US Embassy and Consulate DiscussionBirth Certificate/Certificate of Baptism
My fiancee has just faxed the DS-2100, and DS-230 forms to the US Embassy requesting the interview.
My fiancee is a bit concerned that although she has an authentic notarized copy of her birth certificate she is concerned that in the margins
the certicate seems to be issued in the registry before she was born! She also has a valid Colombian Passport. Her Baptism certificate
shows an incorrect date of birth so we were not going to use this.

Does anyone know if the birth certificate issue could present a problem?

US Embassy and Consulate DiscussionBaptism Certificate
The year of birth is incorrect on my fiance's certificate of baptism, how can we compensate for this?
My fiance's birth certificate has the ages of her parents incorrect and does not indicate the occupation of the father, are these issues to be concerned with?
The embassy website states the certificate of baptism is suggested, is that out-and-out false? Is the certificate of baptism in fact a required document?

Thank you! whistling.gif blush.gif helpsmilie.gif

I have petioned for my fiance and her two children son, age 19, and daughter, age 18 for K1 visa.
Everything is going well and have visa interview scheduled in 2 weeks, but today the son has decided he no longer wants to come to America.
Will the son's change of heart/mind adversely effect my fiance and her daughter's ability to be issued their visas?

Thank you for any and all responses.

Where can I find information about the son changing his mind again deciding to apply for his visa within 6 months?
Should I email the US Embassy before our interview date to explain the son's decision not to apply for his visa at this time or wait until the appointment to explain in person?

Thank you, all replies have been very helpul!

You don't need any special information. Children of a K-1 visa holder (umarried and under age 21) are eligible to apply for a K-2 visa at the consulate within ine year of the issuance of the K-1. IF he decides to do this, call and makean appojntment for an interview, bring the necessary documents to the interview and...VOILA!When the visa is issued he wil have 6 months to use it. Youdo not have to explain anything. Simply list him on your fiancees visa application as a child "to follow".

We did this with one of our two sons, he had conflicts with his college education. One came with my wife in September, the other will come in July. He has his visa interview June 25
Your replies have been awesome! Thank you so much!

My employer also uses the work number for employee verification purposes. So after I played around on their website I figured this will not work for me.
I called my employee benefits department explained that I need a letter for the US Government and I was able to get what I needed.
Good luck with your visa journey.

I've petitioned for my fiancee and her two "adult" children, son 19 and daughter 18.
All documents seem to be in order except for these: the son does not have his military report--some kind of a mix up due to the payment for the report was supposed to have been made a year ago but payment was not made for lack of funds and now can not get an answer as to how much to pay for the military report and so no report.
The son has been attending college for the last six months. Is not having the military report a problem and how to handle it?
The second problem is the fiancee's certificate of Baptism has an incorrect date of birth and can not be corrected. Is it okay not to use the certificte of baptism or use it better to use it even with the mistake?

Thank you, thank you, thank you for your responses. The stakes are so high I just want to be prepared as best as possible. mellow.gif mellow.gif

Cannot comment on the baptism certificate, do you not have birth certificate? I had never heard a certificate of baptism is required, is that consulate specific?

Regarding the military certificate I can say for sure it is absolutley required in Kiev as well as a deferrment for a student (if applicable) if it is for a male over age 18. Not sure how necessary it is in Colombia. Ukraine has compulsary military service for 18-20 year old males and they need to have a deferrment to get a visa. The US will not be used as a sanctuary for "deserters" so to speak. Our son is 18 and we are required to show his military registration card, copy and translation, along with the results of his appeal for a student deferrment, copy and translation.

My fiancee has her birth certificate, on the list of documents it state the baptism certificate is suggested", so I'm inclined to keep the baptism certificate "in our pocket".
The list of documents also states to provide the military report "if available" so I am hoping that not having it will be okay.

Do I submit separate forms for each of the children and do I have the forms notarized prior to the interview or sign the form(s) in the presence of the Embassy Officer?

My fiancee and I had our interview, the interviewer asked a few questions of how we met, how many times have we been together, looked at our email correspondence,
then she said I am convinced you have a legitimate relationship and will approve your visa, but first.....because you have also petitioned for the 18 year old and 19 year old children and their birth certificates were issued 10 years after they were born we need proof the children are truly the children of the mother.

Has anyone applied for a first time British passport with the Embassy in Washington recently? I'm trying to figure out if I would have to physically go there for a passport interview, as the new rules would indicate.

If you have never held a UK passport then how did you enter the USA? They do not do passport interviews, you have to send the required evidence to prove that you are entitled to a UK passport, if that is accepted then they will issue a passport to you.

Sorry, I'll give a bit more info. I'm a dual US/British Citizen by birth in Bermuda to a US mother, Bermudian father. I entered the US as a child with my US birth certificate. I didn't even know that I was a dual citizen until a couple of years ago, when I began researching British nationality law in depth. I am now looking into getting a passport, and according to http://www.britainus...e...2=0&a=46742 they require interviews for all first timers overseas, as of April 2008. I wanted to see if anyone hear was in the same situation, looking to get a first time adult passport since April 2008 and if they had to go in for an interview per this new policy.

Ah so you will need an interview to establish your claim to UK citizenship, that is not just a case of applying for a passport. so yes you will need to go and be interviewed and if they accept your claim to UK citizenship they will then allow you to apply for a UK passport.

I doubt you will find anyone on here how has had to do this as most people on here that are UK citizens were born in the UK and already hold UK passports.

United KingdomTheoretically, what would happen with jury duty?
Once you file form P85 the inland revenue will notify the electrol registar that you are not resident in the UK, if you wish to continue to vote you will need to register with your foreign address and either appoint a proxy vote or select a postal vote, you can not vote in all elections only those open to UK citizens residing abroad.

For Dury duty they will not select anyone who has a foreign address, only those resident in the area that covers were they live.

I'm in the US now, have been since May and we're awaiting AOS.

How would they know I'm not in the UK to be able to do it? What would I need to do to notify them? This hasn't actually happened (and I hope it never will), but theoretically, what's the procedure?

If you have notified the Inland revenue on form P85 that you are no longer in the UK then you will not get called for Jury duty.

Ahh. See, I wondered if there was some kind of official 'I've left the UK, quit sending me things' form.

I also got a National Insurance contribution notice at my old home the other day (my parents still live there, that's how I'd know about this kind of stuff) and whilst it's something I no longer have to worry about, I'd still rather not get letters about that kind of thing.

I'll send off that form in the next few days. Thanks for telling me!

Your welcome. If you have paid tax in the UK this tax year you may get a nice tax rebate as you are no longer resident in the UK. We got almost 6 months tax back when we filed the P85.

QUOTE (Britlover @ Oct 3 2008, 08:06 AM) <{POST_SNAPBACK}>
Thanks for the suggestion. I'm not sure they would accept the card because they are adamant about my providing a statement from the NHS proving that my wife & stepson had coverage for the 18-month period. I gave them copies of their passports (issued 3 years ago) & K1/K2 visas, which proved they were British citizens during that time period but they would not accept these. They said they used to accept passports but had been "burned" before so they require the COCC. huh.gif

We are with BCBS and they accepted the NHS card as proof of coverage, that is the only proof that you can get that you were registered with the NHS for full patient care. It has your NHS Number on it as well as the name of the last GP you were registered with.

Call your insurance company and ask them if this is acceptable.

You need the registration card that everyone in the UK gets when they register with their GP. It is all that is needed here in the US to show you had previous coverage under the NHS.

Hello,

So now I am living in the US, working and paying US social security.
I worked in England for 18 years and paid full NI during that time.
I am under the impression that UK and US have a social security arrangement whereby social security contributions made in both countries during a working lifetime can be added together to make up a person's total SS entitlement for when they retire.

My question is: do I have to "transfer" my NI contributions over to my US SSN or otherwise notify the government of either country? What do I have to do right now or is my US SS entitlement calculated when I retire??

Thank you.

There is nothing for you to do. If you were to claim a Social Security benefit here in the US and you did not have enough credits paid then they can contact the UK for info on your NI contribution record, this can help you to qualify for a SS benefit here in the US but it will not increase the amount paid.

You UK pension is payable here in the US and you should make sure you notify Overseas branch of any change in your address, you can find their address on the Pensions website, they can also send you a pensions forcast so you will know what you are likely to get.

Make sure you file form P85 with the Inland Revenue as this will let them know that you a resident abroad.

United KingdomLost P45 - what can I do about my P85 form?
If all you want to do is avoid jury duty then there is nothing to do. If you were selected from the electoral roll for jury duty they would send it to you last address as you are no longer there you wont get it. If it is a relatives address then all they have to do is write on the envelope "NO LONGER AT THIS ADDRESS" and send it back.

I spent 46 years in the UK and was never called for Jury Duty. You are worrying over nothing. As for the P85 no it is not mandatory to file.

Let the inland revenue sort out your P45 and tell your ex-employer to take you to court if they want the money. The have no legal right to demand anything from you here in the USA and I highly doubt any court would make you repay money that was paid to you. If your ex-employer even went that far.

The US has the worst health care system, and I'm worried about Nathan going without health insurance for too long. Is there any truth that somehow the NHS still takes care of Brits when they're abroad? I have no clue about this.

Thanks!

The NHS does not cover British Citizens living abroad, They don't even cover British Citizen who do not permanently live in the UK, so if I go home for a visit I am not covered by the NHS other than emergency care at an ER.

The NHS will cover citizens who do not live permanently in the UK in an emergent situation - ie you are back home visiting and the UK citizen has a serious accident, etc. "Emergent" doesn't mean coming home for a visit and let's say "accidentally" needing a kidney transplant from a long-standing condition.

The NHS considers Emergancy care to be treatment provided at a Emergancy department of a hospital, it does not include in-patient care, drugs, non-life saving surgery or x-rays/MRI/Scans.

So if you are traveling home for a visit make sure you have medical insurance to cover the cost of any treatment under the NHS.

I have just done my P85 and waiting for my P45 so I can send it off, I doubt I will get anything back as I left work a week into the new tax year

The other thing that they told me to do was to call the Inland Revenue with my new address a couple of days before I go 01512102222 which is for International

Another thing to think about is your state pension depending on your age, I applied for a pension forcast and coz I am an old bird I had paid 29 years and to get a full pension I would have to pay for another year which was £650 ish which would mean that I would get an extra £2 a week so I am not going to bother. I was told that the UK will transfer your pension to a 401K but they check it out first

The paperwork never ends

My wife used to work for the Pensions service in the UK, Your State retirement pension is fully payable in the USA and it can be paid into any bank account you want once you reach retirement age. It can not be paid as a lump sum into a 401k as the state pension is never paid in a lump sum. You could have your 4 weekly pension paid into a 401k account.

As for employer pension schemes they can not be paid into a 401k here in the US because of the diffrent way 401k's are taxed in the US. Most pension companies in the UK will pay pensions and lump sum payments into a US bank account.

Anyone who is over 40 years old and has work all their adult life may want to look into paying voluntary class 3 contributions into their state pension as this will give them a full pension once they retire.

You can request a Pensions Forecast from the Pensions Service.

thanking you in advance for your help on this.

I am filing for my parents and they sent all there doc's to me using UPS 3 day service. I then sent all the papers to NVC using USPS Express mail.

We never had any problems using UPS they collected the packet from my parents home and it was delivered to me 3 days later. I guess you could use the same UPS service to send the doc's to NVC direct. The other option is Royal Mail 1st class airmail no signature as this slows it down big time. it would get there in 5 days.

I was just happier having them send the stuff to me and then me sending it all to NVC.
