Not sure if you have taken care of this already but my suggestion is to type it up and send it as an attachment, that way she prints it sign it and then mail it back to you, then you can sign and then mail it to the service center, this way you save time by having to mail it to her....but as many people said already I won't take a chance on sending in a non-original...GOOD LUCK the rest of the way

Boarding passes showing you were in mexico as well as hotel receipts with few pictures showing you were together within the dates on the boarding pass should be sufficient,also both of you should have letter of intents, the sample on here is very good. I know it can be nerve-wrecking but you will be fine. MAJORITY of the people on here are here to help/coach you through the process like they did/and are doing for me. ok another thing that i have ben debating recently and maybe some one can give me an answer-
like ive said, my fiance is from Mexico, and all of our evidence (boarding passes pics etc) is good to go. But i have wondered if it was a good idea to send some letters (actually by mail) that he and i have sent to each other. I originally didnt think i could/ should send those because i didnt know of an "offical translator person." Now im thinking of sending a copy of a little letter that i sent him and one that he sent me. although it is is spanish, i was wondering if it would be good "evidence" to send this. (obviously on letters it says it's from me, to him, and at the end it has hearts and says "i love you" (in english)... etc.
I guess it would be evidence. ..... but i wonder if they will get mad that it's not with a whole translation of the letter.

please please please let me know! this is THE LAST STEP before i do the final check and recheck, :)





I dont think you need the letter, but it says if you must send anything other than in English Language it has to be translated, When I sent in my package, I even translated some phrases in the emails that were not in English just to be on the safe side.....The worst RFE would be a letter saying "what does this mean? :rofl: :rofl: :rofl: :rofl: :rofl: :rofl: :rofl: :rofl:

Like everybody is saying the chance of getting the tourist visa is very slim....the requirement is seeing each other within the last 2 years but of course the more the better, if you wanteed to provide additional "meeting evidence" it's best you travel home and see each other

My secondary evidence train tickets, money exchange and some misc receipts were in the native language. I did write train ticket and were it was going etc... on the photocopies.
I had no problems with them.

We will have our interview on Monday. It took just over one month from NOA2 (1/2)1 to our interview (2/23). I would call the NVC, there is a good chance it has already left for Kiev. Our was at NVC for only a few days. When you call NVC ask for your KEV# with this you can get a medical appointment (more info. here: http://kiev.usembass..._K1K2_eng.html). Download info packet.

COPIES AND TRANSLATIONS When you arrive for the interview, you MUST present

Shortly after i sent my I-129F I had to move rather abruptly and unexpectedly. I sent a formal letter with my change of address information to the Vermont Service Center, but it has been 1 month now and I have not received my NOA yet. The letter i sent was very formal and official looking. Is there an official Gov't form I should have used instead? I want to call them to find out if they have sent out the NOA and if maybe it got lost? I see the average time for others is about 8 days and I am way over that now. Does anyone know the number to talk to a "real" person at the Vermont Service Center? ANY help would be greatly appreciated.

Congratulations on completing the first leg of the Journey! The NOA1 is important for 1 reason, it contains your receipt number that you will use if you need to inquire with the government on the status of your case. It is also used when you use the USCIS website to see if there have been any touches to your case. I suggest when you get your receipt number that you go and sign up for case alerts. I just got my NOA2 after 6.5 months so sit back and wait this out. Good luck to you my friend!

Your brother will fill out the I-134. Hopefully, his income alone will qualify to cover his dependents and your fiancee (and any of her dependents that will also come from China.)

His wife does not fill out a I-134. But he needs to separate out his income from his wife's income if she also earns money claimed on the 1040. The best way to do that is to provide copies of his W-2's only to show his portion of income earned.

Do not forget to provide copies of his qualifications which are that he is a US Citizen, US National or LPR of at least 18 years of age. (so a birth certificate, naturalization certificate, copy of green card, etc...)

I believe this questions has been asked b/4 b/c it was another question that prompted me to ask this question, but i can't find a thread anywhere. I am purchasing an existing business and will be recently self employed at the time of my fiancee's interview. I am using my brother for the I-134 in the mean time. My question is that my brother files his taxes jointly with his wife. Do I need his wife to fill out the I-134 form as well as my brother? Can i just have my brother supply the I-134 with his tax form? If i had a choice i would prefer to not have her fill out the I-134. Thank you very much for your help and experience.

I would say that's a NO. You did see the "IF either has ever been married" right? If you've never been married, your petition should reflect this and you don't need it. I've never heard of anyone getting a marriagability certificate here in the US.

I have not been married previously. I do not have a marriage certificate or divorce decree. My fiancee has provided a mariagabilty certificate, but is thre anything i need to provide? I was just thinking about this and I did not include anything in my original application packet. I am just making sure we will be ok, b/c i think her P4 will come any day now and i don't want any snags at the interview.

I have a Felony Theft conviction from several years ago. It is not related to any of the crimes listed on the IMBRA form, has nothing to do with the crimes from the AWA and it is not named on the I-129F section. How do I disclose this in the package when I submit it since I am sure my name will pop up on the Criminal Records Search? I want to be up front with the processors to avoid delays and conflicts because of it.

I think your going to be ok, as long as none of the offenses are related to woman or any of the offenses that are specifically listed on the form. I was young and stupid once and have a Possession of Stolen Poperty (Felony Class B) on my record (20 years ago). I am in the process of annuling it now, but it did not affect my criminal records background check for my K-1. If you completed your probation or did what the court recommended or are in the process of completing it and are in good standing with the court then I have high hopes for you. I'm not a lawyer, but that's my experience in a nut shell :). Good luck.

On his I-134 he should state what HIS income is, if that is ALL the income from the apartment building, that is fine. BUT gross revenues of a business or rental property do NOT count as income. They will credit him for the portion of income that is his that appears on line 22 of the 1040. I can tell you this. I have owned rental properties in the past and never showed any "income" from them. All income was written off in the form of expenses and/or depreciation. My rental properties always showed a LOSS which was deducted from my other income. If he is using a professional tax preparer, my guess is that his tax return is similar. They do not care how much money his BUSINESS makes, they want to know how much money HE makes.

The portion of income on line 22 of his tax return belonging to HIM is the amount of income to enter on the I-134.


Wow, ok...better to know and understand all this then learn the hard way after the fact. His w2 income will meet the threshhold so as long as they don't mind it barely clearning the bar then we should be ok. I will be able to show a significant savings account, but not 5x 125% and my business won't show a profit until the next tax year. I will provide all that information as well for them to review. Does he absolutely need the income from his rental property in order to qualify? I ask because this may be a gray area.

In a community property state, the apartments would be considered "separate property" if he owned them before the marriage, but the income from the rentals would be considered a community asset because it was obtained after the marriage. I've seen similar circumstances where someone owned a home outright when they entered a marriage, but their spouse made a claim against the increase in the home's equity during the marriage. A US consulate isn't a divorce court, and rather than try to sort this out the consular officer might just choose to disregard the rental income. The joint tax return muddies the waters, and the I-134 doesn't provide any way to clearly define what belongs to whom. If he clearly qualifies on his W2 income alone, then it will be an easy decision for the CO.


Thank you for this good info also. He clears the bar by about 1k with his W2, but the rental income puts him significantly above the threshhold. I just wanted to be "significantly" above the threshold to make sure we are approved until i can verify my income. I have my fingers crossed :)

My brother will co-sponsor for me since i will not be able to verify my income due to the start up of my new business. He files his tax returns "jointly" with his wife and has an accountant prepare these professionally. I am confident they are correct, but the packet they send to the IRS is pretty large. Since this is a joint return his wifes name is also on the return, but my brother is the only one helping me with the sponsorship. Each page of the ruturn has both names including the page that shows their rental income from their apartment building. The rental income is "only" my brothers income and I need to make sure at the interview they see that as "his" income and not joint income or her income. Below is what we are putting together....please tell me if i need to do anything else to prove his income and job status. Your help is very very appreciated!

1:) I-134 Form
2:) W2 Form
3:) Complete 2009 Joint Tax Return
4:) Letter of employment verification from Employer
5:) Last 3 pay stubs from employer
6:) Deed to his home to prove he owns the Apartment building "Solely" and that the income on the Tax Return should be credited to just him.

If there is anything i am missing or anything i need to add I would like to know so we can pull this off. Interview is so close now :).
