas where he wants to work (such as finance, or IT, or research). What have other people put on this one?

On 23, he wants to know if the list of schools attended should include ALL schools, from like elementary or secondary school on, or just university?

On 24, it asks for military experience, but it only allows enough room to put in one date. So should he put the date he began military service or the date it ended?

And I have one question myself. He's going to mail all of his documents to me so that when we need them I can quickly mail them off. But European paper is bigger than American paper, so that if we use the shortcuts, will it matter if we send in paper that is larger than the one they would have sent out? Or should I mail him American-sized paper? Or are the papers NVC mails out larger than American paper?

We really ought to have a sample DS-230 filled out as sort of a guide for people doing this :)

Sigh. We sent out the email choice of agent thing tuesday before last, the 10th and have yet to hear anything! I called the NVC and asked them what was up and the lady basically told me to wait because it's taking 10-15 days to process this sort of thing.

Man they must be really really backed up :(
Meanwhile, my husband's received the actual choice of agent email. They better hurry up and acknowledge the email! The shortcut's not supposed to take longer than the normal route!

I'm betting that the number is directly related to how many they've sent out that year. This would make it near impossible for us to predict since only a fraction of the immigrant visas handed out are on the forums and a lot of them are ones that have been swimming in the NVC sea for a while waiting for a visa number to become available. I just wish they would get rid of the whole random number thing all together so that our lives would be easier :)

Since they've given you the week that it was generated, it should be easy to guess that the date it was generated was that Monday since the NVC always generates documents on Monday. Why not just throw that date on there and mail it off? Is there something I'm missing here?

Besides, somehow I get the impression having the right date isn't that important...they seem a bit more relaxed at the NVC than at USCIS...

my office will be across the street from NVC in new hampshire so they can be filed 15 seconds after 'generation' and the client informed 10 seconds after that.

Unfortunately, a lot of the stuff doesn't go to the NH office, nor is it sent from there :( But the ones that are (like the AoS fee bill) I got 5 days after generation! That was nice :)

Hey, if you don't mind living in New Hampshire... then the job is all yours pal.
