Now she applies for the visa....so she fills in all the forms (all but affadavit of support forms)

We applied late....see timeline.

Not approved yet.....but we had EAD and that has just been renewed so I'm not that bothered.

We had no real reason for leaving it so long it just happened that way. After the constant worry and form filling it was nice to take a break for a while. :) The up side of waiting is that now we will get a 10 yr GC.

edited to add...we re-did our medicals as the original had expired.

You fill in the I-130 for the child in just the same manner as you did for your wife.

You will not need photos....or the G325A..... you will need the childs birth certificate and a copy of your marriage certificate that proves the marriage to the childs mother.

Hi everyone. Thanks for all the help in previous posts. I have already sent in my I-130 got the NOA1. Now, I'm filling out the I-129f. All is going well. Then when I was filling out the wife's G-325A I couldn't figure out who's name is suppose to go in bold box that says applicant. On the I-130, all the forms (all g-325A too), in the bold box, I put my name. But should I put her name? thanks again.


The actual form G-325a uses carbon paper between sheets so only one signature is needed on page one (top page). Downloaded forms (.pdf) would need signatures on each page.

I was in Perth and when I initially filed I put that as my consulate.

Now despite the fact that Perth do not interview for K3/4 visas my package was sent there....and instead of sending it on to Sydney they sent it back to US. Eventually it found it's way back to Sydney but not after many calls to NVC and finally the State Dept in Washington.

I haven't heard of this happening before so I am sure you will be fine.

I'm about to file the I-130 for my husband (who is finnish) at the Vermont Service Center and I was wondering whether or not I should put "None" in the box on each sheet of the G-325A where it wants my alien registration number, next to my name. What about his sheet? Neither one of us have one yet. Or should I just leave it blank?

USCIS no longer routinely requires submission of original documents or "certified copies." Instead, ordinary legible photocopies of such documents (including naturalization certificates and alien registration cards) will be acceptable for initial filing and approval of petitions and applications.

At the discretion of the officer, original documents may still be required in individual cases. Please be advised that USCIS no longer returns original documents submitted with the exception of Certificates of Naturalization, Forms I-551, Permanent Resident Card, Forms I-94, Arrival/Departure Document, valid passports, or those specifically requested by the officer. Such documents will be returned when they are no longer needed.

Provided my husband's info arrives in the mail tomorrow *crosses fingers* I will be mailing my I-130 to the Vermont SC! But when reading the info on putting the packet together, it says to try not to send originals. For some documents, this makes sense, like my marriage certificate, birth certificate, etc. But what about for the I-130, G-325A, Affidavits, etc. Shouldn't I send the originals since they're only meant for the USCIS to see anyway? So what should I do? Copies or originals?

Man, I was going to start a topic asking about this too but fortunately someone else did so for me :) I ended up calling the IRS to get the info and I pretty much have to file married, jointly so that I can get the deduction for my student loan interest payments (you can't deduct it if you file married separately! what the hell?). Fortunately, my husband is still studying in Finland so he doesn't have much income to speak of...it's less than $8,000 at least. Should I try to get it included on the tax return?

After we got married (in Finland) the city magistrate provided us with a legalization and two copies of our marriage certificate, one in Swedish and in English. From what I've been told from other Finnish-American couples, you don't need to send the legalization in along with the marriage certificate.
Shame that they didn't provide you with a translation though...that would have made things a lot easier for you.

I don't blame you for wanting to just wait out the I-130--I'd much rather just do that so that my husband will automatically be an immigrant. Even though we've been married less than 2 years and there would be some conditions, things would be less complicated in the short-run, I think.
In anycase, I'd rather hedge my bets and file the I-129F, too. Even if having him enter as an immigrant is the best option, I'd rather have him HERE sooner. I'll gladly pay the $170 extra if it means that. Well, okay, maybe not gladly, but I'll pay it :)

Gah. No more using the term DCF, because filing at a USCIS center that's located abroad is NOT the same! Everytime I read someone saying "I'm doing DCF," it makes me go, "WHERE? HOW!?" And then I realize what they mean is filing at a USCIS center abroad :( I'd do that, but I have to be a resident of Finland and that paper work takes 3 months to get through, plus I wouldn't be able to work in Finland :( So that stinks :(

Yep exactly. My husband goes through bouts of depression whenever I have to pay anything for him ;) I'm not sure he would survive 30-90 days of waiting before he gets to work in the US. The CR-1 visa was the visa we were going to get anyway when we were planning on doin DCF in Finland. It's a lot easier, you don't have to Adjust your status (though we'll have to remove the conditional thing since we've been married less than 2 years), and you don't have to wait for permission to work or anything.

Neither one of us are very fond of having the government breath down our necks and pester us, so this route seems to be the one that involves LESS of that. Then he'll get his citizenship once he's been here three years and we should be in the clear to be left alone to live our lives.

Oh, and btw, we were plannign on doin a K-3 visa, but we decided to switch over to a CR-1 visa...it seems to be a better visa and we live in New Hampshire (er, I do). The National Visa is a 45 minute straight shot down Rt 101 from where I live :whistle: I could drive down there and bang on their door...so I think it would go a bit quicker because of that.

I would definitely change it on the G-325A's for the I-129F to - "Other - I-129F petition for K3 visa", because they really aren't in connection with permanent resident status as the K3 is a nonimmigrant visa. The I-130 results in an immigrant visa which grants permanent residence, which is why I think it wasn't a problem for those. :)

Whew. Okay. I'll change around the I-129f.

Technically, you should have checked "Other" and written something like - "I-130 Petition for Spouse". I don't have any actual experience with it, but I can't imagine them rejecting your application because of that. So personally, I wouldn't sweat it. :)

Something I've noticed... I see in your signature that it says you applied for the K-3 visa on Feb 16, but it doesn't say when you filed the I-130. You should wait for the I-130 first Notice of Action before filing the I-129F for the K-3. You probably already knew that, but just in case! :)

Yea, I know that. I filed (mailed off) the I-130 on Feb. 16 (it should say that in my signature at least) so I'm waiting for the NOA beforeI mail off the I-129f. I wonder now, should I change what I have on the G-325a's for the I-129f?? And say that i'm filing it in connection with an I-129f app or is it fine?

On the G-325A, where it asks "Form submitted in connection with application for..." I checked status as permanent resident.
As I submitted the I-130, is this not technically true? The end goal of the I-130 application is status as a permanent resident. I note, however, that the G-325a example under the K-1 visa, it has "other" marked and I-129f filled in...

Is this a really bad mistake to have made :S?

If you make the copy of the passport yourself, you do have to get it notarized. It can either be done at a US embassy or sometimes local notaries are accepted as per the Hague Convention. We're going to get my husband's passport copy notarized at the local magistrate as finland is a signatory of this particular convention :P No need to make extra visits to the US embassy...

Is the additional proof from part 7 always required? Is it required for both I130 and I129F petitions? Also if it isn't sent does it mean i will get a RFE?

I spoke to a lawyer before i started the I130/I129F petitions for my wife and the lawyer told me i don't have to provide additional proof beside the normal requirements (Marriage Certificate, Passport Photo, and G325A) when i file for I130 but my wife will need to provide it when she goes for her interview.

Yea, it's required now as of December 2006...they always have to make it harder it seems.
